WHITTEMORE COMMISSIONER LINDLEY S. BETTISON COMMISSIONER Also attending: Attorney John Randolph, Manager William E. Gwynn, Deputy Town Clerk, Barbara Gwynn, Police Chief William McQuade and Larry M. Ball, Chairman of the Planning and Zoning Board. The Meeting was called to order by Mayor Koch at 9 A.M. Upon motion by Mrs. LaPorte and seconded by Mr. Walker the Commission approved the Minutes of the Regular Meeting March 11, 1977 and Special Meetings March 18 and March 30, 1977. Financial report for the Month of March was submitted to the Commission, also the semi- annual report was reviewed. After a general discussion they were both approved. Cromwell 1035 21 168 10 0 TOTAL 11.917 192 1580 127 10 Mayor Koch reported on his recent meeting before the Environmental Control Board April 7, 1977, he stated the Board was satisfied with progress made toward the Town's implementation of their water system improvement project. Mr. Whittemore informed the Commission that he had been in contact with Mr. Jim Briggs, Manager of the Gulf Stream Golf Club with the assurance from Mr. Briggs that the necessary repairs to the water tower would be made as soon as possible. -2- COMMISSION MEETING APRIL 8, 1977 Cont. Mr. Bettison gave a brief report on the April 6, 1977 Cooperative Dispatch Center Opening Bid Meeting. Mr. Bettison stated that bid evaluation would be done by an expert with another meeting of participating municipalities to take place at a later date. Second Reading of Ordinance 77 -2 was read to the Commission. Upon motion by Mr. Walker seconded by Mrs. LaPorte the Commission unanimously approved Ordinance 77 -2 ORDINANCE 77 -2 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING THE OFFICIAL CHARTER OF THE TOWN OF GULF STREAM AT ARTICLE VII SO AS TO ELIMINATE CERTAIN RESTRICTIONS THEREIN RELATING TO THE ISSUANCE OF BONDS AND TO BRING SAID LANGUAGE INTO CONFORMITY WITH STATE STATUTES. A report was given by Mr. Larry M. Ball concerning the Waste Water Disposal Project. This detailed report was accepted by the Commission and their ( grateful thanks was extended to Mr. Ball. At 4:30 P.M. bids for the Construction of the Water System Improvement Project were opened. Upon motion by Mr. Bettison and seconded by Mr. Whittemore bids were turned over to Russell and Axon for their review and recommendations to be heard at the next regular Commission Meeting May 13, 1977. ORDINANCE NO. 77_2 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING THE OFFICIAL CHARTER OF THE TOWN OF GULF STREAM AT ARTICLE VII SO AS TO ELIMINATE CERTAIN RESTRICTIONS THEREIN RELATING TO THE ISSUANCE OF BONDS AND TO BRING SAID LANGUAGE INTO CONFORMITY WITH STATE STATUTES. BE IT HEREBY ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA: Section 1. Article VII, Section 1 of the Official Charter of the Town of Gulf Stream is amended to read as follows: "Section 1. Whenever it shall be deemed advisable to issue bonds of the Town of Gulf Stream for any purpose or purposes hereinafter named, viz: for raising money to be used in pur- chasing, constructing, extending or improving waterworks, or electric light plants, or for constructing, purchasing or improving gas works or other illuminating works, or for the purpose of constructing or extending or improving a system of sewers or otherwise promoting the health of the Town; for the purpose of opening, widening or paving the streets and sidewalks of the Town, and for opening, constructing, and maintaining parks, promenades or play grounds; for the purpose of establishing and maintaining a fire department in said Town; for the purpose of erecting public wharves or buildings for the use of said Town, and for the purpose of erecting jetties, groins and seawalls within said Town; and for any one or more of said purposes and for any other purpose deemed necessary for the public good, provided that the same is not in conflict with the Constitution or laws of the State of Florida, the Commission in its corporate capacity is hereby authorized to issue bonds of said Town, under the seal of the Municipality, in the manner set forth under Florida Law." eliminated. Section 4. Section 4 of Article VII is hereby amended read as dollows: "Section 3. The Commissioners shall prescribe the form and denomination of said bonds. The Treasurer shall not sign any such bonds until he or she has given a bond, payable to the Town, properly conditioned, with sufficient surety to be approved by (the Commission, and in such an amount as shall be fixed by the Town Commission, that he or she will faithfully perform the duties of Treasurer with respect thereto. No member of said Commission or officer, agent or employ( of the Town shall be directly or indirectly interested in any (contract under the charge of the Commission." Section 5. Section 5 of Article VII is hereby amended ti read as follows: "Section 4. The Treasurer shall keep a separate account Of such bond issue, showing the number and amounts of bonds issued, the receipts therefrom and the disbrusements of the proceeds thereof." Section 6. Section 6 of Article VII is hereby amended to read as follows: "Section 5. All advertisements and notices regarding tlf issuance and sale of said bonds shall be as provided by law.,, Section 7. Severability. If any section, sub - section, sentence, clause, phrase )r portion of this ordinance is for any reason held invalid or inconstitutional by any court of competent jurisdiction such portion ;hall be deemed a separate, distinct, and independent provision and uch holding shall not effect the validity of the remaining portions ereof. Section 8. Ordinances Repealed. All Ordinances or parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed.
