WALKER VICE MAYOR JOHN K. WHITTEMORE COMMISSIONER Also attending: Att'y John Randolph, Mariker William E. Gwynn, Deputy Town Clerk Barbara Gwynn and Larry M. Ball, Chairman of the Planning and Zoning Board. The Meeting was called to order at 9 A,M. by Mayor Koch. Upon motion by Mr. Bettison and seconded by Mrs. LaPorte the Commission approved the minutes of the regular meeting May 13, 1977. Upon motion by Mrs. LaPorte and seconded by Mr. Bettison the Commission approved the May, 1977 Financial Report. Crowmell 951 19 152 8 0 TOTAL 10257 182 1469 123 8 Mayor Koch cited a recent article appearing in the June 4, 1977 Palm Beach News concerning the Area Planning Board recommendation that small police agencies located between South Palm Beach and Gulf Stream consolidate. Mayor Koch pointed out that this recommendation was made without the understanding and consideration of residents who would be affected by this merger and their desire to continue with their own police depart- ments. l Mr. Larry M. Ball gave an up to date report on the Regional Sewage System. -2- COMMISSION MEETING JUNE 10, 1977 Cont. Commissioner Bettison made a motion that a request for a variance from the Gulf Stream School for a maintenance shed be granted. Commissioner LaPorte seconded the motion, motion was unanimously granted. A letter received from Palm Beach Commissioner Lake Lytal was read to the Commission. This letter requested the Commission to comment on Resolution #9 -1977 A RESOLUTION OF THE PALM BEACH COUNTY MUNICIPAL LEAGUE TO THE BOARD OF PALM BEACH COUNTY COMMISSIONERS RESPECTFULLY REQUESTING FUNDING FOR THE SCIENCE MUSEUM OF PALM BEACH COUNTY. upon motion by Commissioner LaPorte and seconded by Commissioner Bettison the Commission unanimously agreed to support Resolution X69 -1977. Mr. Tom Petillo, Manager of Florida Power and Light Company presented a plaque to the Commission in observance of Florida Power and Light's 50th anniversary and stated their appreciation of Gulf Stream's continous service since 1926. A letter from Florida Power and Light was read to the Commission in regard to upgrading the existing 2500 lumen mercury lights to 45 lumen mercury lights. Mayor Koch instructed the manager to include this change in the 1977 -'78 budget. Upon motion by Mr. Bettison and seconded by Mrs. LaPorte Resolution #77 -2 was unanimously accepted by the Commission. RESOLUTION #77 -2 A RESOLUTION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA ASSESSING AN ADDITIONAL METER CHARGE ON THE JUNE 30th BILLING IN THE AMOUNT OF $20.00 PER METER IN ORDER TO ALLOW THE TOWN WATER DEPARTMENT TO RECOUP UNEXPECTED EMERGENCY COST FOR OBTAINING WATER FOR THE TOWN OF GULF STREAM FROM THE CITY OF DELRAY BEACH. After a careful review of drainage plans submitted to the Commission by DeMarco & Son's for homes to be built on Old School Road and Polo Drive, Mayor Koch instructed new on -site drainage plans for Lot 12 Polo Drive and a letter to accompany plans should drainage be insuffient making it their responsibility to correct problem by connecting into the cove thru the existing easement, also,plans presented for Old School Road were unexceptable. -3- COMMISSION MEETING JUNE 10, 1977 Cont. Commissioner Bettison gave a report on his findings regarding the recent police study made by Northwestern University. He stated that each of the salaries in the report were essentially correct with the exception of Gulf Stream. Figures in this report for Gulf Stream were based on the previous year's pay scale and he noted that it is impossible to get a correct comparison based on this outdated data and also for other reasons such as duties etc. Commissioner Bettison reported on the Co- operative Dispatch Center's progress. He informed the Commission that a temporary Board of Directors were installed and of their acceptance of low bid from Motorola for Center's equipment to be funded by a federal grant. He also stated that it is unclear at this time what participation in this Center will cost Gulf Stream and suggested $3,000 be con- sidered when working on the 1977 -'78 budget. Ron Oprzadek gave a report on Gulf Stream's Lethal Yellowing Program. After a survey of the Town and finding several trees infected he suggested a reputable tree removal service be contacted to remove trees within a ten day period. Mayor Koch so instructed the Deputy Town Clerk. The Auditors comment letter and Town Managers reply letter were read to the Commission as required by Florida Statutes. These letters are part of the Minutes. Mayor Koch instructed the Deputy Town Clerk to discourage all unauthorized solicitation in Town. Meeting adjourned 10:20 A.M. WALKER VICE MAYOR JOAN S. LAPORTE COMMISSIONER Also attending: Manager, William Gwynn, Deputy Town Clerk, Barbara Gwynn Police Chief, William McQuade and Larry M. Ball, Chairman of Planning and Zoning. The Meeting was called to order at 9:10 A.M. by Mayor Koch. Mayor Koch gave an up to date report on recent meetings he has had with Delray Beach City Manager Eldon Mariott concerning cost to participate in the Co- operative Dispatch Center. Mayor Koch reported that Mr. Odam from Odam Tank Company was in his office and explained the condition of water tank and advised Mayor Koch that he will send his crew in to paint tower inside and out and do all necessary repairs as per agreement with Gulf Stream Golf Club. Upon motion by Mr. Whittemore seconded by Mr. Bettison a request to change a 40' right -of -way to a 20' right -of -way on Spence property was unanimously denied by the Commission. Due to ever increasing number of dead and dying trees in Gulf Stream caused by Lethal Yellowing Disease the Commission agreed to hire a competent man to co- ordinate a tree removal program, cost of this program to be discussed at a special meeting July 7th. FLORIDA 33444 Mayor and Town Commission Town of Gulf Stream Gulf Stream, Florida Gentlemen: TELEPHONE 1305127 &3214 May 18, 1977 Member of The American Institute of Certified Public Accountants It is my policy and in accordance with an Act of the Legislature of the State of Florida to submit my comments on the operation of the Town for the year ended September 30, 1976 to the Governing Body of the Municipality upon the completion of an audit of their books and records. My comments are submitted for information purposes and reflect certain com- parisons which are not contained in the Audit Report. My examination of the books and records revealed that the proper corrective action has been taken on the certain deficiencies reported last year, and that no other material deficiencies were uncovered this year. In accordance with Chapter 10.500 of the Rules of the State Auditor General, the Town Manager is required to file with the Governing Body of the Munici- pality and with the State Auditor General, within twenty days of the receipt of this report, a written statement of explanation or rebuttal concerning the auditors comments, including corrective action to be taken, if necessary. Ward rnMMRNTR The Town's accounting records for General Government operations are maintained on a modified accrual basis with the most important revenues being recorded when earned and expenditures being recorded when incurred. Accounting records for the Water Distribution Fund are maintained on an accrual basis. GENERAL FUND Revenues for General Government functions totaled $ 207,266 for the fiscal year ended September 30, 1976, an increase of 20.068 over the previous year. Actual collections for General Government exceeded the estimated revenues by $ 15,284. General property taxes produced 61.788 of General Government revenues compared to 59.088 for the previous year. CThe investments were for various periods of time depending on the requirements of the available cash. The interest earned from these investments amounted to $ 1,987. The expenditures for the General Fund operations amounted to $ 206,262 for the fiscal year, an increase of 8.948 over the preceding year. The expenditures for the major functions of the Town are shown in the following tabulation: General and Administrative functions accounted for 19.288 of the General Fund expenditures, an increase of 34.028 over the previous year. Public Safety, which includes the Police Department and Fire Protection, accounted for 55.178 of the General Fund expenditures as compared to 58.998 for the preceding fiscal year. Expenditures for Street and Easements represented 2.838 of the General Fund expenditures, a decrease of 52.858 from the previous year. Sanitation Department accounted for 22.728 of the expenditures as compared to 18.798 for the prior year. FEDERAL REVENUE SHARING FUND During the year, the Town received total revenue of $ 10,845 which represented revenue sharing proceeds. Total expenditures for the year were $ 6,450 which were spent for Financial Administration and Public Works. At year end, the Town had $ 450 of appropriated fund balance for approved projects and $7,501 of unappropriated fund balance to be budgeted in subsequent periods. These assets have been recorded on the books at cost and bear no relation to the actual value of the assets. O x F' d d Ph cn O R M A O 9 r m z H m m A s ORDINANCE NO. 77_4 AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF THE TOWN OF GULF STREAM, FLORIDA; ESTABLISHING THE SAME; PROVIDING FOR THE REPEAL OF CERTAIN ORDI- NANCES NOT INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ORDINANCES, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA: Section 1. That this ordinance consisting of Chapters 1 through 10, inclusive, is hereby adopted and enacted as the "Code of Ordinances of the Town of Gulf Stream, Florida," shall be treated and considered as a new and original comprehensive ordinance which shall supersede all other general and permanent ordinances passed by the Town Commission on or before March 12, 1976, except such as by reference thereto are expressly saved from repeal or continued in force and effect for any purpose. Section 2. That all provisions of such Code shall be in full force and effect from and after 197 , and all ordinances of general and permanent nature of the Town of Gulf Stream, enacted on final passage on or before March 12, 1976, and not in such Code or recognized and continued in force by reference therein are hereby repealed from and after the effective date of such Code, except as hereinafter provided. Section 3. That the repeal provided for in Section 2 hereof shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of such Code; nor shall such repeal affect any of the following: (a) Any ordinance or resolution promising or guaranteeing the payment of money for the Town, or authorizing the issuance of any bonds of the Town or any evidence of the Town's indebtedness, or any contract or obligation assumed by the Town; (b) Any administrative ordinances or resolutions of the Town not in conflict or inconsistent with the provisions of such Code; (c) Any right or franchise granted by any ordinance of the Town; (d) Any ordinance dedicating, naming, establishing, locating, reloacting, opening, paving, widening, vacating, etc., any street or public way in the Town; (e) Any appropriation ordinances; (f) Any ordinances levying or imposing taxes; (g) Any zoning ordinance or any amendment thereto; (h) Any ordinance establishing or prescribing grades in the Town; (i) Any ordinance providing for local improvements and making assessments therefor; (j) Any subdivision ordinance or amendment thereto; (k) Any ordinance extending or contracting the boundaries of the Town; (1) Any ordinance establishing the boundaries of any wards in the Town; (m) Any ordinance regulating or restricting traffic or parking on particular streets or in particular places; (n) Such repeal shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance. Section 4. That any and all additions or amendments to such Code, when passed in such form as to indicate the intention of the Town to make the same a part thereof, shall be deemed to be incorporated in such Code so that reference to the "Code of Ordinances of the Town of Gulf Stream, Florida" shall be understood and intended to include such additions and amendments. Section 5. That a copy of such Code shall be kept on file in the office of the Town Clerk, preserved in looseleaf i form. It shall be the express duty of the Town Clerk or i someone authorized by him to insert in their designated places Y II all amendments or ordinances which indicate the intention of i the Town Commission to make the same a part of such Code when the same have been printed or reprinted in page form, and to extract from such Code all provisions which may from time to time be repealed by the Town Commission. This copy of such Code shall be available for all person desiring to examine the same and shall be considered the official Code of Ordinances of the Town of Gulf Stream. Section 6. Whenever in said Code or in any ordinance of the Town or any act is prohibited or is made or declared to be unlawful or a misdemeanor, or whenever in such Code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such Provision of this Code or any ordinance shall be punished by a fine of not more than one hundred dollars ($100.00) or by imprisonment not to exceed one (1) month, or the discretion of the court. Each day any violation of any provisions of this Code or of any ordinance shall continue shall constitute a separate offense. Section 7. That in case of the amendment of any section of such Code for which a penalty is not provided, the general penalty as provided in Section 1 -8 of such Code shall apply to the section as amended or in case such amendment contains provisions for which a penalty, other than the afore- mentioned general penalty, is provided in another section in the same chapter, the penalty so provided in such other section shall be held to relate to the section so amended, unless such penalty is specifically repealed therein. Section S. That it shall be unlawful for any person, firm or corporation in the Town to change or amend by additions or deletions, any part or portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper With such Code in any manner whatsoever which will cause the law of the Town of Gulf Stream to be misrepresented thereby. Any person, firm or corporation violating this section shall be punished as provided in Section 6 of this ordinance and Section 1 -8 of the Code of Ordinances of the Town of Gulf Stream, Florida. Section 9. That all ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section 10. WHEREAS, the Water Department of the Town of Gulfstream, Florida, has incurred costs in the approximate amount of Five Thousand, One Hundred Dollars ($5,100.00) due to an emergency requirement to obtain water for residents of the Town of Gulfstream from the Town of Delray Beach, and WHEREAS, those additional costs are the responsibility of those persons receiving water from the Town of Gulfstream Water Department.
