The Meeting was called to order by Acting Mayor LaPorte. 2, Mayor LaPorte informed those present that this "Special" Commission Meeting had primarily been called for the pur- pose of the Commission's consideration of Ordinance No. 73 -1. following its SECOND and FINAL READING, said Ordi- nance No. 73 -1 proposing a ZONING CHANGE effecting cer- tain lands within the Town of Gulf Stream. The Town Manager then read, in full, proposed Ordinance No. 73 -1, the original copy of which, properly executed and approved, is attached to the official copy of these Minutes and on file in the Town Hall. Caption of said Ordinance No. 73 -1 is as follows: AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING A PORTION OF SECTION I EN- TITLED "DISTRICTS AND BOUNDARIES THEREOF" OF THE ZONING ORDINANCE BEING ORDINANCE NO. 108 AS AMENDED, OF THE TOWN OF GULF STREAM, FLORI- DA, BY ADDING A NEW DISTRICT ENTITLED "OUTDOOR RECREATIONAL DISTRICT "; AMENDING THE ZONING MAP TO REFLECT THE NEW DISTRICT, AND BY ADDING A NEW SECTION TO ZONING ORDINANCE 108 AS AMEND- ED OF THE TOWN OF GULF STREAM, FLORIDA, NUMBER- ED "VA" AND ENTITLED "OUTDOOR RECREATIONAL DIS- TRICT" WHICH CONTAINS THE ZONING PROVISIONS OF SUCH DISTRICT, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. Page 2 Mayor LaPorte then declared the meeting open for discussion con- cerning proposed Ordinance No. 73 -1 and solicited comments, if any, from the floor. No expressions were forthcoming from those present and he then inquired of the Town's legal counsel - Att'y John C. Randolph - if all legal requirements had been met rela- tive to the Public Hearing, previously held before the Town of Gulf Stream's Commission acting as the Zoning Commission, as well as any Zoning Ordinance regulations or Laws of the State of Flo- rida. The attorney informed the Mayor and Commission Members that he believed all such legal requirements had been met and the re- vised Ordinance Now 73 -1 to be in proper form. The Commission then, upon motion of Mr. Walker, seconded by Mr. Whitney, unanimously approved PASSAGE and ADOPTION of Ordinance No. 73 -1. The Attorney then reminded the Commission that this Ordi- nance shall not become effective until ninety (90) days from date of adoption, namely, March 23, 1973, during which 90 day period any three (3) registered voters of the Town may protest such Or- dinance, thereby requiring the matter to be submitted to a vote of the qualified voters of the Town as to whether or not said a- mending Ordinance shall become effective. 3. The Town Margager then informed the Commission of an unde- sirable condition on GOLFVIEW DRIVE as a result of the PINE TREE growth on the South side of said Drive, extending from Gulfstream Road to AlA, apparently not having been curtailed for the past nine or ten years. The Gulf Stream Golf Club, also recognizing a similar con- dition on their property adjacent to, and south of said Pine Tree Belt, suggested that BIDS be obtained for Tree Topping and Trim- ming of the Club's Tree Belt in conjunction with the solicitation of similar BIDS on behalf of the Town for its responsibility as pertains to the Tree Belt on Golfview Drive. The following BIDS were received for TOPPING and TRIMMING of said Pine Tree Belt on the South side of Golfview Drive, which Bids also provide for disposal of ALL DEBRIS resulting from such Tree surgery, Kirk Materials Co., $ 750.00 Henry Watson 950.00 Ben Johnston 1,050.00 Mayor LaPorte then inquired if all bidders were so organized and equipped to perform this type of service and upon being assured that they were, solicited the pleasure of the Commission which, up- on the motion of Mr. Walker, seconded by Mr. Whittemore, unanimous- ly approved acceptance of the "Low Bid" for such improvement. Upon the motion of Mr. Walker, seconded by Mr. Whittemore, the Commission then unanimously authorized transfer, from the General Fund's Contingency Account, of sufficient funds to cover the Cost of such Tree Surgery on Golfview Drive between Gulf Stream Road and AlA. 4. The Mayor, then citing what appear to be violations of the SIGN regulations as set forth in the Zoning Ordinance, directed the Manager to check all existing "Signs" on properties within the Town of Gulf Stream and take whatever steps may be necessary to assure recognition of, and compliance with, SIGN REGULATIONS as contained in Paragraph "G", Section "VI" of the Town's Zoning Ordinance No. 108, as amended. 5. Mr. Whittemore then mentioned the fact that considerable un- desireable noise within the Town was resulting from major con- struction underway at this time and felt that, if possible, the Commission should discourage such construction during the winter months. It was brought out that NO BUILDING PERMITS for NEW Construc- tion within the Town are issued between December 1st and April 1st. However, such Permits are issueable through NovembeF 30th and con- struction as authorized thereby may get underway after December 1st. During general discussion, pertaining to this issue, and upon the advice of the Town's legal counsel, Att'y. John C. Randolph, the Commission requested that builders, active within the Town at this time, be contacted and informed of the Commission's desire that, to the extent possible, they minimize undesireable and ex- cessive noises as may result from land improvement during recog- nized seasonal months of the year. Analysis of the above "BIDS” indicates that the LOW BIDS are — KIRK'S Two Bids of $750.00 each; and Ben Johnston's "Bid" of KIRK MATERIALS INC. P.O. The properties owned by the Club have been zoned for residential purposes under the plats on file with the Town. This zoning, we are informed, causes the County Tax Assessor some difficulties in assessing the properties as recreational land. Accordingly, we respectfully request that the Town Commissioners rezone the foregoing properties to recreational as promptly as possible. As you know, the golf course is closed until October. If a formal resolution of the Board of Governors is required for your records we shall be pleased to furnish it early in the Fall. This request has been cleared by telephone with the President and a majority of the Executive Committee and we are certain that it will be ratified by the entire Board of Governors at its next meeting.
