AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING AN AMENDED
FINAL PUD PLAN FOR PROPERTY LOCATED AT 2304 LORENZO GREENE DRIVE;
DESCRIBED AS PART OF THE SOUTHEAST QUARTER OF SECTION 24 AND PART OF THE
NORTHEAST QUARTER OF SECTION 25, TOWNSHIP 44 NORTH, RANGE 12 WEST,
JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, James and Jacquelyn Price, owners of the real estate hereinafter described,
having submitted to the City Council an Amended Final PUD Plan of said real
estate, being part of the Southeast Quarter of the Southeast Quarter of Section
24, and part of the north half of the northeast quarter of Section 25, all in
Township 44 North, Range 12 West, Cole County, Missouri, more particularly
described as follows: Beginning at the Northwest Corner of the Northeast Quarter
of the Northeast Quarter of said Section 25; thence west with the line between
Sections 24 and 25, 206.95 feet, to the center of a small branch; thence
southeasterly with the center of said small branch, 245.8 feet; thence North 74
Degrees 59 Minutes East, 666.48 feet, to the westerly line of a public road;
thence North 18 Degrees 30 Minutes West, along said westerly line, 118.40 feet;
thence North 14 Degrees 45 Minutes West, along the westerly line of said road,
50.16 feet; thence in a southwesterly direction 504.9 feet, to the point of
beginning. Except that part conveyed to State of Missouri, for supplementary
State Highway Route B, by deed of record in Book 239, Page 341, Cole County
Recorder's Office. Except that part conveyed to John Erckmann and Wife, by
deed of record in Book 244, Page 701, Cole County Recorder's Office.
Containing 1.15 acres.
WHEREAS, it appears that the procedures set forth in the zoning code relating to PUD have
in all matters been complied with, as said property owner submitted to the
Planning and Zoning Commission and City Council an Amended Final PUD Plan
for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Amended Final PUD Plan submitted by James and Jacquelyn Price, on
file as Case No. P12007 in the Jefferson City Planning Division, is hereby approved for the land
referenced above with the following conditions:
A. Permitted uses of the property shall be limited to permitted uses of the C-1
Neighborhood Commercial zoning district, plus greenhouse, plant nursery, outdoor
storage and sales of landscaping material.
B. Signage and outdoor lighting shall be governed by standards set out for properties
zoned C-1.
SECTION 2. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its

planning and zoning matter on Monday, July 16, 2012 at 6:00 p.m. in the Council Chamber of the

Case No. P12007 — 2304 Lorenzo Greene Drive; Amended Final PUD Plan. Application filed
by James and Jacquelyn Price, property owners, for an amendment to the Final PUD Plan to
modify the permitted uses for the property to allow for uses including greenhouse, plant nursery,
outdoor storage and sales of landscaping material, and all permitted uses of the C-1
Neighborhood Commercial zoning district. The property is located on the western side of
Lorenzo Greene Drive one-quarter mile north of State Route B. The property is described as Part
of the Southeast Quarter of Section 24 and Part of the Northeast Quarter of Section 25, Township
44 North, Range 12 West, Jefferson City, Missouri.
Mr. Barron described the proposal and explained that the applicant is requesting approval of an
amended Final PUD Plan in order to expand the list of permitted uses allowed for the property.
He stated that the permitted uses, as approved in the previous PUD Plan for the property, are
currently limited to Florist, greenhouse, plant nursery, outdoor storage and sales of landscaping
material. Mr. Barron explained that the proposed PUD amendment would expand the list of
permitted uses to include all of the permitted uses of the C-1 Neighborhood Commercial zoning
district. He stated that the purpose of the request is to accommodate a plan to split the existing
building into two separate businesses, retaining the existing lawn and garden center in one half of
the building and locating a new hair salon business in the other half of the building. Mr. Barron
explained that no modifications to the development layout are being proposed.
Ms. Heather Tanner, 1179 Choctaw Ridge, Holts Summit, Missouri, spoke regarding this request
and explained that a hair salon will be located in one half of the building. She stated that the only
structural changes will be to the interior of the building such as putting up walls, lighting, electrical
and plumbing.
No one spoke in opposition to this request and no correspondence was received.

Mr. George moved and Mr. Deeken seconded to recommend approval of the Final PUD Plan
Amendment to the City Council, subject to the following conditions:

This property is currently being used as a landscaping and garden center with
outdoor storage. This use was approved as a Planned Unit Development in 2002.
This Amended PUD plan proposes to establish additional permitted uses for the
property. In addition to the currently permitted uses of '.fkWtSt, greenhouse,
plant nursery, outdoor storage and sales of landscaping material", I propose to
add all permitted uses of the C-1 Neighborhood Commercial Zoning District. The
purpose of the request is to allow the existing building to be split into multiple
suites, with the landscaping/garden center business occupying the northern
section of the building and outdoor storage areas and a salon occupying the
southern portion of the building.
Signage and outdoor lighting on the property is proposed to adhere to
requirements for properties zoned C-1.

Nature of Request

Staff Analysis
Parking: The parking requirement for light volume retail uses is t space per 400 sf. The parking requirement
for stand-alone service businesses is 1 space per 300 sf. The existing parking lot(consisting of 9 spaces) is
sufficient to accommodate the proposed hair salon use.
Permitted Uses: The proposed permitted uses for the property would be less intensive than other commercial
uses found along Lorenzo Greene Drive.
Building Design: No exterior building modifications are proposed.
Signs: Signage is proposed to conform with the current sign code for properties zoned C-1.
Staff Recommendation
Staff recommend approval of the proposed amendment to the Final PUD Plan. The proposed modifications to
the list of permitted uses would allow for a wider variety of commercial and service oriented businesses with
little impact on surrounding properties.
