The Council of the City of Medina met in regular session on Tuesday, October 15, 1991
at 7:30 P.M.
Present: Mayor, Gary Acromite; Councilmembers, Ann Thies, Robert Mitchell, Philip
Zietlow; Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman;
Police Chief, Richard Rabenort; Zoning Administrator, Loren Kohnen; Attorney,
Ron Batty; Engineer, Glenn Cook
Absent: Councilmember, wilfred Scherer
1. NOVEMBER 5, 1991 MEETING
Mayor Acromite announced that the November 5th council meeting would convene at 8:00 P.M.
due to the Delano School District election (a portion of the Delano school district is in
Medina.)
2. ADDITIONAL AGENDA ITEMS
Moved by Mitchell, seconded by Zietlow to discuss the letter received from the Planning
Commission regarding the comprehensive plan amendment.
Motion declared carried
3. MINUTES OF OCTOBER 1, 1991
Ann Thies stated that the name of Philip Zietlow should be omitted from Item 12, Page 133,
Executive Session.
Moved by Zietlow, seconded by Thies to approve minutes of October 1, 1991, as corrected.
Motion declared carried
4. POLICE DEPARTMENT
Burning Permits
Rick Rabenort reported that Hennepin County will no longer accept burning permit requests
on the county sheriff's radio system so changes will need to be made by residents when
burning. Residents will need to call during week day office hours or on Friday if they
wish to burn on weekends.
5. HAMEL AREA BUSINESS REPRESENTATIVE
Robert Mitchell stated that he and Ann Thies had met with the Hamel business representatives
and had discussed sewer capacity for the area and what they might do to address the issue,
themselves.
6. PUBLIC WORKS DEPARTMENT
Hamel Well # 4
Glenn Cook reviewed the report regarding the possibility of constructing another well in
in the Hamel area. He stated that the EPA has become less restrictive with regards to
radium levels in drinking water and it would now be possible to begin the application
process through the DNR for a well in the Mt Simon -Hinckley aquifer, which could be com-
pleted in 1993.
Robert Mitchell asked if another well was needed.
Glenn Cook stated that there should be another well even if there is no additional devel-
opment.
Gary Acromite asked if another well would provide additional capacity.
Glenn Cook stated that a new well would take care of the additional development included
in the comprehensive plan. He recommended that Items 1 and 2 of the report be done at
this time.
Moved by Mitchell, seconded by Thies to authorize construction of a Mt. Simon well, pump-
ing facility and connecting water main for the Hamel area with the appropriate permit
application and water conservation plan submitted to the DNR.

Pioneer Tr., Improvement
Jim Dillman reported that the traffic counter had ceased to function and that they could
only estimate the number of cars using Pioneer Tr. to be less than 300 per day.
Gary Acromite asked if improving Pioneer Tr. was something that councilmembers were
interested in doing.
Philip Zietlow stated that other roads, such as Medina Rd., have much more traffic, with
Pioneer Tr. use a bare minimum.
Glenn Cook reported that he had spoken with Juergen Holzer regarding the easement and
had offered him $10,000, which Mr. Holzer did not agree with, and he had asked for
$13,500.
Robert Mitchell stated that because of the Awes horse stable the road should be paved
and he would not look favorably on a commercial project at that location, without a paved
road.
Philip Zietlow asked how much work is involved in keeping up the road as a gravel road.
Jim Dillman stated that it is more costly to maintain than Medina Rd.
Philip Zietlow asked if completing this road would free up enough funds to maintain a
number of other city roads.
Robert Mitchell stated that there were a number of small roads that could be done.
Jim Dillman stated that the city will get complaints as the traffic on Pioneer Tr. increases.
Gary Acromite stated that the council could talk to Juergen Holzer when he comes to the
city for his Conditional Use Permit.
Robert Mitchell explained that the permit had been approved and that the petition and
waiver agreement for the road improvement is part of the permit. He stated that he would
be willing to increase payment for the easement to $11,000.
Jim Johnson, Planning Commission representative, asked what would happen to the piece of
land on the east side of the esement and he asked if the road projects had been prioritized.
Philip Zietlow stated that this road was at the top of the list because it was to be paid
for by the property owners.
Jim Johnson asked who would benefit from the city spending $50,000 for this road.
Robert Mitchell stated that the council had talked about the road project at the time the
Awes project came before the city and at that time the Holzer application had not been
made. He stated that, at that time, they had not discussed how the westerly portion of
the road would be assessed.
Glenn Cook stated that grading is not assessed in a residential area, so initally the city
would have paid $50,000, but when the Awes project came up it would all have been assessed.
Donna Roehl explained that residents on Hamel Rd, and Pinto Dr. were not assessed when
those roads were improved to 9 ton capacity and that Loram had paid for improving Arrow-
head Rd. with undeveloped property to the west not being assessed.
Moved by Mitchell, seconded by Thies to offer $11,000 to Juergen Holzer for the Pioneer
Tr. road esement with he and owner, Leonard Schlosser to decide how to divide the assess-
ment charges.

7. PLANNING AND ZONING DEPARTMENT
Hennepin County Fair
Loren Kohnen explained that the Hennepin County Fair Board
duct the 1992 county fair on the Elwell property, but that
determined that it was not a permitted us in a residential

Ron Batty stated that the only question is whether or not the fair is a permitted use
either by right or by Conditional Use Permit.
Andy Rozeboom stated that the Planning Commission would not let them make a presentation
and yet they were charged $250 to make application.
Loren Kohnen stated that everyone is charged an application fee of $250 and that the only
discussion by the Planning Commission centered on interpreting the ordinance.
Robert Mitchell stated that this is an unusual use, a commercial type of use, where many
people are expected to be present, not just a park.
Gary Acromite stated that he had a problem with cars parking on an area where septic
systems may be constructed.
Philip Zietlow stated that he was o pposed if soils were going to be ruined for septic
systems.
Andy Rozeboom stated that he had asked if they could make an application for the fair
on a commercial property and had been told that it may also be an unapproved use.
Robert Mitchell stated that a fair may not be allowed anywhere in the ordinance.

Robert Mitchell stated that once a permit is issued they may want to come back to the
city for more and more. He suggested that they talk to Hennepin County about having the
fair in a proper zone.
Andy Rozeboom stated that the fair was trying to survive and the county does not own the
property in a commercial zone.
Moved by Mitchell, seconded by Thies to authorize preparation of a resolution denying use
of the Elwell property for County fair purposes as use is not compatible with uses allowed
in the residential zone, according to recommendations made by the Planning Commission.

Andy Rozeboom thanked the council for listening to their proposal, something the Planning
Commission did not do.
Woodlake Landfill
Loren Kohnen reported that monthly meetings with Woodlake, Wenck and Associates and city
staff will be held to discuss the Woodlake landfill and it operation,and through continued
monitoring to determine if the liner in Area # 2 is leaking. If corrections need to be
made the garbage must be removed and the liner repaired.
Robert Mitchell stated that he would contract Larry Redmond regarding the landfill siting
process.
8. TAX INCREMENT PROJECTS
Council discussed the proposed list of projects that could be
districts and if they should be paid for through assessments
from tax increment funds.
Council prioritized the list of projects with the Hamel well,
ment as projects for 1992 and 1993.
Moved by Acromite, seconded by Thies to approve the Tax Increment projects as agreed upon
and have the financial consultant and engineer prepare a report regarding payment proced-
ures for the projects.

install gas mains on South Ridge Dr.

Moved by Mitchell, seconded by Thies to adopt Resolution 91-80, allowing Wright -Hennepin
Electric to install service in Tuckborough Farms 3rd and 4th Addition.

11. * ANGEL PEREZ, CONDITIONAL USE PERMIT
Moved by Mitchell, seconded by Thies to adopt Resolution 91-81, granting a Conditional Use
Permit to Angel Perez to conduct a propane tank repair business at 3575 Kilkenny Ln.
Motion declared carried
12. COMPREHENSIVE PLAN, PLANNING COMMISSION LETTER
Gary Acromite asked that minutes reflect receipt of a letter from the Planning Commission
regarding the comprehensive plan amendment forwarded to the city council by unanimous
approval of those members attending the October 8th planning commission meeting.
Council discussed the letter and brays to communicate with the planning commission members.
Robert Mitchell suggested that Gary Acromite and Phil Zietlow meet with Planning Commission
members to discuss the dissatisfaction expressed in the letter regarding the Comp. plan.

13. PAYMENT OF BILLS
Moved by Thies, seconded by Mitchell to pay the bills; Order Checks # 10114-10122 in the
amount of $48,628.53 and Payroll Checks # 12407-12427 in the amount of $15,403.61.
