This "Special Meeting" of the Town Commission was called to order by Mayor Koch and those present were informed that the Meeting had been called for the purpose of conducting a PUBLIC HEARING in order that ALL interested persons would be heard concerning the proposed RE- CLASSIFI- CATION of certain lands within the Town of Gulf Stream as set forth in ORDINANCE NO. 73 -1 providing for an AMENDMENT to the Town's Zoning Or- dinance No. 108. CAPTION of said proposed Ordinance No. 73 -1 is as follows: ORDINANCE NO. 73 -1. AN ORDINANCE OF THE T014N OF GULF STREAM, FLORIDA, AMENDING A PORTION OF SECTION I ENTITLED "DISTRICTS AND BOUNDARIES THEREOF" OF THE ZONING ORDINANCE NO. 108 AS AMENDED, OF THE TOWN OF GULF STREAM, FLORIDA, BY ADDING A NEW DISTRICT EN- TITLED "OUTDOOR RECREATIONAL DISTRICT "; AMENDING THE ZONING MAP TO REFLECT THE NEW DISTRICT, AND BY ADDING A NEW SECTION TO ZONING ORDINANCE NO. 108 AS AMENDED, OF THE TOWN OF GULF STREAM, FLORIDA, NUMBERED "VA" AND ENTITLED "OUTDOOR RECREA- TIONAL DISTRICT" WHICH CONTAINS THE ZONING PROVISIONS OF SUCH DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS OF OR- DINANCES IN CONFLICT THEREWITH. The original copy of said Ordinance No. 73 -1 is on file in the Town Hall of Gulf Stream, Florida, and is available for review by any interested persons. In compliance with Town Charter provisions, Ordinance No. 73 -1, as recommended by the Town Planning Board, was then read in full, fol- lowing which presentation the Mayor solicited any desired comments of Commission Members concerning the proposed "Amendments" to the current Zoning Ordinance prior to declaring the Public Hearing open for consid- eration and discussion of the proposed Zoning Ordinance Amendments. Cont. Page 2 Mr. LaPorte inquired of the Town's legal counsel, Attorney John C. Randolph, if this "Public Hearing" was proper, legal and all requirements and regulations, relating thereto, had been met. The Commission, and those present, were assured that all re- quirements and regulations, pertaining to rezoning of lands, as set forth and contained in Chapter 176, Florida Statutes (1971) and of the Town Zoning Ordinance No. 108, have been complied with and fulfilled. Following general discussion, with those present, of the con- tents of said proposed amending Ordinance No. 73 -1, and with the concurrence of representatives of the three properties affected, namely, the Gulf Stream Bath and Tennis Club, the Gulf Stream Golf Club and The Little Club, as well as Attorneys Patrick C. Coughlan and John C. Randolph, it was mutually agreed that Sub - Paragraph 3, Par. "B ", Section 3, as appears on Page 3 of said Ordinance No. 73 -1, be amended to read as follows: 3. "Accessory buildings and uses customarily incident to any of the above uses, in- cluding club houses, golf house, rest fa- cilities, swimming pools, tennis courts and pro - shops." Mayor Koch informed all interested parties that should any of the properties involved and affected by this proposed Amend- ment to the Town Zoning Ordinance, at any later date, desire to deviate from the limitations and restrictions contained in said proposed Ordinance No. 73 -1, there is variance procedure within the Town's 'Zoning Ordinance No. 108, whereby the Commission will consider any petition for "Permissive Use" or a "Variance" from existing regulations and restrictions, on its merit, as brought before the Commission by any property owner. On motion of Mr. Whittemore, seconded by Mr. Walker, The Commission then unanimously approved placing Ordinance No. 73 -1 on First Reading. Att'y. Patrick C. Coughlan, representing the three (3) pro- perty owners concerned with the proposed re- classification of the lands identified in Ordinance No. 73 -1, then requested the Commission to provide for consideration of said Ordinance on its second and final reading at the earliest possible date. On motion of Mr. Walker, seconded mission unanimously agreed to consider its FINAL READING on Friday, March 23, the Town Hall, Gulf Stream, Florida. As you are aware, property values in the Town of Gulfstream have recently been reassessed, and the Tax Assessor has based his assessment on the gol course property on the potential of its development as single - family residences. Any such development would be detrimental to the community. We are writing to request that the Little Club Golf Course be rezoned for recreational use only. We feel that such rezoning will have substantial benefits to the community because it will insure the maintenance of substantial open space and green area and will enable the Little Club to be taxed on a more equitable basis, therefore insuring its continued existence. B. Uses permitted shall only be the following: 1. Outdoor recreation as defined above; 2. Club facilities for social, recrea- tional, fraternal and benevolent pur- poses; 3. Accessory buildings and uses custo- marily incident to any of the above uses, including club houses, golf house, rest facilities, swimming pools, tennis courts and pro shops. C. Building Height Limit: 1. No new building shall exceed two and one -half (2 1/2) stories or thirty - five (35) feet in height; however, any existing club building may be altered and repaired from time to time as shall be necessary for the effective operation and maintenance of such club. D. Front Yard Required: 1. There shall be a front yard of not less than twenty -five (25) feet in depth and a width of not less than one hundred (100) feet. -3- E. Side Yard Required: 1. A RESOLUTION OF THE TOWN COMMISSION FOR THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, RE- LATING TO THE STATE COMPREHENSIVE PLANNING ACT OF 19720 ITS COMPANION LEGISLATION, AND REGIONAL GOVERNMENT. WHEREAS, the Florida State Comprehensive Planning Act of 1972 authorized: (a) the establishment of particular geographical bound- aries within the State of Florida (ostensively for the purpose of state agency planning) and, (b) the creation of the Division of State Planning to coordinate these regions, and WHEREAS, the Governor and his administration have divided the State of Florida into ten multi- county regions or "sub- states" in which appointed regional councils and agents will assume authority previously and properly reserved to elected municipal and county of- ficials, and will assume control and regulation over land, business, development, utilities, production, services, property and people, which control and regulation has never been delegated to any govern- ment by the people of Florida; and WHEREAS, the Florida State Comprehensive Planning Act of 1972, and its companion bill, the Florida Environmental Land and Water Management Act of 1972, together with the funding bill to be intro- duced in the 1973 legislative session to be known as the Florida State Multi- County Planning Commissions Act of 1973 will establish Regional Government in the State of Florida; and WHEREAS, the ten regional divisions of the State of Florida and their respective regional councils correspond in function, and regu- lation with the recent division of the United States into ten federal regions by virtue of Executive Order 11647 - Federal Regional Coun- cils promulgated by the President on February 12, 1972; and WHEREAS, the Federal Region - Sub -State regional government sys- tem will seize the power and authority which properly belongs to mu- nicipal and county governments and even to sovereign states, and will bypass these traditional and constitutional governmental bodies, and will usurp the rights and freedoms of individual citizens guaranteed by the Constitution of the State of Florida and the Constitution of the United States of America: NOW, THEREFORE, BE IT RESOLVED by the Town Commission of the Town of Gulf Stream that: 1. We urge the repeal of the Florida State Comprehensive Plan- ning Act of 1972. 2. We urge the repeal of the Florida Environmental Land and Water Management Act of 1972. cont. Cont. 3.
