The Meeting was called to order at 9 A.M. by Mayor Koch.
Upon motion by Mr. Walker and seconded by Mrs. LaPorte the Commission
approved the Minutes of the Commission Meeting April 9, 1976.
Financial Report for Month of April was submitted and accepted by the
Commission.
The following summarization of the Police Report for the month of April,
1976 was submitted to the Commission.
Proposed Ordinance 76 -2 was read to the Commission;
AN ORDINANCE GRANTING TO FLORIDA POWER AND LIGHT
COMPANY ITS SUCCESSORS AND ASSIGNS AN ELECTRIC
FRANCHISE, AND IMPOSING PROVISIONS AND CONDITIONS
RELATING THERETO.
Upon motion by Mr. Walker and seconded by Mr. Bettison Ordinance 76 -2 was
unanimously approved by the Commission for being place on FIRST reading.
Mr. Joe Collier, District Manager of Florida Power and Light was present
to comment and answer questions concerning the recent power failure in the
Town of Gulf Stream. Mr. Collier assured the Commissioners that the power
servicing Gulf Stream was adequate and displayed a chart pointing out various
areas of electrical supply to the Town. Mr. Collier emphasized to the
r Commissioners that the power failure that occurred March 27th was extremely
l unusual and in all likelihood would never happen again.

COMMISSION MEETING May 7. 1976 Cont.
A request from Mr. C. A. Dennis for a variance of two feet on the west
setback line of Lot #79, Place Au Soleil was presented to the Commission
for their consideration. After a general discussion and Mr. Larry M. Ball,
Chairman of the Planning and Zoning Board giving his approval, Mr. Walker
made a motion that this request be granted. Mrs. LaPorte seconded the
motion, motion was unanimously passed.
A request was made to the Town Commission by Mr. Harold Johnson, 1140 N.
Ocean Blvd, that the Commission consider his offer to donate to the Town
of Gulf Stream a parcel of land (description of land is a part of these
minutes) for a wild life sanctuary. After a general discussion of this
offer it was decided that a possibility of re- zoning this parcel of land
so that it would not be opened to the public would be agreeable between the
two parties. Mayor Koch thanked Mr. Johnson for his generous offer and in-
formed him that they would certainly look into this further and report to the
Commission at the next regular Commission Meeting.
Mayor Koch informed the Commission that after many discussions between the
City of Delray Beach and the Town of Gulf Stream he felt the water contract
is now acceptable to both parties and would be presented to the City of
Delray Beach Council Monday night for their approval,
A report on the present Lethal Yellowing Program in Gulf Stream was presented
to the Commission. After a general discussion the Commission advised Attorney
John Randolph to draw up an Ordinance making it mandatory that all residents
in the Town of Gulf Stream inoculate their palm trees against this dreaded
disease, should a resident fail to comply with this ordinance the Town would
then hire someone to do this and bill the resident directly.
Charles Hair Superintendent of the Sanitation Department informed the Com-
mission that he had found another area for a dumpsite. This area is located
in approximately the same area as the present one, he also stated that it
would cost the Town the same amount of money as they are presently paying.
Mayor Koch stated that Mr. Hair should proceed with drawing up a contract
and also to get a copy of the title to the land.
Mayor Koch informed the Commission that the Palm Beach County Civil Defense
and County Commissioners plan a $75,000 study concerning the beach erosion
and would like the support of surrounding communities on this project. Mayor
Koch noted that they are not asking for money but would like a letter from
each community that they are concerned over this problem and support this
study. The Commission agreed that a letter should be sent in support of the
study.
Mr. Ball Chairman of the Planning and Zoning Department gave a report to the
Commission on his.recent attendance at the Areawide Waste Treatment Management
Planning Meeting held April 29th.

The grantors, for themselves, their heirs ant assigns,

The grantors herein named do further convey all right,
title, claim or intareat which either of them may have in and
to that certain water main, fire plugs, hydrants, valves and
other water installations which are now constructei within s-

accepting this right of way deed, the grantors agree that the;

tae boundaries of said right of way.
