Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, William Reiser, Anne Heideman, Robert Mitchell; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Police Chief, Michael Sankey; Public Works Dir- ector, James Dillman; Attorney, Richard Schieffer; Engineer, Glenn Cook 1. ADDITIONAL AGENDA ITEMS Moved by Scherer, seconded by Heideman to discuss the following additional items: Bruce Neumann, Conditional of yard Minnegasco, Permit requests for Tamarack Dr. So., Hunter Dr. No., Carriage Dr., Navajo Tr., Bridal Path Tr. Motion declared carried 2. MINUTES OF OCTOBER 1, 1985 Moved by Heideman, seconded by Scherer to approve minutes of October 1, 1985, as presented. Motion declared carried 3. MINUTES OF OCTOBER 8, 1985 Moved by Heideman, seconded by Scherer to approve minutes of October 8, 1985, as presented. Motion declared carried 4. PUBLIC WORKS DEPARTMENT Minnegasco Permits Moved by Reiser, seconded by Scherer to adopt the following resolution approving installation of gas lines by Minnegasco. Resolution 85-112, Hunter Trail Subdivision, streets Resolution 85-113, Tamarack Dr. south of Co. Rd. 24 to the Orono city limits Resolution 85-114,Hunter Dr. No., Navajo Tr., Carriage Dr., Bridal Path Tr. Motion declared carried 5. PLANNING AND ZONING DEPARTMENT Alpana Aluminum, Subdivision Moved by Heideman, seconded by Scherer to adopt Resolution 85-115, approving the Alpana Aluminum subdivision. Motion declared carried Zoning Amendment For RR-1 District Council discussed the prepared zoning amendment regarding creating an RR-1 zone to allow horse barns in the Hunter Farms subdivision to be constructed 75 feet from property lines. Robert Mitcehll stated that he did not wish to vote on the matter at this meeting as he believed that the ordinance, as prepared, would allow barns to be placed 75 feet form property lines, in all of Medina, while the intention of the Council was to allow the 75 foot setback in the Hunter Farms Subdivision. Richard Schieffer explained that if the amendment was not satisfactory his office could make revisions. Mr. Mitchell suggested changes in the language to consider Hunter Farms as a first tier suburb of Hamel and that Council might consider granting variances to other barns not now meeting requirements. Moved by Mitchell, seconded by Reiser to table the Zoning Amendment until November 5th and ask the Attorney to revise the ordinance according to Council recommendations. Motion declared carried Lutz Creekside Subdivision JoEllen Hurr reviewed the request of Jim Lutz to delay bonding for the total amount of development of his subdivision project. She stated that he would pay the park dedication fee and enter into the Development Contract. Jim Lutz requested that he also be given an extension beyond the October 20th date for filing of the plat, as he would not be able to complete the grading and utility work, because of the weather and did not want to subdivide and pay higher taxes if no lots could be sold until the site work was completed. Mrs. Hurr stated that she would not advise granting an extension for filing of the plat 3 7 as site work had begun and the preliminary plat approval had been tabled a number of times. Mr. Lutz asked what would happen if he did not file the plat and wished to begin the process in 1986. Mrs. Hurr explained that he would need to reapply, the Planning Commission would rehear, etc. Richard Schieffer suggested that the Council could extend the filing deadline until the November 5th meeting, during which time the ordinance could be reviewed to determine the possibility of granting a longer extension. Robert Mitchell informed Mr. Lutz that he slhould have his attorney review the ordinance and present his opinion as to whether or not the extension could be granted. Mr. Lutz stated that he did not wish to incur additional attorney bills. Moved by Anderson, seconded by Mitchell to extend time for filing of the Lutz Creekside Subdivision plat for 21 days or until November 5, 1985. Motion declared carried Inn Kahoots, Variance JoEllen Hurr stated that owners of Inn Kahoots had asked for a 60 day extension of their variance. She reported that they had begun some work on their building. Moved by Heideman, seconded by Scherer to grant a 60 day extension to Inn Kahoots variance for building changes at 45 Hamel Rd. Motion declared carried Schlosser Addition Moved by Reiser, seconded by Heideman to direct staff to prepare a resolution granting final subdivision approval to the Leonard Schlosser subdivision and to suggest to Mr. Schlosser that the name of the proposed private road conform to city policy for street names. Motion declared carried Bruce Neumann, Conditional Use Permit Anne Heideman explained that the Conditional Use Permit of Bruce Neumann allows for a def- inite parking area, which has now exceeded its boundaries and should be reviewed with the possibility of requiring fencing. She stated that she was concerned about the appearance of the property and its affect on others in the community. Moved by Heideman, seconded by Mitchell to review Bruce Neumann'scompliance with the con- ditions fo the Conditional Use Permit and to inform Mr. Neumann that the matter will be discussed at the November 5th meeting. Motion declared carried 6. CITY INSURANCE Donna Roehl presented a proposal from a Risk Management firm for review of the cities in- surance program. She explained that there were a variety of ways a review could be done and a number of companies that could do be meeting with one of the cities insurance agents that Council seek additional advice. Richard Schieffer agreed that the city should be certain they were covered for all types of risks. Moved by Heideman, seconded by Scherer to ask the Clerk to secure two additional quotes for review of the cities insurance program and present further information at the November 5th meeting. Motion declared carried the work. She reported that to continue coverage, as is, she but would asked 7. FIRE EQUIPMENT CONTRACT Moved by Heideman, seconded by Mitchell to authorize the Mayor and Clerk to sign a contract amendment with Custom Fire, reducing the amount of the contract for truck and equipment pur- chases to $76,765., which will allow for the purchase of a list of equipment from another vendor, and to forward the amendment to Custom Fire, for their approval. Motion declared carried 3 3 )b 8. MEDINA LIBRARY Council discussed the report that the Medina Library would be closed by January 1, 1986. Thomas Anderson stated that he had asked the Clerk to write a letter, for his signature, regarding the fact that Medina has cooperated with the County and various projects and ask that the County Board of Commissioners do all that they can to see that the Medina Library does not close on January 1. He asked that other Councilmembers do what they could do to keep the library open. 9. BILLS Moved by Scherer, seconded by Heideman to pay the bills; Order Checks # 4233-4236 in the amount of $2865.10 and Payroll Checks # 8554-8571 in the amount of $13,294.30.
