HomeMy Public PortalAboutResolution 88-28161 1 RESOLUTION NO. 88 -2816 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING CONDITIONAL USE PERMIT 88 -938, A REQUEST BY PEI LIANG LIU /MORAN PROPERTIES TO ALLOW THE OPERATION OF AN AUTOMOBILE REPAIR GARAGE AT 9237 LOWER AZUSA ROAD. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon a public hearing to consider an appeal of the Planning Commission's denial of Conditional Use Permit 88 -938, a request by Pei Liang Liu /Moran Properties to permit an Automobile Repair Business in Units C & D at 9237 Lower Azusa Road, the City Council finds: 1. That the site for the proposed use is adequate for the size, shape, topography and circumstances in that the subject lot is generally level, provides two access driveways and contains 62,988 square feet of lot area; and 2. That the site has sufficient access to streets and highways adequate with the pavement type to carry the quantity and quality of traffic generated by the pro- posed use in that the site is served by two streets: Lower Azusa Road, an east /west corridor and Encinita Avenue, a north /south street; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment, or valuation of adjacent pro- perty or upon the public welfare, in that the property is buffered from residential neighborhoods and is ade- quately separated from other land uses to prevent ad- verse impacts. Additionally, the subject property is zoned M -2 which permits several more intense industrial uses than the proposed auto repair business and the Conditions of Approval will mitigate impacts. SECTION 2. Accordingly, Conditional Use Permit 88 -938 is approved subject to the following conditions: 1. That the operation be consistent with the submitted site plan. 2. That the uniform sign program be enforced by the pro- perty owner and that the property owner shall be respon- sible for maintaining signs and assuring full compliance with the Temple City Sign Ordinance by all tenants on the subject site. 3. That the property owner and the auto repair business be responsible for assuring that "no parking" occurs in the designated fire lane. RESOLUTION NO. 88 -2816 PAGE 2 4. That all repair work, automobile storage (including overnight parking), job estimating and other activities of the auto repair business be conducted completely within the enclosed building. 5. That the hours of operation shall be limited to 7 a.m.to 7 p.m., Monday through Saturday. 6. That the property owner shall be responsible for con- trolling loitering and other conduct of individuals on the premises. 7. That the employees of `the auto repair business park their personal vehicles in the spaces along the north property line west of the building, between the building and Encinita Avenue. 8. That the Conditional Use Permit be granted subject to a review in six months; if adverse affects are identified said case shall be referred back to the City Council for additional review. 9. Within thirty (30) days of this approval the parking spaces shall be designated for each unit by the property owner and said property owner shall continuously super- vise all on -site parking. SECTION 3. This project is not anticipated to result in any significant adverse environmental impact and a Negative Declara- tion has been prepared in accordance with CEQA Guidelines. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
