The Meeting was called to order at 9 A.M. by Mayor Koch.
Upon Motion by Mr. Bettison and seconded by Mr. Stalker the Commission approved the
Minutes of the Regular Meeting November 12 and the Special Commission Meeting
November 17, 1976.
Mr. Walker made a motion that the Financial Report for the month of November be
accepted, Mrs. LaPorte seconded the motion, motion was unanimously accepted.
The following summarization of the Police Report for the month of November, 1976
was submitted to the Commission.

Second and final reading of Ordinance 76 -3 was read to the Commission, upon
motion by Mrs. LaPorte and seconded by Mr. Walker Ordinance 76 -3 was unanimously
approved by the Commission.
THIS ORDINANCE CREATES A UNIFORM MAXIMUM PENALTY WHICH MAY
BE IMPOSED FOR ANY MISDEMEANOR VIOLATION OF ALL TOWN ORDINANCES
EXCEPT WHERE EXPRESSLY PROHIBITED BY STATE LAW, AND IS ENACTED
PREPARATORY TO AND IN CONJUNCTION WITH THE CONSTITUTIONAL
ABOLISHMENT OF FLORIDA MUNICIPAL COURTS AND THE ASSUMPTION
OF JURISDICTION PREVIOUSLY REPOSED THEREIN BY THE COUNTY
COURT OF PALM BEACH COUNTY, EFFECTIVE ON JANUARY 3, 1977.

Mayor Koch informed the Commission that after numerous meetings with the Gulf
Stream Golf Club Water Committee he felt that they would accept the Commission
offer of an annual lease of $6,250.00 after he informed the members of the Com-
mittee that the Town Commission had rejected their offer for water facilities
on a cost of living basis. He is presently waiting to hear from them and will
report to the Commission on this matter at a later date. The Commission thanked
Mayor Koch for his diligence in securing the best deal for the Town. Mr. Whittemore
however then requested that approval of the minutes of the regular November 12, 1976
Meeting be withdrawn until these minutes are re- submitted for approval by the Com-
mission at the next regular meeting. He requested that the minutes of said meeting
be rewritten to reflect the factual account that the Commission not only rejected
the Gulf Stream Golf Club's offer to lease the water facilities on a cost of living
basis but they had requested Mayor Koch to offer $5,000.00 annually, since the Town
would be leasing less land then originally needed.
Mr. Walker made a motion that the Commission authorize the execution of the
License Agreement with the Florida East Coast Railway Company for water main
crossing of the FEC Railway, and the approval of $52.00 that must be submitted
with this authorization. Mrs. LaPorte seconded the motion, motion was unanimously
granted.
Mr. Whittemore made a motion that the Commission approve a request from Mr. R. C.
Reed to run a water pipe from the Gulf Stream Golf Club water main to an existing
sprinkler system at the entrance of Place Au Soleil at Mr. Reed's expense. Mr.
Bettison seconded the motion, motion unanimously passed.
Attorney Norman Otto representing Mr. Harold F. Johnson was present to discuss and
answer questions concerning the proposed deeds for a parcel of land Mr. Johnson
would like to convey to the Town of Gulf Stream for a bird and wild life sanctury.
After careful consideration of this offer Mrs. LaPorte made a motion that the
Commission accept this generous offer and that paragraph 3 on the quit claim deed
be changed from exclusive to restrictive use of the property. Mr. Walker seconded
the motion, motion was unanimously passed.
Mr. Franklin O'Brien and Mr. Robert Stafford reported on the Lethal Yellowing
Program. Deputy Town Clerk Gwynn was requested to notify residents in the next
water billing the importance of underplanting with malayan palms.
Mr. Whittemore made a motion that the Town employees be given a $100.00 Christmas
bonus, Mr. Walker seconded the motion, motion unanimously approved.
Mr. Bettison gave an up to date report on the Beach Erosion Meeting he attended
December 8, 1976.
A letter from County Court Judge, Daniel T. K. Hurley was read to the Commission
and is a part of these minutes.

Dear Members of the Gulfstream Town Commission:
At the outset let me apologize for this indirect and impersonal
method of communication. Time, however, is short and I felt it was
important to contact you as soon as possible.
I have been assigned by the Chief Judge to serve as the resident
judge at the County Courthouse in Delray Beach and at the branch court in
Boca Raton. This is an assignment which I welcome and I look forward to
the challenge of developing a full service court in the southern part of
the county.
As we begin the final phase of implementing Article V and replacing
Cour Municipal Courts with the County Court system, I believe it is more
important than ever that both branches of government -- the municipal legis-
lative bodies and the local courts -- remain open to each other, consult
with each other, and solicit each other's advice. In this regard, I want
you to know that if you think it would be beneficial, I would be happy to
attend a future workshop or meeting of the Council to answer any questions
that you might have and to discuss the proposed schedule and range of
judicial services that will be available to the citizens of the south
county area.
I would also like to inform you that I am in the process of estab-
lishing a citizen - lawyer advisory committee to study the operations of the
County Court during the next six months and to report on how the Court's
services and functions might be improved. I am hopeful that some of our
present Municipal Judges together with members from the South County Bar
Association and other citizens from the area will be willing to participate
in this project.

POLICE REPORT FOR NOVEMBER 1976
The Gulf Stream Police Department made 13 arrests.
Judge Martin held court for 12 arrests on November 21st 1976.
Fines to the amount of $581.00 was levied.
The Police Department also handled 1 traffic accident and 1 first aid.

ORDINANCE 76 -3
THIS ORDINANCE CREATES A UNIFORM MAXIMUM PENALTY WHICH
MAY BE IMPOSED FOR ANY MISDEMEANOR VIOLATION OF ALL
TOWN ORDINANCES, EXCEPT WHERE EXPRESSLY PROHIBITED
BY STATE LAW, AND IS ENACTED PREPARATORY TO AND IN
CONJUNCTION WITH THE CONSTITUTIONAL ABOLISHMENT OF
FLORIDA MUNICIPAL COURTS AND THE ASSUMPTION OF JURIS-
DICTION PREVIOUSLY REPOSED THEREIN BY THE COUNTY COURT
OF PALM BEACH COUNTY, EFFECTIVE ON JANUARY 3, 1977.
BE IT ENACTED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA,
that:
A fine of not more than five hundred dollars ($500.00) or a term of im-
prisonment not in excess of six (6) gonths, or both such fine and imprisonment,
shall constitute the maximum penalty which may be imposed upon any person who
shall be adjudged to have violated any ordinance of this Town; provided, how-
ever, that this ordinance shall not conflict with any provision for penalties
imposed for any offense under the laws of the State of Florida, and this
ordinance shall supersede any other penalty provision contained in the code
and ordinances of this Town.
THIS ORDINANCE SHALL BECOME EFFECTIVE ON JANUARY 3, 1977.
