HomeMy Public PortalAbout2024-023 Resolution Authorizing a Memorandum of Understanding with SCEMA to Store and Maintain a Pump for use in Flood EventsAnthony Heddlesten, Mayor RESOLUTION 2024-023 Resolution Authorizing a Memorandum of Understanding with Scott County Emergency Management Agency to Store and Maintain a 4" Pump for Use in Flood Events WHEREAS, in years past, the City of Riverdale, Iowa (hereinafter referred to as "City"), has been loaned pump equipment by the Scott County Emergency Management Agency (hereinafter referred to as "SCEMA"), for use during flood events; and, WHEREAS, it would be beneficial to the City to have a pump on -hand to utilize as needed during flood events; and, WHEREAS, the State of Iowa has transferred possession of a new, 4", Godwin, portable, gas -powered pump, Model No. GTP-100HX, to SCEMA, and SCEMA is willing to transfer possession of said pump to the City; and, WHEREAS, it will be the City's responsibility to test and maintain the pump as per the schedule outlined in the Memorandum of Understanding; and, WHEREAS, while staff time and nominal maintenance supplies will be required, no overarching funding source is required for this action. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Riverdale, Iowa, that: Section 1. The Mayor is authorized to execute the Memorandum of Understanding for Use of Portable 4" State Pump with the Scott County Emergency Management Agency. Section 2. The Public Works Operations Manager is directed to use and maintain the pump as per the directives outlined in the Memorandum of Understanding. ATTEST: I�uG�, IMF Kelly Krell it1, Clerk/Treasurer City of Riverdale, Iowa 110 Manor Drive, Riverdale, Iowa 52722 (563) 3552511 www.riverdaleia.org MEMORANDUM OF UNDERSTANDING FOR USE OF PORTABLE 4" STATE PUMP THIS AGREEMENT is made and entered into on the date when fully executed as shown below, by and between the Scott County Emergency Management Agency and the City of Riverdale. I. Purpose. This Memorandum of Understanding for the prepositioning of State of Iowa Equipment that was positioned with Scott County Emergency Management Agency, sets out the respective rights and responsibilities regarding the ownerships, use, storage, maintenance, and legal responsibility for the equipment that is described in Section II of this document. II. The Equipment. Possession of the following equipment, hereinafter collectively referred to as the pump, is hereby transferred from HSEMD to the County EMA and being repositioned to the City of Riverdale, pursuant to the terms and conditions set forth in this agreement: ■ Godwin 4" portable gas -powered pump ■ Model No: GTP-100HX ■ Unit number: 434 ■ State Tag #: 4072 ■ Serial #: 190201023 ■ Included Operational Equipment • 1 Roll of 15' suction w/camlock fittings and small strainer • 2 rolls of 50' discharge w/camlock fittings III. General Understanding and Agreements. The County EMA and City agree to the following general terms and conditions: A. The pump is owned by the State of Iowa and on behalf of the State of Iowa HSEMD transfers possession of the pump to the County for the sole purposes set forth in this agreement. B. The County in possession of the pump has repositioned the pump to the City for prepositioning for local flooding operations. The City is agreeing to this MOU and replaces the Scott County Emergency Management Agency as the responsible party. C. When not in use, the pump will be at the following location: 110 Manor Drive, Riverdale, Iowa 52722 The City cannot transfer this pump or MOU to another City. At any time the City wishes to return the pump, it will be returned to Scott County Emergency Management Agency in good working condition. The City shall have physical possession and operational control of the pump. The Scott County Emergency Management Coordinator shall have the authority to deploy the pump for uses at other locations under the terms of this agreement, and any agreement with the State of Iowa, as it deems necessary, should the City not have otherwise deployed the pump. The City shall shall maintain written records of all deployments of the pump under this agreement, including the location deployed to, the length of time deployed at that location, and the purpose of the deployment and shall take steps to ensure that the pump is properly maintained. D. Should HSEMD require the use of the pump, HSEMD will notify the Scott County EMA, who will notify City Leadership of the same and the City shall relinquish physical possession and control of the pump to Scott County EMA, who can return it to HSEMD or its authorized agent. Once possession of the pump has been transferred, the City and County EMA shall have no further responsibility in respect to the pump. E. Scott County EMA and HSEMD reserves the right to access to the pump at any time. Access to the pump will be coordinated with the City Leadership and will be coordinated in a manner so as not to cause undue hardship or inconvenience to either party. E. Before deploying the pump and allowing it to be used by another person or entity, the County EMA requires approval before allowing the person or entity taking possession of the pump. IV. Specific Duties of the Parties. The parties agree to the following duties in respect to the pump: A. County EMA agrees: 1. To provide the pump for use to the City in accordance with the terms and provisions set forth in this agreement. 2. To notify the City at the earliest indication that County EMA or HSEMD will require the pump for some other purpose. 3. To coordinate with the City when the County EMA or HSEMD requires access to or use of the pump for some other purpose. County EMA or HSEMD will coordinate in such a manner so as not to provide undue hardship or inconvenience to the City. 4. That the pump that is the subject of this agreement is in good operating condition at the time possession is transferred to the City. B. The City agrees: 1. To keep and maintain the pump at its own cost and in a good state of repair, normal wear and tear excepted. 2. To pay HSEMD the fair market replacement value for the pump if it is lost or stolen while in the City's Possession. 3. The City will not have the authority to deploy this pump to another user without Scott County EMA's approval. 4. To safely store, operate, and maintain the pump while under its control by the City in such a manner that will ensure the safety of others and to ensure that the pump remains capable of operating at full capacity, including the following: a. Completing preventative maintenance on the equipment to ensure it's ready for immediate deployment. This may include but not limited to oil changes, replacing fuel or fuel filters, etc. b. Exercising the pump at least once per quarter. c. The City shall take steps to ensure that a professional and properly trained person is operating the pump. 5. To indemnify and hold harmless Scott County EMA and HSEMD and/or the State of Iowa against any and all claims asserted by others against the listed agencies while the pump is in the possession of and under the control of the County EMA or the possession and control of others to whom the County has deployed the pump. V. Expiration Date. This Memorandum of Understanding has no expiration date and shall remain in effect until such time as either party agrees to terminate it. VI. Modification or Termination. This agreement may be modified only upon the written consent of each party. Either party may terminate this agreement by providing a thirty -day written notice of termination to the other party. Upon termination of this agreement, Scott County EMA assumes full control of the pump and the City shall take reasonable steps to facilitate the transfer of possession to Scott County EMA. IN WITNESS WHEREOF and in consideration of the mutual covenants set forth above, the Scott County Emergency Management Agency and the City of Riverdale execute this agreement by signing their names below, effective upon the date set forth.
