AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, RELATING
TO THE SEGREGATION OF ASSESSMENTS FOR LOCAL IMPROVEMENT DISTRICT
NO. 3; MAKING FINDINGS; SETTING FORTH THE ORIGINAL ASSESSMENT ROLL
AND THE DESCRIPTIONS OF ASSESSMENT PARCELS FOR LOCAL IMPROVEMENT
DISTRICT NO. 3, AND THE AMENDMENTS THERETO AS SET FORTH IN
ORDINANCE NO. 663, ADOPTED ON JUNE 30, 1994, AND ORDINANCE NO. 696,
ADOPTED ON JUNE 28, 1996; EXCLUDING FROM THE ASSESSMENT ROLL
CERTAIN PROPERTY CONVEYED TO THE CITY FOR PUBLIC PURPOSES; REVISING -
THE LEGAL DESCRIPTIONS FOR ASSESSMENT PARCELS A, D, E, G, I, J, K,
L, AND M, AND SEGREGATING ASSESSMENTS TO THE REVISED ASSESSMENT
PARCELS; DESCRIBING AND ESTABLISHING ASSESSMENTS FOR SPRING
MOUNTAIN RANCH SUBDIVISION NO. 3; RATIFYING PREVIOUS ACTIONS;
DIRECTING THE CITY CLERK TO MAKE THE SEGREGATION OF ASSESSMENTS ON
THE ASSESSMENT ROLL; DIRECTING THAT A CERTIFIED COPY OF THIS
ORDINANCE BE FILED WITH THE RECORDER OF VALLEY COUNTY, IDAHO; AND
PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE
WHEREAS, by adoption of Ordinance No. 630 on May 13, 1993, as
amended by Ordinance No. 642, adopted on July 28, 1993, the Mayor
and Council of the City of McCall, Valley County, Idaho (the
"City"), duly created Local Improvement District No. 3 ("L.I.D.
No. 3") of the City; and
WHEREAS, by adoption of Ordinance No. 636 on July 3, 1993, as
amended by Ordinance No. 643, adopted on July 28, 1993, the Mayor
and Council, pursuant to notice and hearing as required by law,
duly confirmed an assessment roll and thereafter issued and sold
special assessment bonds for L.I.D. No. 3; and
WHEREAS, Section 50-1721A, Idaho Code, provides that whenever
any land against which there has been levied any special assessment
by any municipality shall have been sold in part or subdivided, the
council of the municipality shall have the power to order a
segregation of the assessment; and
WHEREAS, by adoption of Ordinance No. 663 on June 30, 1994,
the City amended the assessment roll for L.I.D. No. 3 by
segregating a portion of the assessments for Assessment Parcel A,
and by adoption of Ordinance No. 696 on June 28, 1996, the City
further amended the assessment roll for L.I.D. No. 3 by revising
the legal descriptions of the property included in Assessment
Parcels A and E, by describing and providing assessments for Spring
Mountain Ranch Subdivision No. 2, and by revising the amounts of
assessments for Assessment Parcels A through M, inclusive; and

WHEREAS, the owner of a portion of the property included on
the assessment roll for L.I.D. No. 3 has further subdivided
portions of the property included upon the assessment roll for
Assessment Parcels A, D, E, G, I, J, K, L, and M by conveying
certain property to the City for public use and by platting Spring
Mountain Ranch Subdivision No. 3 from portions of the Assessment
Parcels, and has applied to the City Council to further segregate
the assessments therefor to the subdivided property, to remove the
assessments from certain property to be dedicated to the public for
golf course and street right-of-way, and to reallocate such
assessments, all as provided by Section 50-1721A, Idaho Code; and
WHEREAS, the City Council of the City has determined that it
is in the best interests of the City to grant such application and
to segregate the assessments in accordance with the application and
in accordance with Section 50-1721A, Idaho Code, and
WHEREAS, the City Council has further determined that the
interests of the bondholders of the special assessment bonds, and
the security of the lien for the assessments, for L.I.D. No. 3 will
not be adversely affected thereby.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF McCALL, Valley County, Idaho, as follows:
Section 1: The Council hereby finds and determines:
A. Local Improvement District No. 3 ("L.I.D. No. 3") was
duly created by Ordinance No. 630, adopted on May 13, 1993, as
amended by Ordinance No. 642, adopted on July 28, 1993.
B. The assessment roll (the "Assessment Roll") for L.I.D.
No. 3 was duly confirmed by Ordinance No. 636, adopted on July 8,
1993, as amended by Ordinance No. 643, adopted on July 28, 1993,
Ordinance No. 663, adopted on June 30, 1994, and Ordinance No. 696,
adopted on June 28, 1996.
C. Portions of the property included in the Assessment Roll
as Assessment Parcels A, D, E, G, I, J, K, L, and M have been
subdivided, and the owner thereof has applied to the City, pursuant
to Section 50-1721A, Idaho Code, for a segregation of the
assessments for a portion of the property included within
Assessment Parcels A, D, E, G, I, J, K, L, and M to the subdivided
property.
D. It is in the best interests of the City and of the
property subject to assessment within L.I.D. No. 3 that the
application for segregation of assessments be granted.
E. The rights and interests of the owners and holders of the
special assessment bonds issued, and the security of the lien for

the assessments, for L.I.D. No. 3 will not be adversely affected by
the further segregation of said assessments.
Section 2: A copy of theoriginal confirmed Assessment Roll
for L.I.D. No. 3, including the legal descriptions of all
properties included within and subject to assessment for L.I.D.
No. 3, as confirmed by Ordinance No. 636, adopted on July 8, 1993,
is annexed hereto as Exhibit "A" and by reference made a part of
this ordinance.
Section 3: The Assessment Roll for L.I.D. No. 3 was
subsequently amended, pursuant to Section 50-1721A, Idaho Code, by
adoption of Ordinance No. 663, adopted on June 30, 1994, as
follows:
A. The legal description of Assessment Parcel A was revised
to exclude therefrom certain property conveyed to the
City as a water treatment plant site, which property is
particularly described in Exhibit "B" which is annexed
hereto and by reference made a part hereof.
B. The entire assessment for Assessment Parcel A, in the
revised amount as shown below, was segregated to the
revised Assessment Parcel A.
C. The assessments for Assessment Parcels A through M,
inclusive, were revised as follows:

D. The assessments for Spring Mountain Ranch Subdivision
No. 1 (referred to as "Phase I" on the original
Assessment Roll) remained at $1,760,000.

Section 4: The Assessment Roll for L.I.D. No. 3 was further
amended, pursuant to Section 50-1721A, Idaho Code, by adoption of
Ordinance No. 696 on June 28, 1996, as follows:
A. The legal descriptions for Assessment Parcels A and E
were revised to exclude therefrom the property included
in the plat of Spring Mountain Ranch Subdivision No. 2.
The legal description for Assessment Parcel A, as revised
by Ordinance No. 696, is set forth in Exhibit "C" which
is annexed hereto and by reference incorporated herein.
The legal description for Assessment Parcel "E," as
revised by Ordinance No. 696, is set forth in Exhibit "D"
which is annexed hereto and by reference made a part
hereof.
B. The Assessment Roll was revised to include assessments
for Spring Mountain Ranch Subdivision No. 2 in the total
amount of $225,000, as more particularly set forth in
Exhibit "E" which is annexed hereto and by reference
incorporated herein.
C. The assessment for Assessment Parcel A was revised from
$463,000 to $264,100. The assessment for Assessment
Parcel E was revised from $306,560 to $280,560.
D. All other legal descriptions and assessments on the
Assessment Roll remained as set forth in the confirmed
Assessment Roll, as amended by Ordinance No. 663.
Section 5: The Assessment Roll for L.I.D. No. 3 is hereby
further amended as follows:
A. All assessments on the property included in the Nine Hole
Addition to the City of McCall Municipal Golf Course
which is particularly described on Exhibit "F" which is
annexed hereto and by reference incorporated herein, are
hereby removed, in accordance with the Amended and
Restated Golf Course Agreement between Spring Mountain
Ranch Limited Partnership and the City of McCall dated
September 23, 1993.
B. All assessments on the property included in the public
street right-of-way particularly described in Exhibit "G"
which is annexed hereto and by reference incorporated
herein are hereby removed.
C. The legal descriptions of the boundaries of Assessment
Parcels A, D, E, G, I, J, K, L, and M are hereby revised
to include the property set forth in Exhibit "H" which is
annexed hereto and by reference incorporated herein. The
assessments for the revised Assessment Parcels A, D, E,
G, I, J, K, L, and M are hereby established as follows:

D. The Assessment Roll shall include all of Spring Mountain
Ranch Subdivision No. 3 to the City of McCall, Valley
County, Idaho, according to the recorded plat thereof,
the assessments for which, in the aggregate amount of
$287,500, are more particularly set forth in Exhibit "I"
which is annexed hereto and by reference incorporated
herein.
Section 6: The boundaries of Assessment Parcels B, D, F, and
H, Spring Mountain Ranch Subdivision No. 1, and Spring Mountain
Ranch Subdivision No. 2, and the assessments upon such properties,
shall be and remain as set forth in the Assessment Roll for L.I.D.
No. 3 as confirmed by Ordinance No. 636, adopted on July 8, 1993,
as amended by Ordinance No. 663, adopted on June 30, 1994, and as
further amended by Ordinance No. 696, adopted on June 28, 1996.
Section 7: A restatement of the Assessment Roll for L.I.D.
No. 3, reflecting all amendments and segregations of assessments
effectuated by Ordinance No. 663, Ordinance No. 696, and this
Ordinance No. 716, is set forth in Exhibit "J" which is annexed
hereto and by reference incorporated herein.
Section 8: All actions heretofore taken by the City with
respect to the confirmation of and amendment to the Assessment Roll
for L.I.D. No. 3, including, without limitation, the adoption of
Ordinance No. 636 on July 8, 1993, Ordinance No. 643, adopted on
July 28, 1993, Ordinance No. 663, adopted on June 30, 1994, and
Ordinance No. 696, adopted on June 28, 1996, are hereby ratified
and confirmed in all respects.
Section 9: The City Clerk is hereby directed to make the
segregation on the original Assessment Roll, as amended by
Ordinances Nos. 663 and 696, and as provided in this ordinance.
Section 10: A certified copy of this ordinance shall be filed
with the Valley County Recorder in accordance with Section 50-
1721A, Idaho Code.

Section 11: This ordinance shall be published once in the
official newspaper of the City and shall take effect and be in
force from and after its passage, approval, and publication.

proceedings of the Council of the City of McCall, Idaho, and that I am the statutory custodian of all laws, ordinances
and resolutions of said City.
2. That the attached Ordinance No. 716 is a true and correct copy of an ordinance passed at a regular
meeting of the Council of the City of McCall held on October 9, 1997, and duly recorded in my office; and
3. That said regular meeting was duly convened and held in all respects in accordance with law and to
the extent required by law, due and proper notice of such meeting having been given; that a legal quorum was
