DISCUSSION At your Regular meeting of March 12, 2003,the Controller's report for the 2003-2004 fiscal year budget stated that due to the current low interest rates, it appears desirable to re-finance the outstanding 1993 Certificates of Participation and a portion of the 1995 Notes during the second half of this fiscal year(see Report R-03-30). These debt issues first become eligible for re- financing in September 2003. At your Regular meeting of March 26, 2003 and as a part of the Budget approval process,the Administration and Budget Committee noted and supported the issuance of the Midpeninsula Regional Open Space District Financing Authority 2004 Revenue Bonds(see Report R-03-33). At a subsequent meeting of the Committee on July 9, 2003,the members endorsed the issuance of up to $35 million, which includes approximately$10 million for new land acquisitions. Accordingly, Government Code Section 6586.5 requires public hearings to be held in any county where the proceeds of such a bond issue are proposed to be spent for District purposes. Public testimony should be received on the significant public benefit to the District resulting therefrom, including demonstrable savings to the District. On October 21, 2003 it is proposed that you will conduct a hearing in San Mateo County. In accordance with the attached letter from Tom Lockard, Managing Director of Stone& Youngberg, the District's underwriter,the aggregate savings expected from the Midpeninsula Regional Open Space District Financing Authority's bond structure would total $170,000, which is deemed to be a significant savings as defined by law. The JPA was established in 1996 and at that time the District used this financing authority to issue the District's 1996 financing program. During 1998 a law was passed requiring joint powers authorities to conduct public hearings in the jurisdictions where bond proceeds will be expended. The public hearings are intended to set out the purpose for the financing and to establish the costs savings expected to be achieved from the JPA financing. We complied with this law when the District issued bonds in 1999. The 2004 financing program will refinance at lower interest rates COPS sold in 1993,a portion of promissory notes sold in 1995 and raise new funds for acquiring open space in Santa Clara and San Mateo Counties. By selling the financing program in one issue of JPA revenue bonds the District will realize savings in excess of$150,000 from the economy of issuing one bond issue rather than in two or even three—two for the refundings and then another bond issue for the new funds.Included in the $150,000 estimated savings are the costs of bond counsel, trustee, rating, printing, regulatory compliance and underwriter's counsel. Also, by combining issues, the District realizes some annual administrative savings from only paying one set of Trustee and continuing disclosure fees. I estimate the present value cost of these savings to be approximately $20,000. Therefore, the aggregate savings expected from the JPA bond structure totals$170,000. In my opinion, use of the JPA structure will provide significant public benefit to the District by generating the savings described above. Adopt the attached resolution authorizing the execution and delivery of a site lease, a project lease and a continuing disclosure agreement and approving a preliminary official statement and an agreement for bond counsel services and certain other matters in connection therewith. DISCUSSION The favorable bond and bond insurance market conditions make it advantageous to propose the issuance of approximately $34.2 million of revenue bonds. Tax-exempt interest rates are near forty year lows and bond insurance is available at reasonable costs and terms. The bonds will be insured by AMBAC. The proposal is to refund all of the $14.7 million outstanding of the 1993 Certificates of Participation, refund $6.3 million(about 58%)of the 1995 Promissory Notes, and borrow $10 million of new land acquisition funds. The remaining balance of the 1995 Promissory Notes, $4.6 million, is not refundable because it was the result of a prior refinancing. The issuance amount assumes that an 8% cash reserve fund will be required. If AMBAC agrees to substitute a surety bond for the cash reserve fund, then the issuance amount would be reduced by up to $3 million. If successful, this would further improve the cash flow benefits presented below. The debt issued by the District will be sold to, and the District will enter into a lease with, the Midpeninsula Regional Open Space District Financing Authority(the"Authority"), which you approved the creation of at your April 24, 1996 meeting. The District will pay rent under the Lease to the Authority, which will, in turn, issue its 2004 Revenue Bonds using the District's payments as security for payment of the Bonds. This is the same basic structure which successfully utilized for our 1996 and 1999 Revenue Bonds. By utilizing the Joint Powers Financing Authority, this proposed issue has been structured to reduce the District's near-term debt service while yielding $10 million of immediate new land acquisition funds. Despite receiving $10 million additional cash, the District's total debt service would by reduced each year for the next eleven years, by a projected total of$5.3 million. On a cumulative basis, the proposed transaction is net cash positive to the District into the middle of the year 2025 (22 years). This favorable result is made possible by the combination of low interest rates and the ability to extend maturity dates of existing debt. The average coupon rate and average life on the proposed bonds is 4.8% and 23 years, respectively, versus 6.1% and nine years, respectively, on the debt to be refunded. So,the interest rate is reduced by 1.3 percentage points while the average life is extended by 14 years. On an"apples to apples" basis, the present value savings on the refinancing portion of the proposed issue is $1.8 million. Including issuance expenses and bond insurance costs, the total interest cost of the proposed bonds is estimated at 5.26%. Because institutional bondholders generally have large amounts of bonds maturing in January, it g Y g g �'Y is anticipated that this will be good timing for favorable demand. The proposed issue is consistent with long-term financial plans and is easily accommodated within our statutory debt limit. After the proposed debt issue and refinancing, the District's bonded indebtedness would be about 28%of the District's statutory debt limit. The debt limit excludes lease financing. The proposed bond counsel is Orrick, Herrington& Sutcliffe LLP. Orrick has served in this role ' 75 000 with 11 11 f h District's debt issues. The proposed underwriter is Stone&Youngberg LLC(S&Y). S&Y have successfully managed several District financings, including all of the debt issued under the Authority structure. Staff believes that S&Y have done an outstanding job in optimizing the structure of this issue. The proposed underwriting fee of 0.7% is reasonable, R-03-111 Page 3 i i and lower than on any prior District debt issue. The Authority is responsible for executing a Bond Purchase Contract with S&Y since the Authority is the official issuer of the bonds. SUMMARY OF THE PROPOSED TRANSACTION: 1. The Santa Clara County Board of Supervisors approved the agreement at their May 7, 1996, meeting. The Midpeninsula Regional Open Space District Financing Authority was created to assist the District in the financing and refinancing of underlying Notes and Leases. By utilizing the joint powers financing authority, the 1996 Revenue Bonds and two series of 1999 Revenue Bonds were issued. It is now proposed that the $35 million of 2004 Revenue Bonds, which have been structured to significantly reduce the District's near-term debt service and retire the District's 1993 COPs and a portion of the 1995 Notes, be issued. The Joint Exercise of Powers Agreement calls for the Authority to be governed by a board consisting of five members, one member of which shall be, at all times, the District's Board President, currently Director Hanko. Supervisor Kniss' district encompasses the largest territory within the Santa Clara County portion of the District. The attached resolution authorizes the actual issuance of the 2004 Revenue Bonds. The critical financial points in the financing structure are set forth in a non-to-exceed format. Permission for binding the Authority to the financing is transferred to the Executive Director so long as the bond II issue delivered to the Authority is within the parameters set out in the resolution. Controller Michael Foster's report (R-03-111)relating to the issuance of the 2004 Revenue Bonds is attached. The Authority is being asked to authorize a bond issue up to the amount of $35 million. The financing team currently expects an issue in the amount of approximately$34 Million as noted in the Controller's report. The not-to-exceed parameter of$35 million is recommended to take advantage of potential market changes. The underlying Lease would fit within the not-to-exceed $35 million authorization. As noted in the attached Controller's report, the proposed underwriter for the issuance of the Midpeninsula Regional Open Space District Financing Authority bonds is Stone& Youngberg LLC ("S&Y") of San Francisco. S&Y underwrites more California local government financing than any other firm and successfully underwrote the Financing Authority's 1996 and 1999 Revenue Bonds; the District's 1995 Notes; and several District issues in the 1980's. S&Y have done an outstanding job in structuring this issue and have proposed an underwriting fee not to exceed 0.7%. This is lower than the fee charged on the Financing Authority's 1996 and 1999 Revenue Bonds. Attached is the proposed Bond Purchase Contract from S&Y. In summary, S&Y proposes to perform the following: A. Work with Authoritystaff to structure the offering in order to obtain the most g advantageous terms and conditions. B. Lead development of the Official Statement for the Authority. C. Obtain bond insurance. D. At the earliest date practical, submit an offer to the Authority to purchase the notes. E. Sell the Bonds directly or through a syndicate formed by S&Y. The Bond Purchase Contract with S&Y is to be executed by the Financing Authority and the District. The proposed bond counsel is Orrick, Herrington& Sutcliffe. This firm has served as bond counsel for virtually all of the District's debt issues and it is desirable to maintain this successful R-03-01 Page 3 relationship. The fee for Orrick, Herrington& Sutcliffe's services relative to this bond issuance is $75,000, with costs and expenses not to exceed $5,000, payable at the closing of the financing. BACKGROUND In February 2002,the District submitted a grant application to the California Heritage Fund(CHF)Grant Program for the seismic upgrade of the winery building at Picchetti Ranch Open Space Preserve(see Report R-02-06). In May 2002,the State Office of Historic Preservation informed the District that a grant in the amount of$50,000 would be awarded to complete the project. Since the cost to complete this project is approximately$205,000,the District applied for additional funding by submitting a grant application in November 2002 to the Santa Clara County Historical Heritage Commission. In June 2003,the Santa Clara County Board of Supervisors awarded the District a grant in the amount of$66,000 to complete the project. In total,the District has received$116,000 in grants to complete the seismic upgrade of the winery building at Picchetti Ranch Open Space Preserve. DISCUSSION Constructed in 1896,Picchetti Ranch is one of the few remaining historically significant wineries in the Santa Clara valley and is listed on the Santa Clara County Heritage Resource Inventory and the National Register of Historic Places. It is an excellent example of a family-operated ranch and winery of the type prevalent in the area in the late 1800's. The winery remains the central building at Picchetti Ranch and its stone foundation and brickwork on the upper walls gives it a unique distinction among the ranch buildings. The District currently leases the winery complex to Leslie Pantling who operates the property as Picchetti Winery, which is open to the public for wine tasting and sales. The winery building was renovated and upgraded in 1986. These renovations included both seismic and non-seismic repairs and upgrades. Today,the building is in need of further seismic upgrades as a result of the 1989 Loma Prieta earthquake. After the 1989 earthquake,the County of Santa Clara adopted an unreinforced masonry upgrade ordinance,as required by State law. The ordinance classifies existing unreinforced masonry buildings according to their risk(based on the nature of their use)and structural inadequacy. First,the roof and walls must be tied correctly to the floor with anchors and blocking. Second,the roof and floors must be upgraded with blocking so they can better act as diaphragms, which carry and resist lateral forces. Third, the brick walls at the ends of the building must be tied to the roof above with a new shear wall constructed on the face of the wood gable-end walls. Last month, staff requested qualifications from several firms specializing in historic preservation architecture. Of the qualifications received, staff determined that Page&Turnbull of San Francisco was best suited to provide the necessary architectural and structural engineering services for the project. Page &Turnbull is a highly qualified firm that focuses only on projects that are historically significant and in compliance with the Secretary of the Interior's Standards for the Treatment of Historic Properties. In addition to successfully working with the District on past projects at Picchetti Ranch and Rancho San Antonio Open Space Preserves, Page&Turnbull has completed projects for other park agencies including California State Parks and the National Park Service. Staff recommends that the District enter into a contract with Page&Turnbull to provide the necessary architectural and engineering services. The proposed timeline is to commence the design and engineering phases of the project this fiscal year, with construction occurring in fiscal year 2004-2005. The requested contract amount of$44,920 includes a 15-percent contingency and the consultant is available to begin work immediately. FUNDING Although the seismic upgrade of the winery building at Picchetti Ranch was not identified and budgeted in the fiscal year 2003-2004 Work Program, unanticipated delays for other budgeted construction projects will allow sufficient funds for the architectural and engineering phases of this project to be completed. This amendment to the Work Program will be included in the upcoming mid-year budget analysis that is I being provided to the Administration and Budget Committee. CEQA COMPLIANCE At your January 16, 2002 meeting you determined that this project will not have a significant effect on the environment and is categorically exempt from the California Environmental Quality Act(CEQA) under sections 15301 (Existing Facilities) and 15331 (Historical Resource Restoration/Rehabilitation)(see Report R-02-06). Prepared by: Douglas Vu, ASLA, Open Space Planner Contact Person: Same as above i I Regional Open Sp._ _e R-03-107 MIDPENINSULA REGIONAL OPEN SPACE DISTRICT Meeting 03-24 CELEBRATING 30 YEARS OF OPEN SPACE PRESERVATION October 22, 2003 AGENDA ITEM 4 AGENDA Notice of Contract Completion for Repairs to Old Page Mill Frail atSkyline Ridge Open Space Preserve GENERAL MANAGER'S RECOMMENDATION Authorize the General Manager to execute the attached Notice of Contract Completion for the Old Page Mill Trail Repair project. DISCUSSION At your July 23,2003 meeting,you awarded the contract for the repairs to the storm-damaged Old Page Mill Trail at Skyline Ridge Open Space Preserve to Casey Construction of Redwood City, CA,in the amount of $258,150,plus a contingency amount of up to$27,842, for a total amount not to exceed$286,000(see Report R-03-70). The project included repair of two large washouts,installation of a crib retaining wall, and the enlargement of an existing culvert along the lower segment of Old Page Mill Trail. The construction of repairs is now complete. Staff was pleased with the performance of Casey Construction, who finished their work one week earlier than anticipated. Change orders totaling$11,944 were written for the project,to address geotechnical factors that were only possible to observe during construction. The bidding process made provisions for this possibility,with unit prices established ahead of time, so the change order procedure proceeded smoothly. Therefore,the total amount payable to Casey Construction for the project is $270,093.62. The District will retain 10% of payments due to Casey Construction for 60 days, in accordance with the contract documents. This time frame allows staff to review evidence that all payrolls,material bills, subcontractors, and other debts connected with the project have been addressed. The project is almost entirely funded by FEMA, with a grant of$92,850 for the large washout and crib wall repair, and a grant of$29,540 for the small washout repair(a culvert replacement not funded by FEMA was also included in the project).According to FEMA,the grant amount for the large washout should be regarded as an estimate since the grant will cover 100%of actual costs,including professional services, construction, materials, and District field staff labor. Preliminary accounting of the actual costs indicates that the District expenses for the FEMA-funded portion of the project were approximately$307,500 over the last four years. The District has already received$53,242 from FEMA in conjunction with the project, and upon final closeout it is expected that the District will receive an estimated additional$258,000 to cover the cost of the storm damage repairs. The number of pigs trapped per month has decreased substantially over the past 3 years. In 2003, very few pigs were trapped until the past two months when nine pigs have been caught. It is likely that pigs are being attracted to the south Skyline area this time of year as the acorns are dropping from oak trees. In order to cut costs this fiscal year, we have utilized the rangers to monitor the traps, while the pig trapper has been responsible for removing trapped pigs, setting up new j traps, and overall monitoring of pig activity. After this year, we will analyze the seasonal activity of pigs and may focus next year's trapping during the seasons when pigs are most active in the south Skyline area. It damaged three small trees and was stopped by a stump. The driver declined medical attention. F. Reneau, B. Guzman, County Fire, Stevens Creek Volunteer Fire Department, and California Highway Patrol responded. I� I A hiker reported hearing a discharge of firearms in the area of the Manzanita Trail and Fir Trail junction at El Corte de Madera. San Mateo SO searched the area. A cyclist later reported they heard shots on private property near Starr Hill Road. L. Paterson, I Lloyd, R. Carlson. I A vehicle was driven or pushed over a steep embankment from Hwy 35 into Long Ridge OSP. The vehicle was then driven in an attempt to extricate it. A neighbor reported seeing juveniles and vehicles in the area the night before. The owner of the vehicle, whose teenage son had been driving the vehicle the night of the incident, removed the vehicle with the use of a tow truck. L. Paterson. I Early in the morning, a vehicle accident occurred on Page Mill Road. The District's split-rail boundary fence at Monte Bello was damaged. The driver left the scene before rangers or police arrived. The registered owner has a felony arrest warrant for burglary and traffic warrants. Palo Alto Police are conducting an investigation. B. Downing, L. Paterson. 8 At Coal Creek OSP, on the gated dirt portion of Alpine Road, a bicyclist startled an equestrian. The rider was thrown and sustained a serious ankle injury. J. Lloyd, B. Downing. 9 Twenty-seven marijuana plants were discovered at Coal Creek, along with fertilizer and growing supplies. The site was being checked by rangers because of past marijuana growing in the area. J. Lloyd, B. Downing. 15 A contractor workinp, for the District in Sierra Azul reported the theft of three batteries and three "rippers," from heavy equipment left in the area overnight. B. Malone and the Santa Clara County Sheriffs Department completed reports. 14 Three visitors were stopped for closed area violations in Sierra Azul by F. Reneau. K. Carlson and A. Corriea responded to assist. Consent was obtained to search a backpack possessed by one of the subjects. Marijuana paraphernalia, and a single marijuana bud were found. The marijuana bud was destroyed at the scene. The three visitors were cited for closed area, warned about the marijuana, and released. 15 A report was received of a disoriented man in Rancho. Fire personnel and medics were requested by F. Reneau. The disoriented man ignored offers of help and then became involved in a physical altercation with paramedics. The paramedics restrained the individual and placed him on a gurney. A deputy sheriff was requested and the patient became more combative, before he was again restrained. The patient was arrested by the Deputy for being drunk in public. 18 A vehicle was used to vandalize a gate, rails,bollard, and a sign after-hours at Ravenswood. East Palo Alto Police responded, interviewed the driver, and completed an accident report. B. Malone responded the following morning and found more extensive damage and completed a vandalism report. 19 A neighbor reported a weapon being discharged in Sierra Azul. K. Miller and B. Guzman requested a Santa Cruz County Deputy and were told it would be a 45 minute response. D. Danielson and T. Valterria responded from Skyline. K. Miller and B. Guzman arrived and contacted two adults and four juveniles. One of the subjects stated that he had been shooting, and that the unloaded rifle was in his vehicle. The rifle was temporarily removed for officer safety. The adult with the rifle was issued a citation for being in a closed area, the second adult and the juveniles were issued written warnings for the closed area violations. The weapon was returned, but 53 rounds of rifle ammunition were kept for safe-keeping and booked into evidence. Two wooden swords which the juveniles left were also booked as property for safe-keeping. The Deputy was diverted to a higher priority call and never arrived. 26 An altercation over a parking space occurred in Rancho San Antonio Park. Three women were standing in a parking space to save it for a friend. The driver of a vehicle bumped one of the women so he could park. He then went for a run. B. Malone, B. Guzman, and three Santa Clara County deputies met with the victim, who had no visible injuries. The driver returned from his run approximately 90 minutes later, and was cited for reckless driving. 27 A neighbor at El Corte de Madera reported hearing two sets of rapid firearm discharges near gate CM-03. San Mateo SO was requested but took 45 minutes to arrive while rangers waited at Skeggs Point. The area was checked by rangers and deputies but the source of the shots was not located. E. Wickham, R. Carlson, and D. Danielson. 30 A neighbor reported campers in Sierra Azul. F. Reneau requested a Deputy and she met the Deputy in the area. Two people camping in the bed of a truck were contacted. Both were cited for camping and released. September Vandalism I & 7 At Russian Ridge along the Alpine roadside "No Parking Y2Hour after Sunset" signs were vandalized and removed on two separate occasions. L. Paterson. 10 & 23 Two separate incidents of vandalism occurred on the former Paulin property at La Honda Creek. A window was broken, a door slat kicked out, and a fence was torn down by a vehicle. 11 A chain was cut to gain vehicle access through a gate on the former Presentation Center property at Bear Creek Redwoods. is Extensive damage was caused by a vehicle at Ravenswood. See incident description above. 28 Graffiti abusive to rangers was spray painted on a directional sign at Windmill Pasture, Rancho San Antonio. Final determination on access awaiting completion of master planning process. 2. Long Ridge Peters Creek Trail Seasonal Seasonal Very popular with mountain bicyclists. Tread can get very muddy during wet conditions. Staff anticipates closures during and immediately following heavy rainfall. Ridge Trail - Chestnut Orchard Seasonal Seasonal Same conditions as above. to Peters Creek Trail Achistaca Trail* Closed Seasonal* Newly constructed trail, which needs to stabilize over the first winter. 3. El Corte de Methuselah Seasonal Seasonal Trail is highly susceptible to damage during extended periods of rain. Madera Leaf Trail Seasonal Seasonal Trail is highly susceptible to damage during extended periods of rain. Virginia Mill Seasonal Seasonal Trail crosses El Corte de Madera Creek and is not passable during periods of high stream flow. Potential slide areas may cause longer term closures, if a severe winter is experienced. Giant Salamander* Seasonal Seasonal Trail was identified in the geological survey report as being a source of sedimentation. 4. Fremont Toyon Trail Seasonal Seasonal Very popular with equestrians from Garrod Stables and mountain Older bicyclists. Tread can get very muddy during wet conditions. 5. Monte Skid Road Trail to Canyon Trail Seasonal Seasonal Very popular with mountain bicyclists and equestrians. The shaded Bello (Lower Nature Trail) canyon environment can prevent the tread from drying through the winter season. Alternate route available. White Oak Trail Seasonal Seasonal Tread can get very muddy during wet conditions. Staff anticipates (Permit lot to Skid Road Trail) closures during and immediately following heavy rainfall. In these mountains we have amazing owls that silently swoop through the midnight skies sending out haunting hoots, and best of all -no batteries required. Then there is the traditional black cat and witch. We have a very fine black feline named Chance who's always lurking solnewhere about the house. El Corte de Madera Creek Open Space Preserve is the only District Preserve where this off-trail restriction is in place. While it may be inconvenient, this restriction must be applied uniformly to all Preserve visitors. Under exceptional circumstances, the General Manager may issue a permit to enter a closed area, but such a permit would only be issued to a representative of a federal or state resource agency, or to an agent of the Midpeninsula Regional Open Space District. After discussing this matter with Mr. Britton, the Board concurs with the decision to deny your permit request. As the mission implies, however, where public access cannot be achieved in an ecologically sensitive manner, the District emphasizes resource protection over public access. Many of the District's open space preserves, and especially El Corte de Madera Creek Open Space Preserve, are popular destinations for mountain bicyclists. We recognize that in some locations mountain bicycling can result in resource damage or user conflicts. On July 12, 2000, the District Board of Directors approved the closure of 13.6 miles of trails in seven preserves to mountain bicycle use. The multiple-use trails in El Corte de Madera were not closed to mountain bicyclists because of the extensive public planning process associated with the 1996 e Trails Plan for the preserve, and because of the preserve's popularity among cyclists. rBased on a comprehensive evaluation of the road and trail network, staff has determined that erosion cannot be attributed solely to mountain bicyclists; rather it is a function of trail use in combination with trail location, design, and management. Even hikers or equestrians can cause resource impacts if use occurs in ecologically sensitive locations, or if the trails are not designed or managed to accommodate large numbers of visitors. Your letter outlined a number of questions regarding the District's efforts to curb sedimentation and to address bicycle-related impacts to the Preserve's natural resources. The District has prepared a Draft Erosion Control and Sediment Reduction Plan (the Plan) for the Preserve to address these issues. This Plan outlines a wide range of actions to reduce erosion at the Preserve, including(1) Physical improvements to the road and trail system at 73 locations throughout the Preserve, with particular emphasis along 7.3 miles of roads and trails that emerged as sediment reduction priorities; (2) Changes in Preserve use and management practices; (3) Enforcement and public education; and (4) Long- term monitoring. Copies of the Plan and the Draft Road and Trail Erosion Inventory for El Corte de Madera Creek Open Space Preserve, prepared by Timothy C. Best, were sent to you in early December 2002. Please refer to these documents for more detail. The Draft Erosion Control and Sediment Reduction Plan was submitted to the Regional Water Quality Control Board (RWQCB) and the National Marine Fisheries Service (NMFS) on December 1, 2002. To date, only the RWQCB has provided written comments, and a copy of their letter is attached for your reference. District staff recently met with representatives from NMFS in order to expedite their review of the Draft Plan, and they anticipate their review will be complete in the next month. Once the District receives NMFS's review, District staff will incorporate suggestions from the RWQCB and NMFS into a Draft Final Plan, and will prepare the necessary environmental documentation as required by the California Environmental Quality Act. Once complete, the Final Plan and its associated environmental documentation will be submitted to the District's Board of Directors for review and certification. Implementation of the Final Plan will require permits from the California Department of Fish and Game, the US Army Corps of Engineers, the RWQCB, and San Mateo County. District staff anticipates that the necessary permits will be secured in time for project implementation to begin during the 2004 construction season. Work may proceed over a number of construction seasons, but it is the District's intention to complete the work within the five-year timeframe requested by the RWQCB. The projected cost of the project is estimated to be approximately$550,000. The District has been working collaboratively with the resource agencies to develop a comprehensive plan to reduce potential impacts to natural resources at El Corte de Madera Creek Open Space Preserve, while still providing opportunities for multiple-use recreation. Timeline and Schedule The prioritization scheme laid out in the Plan, with an emphasis on environmental protection over recreational access, effectively addresses Our agency's concerns. The I 0-year time frame for implementation, however, does not appear to be an aggressive effort to reduce sedimentation at priority sites. Please provide a schedule for completion of the priority repairs within 5 years. Such a time frame will ensure implementation of the treatment measures prior to the scheduled adoption of a sediment Total Maximum Daily Load (TMDL) for the San Gregorio watershed. Additionally, the treatment schedule described in Table 5-1 does not provide enough specificity regarding the timeline for implementation of the treatment measures. Because these trails tend to descend at steep gradients and drainage provisions are not incorporated into their design, continued mountain bike use could result in substantial erosion. Your letter also referenced plans to evaluate realignment of segments of Leaf Trail, Virginia Mill Trail, Crosscut Trail, Giant Salamander Trail and Blue Blossom Trail. At a minimum, roads and drainage structures will need to be inspected annually prior to the beginnins of the rainy season. Inspections should address culvert inlets and outlets on stream crossings and ditch relief culverts, road surface drainage such as waterbars, outsloping and ditches, as well as road fills. In addition to annual pre-winter drainage structure inspections, crews must inspect and perform emergency maintenance during and following winter stones. Please include this level of specificity, as well as details of your reporting protocol (frequency and report format) in your final Plan. The draft Plan stated that any water quality data collected would be forwarded to the Central Coast Ambient Monitoring Program. Because RWQCB Region 3 administers that program, it is not the appropriate program for the data. Please forward any data collected to the monitoring program for Region 2: Surface Water Ambient Monitoring Program (SWAMP). Please also note that any macro invertebrate sampling should be performed in accordance with the California Bioassessment Procedure. Funding for Plan Implementation Grant funding is currently available through Proposition 13, Proposition 50, and Section 319(h) of the Clean Water Act. We strongly encourage you to apply for grant funding; reduction of sedimentation into tributaries of CWA 303(d) listed waterbodies for sediment is one of our highest regional priorities. An application for implementation of your Plan should be very competitive.
