The Meeting was called to order by Mayor William Koch at 9 A.M. Upon motion by Vice Mayor LaPorte and seconded by Commissioner Bettison the minutes for the regular meeting July 14, 1978 was unanimously passed. Upon motion by Vice Mayor LaPorte and seconded by Commissioner Hunter the Financial Report for the month of July, 1978 was unanimously passed. ORDINANCE 78 -3 AN EMERGENCY ORDINANCE OF THE TOWN m MMISSION OF THE TOWN OF GULF STREAM, FLORIDA RESTRICTING THE ISSUANCE OF BUILDING PERMITS WITH THE TOWN WITHOUT FIRST OBTAINING THE APPROVAL OF THE UTILITIES DE- PARTMENT OF THE CITY OF DELRAY BEACH, FLORIDA. A letter from Coastal Management regarding Federal Funding for ongoing programs was read to the Commission. After a general discussion a memorandum objecting to this request was then read and approved by the Commission, this letter and memorandum is a part of the minutes. -Z- COMMISSION MEETING AUGUST 11, 1978 Cont. In order to set a policy the Town Commission denied a recent request from Mr. C. Jennett at 3145 Polo Drive for a reduction on his June -July water charge. A resolution of appreciation to Mr. Larry M. Ball for his fine and dedicated work as Chairman of the Planning and Zoning Board was read and approved by the Commission. Mayor Koch explained another water problem regarding sand in the water lines in the Westminster, he stated that after thoroughly checking and flushing the Town's lines it was determined by Mr. Earl Harvel that the problem was not created by the Town and was therefore the responsibility of the Westminster. Commissioner Bettison reported on the implementation of an employee evaluation program to commence in the new fiscal year and conducted on a quarterly basis for the police personel during their 1st year of employment. Manager Gwynn explained the the Chief of Police would evaluate his officers and that he would evaluate the Chief of Police and the Deputy Town Clerk would evaluate the Trash Department. Mr. Andy Johnson from Russell and Axon reported that the demolition of the water tower was now complete. He also noted a reduction in the original cost due to damages incurred during removal. Attorney Adams Weaver was instructed to make an amendment to Ordinance 76 -1 to include commercial vehicles. An oil painting and a framed magazine article regarding Gulf Stream polo given by Mr. Winfield H. Jackson was accepted with great appreciation by the Town Commission and will hang in the Commission chambers. The Town Clerk was in- structed to write a note thanking Mr. Jackson for his generous gift. Meeting adjourned 9:55 A.M.. ,�� C� Q,3,1� - - Deputy Town Clerk r EMERGENCY ORDINANCE 78 -3 AN EMERGENCY ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF GULF STREAM, FLORIDA RESTRICTING CERTAIN USES OF WATER FROM THE WATER SUPPLY SYSTEM OF THE TOWN NOT ESSENTIAL TO THE PUBLIC HEALTH, SAFETY AND WELFARE DURING WATER SHORTAGE EMERGENCY SITUATIONS; AUTHORIZING TERMINATION OF WATER SERVICE FOR VIOLATION; PRESCRIBING ENFORCE- MENT PROCEDURES IN THE EVENT OF VIOLATION OF ITS PROVISION; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS the.Town Council of the Town of Gulf Stream has determined emergency situations arise from time to time concerning insufficient water supply due to drought, shortage of raw water supply, inadequate treatment plant capacity and other reasons; and, WHEREAS the Town Council has determined that a water shortage emergency currently exists in the Town due to inadequate treatment plant capacity; and WHEREAS during emergency situations as defined herein it is imperative that certain uses of water not essential to the health, welfare and safety of the users of the Town water supply system be restricted, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE i TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS: I ,j SECTION 1. EMERGENCY RESTRICTIONS ON WATER. A. Definitions. 1. "Town" - Town means the Town of Gulf Stream, Florida., 2. "Emergency Situation" - Emergency situation means a situation determined by the Town Clerk to exist due to an insufficient supply of water of necessary quality to meet the needs and demands of users of the Town water supply system. 3. "Person" - Person means any person, firm, partner- ship, association, corporation, company or organiza- tion of any kind. 4. "Water" - Water means water from the Town's potable water supply system. B. Application. The provisions of this Ordinance shall apply to all persons to whom water is supplied through the Town of Gulf Stream's water system. C. Restriction of Certain Uses. When an emergency situation is declared by the Town Clerk, the Town Clerk shall have authority to order restrictions on the use of water for any or all non- essential purposes as determined by the Town Clerk, including,but not limited to: 1. Watering vegetation. The sprinkling, watering or irrigating of shrubbery, trees, lawns, grass, ground cover, plants, vines, gardens, vegetables, flowers or any other vegetation. 2. Washing Mobile Equipment. The washing of auto- mobiles, trucks, trailers, campers, boats, rail- road cars, or any other type of mobile equipment. 3. Cleaning Equipment and Machinery. The washing and cleaning of any business or industrial equipment or machinery. 4. Ornamental Fountains and Swimming Pools. The operation of any ornamental fountain, swimming pool, wading pool or other structures making similar uses of water unless same employs a recirculating system. 5. Escape Through Defective Plumbing. The escape of water through defective plumbing which is known to the user or owner. D. Exceptions to Restriction or Curtailment. Upon adequate determination of the need therefor, the Town Clerk shall have the authority to permit reasonable use of water as an exception to a restric- tion imposed under Subsection C hereof if necessary to maintain adequate health, safety and welfare standards for the users of the Town water supply system. 2 E. Enforcement. 1. Any person in violation of the provisions of this Ordinance shall be penalized as follows: (a) First Violation - A written notice of violation will be issued by a police officer of the Town. (b) Second Violation - A fine of not less than $50.00 or imprisonment not to exceed 30 days or both. (c) Third and Subsequent Violations - A fine of not less than $100.00 or imprisonment not to exceed 30 days or both, and the Town Clerk's designee shall have the authority to order the immediate discontinuance of water service. When water service is discontinued hereunder, the person aggrieved shall have the right to appeal the decision of discon- tinuance to the Town Clerk who shall have the authority to reverse or modify the discontinuance. SECTION 2. That should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision i shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. SECTION 3. That all ordinances or arts of ordinances in conflict P i i with the provisions of this Ordinance are hereby repealed. SECTION 4. BALL ADOPTED AUGUST 11, 1978 WHEREAS, LARRY M. BALL has tendered his resignation, which has been regretfully accepted, as a member of the Planning and Zoning Board of the Town of Gulf Stream; and WHEREAS, Mr. Ball has served as Chairman of the Planning and Zoning Board since June 4, 1971, devoting much of his time and talents, energy and efforts to the affairs and interests of the Town of Gulf Stream and its citizens: NOW, THEREFORE,.BE IT RESOLVED, BY THEJOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, in session assembled August 11, A.D. 1978: The Town Commission, for the members thereof and in behalf of the citizens of Gulf Stream, in recognition of the outstanding and valuable contributions by Mr. Ball to the Town and its citizens, does hereby extend to him its thanks and appreciation for his untiring efforts, accomplishments and contributions to the Town of Gulf Stream. WHEREAS, the Town of Gulf Stream receives its supply of water for its residehts from the City of Delray Beach; and WHEREAS, the City of Delray Beach has recently entered into a Stipulation Agreement with the Palm Beach County Environ- mental Control Board, which stipulation limits the City of Delray Beach to fifty Equivalent Residential Connections per month on its water use; and WHEREAS, in order to comply with the Stipulation, the i i i City of Delray Beach has requested that the Town of Gulf Stream not issue any building permits in the Town without the applicant having received prior approval by means of a City of Delray Beach stamp on the applicant's plans approving the water connection from the Utilities Department of the City of Delray Beach; and WHEREAS, the Town Commission of the Town of Gulf Stream is of the opinion that an emergency situation exists and that this emergency ordinance be passed on the first reading; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS: SECTION 1. No building permits shall be issued by the Town of Gulf Stream which construction necessitates a water connection, unless and until the plans submitted to the Town are approved and stamped by the Utilities Department of the City of Delray Beach, Florida. SECTION 2. It shall be the responsibility of any person or firm seeking to obtain a building permit from the Town of Gulf Stream to provide sufficient proof to the Town of approval by the City of Delray Beach Utilities Department as described in Section 1 above. SECTION 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 4. That this Emergency Ordinance shall become effective immediately upon passage on first and final reading and shall remain in effect until rescinded as provided,by law.
