ASSISTANT MAYOR SALVER: We are now going
to discuss Lynne Bloch Mullen , et al versus Bal
Harbour Village, et al , 17 -15260-CA-21, which is
the complaint .
MR. SEROTA: So here we have a complaint
that we have not been served with, but it has been
filed . It was filed on June 23rd, 2017. I
believe they have got 120 days to serve i t, which
would leave it to third week in October. Exactly
why they haven 't served us , we really don't know.
We haven 't put a lot of time into i t because until
we are served, we really don't feel comfortable
spending your money to be a na lyzi n g it .
I will tell you wha t they have done is they
filed what is called a master p lan challenge under
163 Florida Statute . What they are claiming is
that the approva l s, the development orders that
you approved do not comply with your master plan .
They have to do that within 30 days of the
what is called a development order, which they
have done, but much more than tha t , it 's a very
broad complaint .
As I say, we haven 't re ally gotten in to it
a lot, but they are saying it violates the master

plan.
In fact , the substance of this is only
real l y a couple of pages long . The factual
background, there is a lot of factua l background ,
but the actual argument or allegations and the
cause of action are quite limited .
So they certainly can amend at some point .
They have to serve us because they can 't dismiss
this case without p r ejudice. They wi ll lose the
timing because they had to file it within 30 days.
We expect they will serve it. Why they
haven 't, I am not sure , but , as I say , t he reason
I think they are going to serve it is because if
they don 't serve it, they will lose t h eir r i ght to
bring this challenge.

rapidly got phone calls from people telling us you
know this has been filed . So we went and looked
in the docket , and it was there .

MS. TREVART HEN : But we have not yet been
formally served . Therefore, the clocks don 't
start on all the procedures in responding to it .

bones of what the challenge is .
