Umunhum Area of Sieip AzuI Open Space Preserve GENERAL MANAGER'S RECOMMENDAMO::7� 1. Determine that the recommended actions are categorically exempt from the California Environmental Quality Act as set out in this report. 2. Adopt the attached resolution authorizing purchase of the Daloia property, authorizing the President to execute the Acquisition Funding Agreement with the Bay Area Ridge Trail Council (and the State of California Coastal Conservancy). 3. Adopt the attached Resolution dedicating the Daloia property as public open space. 4. Tentatively adopt the Preliminary Use and Management Plan recommendations contained in this report and naming the property as an addition to Mt. Umunhum Area of Sierra Azul Open Space Preserve. DESCRIPTION (see attached map s The 40-acre Daloia property is located east of Los Gatos between Mt. Umunhum and Guadalupe Reservoir. Surrounded entirely by Sierra AzuI Open Space Preserve, the property includes one of the last remaining privately owned sections of the 11-mile stretch of the planned Bay Area Ridge Trail that connects Lexington Reservoir to Almaden Quicksilver County Park. The property is in the center of the rugged and remote Rincon Creek watershed on the north-facing slope overlooking the County Park and Almaden Valley. The planned Jacques Ridge parking area, due to be constructed later this fiscal year, is located approximately 2.5 miles to the east at the intersection of Hicks Road and Mt. Umunhum Road. When constructed, the staging area will provide easy access to the property. In recognizing the importance of this property as it relates to completing the Ridge Trail, the Bay Area Ridge Trail Council is supporting this acquisition with grant funds being secured from the California Coastal Conservancy. Umunhum on extremely steep and rugged west- facing slopes overlooking the uppermost reach of the Rincon Creek. The landscape is largely comprised of a dense mixed evergreen forest, including madrone, bay laurel, oak, and Douglas fir. A tributary of Rincon Creek bisects the western portion of the property and joins Rincon Creek a few hundred feet north of the property line. The creek runs year-round and, together with the property's diverse landscape, provides desirable habitat for a wide variety of wildlife that includes mountain lion, deer, bobcat, and coyote. The property is accessed by Woods Road, an unsurfaced road that is the planned alignment of the Bay Area Ridge Trail connecting Almaden Quicksilver County Park to Mt. El Sombroso and Lexington Reservoir County Park. Historically, the road was constructed in the late 1800's for the purpose of bringing timber out of the watersheds of Rincon Creek and Guadalupe Creek to the Almaden and Guadalupe mines. Hikers, bicyclists, and equestrians have passed through the property for many years, gaining access to adjacent District and County lands. Although densely wooded, there are places along Woods Road where trail users can catch dramatic views of Mt. El Somboso, Mt. Umunhum, and Almaden Quicksilver County Park. Beyond the property to the west, Woods Road connects to Kennedy Trail and Kennedy Road in Los Gatos, as well as Limekiln Trail and Priest Rock Trail originating in Lexington Reservoir County Park. Immediately to the south of the property, Woods Road intersects Barlow Road which connects to Mt. Umunhum near Bald Mountain. USE AND MANAGEMENT PLAN Planning Considerations The property is located within the District's sphere of influence and in an unincorporated area of Santa Clara County. It is zoned HS (Hillside), requiring one dwelling unit per 160 acres, unless the development is clustered whereby the allowable density is based on the average steepness of the property. The property has a legal density of one dwelling site. The Santa Clara Countywide Trails Master Plan shows the Bay Area Ridge Trail in the vicinity of the property, located along Woods Road between Mt. El Sombroso and Almaden Quicksilver County Park. The District's Regional Open Space Study shows Woods Road as an existing major trail and planned Bay Area Ridge Trail. The property is rated in the District's Open Space Master Plan as having moderate composite open space values and is important in terms of providing potential outdoor recreation, wildlife habitat, and scenic backdrop as viewed from the surrounding area and Almaden Quicksilver County Park. R-02-100 Page 3 Property Assessment As part of the due diligence investigation of the Daloia property, the District contracted with Michael Cox to provide a detailed mining assessment. Mr. Cox is a geologist having a high level of expertise and knowledge of mining activities in and around Almaden Quicksilver County Park. According to the April 29, 2002 Michael Cox Report, there are no signs of mercury mining activities on or near the property. Preliminary Use and Management Plan Recommendations The preliminary use and management plan will take effect at the close of escrow and remain effective until the plan is amended or a Comprehensive Use and Management Plan is prepared. Any proposed changes to land use will be subject to further environmental review and public input. Public Access: Site will be open to public trail use. Trail Use Designation: Woods Road will be designated as a multi-use trail. Signs: Recognition signs for granting agencies will be placed at appropriate locations near the trailhead and on-site. Patrol: Maintain Woods Road for patrol purposes. Dedication: Indicate your intention to dedicate as public open space at this time. Name: Name the property as an addition to the Mt. Umunhurn Area of Sierra Azul Open Space Preserve. Site Safety Inspection: Preliminary inspection is complete and no hazards were found: comprehensive inspection to be complete before the close of escrow. CE0A COMPLIANCE Project Description The project consists of the acquisition of a 40-acre parcel of land as addition to the Mt. Umunhum Area of Sierra Azul Open Space Preserve, and the concurrent adoption of a Preliminary Use and Management Plan for the property. Ultimately, the property will be included in a Comprehensive Use and Management Plan for the adjacent open space preserve. The land will be permanently preserved as open space and will be maintained in a natural condition. It will be open to the public for low-intensity recreation use. R-02-100 Page 4 CEGA Determination The District concludes this project will not have a significant effect on the environment. It is categorically exempt from CEQA (California Environmental Quality Act) under Article 19, Sections 15316, 15317, 15325, and 15061 of the CEQA Guidelines. Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural condition and the management plan proposes to keep the area in a natural condition. The use and management plan specifies the property will be maintained in a natural condition. Section 15317 exempts the acceptance of fee interests in order to maintain the open space character of an area. The District will accept fee interests and will maintain the property as open space. Section 15325 exempts transfers of ownership of interests in land in order to preserve open space. The acquisition will transfer ownership•to the District and ensure the property is preserved as open space. This acquisition qualifies under three sections. The actions proposed in the Preliminary Use and Management Plan are also exempt under section 15061, as there is no possibility the actions may have a significant effect on the environment. TERMS AND CONDITIONS The 40-acre Daloia property is being acquired at a purchase price of$300,000 as a seperatley developed residential site (approximately $7,500 per acre). This price is considered to be the fair market value of the property based upon the current real estate activity in this market area and has been confirmed b a fee appraisal of the subjectproperty. This ac acquisition is art of a Y PP J q P Bay Area Ridge Trail Council acquisition grant which is being funded through the California Coastal Conservancy. The Ridge Trail grant provides for fifty percent of the acquisition funding or $150,000 as a matching financial contribution. As part of the grant funding agreement with the Ridge Trail Council (and the State of California Coastal Conservancy), the District is required to dedicate the property for public open space purposes and record a Memorandum of Agreement memoralizing the funding agreement. As part of the Purchase Agreement, the seller has requested financing 80% of the purchase price. The District would be required to pay $60,000 in cash at the close of escrow, and pay $240,000 in quarterly installment payments of principal and interest based upon a secured promissory note at a tax free interest rate of 6.25% per annum over fifteen years. This interest I I I I I I i R-02-100 Page 5 rate was established in consultation with the District's bond underwriter and is considered a market rate for this type of rate. The note will be secured with a deed of trust encumbering other District owned land in the Mt. Umunhum area (the former Sink and Kelsey properties, see attached map) so that the subject property is free and clear of encumbrances to satisfy the dedication requirements of the grant. Ilk i 0.25 0. 0.75 1 s A - y rl o RESOLUTION NO. 02- RESOLUTION OF THE BOARD OF DIRECTORS OF MIDPENINSULA REGIONAL OPEN SPACE DISTRICT AUTHORIZING ACCEPTANCE OF PURCHASE AGREEMENT, AUTHORIZING OFFICER TO EXECUTE THE ACQUISITION FUNDING AGREEMENT AND THE MEMORANDUM OF AGREEMENT AND THE CERTIFICATE OF ACCEPTANCE OF GRANT TO DISTRICT, AND AUTHORIZING GENERAL MANAGER TO EXECUTE ANY AND ALL OTHER DOCUMENTS NECESSARY OR APPROPRIATE TO CLOSING OF THE TRANSACTION (SIERRA AZUL OPEN SPACE PRESERVE - LANDS OF DALOIA) The Board of Directors of Midpeninsula Regional Open Space District does resolve as follows: Section One. The Board of Directors of Midpeninsula Regional Open Space District does hereby accept the offer contained in that certain Purchase Agreement between the Robert J. Daloia and Midpeninsula Regional Open Space District, a copy of which is attached hereto and by reference made a part hereof, and authorizes the President or appropriate officers to execute the Purchase Agreement, Promissory Note and Deed of Trust on behalf of the District. Section Two. The President of the Board of Directors or other appropriate officer is authorized to execute the Acquisition Funding between the Bay Area Ridge Trail Council (and the State of California Coastal Conservancy) and the Midpeninsula Regional Open Space District and the Memorandum of Agreement memorializing said Acquisition Funding Agreement. Section Three. The President of the Board of Directors or other appropriate officer is authorized to execute a Certificate of Acceptance for the Grant Deed on behalf of the District. Section Four. The General Manager of the District shall cause to be given appropriate notice of acceptance to the seller. The General Manager and General Counsel are further authorized to approve any technical revisions to the attached Purchase Agreement, Acquisition Funding Agreement, Memorandum of Agreement and other transactional documents which do not involve any material change to any term of said agreements or other transactional documents, which are necessary or appropriate to the closing or implementation of this transaction. Section Five. The General Manager of the District is authorized to expend up to $5,000 to cover the cost of title insurance, escrow fees, and other miscellaneous costs related to this transaction. Section Six. It is intended, reasonably expected, and hereby authorized that the District's general fund will be reimbursed in the amount of$300,000 from the proceeds of the next long-term District note issue. This section of this Resolution is adopted by the Board of Directors of Midpeninsula Regional Open Space District solely for purposes of establishing compliance with the requirements of Section 1.103-18 of the Treasury Regulations. The reimbursement of this payment expenditure is consistent with the District's budgetary and financial circumstances. There are no funds or sources of moneys of the District that have been, or are reasonably expected to be, reserved or allocated on a long-term basis, or otherwise set aside to pay the costs of this open space land acquisition project which are to be paid or reimbursed out of proceeds of indebtedness to be issued by the District. The Board of Directors hereby declares the District's official intent to use proceeds of indebtedness to reimburse itself for this open space land acquisition project expenditure. DISCUSSION The existing Memorandum of Agreement with SEIU Local 715 expires April 1, 2003 and the District anticipates beginning negotiations in late Fall 2002. As you are aware, labor negotiations are very time intensive, and involve evaluation of numerous and sometimes complex labor issues, as well as research concerning comparable agency data. Therefore, the assistance of an outside labor relations firm experienced and qualified in public sector work would be extremely efficient and effective for negotiations. Staff is recommending contracting with a non-profit firm, IEDA which conducts labor relations for dozens of Northern California public sector employers, including many local cities, as well as San Mateo County. Staff has met with the representative who would be assigned to us and found her to be extremely knowledgeable in labor relation strategies and in particular in the specifics of other SEIU contracts with local agencies in our area. She would serve as the negotiating team spokesperson with our management staff, assist in analyzing union proposals and in preparation of management proposals and counter proposals. General Counsel, of course, would be kept informed, and would give input throughout the process to consult with the Board, General Manager and the negotiating team. There are other advantages to contracting with IEDA at this time. In addition to direct involvement in negotiations, IEDA provides ongoing pro-active labor relations support as part of their annual contracts. These services include training for management on employee relations, grievance prevention strategies, and if needed, the handling of grievances. The training component could help us meet our ongoing commitment for management/supervisory training as outlined in the Workplace Enhancement Plan. Staff feels confident IEDA will be a valuable, informed, and very qualified member of the District labor relations team. In the section on Environmental Restoration FormerlyUsed Defense Sites FUDS oneproject "( ), m particular is named, Mount Umunhum in San Jose, CA. As you know, the Department of Defense (DoD) is responsible for cleaning up FUDS properties, and the Army Corps of Engineers ("the Corps") manages and executes the cleanup. In 1986, the Midpeninsula Regional Open Space District (MROSD) acquired the former Almaden Air Station and all of its remaining facilities on Mount Umunhum at full market value, with the intent of restoring the site to a natural condition and providing public access to this 3,486 foot high peak. Mount Umunhum offers spectacular panoramic vistas, from Monterey Bay to Mount Diablo to San Francisco, and represents precious remaining limited open space. Unfortunately, high levels of toxic materials have been found in the abandoned U.S. Air Force facilities, making restoration of this area difficult for the MROSD and leaving the area closed to the public. As long ago as 1988, the Defense Environmental Restoration Program recorded that P g g g it had spent some $990,000 toward decontaminating the former air station and estimated that it had yet to spend an additional $2.5 million, but no action has been taken. For some time, the MROSD has been working with the community, state and congressional leaders to obtain federal funding to clean up the site and allow it to be opened to the public for low-intensity recreational use. To assist in this effort, the San Jose City Council passed a resolution on October 23, 2001, in support of the MROSD's efforts to obtain federal monies for the clean up of Mount Umunhum. With this local endorsement, I worked with the Defense Appropriations Subcommittee to have the project included in the FY 2003 Defense Appropriations bill. This effort is reflected in the language included in the committee report, which identifies that the cleanup of Mount Umunhum is a priority for the committee, as it is for me and my constituents. Senator Barbara Boxer has also voiced her support for this project. At the request of several coastside organizations and individuals, and based upon the results of a 1998 advisory vote (Measure F) and a San Mateo County-wide poll, the District undertook studies as to the types and level of open space and land management services it might offer in the San Mateo coastside region. Measure F indicated a clear majority of support for a District open space and management program, and countywide polling indicated that approximately 90%of all County residents consider such a program important. I As a result of the requests for District services, the results of Measure F, and the countywide poll, the District has spent over 3 years and $400,000—including a year of Coastal Advisory Committee meetings and over 25 public workshops to work with coastside community residents to develop a thorough, responsive coastal annexation program proposal. The District's final Service Plan and Environmental Impact Report (EIR)will include ideas and input from many interested organizations and thoughtful individuals. In fact, one point of concern heard by the District, raised primarily by southcoast residents, was the District's power of eminent domain. Over 200 individuals signed a petition, presented to the District, agreeing that "the District could bring significant benefits to the coastside, and that coastside residents could offer significant benefits to the District..." and therefore agreeing "that should the District Board pledge to permanently remove eminent domain from its policies in the proposed annexation area...(possibly in the LAFCo process)...that we,the undersigned,will immediately pledge our full support and best efforts to assist the District through the annexation process..." Most importantly, the opportunities for public input continue. The District is currently receiving public comment through its EIR process. Before making any application to LAFCo, there will be additional public meetings and more opportunities to consider written comments. Thereafter, the LAFCo process will also include ample opportunity for public input to shape an outcome. Furthermore, the LAFCo process itself includes the opportunity for an election. For these reasons, I believe a second advisory vote would be redundant, unnecessary, and disruptive of the District's EIR and LAFCo's processes. Finally, because the San Mateo coastside is a national treasure of great regional pride and interest, I believe any such advisory vote, if considered, should be countywide. I would like to clarify some points about the Open Space District's coastal annexation proposal. First,the District has agreed to give up its use of eminent domain on the coastside. To ensure permanence of this policy, the District has done so by several legal mechanisms: by inclusion in the Coastal Service Plan, as a mitigation measure in the Environmental Impact Report, and as a proposed ordinance, to be included in any application to the Local Agency Formation Commission. Of the 11,800 acres the District anticipates it could acquire over a 15 years, approximately W1*would consist of providing management services to open space land acquired by other organizations or agencies, and the remaining easements or acquisitions would be from willing sellers only. At least one of your readers is under the mistaken impression that the District possesses power it does not;the District is, in fact, another landowner, subject to all local, state and federal land use regulations,just as other property owners are. The District has no authority over how others use or manage their property. The District has no regulatory power. In fact, as a public agency and good neighbor,the District considers more input and subjects itself to more influence by its neighbors than most private property owners do,while struggling with many of the same permitting and other issues faced by neighbors. Fortunately,the District can offer its staff resources to collaborate with interested neighbors to address common land management goals, such as feral pig management, erosion control, and other resource management issues. The District also offers a public safety presence, fire suppression services, and modest facilities for its very low-impact public access to its preserves. Preserves typically accommodate minimalist trail systems, and attract fewer and different types of visitors than parks or campgrounds. The District also offers many opportunities for public participation-4n its childrens' educational programs, in other community programs, and in its planning and decision-making, which include full public participation. We hope we'll have many more coastsiders informing themselves and becoming involved—soon, perhaps as elected representatives. On Wednesday evening, July 31, at 7:00 p.m., Midpeninsula Regional Open Space District staff helped release two three-month-old, recovered and rehabilitated owls at the Duveneck Windmill Pasture atop Rhus Ridge. Apparently, Raptor Rehabilitator Lisa Konie, associated with the Wildlife Center of Silicon Valley, had been seeking the optimal location to release the owls,which had been raised by one of her colleagues. Since raptors are one of the many species requiring a considerable range of open space land to survive, Ms. Konie, Ranger Jeff Miller, and District Resource Management Specialist Cindy Roessler identified the preserve land between Rancho San Antonio and Monte Bello Open Space Preserves as an ideal location for the release of the owls. We are so pleased, and felt you would be proud to know that the Windmill Pasture has offered its hospitality to help these very special new neighbors flourish. As long ago as 1988,the Defense Environmental Restoration Program recorded that it had spent some$990,000 toward decontaminating the former air station and estimated it had yet to spend an additional$2.5 million. The Mid-Peninsula Regional Open Space District of Santa Clara County purchased the site in the 1980s at full market value,and wishes to make this land available for public recreation use. It is the crowning centerpiece of 200 properties totaling over 14,000 acres on Mount Umunhum purchased by the Open Space District. 71us area constitutes the District's largest preserve and includes panoramic vistas over Silicon Valley and around to the Monterey Peninsula. It is,in a word,magnificent. However,given the presence of lead and friable asbestos and likely polychlorinated biphenyl(PCB)and solvent contamination,the District cannot safely open the area for public access. I call on the Corps to immediately begin working with the Open Space District to determine the most expedient course of action,as the cost of completing the cleanup has increased since 1998.
