BALL. 11 The Meeting was called to order at 9:00 A.M. by Mayor Koch. 2. On motion of Mr. Whittemore, seconded by Mr. Walker, the Com- mission unanimously approved the "Minutes" of the regular meet- ing held on March 9th, and the "Special" meeting held on March 23rd, 1973, 3. The "Financial Report" for the Month of MARCH was accepted by the Commission. 4. The Commission was informed by the administration that a "Peti- tion" had been received requesting REZONING of the parcel of land described below from its present Classification "A" which is SINGLE FAMILY DWELLING, to an APARTMENT "C" Classification: A tract of land lying between the Easterly boundary of North Federal Highway (State Rd. No. 1) and the Westerly boundary of the In- tracoastal Waterway, bounded on the South by the North line of PLACE AU SOLEIL Subdivision and extending northerly therefrom a distance of 100 ft. cont. ITEM• Page 2 5. cont. Dr. S. C. Morrow, resident owner of improved LOT 68, in PLACE AU SOLEIL Subdivision, 930 Indogo Point, expressed objection to such REZONING, believing 'Apartment' classification of the land described in the Petition would be detrimental to the welfare of the present immediate area which is Single Family Dwelling units, and requested that his objection thereto be made a matter of record as he might be absent from Town at a time when a Public Hearing might be held for consideration of the rezoning request. Following general discussion of the "Petition" it was unani- mously agreed that the "Petition" for Rezoning be referred to the Town Planning Board for review, study and recommendation thereon for further consideration by the Commission at its next regular meeting, scheduled to be held on Friday, May 11, 1973. 6, RESOLUTION NO. 4 -73, expressing the intent of the Commission to undertake certain DRAINAGE installations and RE- SURFACING of Public Rights -of -Way affected thereby, was submitted to the Commission for consideration. Said Resolution No. 4 -73 further identifies the "AREA" to be affected by the proposed DRAINAGE IMPROVEMENT to be as follows: That part of Gulfstream Road commencing at a point 300 ft south of Banyan Road and extend- ing northerly therefrom to Old School Road; also that portion of Banyan Road from Gulf - stream Rd extending easterly to Oleander Way; and that part of said Oleander Way extending northerly from Banyan Rd for a distance of 100 feet. The Resolution also indentifies the fourteen (14) properties abutting on this proposed Improvement, the owners of which have previously agreed with the Town Commission to share in the TOTAL COST of the DRAINAGE portion of said Improvement. The Commission having determined, at a previous meeting with said property owners, to absorb the entire cost of RESURFAC- ING of the roads affected by such Drainage Installations. Said RESOLUTION NO. 4 -73 further provides that the Town Com- mission shall sit in the Town Hall at 9:00 o'clock A.M., on the eighth day of June, 1973, for the purpose of hearing ob- jections, if any, on said proposed improvements as set forth therein, as well as the sharing of the ESTIMATED Total Cost of only the Drainage Installations project. On motion of Mr. Whittemore, seconded by Mr. Walker, the Com- mission unanimously approved adoption of Resolution No. 4 -73. ITEMS: Page 3 7. Ordinance No. 73 -2, providing for MOORING or ANCHORING of HOUSEBOATS in Waters within the Town of Gulf Stream; Ex- ceptions; Definitions; Penalty; effective date of this Or- dinance, was then read in full and submitted to the commis- sion on this SECOND and FINAL reading. On motion of Mr. Whittemore, seconded by Mr. Walker, the Commission unanimously approved PASSAGE and ADOPTION of Or- dinance No. 73 -2 on this second and final reading thereof, which, in part, provides for said Ordinance to become ef- fective immediately. 8. The following communication was submitted to the Commission: "Town Commissioners, Gulf Stream Town Hall. Gentlemen: For the past six months I have been taking care of the chlorination, taking water samples and making out a monthly report for the water department, hours at to me at mount of consider you woulc As I do this on my own time and after the club, I feel that the amount of wages paid one dollar per day is inadequate to the a- work and trouble in this job. I will leave it up to you gentlemen to whether I should get more money and what I consider fair." Sincerely yours, /S/ GLEN A. SOVA Following general discussion on this communication, the Mayor requested Mr. Whittemore to contact Mr. Glen Sova with the hope that a satisfactory arrangement, with reference to remuneration for services rendered, could be accomplished, and that Mr. Whittemore submit his recommendation, relative thereto, for Commission consideration at its next meeting. 9. Mr. L. M. Ball then inquired if the Commission had ever con- sidered Group Insurance or Protection Plan for the benefit of the Town Employees. Mayor Koch informed Mr. Ball that a Commission had considered such an issue several years ago, but the matter had been a- bandoned upon lack of interest by the Police Department upon learning that Cost thereof would be on an equal sharing basis between the officers and the Town. Following discussion of the issue, the Mayor requested Mr. ( Whitney to review the matter and submit a recommendation to the Commission for consideration relative thereto. Pa4e 4 10. Mr, Whitney mentioned having recently received a copy of the FLORIDA POLITICAL REPORTER (VOl.l, No. 1), which he felt might be worth while subscribing to in view of the broad coverage of various branches of State Government and what one may expect to happen in Tallahassee during the coming months and years, all of which might greatly aid local governments in evaluation of political, as well as business, trends which lie ahead. Annual Subsciption Cost is $75.00. For further clarification of this publication, to determine that such is not the product of any given political party, the Commission, which otherwise favored the recommendation of Mr. Whitney, recommended and determined to await the re- ceipt of one or two more issues of said publication. Box 255 Delray Beach, Florida 33444 Gentlemen: This is to request that the real estate described as Lot "A" and Lot "B" on the attached map, and located in Gulf Stream, Palm Beach County, Florida, be rezoned from Residential "A" to Apartment zoning C Red. This property lies on the west side of the Intracoastal Waterway and runs to U. S. Highway One. We wish to develop this property for apartments of not more than three stories, so as to avoid using elevators. Farrar that the property extending 100 feet north from the north boundary of Place au Soleil and running from U. S. Highway One to the Intracoastal Waterway (map submitted with request) be rezoned from RESIDENCE DISTRICT "A" to APARTMENT AND RESIDENCE DISTRICT "C." The Planning Board members have reviewed this proposal for compliance with the Zoning Ordinance and in particular reference to its impact ons 1. The character of the community. 2. The density of population. 3. The supply of water. 4. Vehicular traffic. 5. The provision of sewerage facilities. 6. Police and Fire protection. 7. The collection of garbage and trash. Since the proposed zoning change would have an adverse dffect in all the above categories it is the unanimous recommendation of the Planning Board that thisrequest to downgrade the zoning classification be denied.
