HomeMy Public PortalAboutResolution - 20-06 - 3/18/2020 - AUTHORIZING CITY MGR TO DECLARE STATE OF EMERGENCY DUE TO COVID-19 PANDEMICRESOLUTION NO. 20-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ATLANTIS, FLORIDA, AUTHORIZING THE CITY MANAGER TO DECLARE A LOCAL STATE OF EMERGENCY DUE TO IMPACTS FROM THE COVID-19 PANDEMIC AS REFERRED TO IN COUNTY, STATE AND NATIONAL HEALTH EMERGENCY DECLARATION ORDERS, THEREBY ACTIVATING THE PALM BEACH COUNTY COMPREHENSIVE EMERGENCY MANAGEMENT PLAN AS THE CITY'S ADOPTED EMERGENCY MANAGEMENT PLAN, AND LIKEWISE PUTTING INTO PLACE THE EMERGENCY POWERS CONFERRED UNDER CHAPTER 252, FLORIDA STATUTES; FURTHER AUTHORIZING THE CITY MANAGER TO SUSPEND, CANCEL OR RESCHEDULE NON -ESSENTIAL PUBLIC MEETINGS, LIMIT PUBLIC ACCESS TO CITY FACILITIES AND SERVICES, PROVIDE FOR EMPLOYMENT MATTERS INCLUDING BUT NOT LIMITED TO FLEXIBLE SCHEDULING AND ALTERNATIVE STAFFING TO SERVE THE CITY'S NEEDS; FURTHER AUTHORIZING THE CITY MANAGER TO CANCEL OR POSTPONE THE 2020 "SPRING FLING" AND OTHER OUTSIDE EVENTS AND ACTIVITIES IN ORDER TO PROVIDE FOR THE SAFE OPERATION OF THE CITY IN CONJUNCTION WITH THE CONTINUED EFFICIENT PROVISION OF MUNICIPAL SERVICES; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. WHEREAS, on March 11, 2020 the World Health Organization declared the COVID-19 outbreak a global pandemic; and WHEREAS, the United States Centers for Disease Control and Prevention (CDC) has deemed it necessary to prohibit or restrict non -essential travel to or from certain countries of concern; and WHEREAS, Federal, State of Florida and Palm Beach County governments have all declared "States of Emergency" regarding the COVID-19 Pandemic, and have issued executive orders regarding same; and WHEREAS, Federal, State of Florida and Palm Beach County governments have all recommended limiting public access, exposure and congregation of the public at events, meetings and gatherings of more than 10 people, and have further directed employers to provide for flexible staffing, alternate work schedules, telecommuting, paid leave time and other pandemic pay policies for employees, and to suspend, cancel or reschedule non- essential public meetings, and to limit public access to public facilities and services; and WHEREAS, The health and safety of the public in general under existing government emergencies declarations regarding the COVID-19 Pandemic are ongoing and evolving at a rapid unpredictable and unprecedented pace; as such it is the strong belief of 1 the City Council of the City of Atlantis, Florida that this resolution be adopted in furtherance of the protection of the public health, safety and welfare. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATLANTIS, FLORIDA, THAT: Section 1:, The foregoing recitals are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. Section 2: The City Council of the City of Atlantis, Florida hereby authorizes the Atlantis City Manager to declare a local state of emergency due to impacts from the Covid- 19 (Coronavirus) Pandemic as referred to in Palm Beach County, State of Florida and Federal health emergency declaration orders. In accordance with Resolution 07-07 such declaration shall activate the Palm Beach County Comprehensive Emergency Management Plan as the City's adopted emergency management plan and shall likewise put into place the emergency powers conferred under Chapter 252, Florida Statutes. Section 3: The City Council of the City of Atlantis, Florida further authorizes the Atlantis City Manager to suspend, cancel or reschedule non -essential public meetings, limit public access to City facilities and services, and provide for employment matters including but not limited to flexible scheduling and alternative staffing to serve the City's needs. Section 4: The City Council of the City of Atlantis, Florida further authorizes the Atlantis City Manager to cancel or postpone the 2020 "Spring Fling" and other outside events and activities in order to provide for the safe operation of the City in conjunction with the continued efficient provision of municipal services. Section 5: All Resolutions or parts of Resolutions in conflict herewith are to the extent of such conflicts hereby repealed. Section 6: If any clause, section, or other part or application of this Resolution shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated, and so not affecting the validity of the remaining portions or applications remaining in full force and effect. Section 7: This Resolution shall take effective immediately upon adoption. PASSED AND ADOPTED this 18`h day of March 2020.
