Mayor Gilbertson called the regular meeting of the City Council to order at 7:40 p.m. 2. The invocation was given by the Reverend James Thomann, First.United Methodist Church, 5957 Golden West, Temple City: I3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson. 4. ROLL CALL: 1 1 PRESENT: Councilmen - Harker, Merritt, Tyrell, Gilbertson ABSENT: Councilmen- Briggs ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning Director Dragicevich,-Civil Engineering Assistant Linares, Assistant Fire Chief Dean Russell Councilman Merritt moved to excuse Councilman Briggs'. absence for cause, seconded by. Councilman Harker, and carried. 5. APPROVAL OF MINUTES: Councilman Merritt moved to approve the minutes e4 the regular meeting !held July 6, 1971.,'.as mailed:; secondedby Councilman Harker and carried. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. Re. ORDINANCE NO. 71 -330 - 2nd read. Re. Amending Ordinance No. 69-291 (Fire Code) by adopting by reference County Ordinance No. 10,251. City Manager Koski advised that Notices for Public Hearing had been published as required to hold hearing for the purpose of adopting by reference County Ordinance No. 10,251, amending the Fire Code. Assistant Chief Dean Russell reported that the amendment was primarily to define mobile homes as structures and to provide restrictions for open fires in areas within 500' of of native brush covered land. Mayor Gilbertson declared the Public Hearing open and invited those present who wished to speak for or against the matter to come forward. No one wished to speak. Councilman Merritt moved to close the public hearing, seconded by Councilman Harker and carried. Following discussion, particularly as the ordinance might pertain to restriction of outdoor. barbecues, Councilman Merritt moved to waive further reading and adopt. Councilman' Tyrell seconded the motion, however he stated that he felt the ordinance had poor construction. There was no opposition and the motion carried. 7 ORDINANCE NO. 71 -332: 2nd read. Re. Amendment to Municipal Code Relating to Personnel. City. Attorney Martin presented Ordinance No. 71 -332, entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 2371, 2368 and 2702 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO PERSONNEL for second reading by title only. Councilman Harker moved to waive further reading and adopt, seconded by Councilman Tyrell and carried. 8. ORDINANCE NO. 71 -333: 2nd read. Re. Creating and Establishing a Community Redevelopment Agency. City Attorney Martin presented Ordinance No. 71 -333 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY CREATING AND ESTABLISHING A. COMMUNITY REDEVELOPMENT AGENCY, for second reading by title only. Councilman Harker moved to waive further reading and adopt, seconded by Councilman Merritt and carried. Council Minutes, July 20, 1971 - Pag e 2 9. ORDINANCE NO. 71 -334: 1st read. Re. Amendment to Municipal Code Regarding Outdoor Advertising Structures, City Attorney Martin advised that in accordance with the instruction of the Council, Ordinance No. 71 -334 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9202 AND 9273, OR THE TEMPLE CITY MUNICIPAL CODE RELATING TO OUTDOOR ADVERTISING STRUCTURES, had been prepared and was presented for first reading by title only. Councilman Harker moved to waive further reading, and to refer back to Planning for review, seconded by Councilman Merritt and carried. Affirmation of acceptability of the ordinance as written was given by Jay Kingry, representative of Pacific Outdoor Advertising Co., and John Glyn, representative of Foster & Kleiser, who were present in the audience. NEW BUSINESS: 10. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of July 13 1971. A. PROPOSED C -1 RETAIL COMMERCIAL ZONE: City Manager Koski advised that the proposed C -1 Retail Commercial Zone consisted of two parts (a) establishment of C -1 zone with a list of permitted uses, and (b) a change of zone from C -2, General Commercial, to C -1 Retail Commercial for properties generally fronting on Las Tunas Drive, as more fully set forth by property description contained in Resolution No. 71- 420PC, and that the Planning Commission had adopted Resolution No. 71- 420PC, recommending the amendment to the Municipal Code. He advised that zoning was presently restricted by Interim Ordinance No. 71 -322 until April 20, 1972. . Councilman Tyre l l moved to set for Public Hearing for September 7, 1971, at 7:30 p.m., seconded by Mayor Gilbertson and carried. B. ESTABLISHMENT OF ZONING MODIFICATION COMMITTEE - ORDINANCE NO. 71 -335 - 1st read. City Attorney Martin presented Ordinance No. 71 -335 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW PART IIIA TO ARTICLE IX OF THE TEMPLE CITY MUNICIPAL CODE ESTABLISHING A ZONING MODIFICATION COMMITTEE, which had been drawn as a result of previous consideration by the Council in joint session with the Planning Commission, for first reading by title only. Councilman Merritt moved to waive further reading, seconded by Councilman Harker and carried. 11. RECOMMENDATIONS FROM TRAFFIC COMMISSION — Meeting of July 7, 1971: A. "SHARE -THE- RIDE" PROGRAM. City Manager Koski advised that the Traffic Commission recommended implementation of a share - the -ride program wherein a City staff member would serve as coordinator. A report from the City. Attorney's Office was received, advising that no legal liabilities could be foreseen in the establishment of a central bureau to provide residents with car pool information so long as there was no involvement in providing drivers and /or automobiles. Councilman Harker moved to approve, and to instruct staff to carry out the City's part in the program as outlined, on a trial basis, 1) to see if it does entail expense, and 2) to see if participation is worthwhile and justifies the effort. The motion was seconded by Councilman Merritt and carried. Council. Minutes, July 20, 1971 - Page 3 B. LAS TUNAS DRIVE - SIGNAL MODIFICATION. City Manager Koski advised that the Traffic Commission recommended that signals on Las Tunas Drive at Sultana, Loma, Alessandro, Cloverly, Primrose, Camellia and Kauffman Avenues be placed on full operation until 10 p.m. to provide uniformity of full operation of al 1 signals on Las Tunas Drive through the evening-, hours. Following discussion it was moved by Councilman Merritt to approve the recommendation as outlined, seconded by Mayor Gilbertson. ROSEMEAD BOULEVARD, SOUTH OF LONGDEN - PARKING RESTRICTIONS. City Manager Koski advised that the Traffic Commission recommended removal of two -hour parking restrictions on Rosemead Boulevard, southerly of Longden Avenue, where two business concerns are no longer in operation which had necessitated the restrictions. Councilman Merritt moved to approve, seconded by Councilman Harker and carried. 12. RECOMMENDATIONS FROM PARKING COMMISSION - Meeting of July 14, 1971 A. Reverse present posted 2 -hour parking restriction from south to north half of Lots IA and 1B, Mall 1A, P.D. #1. City Manager Koski advised that the 2 -hour parking restrictions presently in effect were posted on the portion of Lots .1A and 1B farthest from Las Tunas, and that Parking Commission recommended reversing this restriction so that the portion closest to the business area would be restricted and that those parking for longer periods could park farther back in the lot. Following discussion, it was moved by Councilman Merritt to approve, seconded by Councilman Tyrell and carried. B. Post north half of lot 8A, P.D. #2, with 2 -hour parking restriction. City Manager Koski advised that the Parking Commission recommended that both the northerly and southerly portion of this lot be posted with two -hour restriction, due to its heavy use, which would require two additional signs to be placed on lighting posts. Councilman Merritt moved to approve, seconded by Couniclman Harker, and carried. C. "Back -In Parking Prohibited'! Signs. City Manager Koski advised that due to a continuing problem in which damages have been sustained from back -in parking, The Parking Commission recommended that signs be relocated in more conspicuous places, and that new signs be placed in those lots presently not adequately posted. Councilman Tyre]] moved to approve, seconded by Mayor Gilbertson and carried. 13. ACCEPTANCE OF BID: STREET IMPROVEMENTS - EL MONTE AVENUE, LIVE OAK TO LOWER AZUSA ROAD (Cash Contract 4767X) City Manager Koski advised that sealed bids for street improvements, El Monte Avenue, Live Oak to Lower Azusa Road, had been opened on July 14, and that a recommendation had been received from the County Road Department to award the contract to Aman Bros., Covina, who was low bidder, in the amount of $116,997.54; that jurisdiction had been received from the City of Arcadia for that section of the project within the City of Arcadia, estimated costs for which were $3,872.92; and that proposed schedule to commence work was August 4, 1971, with completion by the end of October (60 working days). 1 1 Council Minutes, July 20, 1971 - Page 4 Councilman Tyrell moved to accept jurisdiction granted by the City of Arcadia; accept the low bid of Aman Brothers of Covina in the amount of $116,997.54; and request the City Attorney to prepare agreement and to authorize the Mayor and City Clerk to sign. Civil Engineering Assistant Linares advised that property owners on the east side of El Monte Avenue, between Grand Avenue and the southerly city limits, had previously opposed sidewalks in connection with the project, but that they had now changed their minds and were requesting this improvement, which could be made in conjunction with the project at less cost than at some future date. Staff was instructed to prepare cost estimates for this additional improvement, to be submitted to the Council at the next meeting. Councilman Tyrell suggested that in the future, bid offerings include a more substantial penalty phase. 14. REFUNDS FOR DEPOSITS FOR FIREWORKS STANDS: City Manager Koski advised that both the Building Department and the Fire Department have reported that all fireworks stands have been removed and cleared of debris, and that the organ- izations involved were now eligible for refunds of deposits. Councilman Tyrell moved to approve refunds for eleven depositors for Fireworks stands, as listed in memorandum dated July 16, 1971, seconded by Councilman Harker and carried. 15. RESOLUTION No. 71 -1120: Request for Allocation of County Aid -to- Cities Funds for Maintenance of Select System Streets. City Manager Koski advised that the County of Los Angeles has appropriated funds for maintenance of the City's approved select system streets in the amount of $39,276. Councilman Tyrell moved to adopt Resolution No. 71 -1120 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING AN ALLOCATION OF COUNTY AID -TO- CITIES FUNDS FOR THE MAINTENANCE OF SELECT SYSTEM STREETS, seconded by Councilman Harker and carried. 16. CATV FRANCHISE: Specifications and Advertising for Proposals. City Manager Koski advised that following adoption of Ordinance No. 71 -329 to provide for franchise of cable antenna television within the City of Temple City, specifications and instructions for submitting bid proposals had been prepared, with proposals to be submitted no later than 5 p.m. on August 31, 1971. Councilman Tyrell moved to approve the specifications and instructions as outlined in memorandum dated July 16, 1971, and presented by the City Manager, and to authorize the City Clerk to advertise for proposals, seconded by Council- man Merritt and carried. 17. RESOLUTION No. 71 -1121: WARRANTS & DEMANDS, Demand Nos. 4420 thru 4467, in the amount of $25,442.76. Councilman Tyrell moved to adopt Resolution No. 71 -1121 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $25,442.76, DEMAND NOS. 4420 THRU 4467, seconded by Councilman Harker and carried. Council Minutes, July 20, 1971 - Page 5 18. COMMUNICATIONS: A. A request from Mr. and Mrs. Michael L. Tkach, 6028 Avon Avenue, San Gabriel, was received, appealing a denial of an overnight parking permit application by the Traffic Commission. It was noted that additional information was provided in regard to the parking problem, which merited further consideration. Councilman Tyrell moved to refer back to the Traffic Commission for additional review, seconded by Councilman Harker and carried. B. Quarterly Report from April 1, through June 30, 1971, was received from the Chamber of Commerce, pursuant to terms of agreement. Matt English, Chamber Manager, was present at the meeting and provided additional information relative to new businesses within the City. 19. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: Alice Way, 6210 Temple City Boulevard, who had not been present earlier in the meeting, inquired as to the action taken on the Community Redevelopment Agency, and was advised as to the adoption of the ordinance. 20. MATTERS FROM CITY OFFICIALS: A. Councilman Merritt reported that a burglar alarm had been ringing for a long period of time on Sunday, and inquired as to the need for better service from the Sheriff's Department. Lt. Kirkpatrick of the Sheriff's Department reported on policy of the Department relative to such situations, and that the Department does investigate as to whether there has been a forceable entry, but that the property owner does not always respond or cannot always be reached to turn off the alarm. It was suggested that merchants need to be alerted as to leaving a card in their window with information on how to be reached in emergency, so that notification of such matters can be made. B. Mayor Gilbertson reported that the proposed resolution relative to City representation on District Boards, such as Fire District, etc., has passed the Resolutions Committee of the League, and would be presented to the Executive Board. C. Mayor Gilbertson presented a request from Commissioner Greenberg who serves as Treasurer of the California Association of Parks and Recreation Commissioners and Board Members for attendance at mid -year meeting to be held at Pacifica, with estimated expenses not to exceed $100. Councilman Tyrell moved to approve, seconded by Councilman Harker and carried. D. Request for Rate Increase - Community Disposal. City Manager Koski presented a request from Community Disposal Company for increase in rates, based on the Consumers' Price Index, increasing rates for single units by 25 per month, and proprotionate increase for multiple units. Alternate proposal included once -a -week service at reduced rates. Councilman Tyrell moved to grant the increase as outlined, retaining twice -a -week service, and to instruct the City Attorney to prepare the appropriate amendment to the agreement. The motion was seconded by Councilman Merritt and carried. E. City Manager Koski advised the Council of an application for license to sell alcoholic beverages by Demian's Cafe, 5910 Temple City Boulevard. and that applicant had been advised relative to Conditional Use Permit requirement. Councilman Tyrell moved to instruct staff to notify the Alcoholic Beverage Control Board that Conditional Use Permit is required by the City of Temple City, and to hold the application in abeyance until this condition is met. The motion was seconded by Councilman Merritt and carried. Council Minutes, July 20, 1971 - Page 6 F. City Manager Koski advised that staff had reviewed the mailings of printed matter from the City, and that it was recommended to continue to mail agenda and minutes to news media as first class mail (to be flexible in the event of exceptionally bulky quantity of minutes, in which case third class mailing may be used); and to initiate third class mailing on a trial basis for all other mailings of printed material. CouncilmanHarker moved to approve as outlined, seconded by Councilman Merritt and carried. G. City Manager Koski requested authorization for attendance and advance registration for 9 City officials attending the League of California Cities Conference, September 26 -29, 1971, in San Francisco. Councilman Harker moved to approve, seconded by Councilman Merritt and carried. 21. ADJOURNMENT: Councilman Tyrell moved to adjourn to a personnel session, and a study session, seconded by Councilman Merritt and carried, and the meeting adjourned at 9:17 p.m. Next regular meeting of the Council will be on Tuesday, August 3, 1971, in the Council Chambers of the City Hall.
