Home My Public Portal AboutOrd. 05-05 No. 05-5 (IDrhiuaure nf t4e lßnrnug4 nf QIaderd, ~ 4' W 4' ORDINANCE PROHIBITING THE INSTALLATION OF RETRACTABLE MET AL SECURITY SCREENS OR WALLS ON THE EXTERIOR OF COMMERCIAL BUILDINGS WHEREAS, the Mayor and Council have determined that the use of retractable, roll-up metal security screens or walls on the exterior facades of commercial buildings creates an unsightly condition; and WHEREAS, this condition has become prevalent in the Borough's commercial zones and has significantly degraded the aesthetics of these zones. BE IT ORDAINED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey as follows: Section 1. A. The installation, replacement, and or functional repair ofretractable, roll-up metal security screens, walls, or similar devices on the exterior commercial buildings in the Borough's Commercial Zoning Districts is hereby prohibited. B. All existing and currently functioning retractable, roll-up metal security screens, walls, or similar devices may remain in place provided that the housing for same, while in its retracted position, is covered by an appropriate awning or similar aesthetic covering within sixty (60) days of the effective date of this Ordinance. C. Notwithstanding the forgoiFlg, the installation of retractable, roll-up metal security screens, walls, or similar devices on the interior of windows and doors to commercial buildings shall not be prohibited hereby. Section 3. All Ordinances and/or provisions thereof inconsistent with the provision of this Ordinance shall be and are hereby repealed as to the extent of any such inconsistencies. If any section, subsection, part, clause or phrase of this Ordinance shall be declared invalid by judgment of any Court of competent jurisdiction, the section, subsection, part, clause or phrase shall be deemed to be sever able from the remainder of this Ordinance.
