WHITTEMORE COMMISSIONER ABSENT: LINDLEY S. BETTISON COMMISSIONER Also attending: Attorney John Randolph, Manager, William E. Gwynn, Deputy Town Clerk, Barbara Gwynn, Police Chief, William McQuade and Chairman of the Planning and Zoning Board, Larry M. Ball. The Meeting was called to order by Mayor Koch at 9 A.M. Upon motion by Mr. Walker and seconded by Mrs. LaPorte the Commission approved the Minutes of the Regular Meeting July 15th and Special Commission Meeting July 26th, 1977. Financial Report for the month of July and August was submitted and accepted by the Commission. ORDINANCE NO. 77 -3 AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA; REQUIRING FINAL GRADING PLAN OR DRAINAGE PLAN TO ACCOMPANY BUILDING PERMIT APPLICATIONS TO ASSURE THAT ADJOINING PROPERTIES WILL NOT BE ADVERSELY AFFECTED; PROVIDING PENALTIES FOR FAILURE TO MAINTAIN DRAINAGE IMPROVEMENTS; PROVIDING FOR REPEAL OF ANY ORDINANCE OR PART OF SAME IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. -2- Commission Meeting, September 9, 1977 Cont. The Town Manager read the proposed Cooperative Dispatch Center Agreement Contract, then Attorney Randolph read the changes he felt should be made to this contract. After a general discussion, Mr. Walker moved that this contract be approved with these changes, Mr. Whittemore seconded the mo- tion, motion was unanimously accepted. After a general discussion Mrs. LaPorte made a motion that the 1977 -78 proposed budget and millage be accepted as presented. Mr. Walker se- conded the motion, motion was unanimously accepted. It was also announced that there will be a hearing on the proposed budget and millage September 21st and 28th at 5 P.M. at the Town Hall. These meetings are to give the public an opportunity to examine the budget and voice their opinion re- garding the said budget and especially how the Town will spend the antici- pated Federal Revenue Sharing Funds and Anti - Recession Fiscal Assistance Funds for the coming year. Mr. John Klink from Russell & Axon gave an up to date report on the water System Project stating that at this time 36% of the job is completed. Permission was granted by the Commission to proceed with the removal of diseased coconut trees after notification to the following residents by phone. F. E. Burke, Paul Layman, J. D. Danforth and Ralph Trix. The Town Clerk was instructed to notify Mr. Jerry B. Frocht, Executive Director of the Charter Advisory Council their desire to have him appear before the Commission to discuss the County Charter Effort. A letter from the Town of South Palm Beach was read requesting the Town Commission's consideration in the development of a joint public safety agency to provide police and fire protection for the following towns. Briny Breezes, Manalapan, Ocean Ridge, South Palm Beach and Gulf Stream. The Town Commission instructed the Town Clerk to notify South Palm Beach that they would strongly object to such a merger. On motion by Mrs. LaPorte, seconded by Mr. Whittemore Ordinance 77 4 was unanimously accepted by the Commission on first reading. ORDINANCE 77 -4 AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF THE TOWN OF GULF STREAM, FLORIDA, ESTABLISHING THE SAME; PRO- VIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ORDINANCES, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. -3- Commission Meeting, September 9, 1977 Cont. The Town Clerk was instructed to write a letter to the A -95 Coordinator, Area Planning Board of Palm Beach County voicing objection to the Florida Department of Environmental Regulation's request for Coastal Zone Management Development Program Supplemental Grant, the Town felt that this was a dupli- cation of effort and a waste of money on part of the State. Gwynn, Town Manger, Barbara Gwynn, Deputy Town Clerk. The Special Advertised Meeting on the proposed budget and millage was called to order at 5:01 P.M. by Mayor Koch. Town Manager Gwynn announced that another Special Advertised Meeting will be held September 28, 1977 and the millage and budget will then be adopted. Mayor Koch stated that the proposed millage based on the assessed valuation of the Town of Gulf Stream as given to the Town by the Tax Assessor is $38,814,381.00 and for this proposed budget it would require a 4.26 millage. This is a decrease of .03 mills under last year. The total budget for the fiscal year 1977 - 1978 would be $264,765.00. Meeting adjourned 5:15 P.M. k�� K Deputy Town Cledc ORDINANCE NO. 77_3 AN ORDINANCE OF THE TOWN OF GULFSTREAM, FLORIDA; REQUIRING FINAL GRADING PLAN OR DRAINAGE PLAN TO ACCOMPANY BUILDING PERMIT APPLICATIONS TO ASSURE THAT ADJOINING PROPERTIES WILL NOT BE ADVERSELY AFFECTED; PROVIDING PENALTIES FOR FAILURE TO MAINTAIN DRAINAGE IMPROVEMENTS; PROVIDING FOR REPEAL OF ANY ORDINANCE OR PART OF SAME IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, The Town Council of the Town of Gulfstream, Florida, has determined that it is in the best interest of the health, safety and welfare of the community to assure properties within the Town protection from rainfall drainage discharge. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF GULFSTREAM, FLORIDA: Section 1. DEFINITION. "One -inch rainfall" shall mean the first one -inch of rain waters which fall on the proposed building site. Section 2. AREA WITH EXISTING DRAINAGE SYSTEMS. In any area of the Town where Town - approved positive drainage systems exist, the following shall be required: All permit applications for any new buildings, and all modifications, alterations or additions to any such buildings whict alter the existing drainage flow, shall be accompanied by a Final Grading Plan prepared, signed and sealed by a Florida registered engineer or architect showing the proposed site plan with flow arrows indicating the final direction of flow of rain waters to the existing drainage system. Section 3. AREA WITH NO EXISTING DRAINAGE SYSTEM. In any area of the Town where no Town- approved positive drainage system exists, the following shall be required: All permit applications for new buildings, and all modifications, alterations or additions to any such buildings which alter the existing drainage flow, shall be accompanied by a Drainage Plan prepared, signed and sealed by a Florida registered engineer or architect which will provide for adequate drainage on the site or within swale areas on adjacent and contiguous public rights -of -way to retain all run -off from the first one -inch rainfall and to drain the additional rainfall above one inch so that adjoining privately -owned properties will not be adversely affected. When swales within public rights -of -way are utilized for retention, the Swale shall be of adequate capacity to retain the run -off from a one -inch rainfall on the right -of -way and the adjacent and contiguous sites. Section 4. DESIGN CRITERIA. The following basic design criteria shall be used in the development of all drainage plans. The design computations shall be shown on or attached to and made a part of the drainage plan submitted with the application for a building permit. (a) Total proposed impervious and pervious lot area will be indicated. (b) Run -off coefficient for impervious and pervious areas are to be used to determine total run -off to be contained from the one -inch rainfall. (c) The volume of computed run -off from a one -inch rainfall will be controlled by means including, but not limited to, the use of holding ponds, swales, or drainage structures. Section 5. CERTIFICATE OF OCCUPANCY. No certificate of occupancy shall be issued until a final inspection has been made to assure compliance with the approved grading or drainage plan filed with the building permit documents. Section 6. PENALTY. Property owners shall maintain required &ainage improve- ments on their property in compliance with the approved grading or drainage plan. Failure to maintain drainage improvements shall be deemed a public nuisance and a violation of this section, and shall be punishablelto the full extent provided by law. Each day in which a property owner fails to maintain said improvements shall be a separate violation. Section 7. INCONSISTENT ORDINANCES. All ordinances or parts of ordinances inconsistent with :his Ordinance are hereby repealed to the extent of such inconsis- tencies. Section 8. SEVERABILITY. If any article, section, sub - section or phrase of this Ordinance is for any reason declared invalid or unconstitutional by a court of competent jurisdiction, such decision shall not hffe( the validity of the remaining portions of this Ordinance. WHEREAS, The Town Council of the Town of Gulfstream, Florida, has determined that it is in the best interest of the health, safety and welfare of the community to assure properties within the Town protection from rainfall drainage discharge. In any area of the Town where Town- approved positive drainage systems exist, the following shall be required: All permit applications for any new buildings, and all modifications, alterations or additions to any such buildings which alter the existing drainage flow, shall be accompanied by a Final Grading Plan prepared, signed and sealed by a Florida registered engineer or architect showing the proposed site plan with flow arrows indicating the final direction of flow of rain waters to the existing drainage system. Section 3. AREA WITH NO EXISTING DRAINAGE SYSTEM. In any area of the Town where no Town- approved positive drainage system exists, the following shall be required: All permit applications for new buildings, and all modifications, alterations or additions to any such buildings which alter the existing drainage flow, shall be accompanied by a Drainage Plan prepared, signed and sealed by a Florida registered engineer or architect which will provide for adequate drainage on the site or within swale areas on adjacent and contiguous public rights -of -way to retain all run -off from the first one -inch rainfall and to drain the additional rainfall above one inch so that adjoining privately -owned properties will not be adversely affected.
