COMMISSION MEETING
APRIL 11, 1975

Gwynn, Deputy Town Clerk, Roy Cowart, Chief of Police.
The Meeting was called to order at 9:00 A.M. by Mayor Koch.
Upon motion by Mrs. LaPorte and seconded by Mr. Walker the Commission
approved the Minutes of the Regular Meeting March 14, 1975 and Commission
Meeting of Newly Elected Commission, March 18, 1975.
Financial Report for month of March, 1975 was submitted and accepted by
the Commission.
Mr. Walker moved that the Budget Report for the Period October 1, 1974
thru March 31, 1975 be accepted, Mrs. LaPorte seconded the Motion. Motion
was unanimously passed.
The following summarization of the Police Report for the Month of March
1975 was submitted to the Commission.
A plaque was presented to former Commissioner Henry N. Whitney by Mayor
Koch in appreciation for outstanding work and time Mr. Whitney performed for
the Town of Gulf Stream. Mr. Whitney said "that he enjoyed the three years
he had served for the Town and was glad he could serve the residents of Gulf
Stream."

Second and final reading of Ordinance 75 -2 was read.
AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA,
ASSESSING A FEE FOR THE FILING OF PETITIONS FOR
RE- ZONING AND FOR THE PLATTING OF SUB - DIVISIONS
WITHIN THE TOWN OF GULF STREAM.
Upon motion by Mr. Walker, seconded by Mr. Bettison, Ordinance 75 -2 was
unanimously carried.
Letters were read to the Commission concerning water mains located on Shore
Road. Mr. Iglehart will be starting construction shortly in this area and
had found that the existing water mains are not deep enough and feels should
work commence and water mains be damaged the responsibility should be the Town's.
Commissioner Whittemore was advised to contact Earl Harvel to get a price on
the cost of this project, and it was also suggested that it would be to the
best interest of all parties concerned with receiving water in this area that
a meeting be held and a reasonable agreement be made with the possibility of
property owners paying a portion of the cost to relocate the mains and the
Town pay a portion of the cost.
Mr. Severn presented a complaint regarding the Gulf Stream Shores Apartments.
The Town Attorney advised Mr. Severn this was a civil matter and was not in
the realm of municipal jurisdiction.
A discussion of a proposed Ordinance concerning the removal of dead stumps
and trees that had become infected with lethal yellowing was read to the
Commission, after a discussion Attorney Randolph was advised to present to
the Town Commission at the next regular meeting a revised ordinance conforming
with the Town's specifications.
Mayor Koch gave a short report on the water status with the City of Delray
Beach, he told the Commission that he had been in contact with Delray many
times and that he would like to have all the Commissioners meet Wednesday,
April 16th, at 3 p.m. at the Delray Beach City Hall with Delray's Commission
to work out some kind of an agreement concerning purchasing water from
Delray Beach.
Ordinance 75 -4 was read.

OR SPECIAL EXCEPTIONS FROM THE OFFICIAL ZONING ORDINANCE OF
THE TOWN OF GULF STREAM.
Upon motion by Mr. Whittemore and seconded by Mr. Bettison, Ordinance 75 -4
was accepted for first reading by the Commission.

ORDINANCE NO. 7 S -- L
AN ORDINANCE OF THE TOWN OF GULF STREAM,
FLORIDA, ASSESSING A FEE FOR THE FILING
OF PETITIONS FOR RE- ZONING AND FOR THE
PLATTING OF SUB - DIVISIONS WITHIN THE
TOWN OF GULF STREAM.
WHEREAS, the Town Commission has determined that it is
necessary to assess a•filing fee for petitions for re- zoning and
platting of sub - divisions within the Town of Gulf Stream to defray
the costs involved in processing such applications; and
WHEREAS, the Town Commission has determined that it is
to the best interests of the Town and its citizens that such fees
be assessed; now, therefore,
BE IT ORDAINED by the Town Commission of the Town of
Gulf Stream, Florida, as follows:
Section 1: Upon filing a petition or a request for
re- zoning within the Town of Gulf Stream the petitioner shall pay
a fee of TWO HUNDRED DOLLARS ($200) to the Town Clerk. The fee is
not reimbursable but is to help defray the costs of administrating
and processing of such application.
Section 2: Upon filing of a sub - division plat with the
Town the developer shall pay a fee of TWO HUNDRED DOLLARS ($200)
to the Town Clerk as the minimum fee for platting of the sub-
division. In addition the developer shall pay a fee of TWENTY -F
DOLLARS ($25) for each lot platted within the sub - division. The
fee is not reimbursable but is to help defray the cost of adminis-
trating and processing the plat.
Section 3: All ordinances or parts of ordinances in
conflict herewith are repealed.
Section 4: This ordinance shall take effect and be in
force from and after its approval as required by law.
