APPROVING CHANGE ORDER #5 AND PAYMENT FOR EMERGENCY
SEWER SERVICES CONTRACT! B& W CONSTRUCTION!MILlK STREET
STORM DRAIN REPAIR
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a
contract to B & W Construction in the amount of $102,220 for 2004 Emergency Sewer
Services; and
WHEREAS, the Borough Engineer has advised the Governing Body that a modification
of the contract is reasonable and necessary and has recommended that the aforesaid
contract be modified in accordance with Contract Change Order #5 (see attached); and
WHEREAS, Change Order #5 provides for a net increase in the contract price in the
amount of $39,609.44, including all previously approved change orders, resulting in a
revised contract price of $676,817.13; and
WHEREAS, the Borough Engineer has advised that the above described changes and/or
modifications to the project were unforeseen at the time of the award of the origina1
contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Counci1 of the Borough
ofCarteret as follows:
1. That the Contract Change Order #5, a copy of which is attached hereto and made
a part hereof, providing for a net increase in the contract price of $39,609.44
including all previously approved change orders, resulting in a revised contract
amount of $676,817.13 is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to execute Change
Order #5 based upon the recommendation of the Borough Engineer.
3. That the Borough Purchasing Department is hereby authorized to issue payment
pursuant to the attached Invoice in the amount of $39,609.44.
4. A copy of this resolution and a fully executed copy of Change Order #5 be
forwarded to the Borough Engineer for distribution to B & W Construction.

original on February 18, 2005.
