WHITTEMORE COMMISSIONER HENRY N. WHITNEY COMMISSIONER Also attending: Att'y John C. Randolph, William E. Gwynn, Town Manager Barbara Gwynn, Deputy Town Clerk, Police Chief, Roy Cowart. The Meeting was called to order at 9:00 A.M. by Mayor Koch. Upon motion by Mr. Whittemore and seconded by Mr. Walker the Commission approved the "Minutes" of the January 10th, 1975 and Special Meeting February 7th, 1975. The Financial Report for the month of January was submitted to and accepted by the Commission. The following summarization of Police Reports for the Month of January - 1975 was submitted to the Commission. Attorney Otto presented to the Commission for re- approval a plat for H. V. Pope Sub- division. Attorney Atto noted that the Commission had previously approved this plat but in the meantime the signature of the mortgagee had been removed and change of title certification. He notedthat he wanted to go ahead and record the plat with the mortgagee approval deleted. Attorney Otto stated that the mortgage had been satisfied and clear title to the property now exists. It is noted at this time that Attorney Otto for the petitioner stated that the mort- gagee has been satisfied and there is a clear title to the property. Attorney Otto made a request to the Commission that they release Ashbourne Realty from their letter of credit and also their bond. Town Manager Gwynn reported to the Commission that he had inspected the property involved and Ashbourne Realty had met their obligations. Mr. Walker made a motion that they release the letter of credit and personal bond. Mr. Whittemore seconded the motion. Motion passed. ORDINANCE 75 -1 was read, this is an Ordinance concerning a zoning change. AN ORDINANCE OF THE TOWN OF GULF STREAM AMENDING THE 1952 ZONING ORDINANCE NO. 108 AS AMENDED, OF THE TOWN OF GULF STREAM FLORIDA, BY CHANGING THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 4, TOWNSHIP 46 SOUTH, RANGE 43 EAST, LYING EAST OF RIGHT - OF - WAY OF U. S. HIGHWAY NO. ONE FROM RESIDENTIAL DISTRICT "A" TO OUTDOOR RECREATIONAL DISTRICT. Upon motion by Mr. Walker, seconded by Mr. Whitney the Commission unanimously approved said Ordinance on lat reading, second and final reading March 14th, 1975. ORDINANCE 75 -2 was read: AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, ASSESSING A FEE FOR THE FILING OF PETITIONS FOR RE- ZONING AND FOR THE PLATTING OF SUB - DIVISIONS WITHIN THE TOWN OF GULF STREAM. Upon motion by Mr. Whittemore and seconded by Mr. Walker the Commission unanimously approved placing Ordinance 75 -2 on first reading. RESOLUTION 75 -1 was read: A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA AUTHORIZING A PRO RATA SHARE OF GENERAL FUND EXPENSES TO BE BORNE BY THE WATER FUND FOR SAID FISCAL YEAR TERMINATING ON SEPTEMBER 30, 1975. Upon motion by Mrs. LaPorte and seconded by Mr. Walker Resolution 75 -1 was unanimously approved by the Commission. COMMISSION MEETING - FEBRUARY 14, 1975 Cont. Page 3. Deputy Town Clerk Gwynn gave a report on the progress of the Comprehensive Plan for the Town. It is hoped that the Comprehensive Plan will be com- pleted in the very near future. A motion was made by Mrs. LaPorte to appoint Nina and Arthur Sprott as Inspectors and Marian George, Clerk, as the Town's officials for the upcoming election March 4th, 1975. Mr. Whittemore seconded the motion. Motion Passed. Mr. Walker made a motion to accept for study the Audit Report for the Town from Himes and Himes. Mr. Whittemore seconded the motion. Motion passed unanimously. Mayor Koch, in compliance with the laws of the State of Florida, and the Charter of the Town of Gulf Stream, issued a Proclamation that a General Election for the purpose of electing five Commissioners to serve the Town of Gulf Stream for a period of three years. Election to be held Tuesday March 4th, 1975. Mayor Koch gave a report on the recent hearing by the Palm Beach Zoning Commission. This is a re- zoning request concerning a parcel of land adjacent to the Town Limits. He made a special point of thanking Those that had taken their time to appear at this meeting on behalf of the Town. Mayor Koch reported that the request was denied and another meeting would be held concerning this request February 2%nd, 1975 and urged everyone to attend since this meeting could be even more important than the first one. AN ORDINANCE OF THE TOWN OF GULF STREAM AMENDING THE 1952 ZONING ORDINANCE NO. 108 AS AMENDED, OF THE TOWN OF GULF STREAM, FLORIDA, BY CHANGING THE SOUTHEAST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 4, TOWNSHIP 46 SOUTH, RANGE 43 EAST, LYING EAST OF RIGHT -OF -WAY OF U. S. HIGHWAY NO. ONE FROM RESIDENCE DISTRICT A TO OUTDOOR RECREATIONAL DISTRICT. WHEREAS, the Town of Gulf Stream has been substantially developed since the passage of the original zoning ordinance; and WHEREAS, the Town Commission wishes to insure to the extent that it can, that the property presently owned by the Gulf Stream Golf Club, Inc. will remain substantially open and wil] not be developed as residences which would result in greatly increased density of population; and WHEREAS, the adoption of this ordinance will protect the health, welfare and safety of the Town; and WHEREAS, the Gulf Stream Golf Club has requested that certain of its properties be changed from Residential District A to Outdoor Recreational District and to amend the zoning map to reflect such change; and WHEREAS, the above proposal was submitted to the Town Commission sitting as a Zoning Commission; and WHEREAS, at least twenty -one (21) days notice of a public hearing was properly given; and WHEREAS, written notice to owners of property within five hundred (500) feet of the proposed change have been properly given; and WHEREAS, all of the other requirements of Section XII entitled "Changes and Amendments" of the zoning ordinance of the Town of Gulf Stream, Florida, have been complied with; and 111115 WN N N RANOOLM OVEY WILDING VM CEACH. rLA. 31402 RESOLUTION 75-16 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM PALM BEACH COUNTY, FLORIDA AUTHORIZING A PRO RATA SHARE OF GENERAL FUND EXPENSES TO BE BORNE BY THE WATER FUND FOR SAID FISCAL YEAR TERMINATING ON SEPTEMBER 30, 1975. BE IT RESOLVED that, in lieu of there being any Water Department personnel, the administration, functioning within the General Fund, performs all necessary services relating to: (a) Determining Water consumption of individual properties by Reading Meters; (b) Billing of Water Charges; (c) Collection of said Charges; and (d) Maintaining proper accounting of all funds accumulating to said Water Fund.
