COUNCIL MINUTES
JULY 6, 1971
INITIATION:
1. Mayor Gilbertson called the regular meeting of the City Council
to order at 7:40 p.m.
2. The invocation was given by the Reverend Dean Grelling,
Temple City Southern Baptist Church, 5221 El Monte Avenue,
Temple City.
3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson.
4. ROLL CALL:
PRESENT: Councilmen - Briggs, Harker, Merritt, Gilbertson
ABSENT: Councilmen- Tyrell
ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning
Director Dragicevich
Councilman Harker moved to excuse Councilman Tyrell's absence due
to vacation, seconded by Councilman Briggs and carried.
At this point, Mayor Gilbertson was presented with a Pedestrian Safety
Award, for the City of Temple City, in recognition of no pedestrian
fatalities in the year 1970 within the City, by Don Hoffman, Safety
Consultant for El Monte District, Automobile Club of Southern
California, on behalf of the American Automobile Association.
Mayor Gilbertson called upon Commander James C. Sturch, Temple City
American Legion Post No. 279, for remarks on the contribution by the
American Legion Post to the community. Mayor Gilbertson presented
Commander Sturch with a certificate of appreciation in recognition
of the volunteer assistance provided by the organization.
Youth Commissioners Arthur Gaffrey and Gregory Stockdale were sworn
in as new members of the Commission by Mayor Gilbertson.
5. APPROVAL OF MINUTES:
Councilman Briggs moved to approve the minutes of the
regular meeting of June 15, 1971, as printed, seconded by
Councilman Harker and carried.
Councilman Harker moved to approve the minutes of the Special
Joint Meeting of the Council with the Planning Commission
of June 22, 1971, as printed, seconded by Councilman
Briggs, and carried.
UNFINISHED BUSINESS:
6. APPEAL FROM PLANNING COMMISSION DECISION: Zone Variance Case
No. 71-341 (9644 Gidley and 4409 Temple City Boulevard)
(Continued from April 6, 1971).
City Manager Koski advised that the Planning Commission had
held Public Hearing on this case on March 9, 1971, and
passed Resolution No. 71 -411PC granting Phase I on the
plot plan marked Exhibit "A" in the applicant's request
to expand existing nonconforming M -2 lots, which was a
partial approval of the applicants request. The decision
was appealed by the applicant together with a request to
postpone the hearing for 90 days which had been granted by
the Council.

City Manager Koski stated that Planning Director Dragicevich
has advised that the applicant had now submitted a new plot
plan with respect to the alternate development of his
property, which deviates from the original plan. Phase I
is now excluded from the proposed development on Parcel I
and the proposed addition to the existing residence on
Parcel 2, and the proposed extension of workshop, marked
Phase 2 on the original exhibits are now withdrawn.
Councilman Briggs moved that due to substantial modifications
from the previous plans the matter be returned to the
Planning Commission for supplemental hearing on the new
proposal, seconded by Councilman Harker and carried.
PROPOSED AMENDMENT TO TEMPLE CITY MUNICIPAL CODE RE. OUTDOOR
ADVERTISING STRUCTURES AND NONCONFORMING USES.
City Manager Koski advised that Public Hearing had been
held on June 1 and June 15, 1971, and the hearing had
been closed, with final determination of the Council
withheld, pending a meeting of the City Attorney, City
Manager, Planning Director and representatives of the
outdoor advertising companies to determine if any modifica-
tions could be made which would still meet the intent of the
ordinance and acceptable to the businesses involved. He advised
that such a meeting had been held on June 22, 1971 and that
letters of counter proposals from the agencies concerned had
been received.
The request of the Kennedy Outdoor Advertising Company that
their signs be exempted from the restrictions since they are
under 75 square feet, was not acceptable to the Council.
The proposal from Foster & Kleiser and Pacific Outdoor
Advertising Companies, dated July 1, 1971, and staff recommenda-
tions were reviewed by the Council and modifications considered
and reviewed with representatives of the outdoor advertising
companies as to their acceptance. In discussion of existing.
signs in C -M and M zones, Councilman Merritt stated he was
still of the opinion that a 500' requirement be established
between signs, rather than the 300' as proposed on the check
list of standards, which was not part of the ordinance, but
developed as part of a possible conditional use permit require-
ment.
Councilman Harker moved to accept the recommendations outlined
by staff memorandum, however withheld the motion in order to
clarify the matter of grandfather clause relating to signs
presently in existence in CM and M zones. Following
clarification that existing signs would be grandfathered in
without any conditions upon them, Councilman Briggs moved
to accept the compromise of the outdoor advertising companies
and to instruct the City Attorney to prepare the appropriate
ordinance phasing out four structures as follows: one double
structure at 9044 Las Tunas; single structures at 9135 and
9165 Las Tunas; and a double -faced structure at 9475 Las Tunas;
(C -2 zone), by December 31, 1971, and remaining structures on
Las Tunas (C -2 zone),, in 3 years from date of adoption; to remove
all conditional use permits, and to make all future outdoor
advertising signs subject to compliance to the checklist of
standards to be included in the new ordinance, that the checklist
of standards for all new signs be revised to require a distance
of 500' from existing signs; and to grandfather in all existing
signs presently in CM and M zones. The motion was seconded by
Councilman Merritt and carried.

ORDINANCE NO. 71. -329: 2nd read. Re. Proposed Amendment to
Temple City Municipal Code Relating to Granting Franchises for
Commercial Antenna Television Systems.
City Attorney Martin presented Ordinance No. 71 -329 entitled
AN. ORDINANCE OF THE CITY OF TEMPLE CITY ADDING CHAPTER 8 TO
ARTICLE VI.OF,THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE
GRANTING OF FRANCHISES FOR COMMUNITY ANTENNA TELEVISION
SYSTEMS for second reading, advising that this was an enabling
ordinance. Councilman Harker-moved to waive further reading,
seconded by Councilman Briggs and carried. Councilman Harker
moved to adopt, seconded by Councilman Briggs and carried.
NEW BUSINESS:
9. RESOLUTION NO. 71 -1116: Re. Adopting a Salary Schedule and
Pay Plan.
City Manager Koski presented Resolution No. 71 -1116, entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ADOPTING A SALARY SCHEDULE AND'PAY PLAN. Councilman Merritt
moved to adopt, seconded by Councilman Harker and carried.
10. ORDINANCE N O. 71 -332: 1st read. Re. Amendment to
Municipal Code Relating to Personnel.
City.Attorney.Martin presented Ordinance No. 71 -332 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 2371,
2368, AND`',2702 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO
PERSONNEL, advising that the changes were made to conform the
code to personnel policies arrived at in budget hearings.
Councilman Briggs noted that the normal working hours were
until 5 :15 p..m. and that changing the time off on Good Friday
from 12 to 5:00 p.m. to read 12:15 to the closing hour would
be more adaptable. Councilman Briggs moved to waive - further
reading as amended, seconded by Councilman Merritt and carried.
11. ORDINANCE NO. 71 -333: 1st read. Re. Creating and Establishing
a Community Redevelopment Agency.
City Manager Koski- advised that pursuant to Section 33,000,
et seq. of the Health and- Safety. Code, that a community
redevelopment agency may created; however that no plan
was before the Council at the present time for consideration.
He advised that the proposed ordinance was proposed at this
time so that the Council may give consideration.to those
developments for which a specific plan may be developed
in the future.
City Attorney Martin presented Ordinance No. 71 -333 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY CREATING AND
ESTABLISHING A COMMUNITY" REDEVELOPMENT. AGENCY for first
reading. Mayor Gilbertson moved to waive further reading,
seconded by Councilman Merritt and carried.

12. RECOMMENDATIONS FROM PARKING COMMISSION: Meeting of June 16, 1971.
A. Renewal of Agreement - Permit to Cross -over Mall IA
(Zager Smith Carpet Company)
City Manager Koski advised that the Parking Commission
recommended extension of the agreement for Zager -Smith Carpet
Company to cross over the pedestrian sidewalk in Mall 1A, for
a one -year period from September 1, 1971, to September 1, 1972,
subject to the repair and maintenance of the existing ramp which
is used to provide vehicular access across the pedestrian mall.
He advised further that repair of the ramp had now been accom-
plished, as was the general cleanup of the area. Councilman
Merritt moved to approve the extension of the agreement as out-
lined, subject to the conditions as established in the past, and
continued maintenance of the area, seconded by Councilman Harker
and carried.
B. Random Enforcement - Public Parking Lots (Lots 5, 8A and 8B)
City Manager Koski advised that the matter of vehicles parking
all day in certain public parking lots was of concern to the
Parking Commission who felt the misuse of the lots was sufficient
to warrant enforcement of the parking restrictions posted on the
lots. While random enforcement has been made from time to time,
the Commission wished to recommend the random enforcement of two -
hour parking restrictions on Lot 5, located between Temple City
Boulevard and Camellia Avenue; and Lots 8A and 8B, located between
Primrose Avenue and Temple City Boulevard, northerly of Las Tunas.
Council discussed the matter at length, weighing alternatives which
might bring more effective results from enforcement, such as citing
under a different code section which would result in a $10 fine;
but which may also result in adverse public relations for the
business community. It was recommended by the Council that the
entire matter be reviewed by the Parking Commission, the businesses
involved and the Chamber of Commerce at a special meeting in the
near future, to recommend alternatives that may be taken to
alleviate the problem.
Councilman Briggs moved to approve the random enforcement as out-
lined by the Parking Commission, and to refer the matter to a
special meeting of the Parking Commission as discussed, seconded
by Councilman Harker and carried.
13. LAW ENFORCEMENT SERVICES AGREEMENT WITH COUNTY OF LOS ANGELES
(5 year period)
A. Renewal of Agreement.
City Manager Koski advised that the law enforcement services agree-
ment submitted by the County was the basic agreement from which the
cost of service for Temple City can be determined on an annual
basis; and that the agreement provided for termination by the City
upon 60 days notice prior to July 1 of each year, or in the event
of rate increase. Following discussion, it was moved by Councilman
Briggs, seconded by Councilman Merritt and carried to approve the
agreement and to authorize the Mayor and City Clerk to sign.
B. RESOLUTION No. 71 -1117: Requesting Additional Services
City Manager Koski advised that additional services for business
license enforcement and traffic control, under the law enforcement
services agreement, are identified in Resolution No. 71 -1117,
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY REQUESTING ADDITIONAL LAW ENFORCEMENT SERVICES WITHIN THE
CITY OF TEMPLE CITY FROM THE LOS ANGELES COUNTY SHERIFF'S DEPART-
MENT UNDER THE LAW ENFORCEMENT SERVICES AGREEMENT. Councilman
Harker moved to adopt, seconded by Councilman Briggs and carried.

14. RENEWAL OF SERVICE AGREEMENTS (Services Provided for Los Angeles
County by City of Temple City)
A. Community Recreation Program in Unincorporated Territory
- Emperor School
City Manager Koski advised that the agreement submitted by the
County for the City of Temple City to conduct community recreation
program at Emperor School carried an amount of $2,176, to be paid
by the County of Los Angeles to the City upon demand, which amount
was a reduction in the amount of $242 from the previous year,
however that the Director of Recreation has reviewed the proposal
and feels that an adequate program can be offered. Mayor Gilbertson
questioned the conducting of this program by the City if the costs
were in excess of those provided by the County. It was noted by
City Manager Koski that the program at Emperor School was part of
the agreement previously entered into with the school district, to
provide a program within the district. Councilman Merritt moved
to approve the agreement, and to authorize the Mayor and City Clerk
to sign, seconded by Councilman Harker and carried.
B. Grounds Maintenance Agreement (Library and Adjacent Grounds).
City Manager Koski advised that the agreement has been received
whereby the City of Temple City provides grounds maintenance services
for County property adjacent to the library building and County
parking lot. An amount of $740 will be paid to the City upon demand
for service during fiscal year 1971 -72, an increase of $44 over the
previous year. Councilman Merritt moved to approve Grounds Mainten-
ance Agreement No. 13886 -3, and to authorize the Mayor and City
Clerk to sign, seconded by Councilman Briggs and carried.
15. RESOLUTION No. 71 -1118: Employment of Temporary Personnel.
Councilman Merritt moved to adopt Resolution No. 71 -1118 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING TEMPORARY PERSONNEL, seconded by Councilman Briggs and
carried.
16. RESOLUTION No. 71 -1115: WARRANTS & DEMANDS, Demand Nos. 4290
thru 4419, in the amount of $47,718.23
Councilman Harker moved to adopt Resolution No. 71 -1115 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $47,718.23, DEMAND NOS.
4290 THRU 4419, seconded by Councilman Briggs and carried.
17. COMMUNICATIONS:
City Manager Koski presented the following communications from the
League of California Cities:
1) Request for League Annual Conference Resolutions from Cities.
Mayor Gilbertson advised that he had been appointed to the
Resolutions Committee of the League, and that the Committee was
to meet on July 15, 1971, to consider Resolutions that had been
submitted. In this regard he suggested that a resolution be
submitted which would request the League of California Cities
to support legislation which would provide for municipal rep-
resentation on district governing boards, similar to the
structure of the Sanitation District. Districts which do not
provide for municipal representation are Fire Protection Dis-
trict, County Library District, Sewer Maintenance District and
Flood Control District serving Temple City, however there are
many other types of districts which do not affect our community.
City Attorney Martin was instructed to prepare the resolution
for submission to the Resolutions Committee of the League.

2) Shoreline Preservation Task Force for Shoreline Legislation.
Support for the position of the Shoreline Preservation Task
Force with respect to shoreline protection was requested.
Councilman Merritt moved to adopt Resolution No. 71 -1119
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY RELATING TO THE CONSERVATION OF THE CALIFORNIA
COASTLINE, urging conservation of coastline resources through
regional and local coordinated efforts, seconded by Councilman
Harker and carried.
18. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Dominic Mortellaro (Dominic's Shoes) 9629 Las Tunas Drive,
spoke relative to the continued need for naming and posting
of names in the Malls within the City for easy identification,
and spoke regarding the need for additional parking spaces
that would be gained by the removal of the planter area, which
item had been deleted from the budget. He also discussed the
general parking and enforcement problems which had been previous-
ly considered under Item 12B, and the need for random enforcement.
Albert Anspach (Lieberg's), 9525 Las Tunas Drive, added to
the discussion regarding parking problems and the misuse of the
lots by employees.
19. MATTERS FROM CITY OF'FICIALS i
A. Mayor Gilbertson noted that the SCAG billing was again
based on population of 40,000, instead of current census,
and he questioned the legal basis for paying on this
figure.
B. A meeting on Revenue Sharing, conducted by Congressman
Charles Wiggins (25th District) will be held for city and
school officials on Friday, July 16, 1971, from 2 to 4 p.m.
in the ,E 1 Monte City Hall.
C. An award has been recommended to Governor Reagan for
Kevin Larrett for Young American Medals for Bravery.
Kevin is a 10 -year old boy who saved a man from drowning.
D. A Progress Report for the 4th quarter for Pedestrian -
Bicycle Safety Education and Enforcement Project, prepared
by the Project Director, was discussed briefly.
20. ADJOURNMENT:
On motion of Councilman Harker, seconded by Councilman Briggs
and carried, the meeting adjourned at 9:25 p.m. Next regular
meeting of the Council will be held on Tuesday, July 20, 1971,
at 7:30 p.m. in the Council Chambers of the City Hall.
