Leonard, General Partner Dear Sirs, The City of McCall recently removed its water tower upon which your CATV antennae were mounted. These were relocated to telephone poles, l)urch,se(I at city cost, on the rear of the city owned lots. actions have made these lots usable for residential purposes. The city is now interested in selling these lots. We would, however, be interested in retaining a perpetual easement upon the lots to ensure your use and a continued availability of your service to McCall res- idents. Secondly, your firm also leases land at the city shop for other facilities. Originally, this land was leased from W.O.J. Seetin. The city purchased the land from Seetin in January 1987. Furthermore, this past year, a second satellite dish was installed outside of the 60' X 25' parcel which you rent. This installation is a trespass upon our property. That situation must be remedied immediately. A remedy would be to lease an additional 25' X 25' parcel which is available and which we are willing to lease. I would like to remedy both of these matters at the same time. As I see it the following actions will be required: A perpetual utility easement satisfactory to accommodate your future needs must be drawn and recorded on the former tower site. I would expect a one-time, one-dollar cost for the city's grant of such an easement; o A settlement for any unpaid rental pursuant to the agreement on the tower site must be reached and amounts in arrears paid to the city; A new lease or amendment of the existing lease must be drawn for the land at the shop site and an increased rental payment for that site would be expected. To aid your review of this matter, I am enclosing copies of the agree- ments and lease assignments. Please let me hear from you at your ear- liest convenience.
