This "Special Meeting" of the Town Commission was called to order
by Mayor Koch and those present were informed that the Meeting had been
called for the purpose of conducting a PUBLIC HEARING in order that ALL
interested persons would be heard concerning the proposed RE- CLASSIFI-
CATION of certain lands within the Town of Gulf Stream as set forth in
ORDINANCE NO. 73 -1 providing for an AMENDMENT to the Town's Zoning Or-
dinance No. 108.
CAPTION of said proposed Ordinance No. 73 -1 is as follows:
ORDINANCE NO. 73 -1.
AN ORDINANCE OF THE T014N OF GULF STREAM, FLORIDA, AMENDING
A PORTION OF SECTION I ENTITLED "DISTRICTS AND BOUNDARIES
THEREOF" OF THE ZONING ORDINANCE NO. 108 AS AMENDED, OF THE
TOWN OF GULF STREAM, FLORIDA, BY ADDING A NEW DISTRICT EN-
TITLED "OUTDOOR RECREATIONAL DISTRICT "; AMENDING THE ZONING
MAP TO REFLECT THE NEW DISTRICT, AND BY ADDING A NEW SECTION
TO ZONING ORDINANCE NO. 108 AS AMENDED, OF THE TOWN OF GULF
STREAM, FLORIDA, NUMBERED "VA" AND ENTITLED "OUTDOOR RECREA-
TIONAL DISTRICT" WHICH CONTAINS THE ZONING PROVISIONS OF
SUCH DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS OF OR-
DINANCES IN CONFLICT THEREWITH.
The original copy of said Ordinance No. 73 -1 is on file in the
Town Hall of Gulf Stream, Florida, and is available for review by any
interested persons.
In compliance with Town Charter provisions, Ordinance No. 73 -1,
as recommended by the Town Planning Board, was then read in full, fol-
lowing which presentation the Mayor solicited any desired comments of
Commission Members concerning the proposed "Amendments" to the current
Zoning Ordinance prior to declaring the Public Hearing open for consid-
eration and discussion of the proposed Zoning Ordinance Amendments.

Mr. LaPorte inquired of the Town's legal counsel, Attorney
John C. Randolph, if this "Public Hearing" was proper, legal and
all requirements and regulations, relating thereto, had been met.
The Commission, and those present, were assured that all re-
quirements and regulations, pertaining to rezoning of lands, as
set forth and contained in Chapter 176, Florida Statutes (1971)
and of the Town Zoning Ordinance No. 108, have been complied with
and fulfilled.
Following general discussion, with those present, of the con-
tents of said proposed amending Ordinance No. 73 -1, and with the
concurrence of representatives of the three properties affected,
namely, the Gulf Stream Bath and Tennis Club, the Gulf Stream
Golf Club and The Little Club, as well as Attorneys Patrick C.
Coughlan and John C. Randolph, it was mutually agreed that Sub -
Paragraph 3, Par. "B ", Section 3, as appears on Page 3 of said
Ordinance No. 73 -1, be amended to read as follows:
3. "Accessory buildings and uses customarily
incident to any of the above uses, in-
cluding club houses, golf house, rest fa-
cilities, swimming pools, tennis courts
and pro - shops."
Mayor Koch informed all interested parties that should any
of the properties involved and affected by this proposed Amend-
ment to the Town Zoning Ordinance, at any later date, desire to
deviate from the limitations and restrictions contained in said
proposed Ordinance No. 73 -1, there is variance procedure within
the Town's 'Zoning Ordinance No. 108, whereby the Commission will
consider any petition for "Permissive Use" or a "Variance" from
existing regulations and restrictions, on its merit, as brought
before the Commission by any property owner.
On motion of Mr. Whittemore, seconded by Mr. Walker, The
Commission then unanimously approved placing Ordinance No. 73 -1
on First Reading.
Att'y. Patrick C. Coughlan, representing the three (3) pro-
perty owners concerned with the proposed re- classification of
the lands identified in Ordinance No. 73 -1, then requested the
Commission to provide for consideration of said Ordinance on its
second and final reading at the earliest possible date.
On motion of Mr. Walker, seconded
mission unanimously agreed to consider
its FINAL READING on Friday, March 23,
the Town Hall, Gulf Stream, Florida.

The Town Commission for the Town of Gulf Stream, Florida,
sitting as the ZONING COMMISSION, in accordance with Section XII
of the Town's Zoning Ordinance No. 108, considered an AMENDMENT
thereto, as recommended by the Town Planning Board. Said "Amend-
ment" being set forth in proposed Ordinance No. 73 -1, caption be-
ing as follows:

FLORIDA, AMENDING A PORTION OF SECTION I
ENTITLED "DISTRICTS AND BOUNDARIES THERE-
OF OF THE ZONING ORDINANCE, ORDINANCE NO.
108 AS AMENDED, OF THE TOWN OF GULF STREAM,
FLORIDA, BY ADDING A NEW DISTRICT ENTITLED
"OUTDOOR RECREATIONAL DISTRICT "; AMENDING
THE ZONING MAP TO REFLECT THE NEW DISTRICT,
AND BY ADDING A NEW SECTION TO ZONING ORDI-
NANCE NO. 108 AS AMENDED OF THE TOWN OF
GULF STREAM, FLORIDA, NUMBERED "VA" AND EN-

Following general discussion of this proposed Ordinance, pro-
viding for an AMENDMENT to the Town Zoning Ordinance No. 108, dur-
ing which certain changes therein were agreed upon, and on motion
by Mr. Whittemore, seconded by Mr. Walker, the Commission unani-
mously approved the general composition of said amending ordinance
and directed the Planning Board and Attorneys Patrick C. Coughlan
and John C. Randolph to effect the 'Changes' heretofore mentioned
in order that said Ordinance No. 73 -1 may be submitted to the Town
Commission, for consideration on first reading, at its next regu-
lar meeting to be held on Friday, February 9, 1973, in the Town
Hall at 9:00 A.M.

The 'Zoning Commission further directed the administration
to take the necessary steps for compliance with the Laws of the
State of Florida as well as the regulations of the Town Charter
as pertains to Commission consideration for ANY AMENDMENT to the
Town's Zoning Ordinance as amended.

I represent the Little Club, Inc., whose mailing address
is 100 Little Club Road, Gulfstream, Florida 33444. My client
is the owner of the following described real property located in
the Town of Gulfstream:
See Schedule A
The property has been used for recreational purposes
for the past four years, and it is the intention of the Board of
Governors of the club that the property will continue to be used
for such purposes by the present and future members of the club.
The property owned by The Little Club is presently
zoned as residential property. It is the opinion of the Board of
Governors that the continued use of this property for recreational
purposes will provide a valuable "green area" which is of benefit
to all members of the community in that it provides open space
and reduces the residential density of the community.
On behalf of The Little Club, Inc. I respectfully request
that the Town Commissioners of the Town of Gulfstream, Florida, re-
zone the above described property to a recreational or open space
zoning category.
By separate cover I will forward to you a Resolution of
the Board of Governors of The Little Club, Inc. supporting this
petition.

Gentlemen,
A meeting of the Planning Board is scheduled for Thursday,
18 Jan 1973, 9:OGAM, at City Hall to discuss the following
items.
1. A proposed ordinance providing for a zoning classification
titled, "Outdoor Recreational Land." The Gulf Stream Golf
Club, The Little Club, and The Bath and Tennis Club desire
to have their property classified in this way; the present
classification is "Residence District A." Atty. Patrick
Coughlan represents the three clubs and will be present
to make a proposal. It is important that the Planning Board
act on this item at this time so that we can make a re-
commendation to the Town Commission for its special meeting
on 22 Jan 1973.
2. Other zoning ordinance modifications which may be
discussed but not necessarily resolved include:
A. A requirement that set back lines conform to
the applicable deed restrictions when these
are more restrictive than the general Gulf
Stream requirements.
B. Some restriction on the location of air -
conditioning condensors, pool pumps, and
other machinery which might generate noise
problems.
C. A zoning classification for land used for
school purposes.
D. A specification of
divisions including
storm drainage, and

in the Town of Gulfstream, Florida, and
letter to you on the Club's behalf.

As you may be aware, The Little Club recently
acquired title to the golf course, which should have substantial
collateral benefit to the residents of the Town of Gulfstream
because it insures that the golf course will remain in existence
for the foreseeable future.
It is our opinion that the continued existence of
The Little Club Golf Course adds to the attractiveness and value
of homes located in the Town. As you are aware, property
values in the Town of Gulfstream have recently been reassessed,
and the Tax Assessor has based his assessment on the gol course
property on the potential of its development as single - family
residences. Any such development would be detrimental to the
community.
We are writing to request that the Little Club Golf
Course be rezoned for recreational use only. We feel that such
rezoning will have substantial benefits to the community because
it will insure the maintenance of substantial open space and
green area and will enable the Little Club to be taxed on a more
equitable basis, therefore insuring its continued existence.
If you are favorably inclined to grant The Little
Club's request to have its golf course rezoned for recrea-
tional use only, I will be happy to cooperate with your Town
