PROFESSIONAL EXPERT ENGINEERING/PLANNING SERVICES
CONTRACT WITH NAJARIAN ASSOCIATES
WHEREAS, pursuant to Ordinance #04-31, the borough of Carteret authorized the
acquisition and/or condemnation of real property comprising the Carteret Landfill
Reclamation Improvement District; and
WHEREAS, pursuant to said Ordinance, the Borough's special redevelopment counsel,
namely the finn of Windels Marx Lane & Mittendorf, LLP, or any attorney associated
with such firnl, and/or the Borough Attorney were hereby authorized and directed to
perfonn or cany out or cause to be perfonned or canied out, any studies, surveys, tests,
soundings, borings, appraisals, title searches and title report reviews as reasonably
necessary to detennine the value of any of the properties, the location and quality of any
of the properties and any environmental matters appropriate to acquire the
aforementioned real properties; and
WHEREAS, pursuant to said provision, special redevelopment counsel has advised the
Borough Attorney that there exists a need for redevelopment couLsel to retain expert
Engineering/Planning Services to assist with the detennination of value of certain parcels
identified on Exhibit A to Ordinance #04-31, namely: the real pr:Jperty identified as
owned by CDI Industries, Inc. and the Urmamed Street, Driftway and Rail Road
Crossing; and
WHEREAS, pursuant to N.J.S.A. 40A;11-5 (l)(a) Professional Services are exempt
from the requirements of Competitive Bidding; and
'WHEREAS, funds are available for such expert services.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough
of Carteret as follows:
I. That the finn of Win de Is Marx Lane & Mittendorf, LLP, sp"cial redevelopment
counsel be and is hereby authorized to retain the finn of Najarian Associates,
One Industrial Way West, Eatontown, NJ 07724, t:J perfornl expert
Engineering/Planning Services at a total cost not to exceed $5,000.00.
2. That a copy of this ordinancc be forwarded to the Borough Attorney, Windels
Marx Lane & Mittendorf, LLP and the Borough's Purchasing Department.
