HomeMy Public PortalAboutOrd. 631 - Sale of Old Golf Clubhousea ORDINANCE NO. 631 AN ORDINANCE OF THE CITY OF McCALL, IDAHO, RELATING TO THE SALE OF PROPERTY DESCRIBED HEREIN; EXPRESSING THE INTENT TO MAKE SUCH SALE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO, AS FOLLOWS: Section 1. It is the intent of Council that the property described in Section 2 be sold at public auction held in compliance with law. Section 2. The property to be sold shall consist of: Commencing at the northwest corner of Lot 1, Block 8, DAVIS BEACH TRACTS; thence S. 0° 03' E. a distance of 200.00 feet to the true point of beginning; Thence East a distance of 150.00 feet to a point which is the southwest corner of Greenbriar Condominiums, recorded in book 7 at page 77 of Plats; Thence continuing East a distance of 70.03 feet to a point on the south boundary of such condominiums; Thence S. 2° 11' E. a distance of 216.53 feet to a point; Thence N. 77° 16' W. a distance of 233.89 feet to a point; Thence N. 0° 03' W. a distance of 164.81 feet to the point of beginning. Excepting, however, a strip of land 25 feet wide extending the full length of the property along Davis Avenue, which will be concurrently dedicated by the City to public highway right-of-way. Section 3. The deed to be issued shall impose a deed restriction or negative easement for a special building setback line barring structures, which setback line is 25 feet from and parallel to the centerline of the golf cart path located on or near the easterly property line; and shall further reserve an easement for golf play within the area between such setback line and the easterly property line. Section 4. The City Clerk is appointed to carry out this Ordinance by sealed bid auction. Section 5. No bid shall be accepted for less than the amount of the appraisal obtained by the City, namely: $182,000. Section 6. Such auction sale shall not be held prior to the sixty-first day after the date of passage of this Ordinance, stated below. Section 7. This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. Passed and approved June 24, 1993. Laurence • .
