RESOLUTION IN SUPPORT OF A-3288 & A-3338
WHEREAS, in the preparation of its annual budget, a municipa1ity is required to limit
any increase in said budget to 2.5%, or the cost-of-living adjustment, whichever is 1ess,
over the previous year's final appropriation subject to certain de1ineated exceptions. This
limitation of expenditures is commonly known as the "Cap Law"; ánd
WHEREAS, pursuant to the proposed Assemb1y Committee Substitute for Assemb1y
Bills 3288 and 3338, the following exceptions would be added to the presently permitted
exceptions to the Cap Law:
1. Amounts appropriated to pay for increases for the costs of goods or services,
including increases in salaries and wages, in excess of the lesser of2.5% or
the cost of living adjustment, that are required pursuant to any contract
entered into priorto the effective date P.L. 2004, c.74 (July 7, 2004).
2. Amounts appropriated, and not exempted under subsection pp. pfthis section,
for the costs of sa1ary and wages for emergency service personnel, inc1uding,
nut not limited to, police officers, firefighter and emergency medical
technicians, up'to 5% over the expenditures for the cost of salary and wages
for emergency service personnel for the previous year; and
WHEREAS, the above set forth exceptions are vital to municipalities, like the Borough
of Carteret, that are struggling to provide the budgetary funds necessary for additional
emergency services personnel, such as police officers, during these times of heightened
public security needs.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, do hereby strongly support the
passage of Assembly Committee Substitute for Assembly Bills 3288 and 3338 for the
reasons set forth hereiµ and urges all municipalities of the State to resolve to support
passage of said legislation.
BE IT FURTHER RESOLVED by the Mayor and Council of the Borough ofCarteret
that the Municipal Clerk forward a copy of this resolution to Acting Governor Codey,
Senator Joseph Vitale and Assemblymen John Wisniewski and Joseph Vas.
