HomeMy Public PortalAboutOrd. 709 - Deadline for Removal of Non-conforming SignsORDINANCE NO. 709 AN ORDINANCE OF THE CITY OF McCALL, IDAHO, RELATING TO THE DEADLINE FOR THE REMOVAL OF NONCONFORMING SIGNS; DECLARING AN EMERGENCY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO, AS FOLLOWS: Section 1. The Council finds that both the City Planning and Zoning Commission and the Area of City Impact Joint Planning and Zoning Commission have requested Council to establish a moratorium on the enforcement of the deadline set out in Title 3, Chapter 14, McCall City Code for the removal of signs not conforming to such ordinance, by reason of the fact that an amendment to such deadline is pending before such Commissions and would affect the deadline and its administration. Section 2. McCall City Code, Title 3, Chapter 24, is amended to read as follows 3-24-050. NON -CONFORMING SIGNS. (A) Signs existing on March 24, 1994 and not conforming may be continued for a period of thrcc y ars from the date of their construction or 18 months from March 24, 1994, whichever is longer until July 1. 1997, if properly repaired and maintained as provided in this Code and are in conformance with other ordinances of the City. At the end of this period they shall be removed. Both the owner and the occupant of the property are responsible for removal. Section 3. March 24, 1997 being the final deadline presently set out with respect to any and all signs, administration of the deadline under the present ordinance being potentially inconsistent with pending legislation, and enforcement of a deadline being inequitable under circumstances where such deadline may well be relaxed, an emergency is declared under IC 67-6523, and the City Attorney is requested not to commence enforcement of 3-24-050 (A) as printed in the City Code prior to July 1, 1997. Section 5. This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law, and shall be effective for 120 days.
