The Boa Y Y g Y of Directors reviewed your email at its regular meeting last night. The District is very concerned about the safety of all preserve visitors and actively works to reduce conflicts on District trails. Please be assured that your email has been forwarded to staff at the Skyline Field Office with a request to pay special attention to usage on the Meadow Trail. Also as you may know, the District has an effective volunteer trail patrol program comprised of hikers,bicyclists, equestrians, and dog walkers who continually educate and remind visitors to share the trail. The District also distributes trail etiquette brochures and provides information on trail safety and trail etiquette on the District's website. j The Meadow Trail is considered a very important trail among hikers, equestrians, and bicyclists alike since it provides a direct connection between Alpine Road and the interior of the preserve. This trail also forms part of a popular loop trail that connects to the heavily used Spring Ridge Trail. In addition, many preserve users value the lower segment of the Meadow Trail since it provides a more scenic and pleasant trail experience compared to the wider and steeper driveway entrance. As such, hikers, equestrians, and bicyclists together greatly use and enjoy this particular trail and we will alert our trail patrol volunteers to be mindful of potential conflicts in the area. j In an effort to meet the needs and desires of all preserve users, the District will continue to stress the importance of proper trail etiquette and safe trail use to help improve the trail experience that is gained by sharing the Meadow Trail between the hiking, equestrian, and bicycling communities. Two of us were ridingour horses down hill at a walk when we came face to face with a cyclist around a blind , Y corner coming uphill at a narrow point in the trail. All concerned - horses, riders cyclist -were seriously startled. However, no one was hurt and the cyclist was polite and concerned, moving off the trail. However, had the cyclist been coming downhill when we were going up, the results could have been different and very painful. The si htlines on tha t at trail are simply too short in many places and the width too narrow to accommodate bikes. However, there are other reasons to reconsider the designation for the Meadow Trail. That trail is heavily used by Sequoias residents. Walkers would have been equally vulnerable in that situation just described, and were they among less agile walkers, even more so. Without the support of the Sequoias residents, it is unlikely that the Windy Hill Preserve would have been approved in Portola Valley. You may recall the Board Meeting at the time the Betsy Crowder trail (then the Sausal Trail)was dedicated; Betsy herself reported contacting the Sequoias residents regarding permitted uses for that trail; the residents indicated they were comfortable with the horses but not with bikes and that is largely why it is now designated for horses (in season)and walkers. At a given speed, horses can stop in the same distance as a person, a coasting bike cannot. One other issue comes to mind with regard to designated uses for the Meadow Trail. A few years ago when the then Sausal Trail was dedicated, a number of us -walkers, riders, MROSD staff and some Directors -participated in a field trip to help decide the appropriate uses for that trail. At that time, we were told by staff, that because of the heavier equestrian usage in the Windy Hill Preserve, only the Spring Ridge Trail would be open to bikes. The reasons given were that Spring Ridge is an essential connector to other trails and that the greater width and longer sight lines make it safe for multiple uses. For all the reasons cited above, we strongly urge you to consider designating the Meadow Trail for walkers and equestrian use. DISCUSSION Peninsula Open Space Trust is offering the District a gift of property adjacent to Sierra Azul Open Space Preserve. In October 2001,you approved the purchase of the 162.06-acre McKannay property in the Mt. Umunhum area of Sierra Azul Open Space Preserve locally known as Twin Creeks(see Report R-01-23). In a separate transaction,Peninsula Open Space Trust(POST)received a gift of seven lots in the"paper" subdivision of Hacienda Park totaling approximately 33.85-acres from the McKannay Trust. The District entered into a lease and management agreement with POST in May 2002,based on their desire that the District ultimately acquire the property and incorporate it into the Mt.Umunhum Area of the Sierra Azul Open Space Preserve. In December 2002,the District acquired ninety percent of the surrounding lots in the Hacienda Park subdivision that were owned by the County of Santa Clara and acquired through tax delinquency(see Report R-02-91). With the addition of this 33.85-acre gift, District ownership in this paper subdivision will total approximately 180 acres. The remaining lots in the subdivision are owned by approximately twenty private property owners. DESCRIPTION The Hacienda Park subdivision map was filed in 1909,but never developed because of its steep and inaccessible terrain. The POST property consists of seven larger lots in the 185-acre subdivision including all of the major drainages and springs that flow into Alamitos Creek(see attached map). The creek canyon and drainages are densely forested with Douglas firs giving way to oak scrub and steep chaparral on the upper hillsides. Alamitos Road and Alamitos Creek pass through the largest of these lots at the northwest comer of the subdivision connecting the two non-contiguous properties to District land. Views of Mt. The subdivision is bordered by District land to the south,north and west. USE AND MANAGEMENT Plamiruz Considerations These properties are located in an unincorporated area of Santa Clara County near the southerly extent of the District's sphere of influence.The major portion of the property is located within the unincorporated area of Santa Clara County and zoned HS (Hillside),requiring a 20-to 160-acre minimum lot size based upon a slope density formula. Adjacent property is rated as having moderate to high composite open space value in the District's Open Space Master Plan. The District's Regional Open Space Study shows a regional trail corridor running from north to south through this"paper"subdivision. As a part of the District's due diligence in this area because of past mercury mining,Locus Technologies conducted a Phase I Environmental Assessment of the Hacienda Park subdivision in September 2001. The purpose of the Phase I assessments was to identify the presence,or likely presence,of any hazardous substances under conditions indicating existing release,past release,or threat of release into the ground, groundwater,or surface of the property. The process includes site inspections,review of public records,and interviews with persons familiar with the site. Michael Cox,a geologist having a high level of expertise and knowledge of mining activities in and around Almaden Quicksilver County Park,provided a detailed mining assessment to Locus Technologies. The results of the investigation indicated that there are no signs of a current release,or potential threat of release,of hazardous materials or waste on the property. A review of historic aerials and topographic maps did not depict conditions or the presence of structures or facilities that would suggest the presence of any potential hazardous materials. The Regional Water Quality Water Board and Santa Clara Valley Water District confirmed that there were no records of contaminated water on the site. According to the 2001 Michael Cox Report,confirmed by Locus Technologies,there are no signs of mercury mining activities on or near the property. Preliminary Use and MaqUement Plan Recommendations The preliminary use and management plan will take effect upon close of escrow and remain effective until the plan is amended or a Comprehensive Use and Management Plan is prepared. The property will be maintained in a natural condition and eventually open for low intensity recreation use. Future land use decisions, including plans for public access,will be subject to public input and further environmental assessments to ensure land use decisions are consistent with ecological values. Signs: Install preserve boundary signs where appropriate. Site Safety Inspection: Preliminary site safety inspection has been conducted and there are no known safety hazards on the site. R-04-19 Page 3 CEQA DETERMINATION Project Description The project consists of the acquisition of the 33.85-acre Peninsula Open Space Trust property as an addition to the Mt. Umunhum Area of Sierra Azul Open Space,and the concurrent adoption of a Preliminary Use and Management Plan for the property. Ultimately,the property will be included in a Comprehensive Use and Management Plan for the nearby Sierra Azul Open Space Preserve. The land will be permanently preserved as open space and will be maintained in a natural condition. Although closed to the public during the planning process,the property will eventually be open for low intensity recreation use. CEQA Determination The District concludes this project will not have a significant effect on the environment. It is categorically exempt from CEQA(California Environmental Quality Act)under Article 19, Sections 15316, 15317, 15325 and 15061 of the CEQA Guidelines. Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural condition and the management plan proposes to keep the area in a natural condition. The use and management plan proposes to keep the area in a natural condition. Section 15317 exempts the acceptance of fee interests in order to maintain the open space character of an area. The acquisition will accept fee interests and will maintain the property as open space. Section 15325 exempts transfers of ownership of interests in land in order to preserve open space.The acquisition will transfer ownership to the District and ensure the property is preserved as open space. The acquisition qualifies under all three sections and is also exempt under section 15061,as there is no possibility the actions may have a significant effect on the environment. TERMS &CONDITIONS This gift of the 33.85-acre POST property will round out and further define the public open space ownership in the Hacienda Park subdivision in the Mt. Umunhum area of Sierra Azul Open Space Preserve. In 2001, POST received a gift of this property from the McKannay Trust with the understanding that the property would ultimately be transferred to District ownership. PUBLIC NOTIFICATION The adjacent property owners within the Hacienda Park subdivision have been mailed written notices of this proposed transaction. DISCUSSION Section 2.40, "Financial Instrument Signatories,"of your Rules of Procedure states that, "The authorized signatories ... for payroll or for amounts less than$5,000 shall be any one of the following six employees: (i)the General Manager; (ii)the Assistant General Manager; (iii)the Administration and Human Resources Manager; (iv)the Operations Manager, (v)the Public Affairs Manager, or(vi)the Planning Manager,"and that, "The authorized signatories for ... amounts of$5,000 or greater(excluding payroll) shall be any two of the following employees: (1)the General Manager; (ii)the Assistant General Manager; (iii)the Administration and Human Resources Manager; (iv)the Operations Manager, (v)the Public Affairs Manager,or(VI)the Planning Manager." DISCUSSION The District's five-year capital equipment schedule provides for two replacement patrol vehicles in fiscal year 2004-2005. Purchase orders for vehicles acquired through the State of California Department of General Services (DGS) must be placed prior to the manufacturer's cut-off dates in spring of 2004. The District's ability to purchase vehicles through DIGS provides a significant cost savings and greatly reduces the amount of staff time that would otherwise be required if the District conducted a separate bid process. The two new vehicles will replace patrol vehicles that have reached, or are approaching the 80,000-mile mark, when District patrol vehicles are ordinarily retired from patrol use. The retired patrol vehicles will be reassigned to maintenance crews. Reassigning patrol vehicles to maintenance has proven to be a workable system and is financially beneficial to the District. Staff is requesting authorization to purchase the vehicles before the 2004-2005 fiscal year budget is approved because cut-off dates typically occur prior to final approval of the budget. The Administration and Budget Committee approved the inclusion of two replacement vehicles in the proposed budget at its February 4 meeting and supports the continued use of the State of California Department of General Services purchasing program. GENERAL MANAGER'S RECOMMENDATION Authorize the General Manager to enter into a four-year lease wi nier Corporation for two new copy machines for the Administrative office. DISCUSSION The copy quality of our larger copy machine has deteriorated and calls requesting service have increased. Staff has been researching and meeting with representatives from different copier companys, including Lanier, Xerox, and Panasonic. After reviewing the information received, staff has concluded that it is in the best interest of the District to lease a new copy machine. As each year passes, the copier technology improves while the price decreases. As a result, Lanier offers the District the best and most cost effective package for replacing the current 5365 model and 5216 models. Although the District's current four-year lease does not expire until April 2005, Lanier has included"buying back" the current lease and is able to offer two new copiers that incorporate more desirable features for the District. The new recommended model LD060 represents the pinnacle of technology for digital devices. The document feeder is a"single pass" two-sided scanner that scans both sides of the documents simultaneously and then sends the output of the document through a single sheet vertical duplexer with a shorter paper path which results in a lower chance of paper jams and maximizes productivity. It also allows a faster warm up time and a quicker first copy time. There is a document server to store commonly used forms (fax forms, memo templates, routing slips, etc.). Scanning Any document can be scanned: from I I" x 17" sized documents to book originals to one or two- sided documents. Once scanned, the document(s) can be sent to a file on a computer workstation, or e-mailed to a P party. Scan a document into the copy machine's scanner and then distribute to the recipient's e- mail inbox. Volunteers could possibly be utilized to scan historic District documents which could then be backed up electronically or"burned" into the CD/DVD format. It is possible to save office space by storing documents electronically as opposed to hard copies. Copier as Printer Staff comfortable with HP printers can continue to use those models, but the new printer capability on the copy machine includes printer domain and offers a faster printing speed than HP printers. This print function allows users to utilize icons to produce jobs, making printing complex jobs easier. This function also allows the user to both print and make appropriate copies in a"one stop shopping" scenario. RECOMMENDATION There is no cost to make a change in our copy machine now, rather than waiting until the lease expires in April 2005, in fact there is a nominal savings. Currently the District is paying $1,391.00 per month for both the 5365 and the 5216 copy machines. The proposal from Lanier includes replacing the 5216 machine with a slightly faster model that allows form feeding. The cost per month for upgrading both copy machines will be $1,365.00 based upon a 48 month term, bringing a yearly savings of$322.00 to the District The total cost to the District over the four-year lease will be $65,474.40, or$16,368.60 per year. The Program would extend the District's service boundary to the San Mateo Coast and allow the MROSD to purchase and manage land in order to preserve these unique open space and agricultural resources for generations. MROSD's Board of Directors is requesting, through this bill, that it be prohibited from exercising the power of eminent domain only in this area in response to requests by the Farm Bureau and citizens of the coastal area. Passage of this bill is a critical step to ensure that the District can successfully move forward with the application for its Coastside Protection Program to the San Mateo County Local Agency Formation Commission(LAFCo). AB 1195 would eliminate eminent domain in this specific geographic area, which is necessary rY and appropriate because of the unique situation on San Mateo's coast and the exceptional nature of the District's Coastside Protection Program. The plan was developed over the last six years in response to citizen concerns that improper development and sprawl are threatening the San Mateo coastline and that unless the District takes action now, scarce farmland may be lost and the region's natural heritage compromised. The Coastside Protection Program's twin goals are therefore to protect agriculture's physical and economic integrity on the San Mateo Coast and the area's natural environment, including its world-famous scenic and natural beauty. To achieve these objectives, the program would extend the District's service boundary to include rural San Mateo County, which would allow MROSD to purchase, manage, and preserve land in the area. In the process of developing the program—a multi-year collaborative effort involving over 40 public meetings, including 17 Citizens' Advisory Committee meetings, 21 District Board meetings, and 7 Public hearings on the Environmental Impact Report—the District's Board responded to the agricultural community's concerns about protecting their long-term economic viability. The Coastside Protection Program recognizes that agriculture is a vulnerable and fragile industry that needs to be protected. The purpose of annual fall deer surveys is to track general trends in the deer population. The surveys are not an exact count of the herd as not all preserves are covered and surveys are conducted on consecutive nights in the fall rather than all at one time. Deer surveys have been conducted in some preserves since 1993. Since 2002, we have been conducting the surveys in a consistent manner so as to allow comparisons between years. The deer surveys are conducted during the rut in the first quarter to half moon phase in October and before heavy rains make roads undrivable. Surveys are started '/2 hour before sunset and continue until 1-Y2 hours after sunset. Two observers drive slowly along designated routes using a 1- or 2- million candlepower spotting light and binoculars. The number of does, bucks, fawns and antler points on bucks are recorded. Observations of other wildlife are noted. Deer surveys are conducted every year at the following preserves: Rancho San Antonio, Rancho de Guadalupe, Monte Bello, Skyline Ridge, Long Ridge, and Russian Ridge. As time and weather allow, surveys are conducted at the following additional preserves: Fremont Older, Picchetti Ranch, La Honda and Windy Hill. The data is analyzed to determine the number of deer observed per mile driven and the nu observation. The year 2000 showed a noticeable increase in the number of deer C,-NERAL MA JAGER: observed overall and this was a trend seen in each preserve surveyed that year except for Russian Ridge. Please let us know if reporting deer surveys in this format is useful to the California Department of Fish and Game (CDFG). On another wildlife note, we have been receiving an increased number of contacts from the public worried about mountain lions since the fatal attack in Orange County last month. We make three points whenever we receive such calls: 1) there have never been any attacks by mountain lions on humans in Midpeninsula Open Space District preserves, 2) we refer them to our website with tips on what to do if one encounters a mountain lion (taken from CDFG publications), and 3) our rangers are trained on how to protect the public if a mountain lion ever exhibited aggressive behavior towards humans in our preserves. You may recall that Jodi Isaacs prepared Wildlife Incident Response Protocols for our staff defining what would be considered aggressive behavior, and when to close a preserve and contact CDFG. We also have been checking with Santa Clara County Parks to compare any recent observations regarding mountain lions in the Hicks Road/Guadalupe Reservoir area. To our knowledge, no aggressive behavior by mountain lions has been observed. For your information, I have attached a table showing mountain lion observations that have been reported to us by the public and our staff over the past two years. It is difficult to assess the reliability of many of these reports. When possible, our staff tries to confirm reports by interviewing the reporting party and by visiting the observation site to look for tracks or examine kills. Maciel, Operations Manager Subject: Wildlands Weeds Workshop Date: February 10, 2004 The District will be co-sponsoring a Wildlands Weeds Workshop on Saturday, March 61h The event is being presented by the San Mateo County Weed Management Area, and will occur from 9:00 AM till 12:00 PM, with an optional weed work party in the afternoon. The morning session will be held at the Portoia Valley Town Center. The afternoon work party may be held at Thornewood Open Space Preserve. Cindy is working with the event organizers to confirm this. Cindy will also be giving a presentation about the District's weed management program at the morning session.
