W I T N E S S E T H: WHEREAS, the city and County are desirous of providing by agreement for mutual aid in the case of a disaster between the two governmental entities, said mutual aid being authorized under Chapter 252, Florida Statutes; and WHEREAS, the two entities recognize the need for coopera- tion in the time of disasters that affect both the County and the municipal corporation. NOW, THEREFORE, it is mutually agreed by the parties her 'to that: 1. In the event of the declaration by the President of the United States, the Governor of the State of Florida, or the governing body of a local entity, that a state of emergency exists within the boundaries of the municipality or County as authorized by Chapter 252 of the Florida Statutes, it should be the duty of the city and /or County to. render assistance to the other in accor- dance with the provisions hereof in a manner consistent with the ,State Emergency Operations Plan and program. 2. Upon the declaration of a state of emergency within I 'the municipality or County covered by this agreement, the Palm Beach County Civil Defense Director shall notify the governing body of the respective entity of such a declaration and be responsible for coordinating any activities connected with such declaration. 3. Upon receipt of such notification the Chief Operating Officer of the municipality and County shall request an immediate I emergency meeting of their respective governing bodies for the pur -. pose of assigning and making available to Palm Beach County for pur- poses of effectuating this agreement, all the departments, agencies i and services of the governmental entity, including, without limiting I'the generality of the foregoing, employees,'property, equipment and ! all other resources administered by the respective governing body. The Civil Defense Director of Palm Beach County shall recommend to the County Commission the disposition to be made of all resources so mobilized after taking into account the needs of all the partie to and the State Emergency Operations Plan and program. 4. When the employees of the govermental entity are rendering outside aid pursuant to this agreement, such employees shall have the same powers, duties, rights, privileges and immuni- ties as if they were performing their duties within the territoria daries of the governmental entity in which they are normally !employed. 5. The municipality or County in which any equipment is Fused pursuant to this agreement shall be liable for any loss or I;damage thereto and shall pay any expense incurred in the operation :and maintenance thereof: No claim for such loss, damage or expense! l; shall be allowed unless, within sixty (60) days after the same is i !,sustained or incurred, an itemized notice of such claim, under oath!, !is served, by mail or otherwise, upon the chief.frscal officer of i i the other party to this agreement where the equipment was used. The entity which is aided, pursuant to this section, shall also pay and reimburse the other party furnishing such aid for the compensa -'. i tion paid to employees, furnished under this agreement during the j I time of the rendition of such aid, and shall defray the actual i traveling and maintenance expense of such employees while they are :rendering such aid. Such reimbursement shall include any amounts it ;paid or due for compensation due to personal injury or death while ;such employees are engaged in rendering such aid. The term "em- ployee" as used in this agreement shall mean, and the provisions of I !this agreement shall apply with equal effect to, paid, volunteer, !auxiliary, or Civil Defense workers, specifically authorized and j !directed by the entity furnishing such aid to assist the other part' !which is aided. 6. All employees, shall, while on duty outside the govern mental entity in which they are normally employed, be subject to operational control of the authority in charge of Civil Defense activities in the area in which they are serving. 7. Traffic control within each governmental entity shal be controlled by the authority in charge within that entity and each entity will execute plans and regulations for the control of traffic to provide for the safe and rapid movement or evacuation over public highways, of people, troops or vehicles and materials in case of an emergency. 8. It shall be the responsibility of each governmental entity, a party hereto, to make available to the Civil Defense Director or other authorized person of the other entity, its tural Disaster Plan plus the following appendices: Damage Team, Civil Disturbances, Evacuation Plan and Transportation Acci- dents. 9. This agreement shall at all times be subordinate to -the authority of the Division of Disaster Preparedness to make available any equipment, services or facilities owned by the Coun as granted by Chapter 252, Florida Statutes, and to plans of the Federal Government and the State of Florida acting through the IiDivision of Disaster Preparedness. ! R -78- 266 RESOLUTION APPROVING MUTUAL AID AGREEMENTS BETWEEN PALM BEACH COUNTY AND VARIOUS MUNI- CIPALITIES WITHIN PALM BEACH COUNTY. WHEREAS, in order to be eligible for Federal disaster financial assistance in time of a natural or man -made disaster, it is necessary for local governments such as municipalities and counties to complete an accurate documentation of expenses incurred ;by the local government before, during and after a disaster and ;present those records to the Federal government in order to be ! �leligible for financial assistance; and I� WHEREAS, in addition to the above requirements, it is :I !necessary for all governmental entities within a defined geographi- kcal area such as a county boundary to coordinate their efforts on i mutual aid basis so that when a Federal team reviews the assistance 'program with local governments these costs can be readily deter- mined as allocated between the various governmental entities when the disaster occurred within any one single or combination of governmental entities; and WHEREAS, the various municipalities within Palm Beach County and Palm Beach County itself are desirous of providing by agreement for mutual aid in the case of a disaster between the two !;governmental entities, said mutual aid being authorized under i Chapter 252, Florida Statutes; and i i WHEREAS, under the terms of the agreement after a declara- tion of emergency either by the President of the United States or 'the Governor of the State of Florida or the governing body of a local entity it shall be the duty of the city and /or county to ren -, der assistance to the other in accordance with the provisions of i' the State Emergency Operations Plan and Program; and i WHEREAS, the municipality or county in which equipment j; and /or manpower may be used pursuant to the terms of the agreement shall be liable for any loss or damage thereto and shall pay any li iiexpense incurred in the operation and maintenance thereof so long I ias the claim for damage is within sixty (60) days after the same is' !:sustained or incurred, this item being eligible item for reimburse -I ' !ment under the Federal financial assistance program. Cessna, Director of Utilities, to Mr. Frank Kohl, City Manager of Boynton Beach, subject: "Place Au Soleil Turnover to the Town of Gulf Stream," which included a summary of materials in -place in the Place Au Soleil Water System, and a state- ment of unit prices therefor. We do not believe it would be necessary to conduct an actual on -site survey to verify the existence of the listed parts and equipment be- cause, (1) indicated quantities are consistent with service require- ments for the number of customers within that system, and (2) it would be reasonable to assume that all of the listed parts and equip- ment are in operational condition. The unit prices quoted represent typical costs of such parts and equip- ment when purchased in bulk, as would be the normal practice of the City of Boynton Beach, and do not include administrative and handling costs for putting such items "on the shelf ", nor the further expenses for labor of installation, maintenance, etc., which could represent from 50% to 100% above the stated unit prices. Since Mr. Cessna's memorandum of September 29, and the accompanying price list ($9,701.28 total) actually constitute a City of Boynton Beach in -house communication, and are not an offer to sell, we assume that an offer to buy would be in order at this time. 167 N. The City of Boynton Beach has collected revenue from the system for some ten years and is now in the position of disposing of a source of future revenue which would require no major capital outlay. There is no "compensation" in- cluded in the estimated costs. 2. The Town of Gulf Stream acquires the Water System as per the original Owner's Contract -- at no cost, except for the City's facilities -- which were not included in the original developer's contract. The Town thereby acquires all future revenues at a minimal cost. 3.
