Ball, Chairman of Planning and Zoning and Mr. Franklin O'Brien Secretary for the Civic Association. The Meeting was called to order at 9:00 A.M. by Mayor Koch. Upon motion by Mr. Whitney and seconded by Mr. Walker the Commission approved the "Minutes" of the October 11, 1974 Commission Meeting. Financial Report for the Month of October was submitted to and accepted by the Commission. ORDINANCE 74 -6 AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, RECOGNIZING THE PUBLIC NEED FOR FLOOD INSURANCE AND DIRECTING COMPLIANCE WITH REGULATIONS GOVERNING THE NATIONAL FLOOD INSURANCE PROGRAM AS PUBLISHED IN THE FEDERAL REGISTER OF SEPTEMBER 10, 1971. (36 FR 18175 -66) COMMISSION MEETING NOVEMBER 8., 1974 Cont. Page 2. Mr. Larry M. Ball, Chairman of the Planning and Zoning Board gave a report on the application by Candelaria Inc. for approval of plans in the apartment zoned area. Mr. Ball noted that the plans had been presented in August and that they are now fully approved by the Health Department. However, the Planning Board recommends that the Town Commission schedule a special meeting for November 22nd at 9:00 A.M. in order to give Mr. Joel Hunter extra time to make a thorough investigation concerning the flow of surface water involving his property since his property is immediately north of Candelaria Inc. and could cause problems if the water does not drain properly. He also stated that the Planning Board has set up a meeting for November 21st to review Mr. Hunter's information concerning this problem. A discussion followed. Mr. Walker made a motion that the Commissioners hold a special meeting November 22nd 9.00 A.M. concerning this problem, Mr. Whitney seconded the motion, the motion was passed unanimsouly by the Commission. Commissioner Whittemore gave a report on the Trash Department. Mr. Whittemore stated that a committee consisting of Mayor Koch, Mr. Schaffer, Mr. Pierpont and himself was formed and met October 17th to discuss serious problems with the collection of trash. The Cormittee decided that starting January 1, 1975 the following changes will be made. 1. Scheduling trash collection so that every resident in Gulf Stream would have one trash pick -up weekly. 2. A flat rate set -up of $2.00 per cubic yard. 3. Residents must be responsible for trash pick -up over one full truck load and heavy trimming in spring and summer. Letters have been received from Mayor Koch and Vice Mayor George Walker informing the Town and the Board of Commissioners that both serve on Bank Boards. Mayor Koch at the Sun First and Sun Second National Bank and Vice Mayor Walker with the First Bank and Trust of Boynton Beach. Mr. Ball gave a report on the Comprehensive Plan that the Town of Gulf Stream must submit to the Area Planning Board by October 30, 1975. Mr. Ball felt after talking to Mr. Eugene A. Caputo, Principal Planner for the Area Planning Board of Palm Beach that the Gulf Stream Planning Board would be able to do their own Comprehensive Plan. This was the recommendation of Mr. Caputo. Mrs. LaPorte brought out the fact that there are many areas in Town concerning blocking of views at intersections by shrubs, and suggested the Police Department make a study of this condition report it to the Town Clerk for notification to property owners. A discussion on road repair work was heard. A bid from Hardrives was submitted and a suggestion was made to get bids from other road contractors and a special meeting would be held to discuss road problems at a later date. Upon execution of a purchase order with a reputable well drilling firm, each party shall pay one -half each of all invoices, the total sum to be borne by each part not to exceed Three Thousand ($3,000.) Dollars; Gulf Stream Bath and Tennis Club, Inc. will deposit its share of said cost with Robert D. Chapin, Esq. and Candelaria, Inc. with J. Clinton Scott, Esq., for their said attorneys to pay invoices as received. 4. The parties acknowledge that the drainage plan attached hereto as an exhibit which was prepared by CANDELARIA, INC.'s engineers (O'Brien, Suiter & O'Brien) has been approved by GULF STREAM BATH AND TENNIS CLUB, INC. 'S engineers (Russell « Axon) to be satisfactory, recognizing that the said premises of the latter will be used by the former as a collecting area for surface water. Both parties agree to be bound by the plan of said exhibit. N 5. This Agreement shall be voidable by CANDELARIA, INC. should it fail to obtain a building permit from the Town of Gulf Stream on or before December 1, 1974 for the construction of four (4) dwelling units on its said premises. 6. This Agreement shall be binding upon and shall inure to the benefit of the parties hereto, their successors and assigns. 7. This Agreement constitutes the entire Agreement between the parties, and this Agreement shall not be amended except by an amendment in writing duly executed by the parties i hereto. 8. Both parties hereto agree to execute all necessary applications to procure all necessary permits for the installa- tion of said reverse or dry well drainage system.
