Proposed Application DISCUSSION l At your May 26, 2004 meeting(see Report 04-57)you adopted Resolution No. 04-13 establishing a plan for appointment of an ombudsperson in conformity with San Mateo County Local Agency Commission (LAFCo) Resolution No. 960. That Resolution assigned responsibility for development of recommendations to the Legislative, Finance and Public Affairs Standing Committee. The Committee met on June 30, 2004 and again on July 16, 2004, and now recommends adoption of the Roles and Duties of the Ombudsperson (see Exhibit A),the Desired Qualification Criteria of the Ombudsperson (see Exhibit B), and the Ombudsperson Application form(see Exhibit C). The committee further recommends that the Ombudsperson be an unpaid position, under contract with the Board of Directors, with reimbursement for authorized expenses,that the term of appointment be one year, and that the appointee be a registered voter within the boundaries of the District. The General Manager concurs with these recommendations. After approval of these recommendations, and within one week of San Mateo County LAFCo's certification of the annexation, District staff will advertise in local newspapers and on the District's web site for the position. The public will be invited to submit questions to the Board that they suggest be asked during the interview process. The Board shall then have a series of meetings for the purpose of screening and interviewing applicants. The Board shall then appoint the appropriate applicant as the District Ombudsperson. The Ombudsperson works independently and objectively to assist in maintaining positive relations with District residents and neighbors. i Duties of Ombudsperson •'• Listens to resident concerns ❖ Opens avenues of communication between residents and neighbors and the District ❖ Gathers information and educates residents on District policies or procedures and their purpose or effect •'• Facilitates conflict resolution ❖ Finds other resources to meet resident needs, if applicable ❖ Provides a written summary of citizen concerns as requested by the Board of Directors Scope of Duties The Ombudsperson would assist residents in their interactions with the District and facilitate conflict resolution when needed. The Ombudsperson would not handle issues which are privileged or confidential, or which involve personnel, labor relations, legal matters, or Board decisions. The Exhibit A MIDPENINSULA REGIONAL OPEN SPACE DISTRICT Ombudsperson Program Ombudsperson would present facts that may lead the Board or staff to improve operations or better address citizen needs, as opposed to advocating either for or against a resident, staff or Board policy. The Ombudsperson would not establish or recommend District policy, or affect or make fiscal or budgetary decisions. Assignment and Reporting_Responsibilities If the initial contact from a citizen is the Ombudsperson, the Ombudsperson will contact the General Manager before taking further action. If the General Manager is not able to resolve the concern/complaint to the citizen's satisfaction, the Ombudsperson will follow-up with the citizen for further resolution efforts. If the initial contact from a citizen is a Board Member, the Board Member would immediately contact the General Manager. If the General Manager is not able to resolve the concern/complaint to the citizen's satisfaction, the General Manager shall inform the citizen of the District's Ombudsperson process and shall request the Ombudsperson contact the complainant to offer further assistance. After completing inquiry and resolution efforts the Ombudsperson would then report back to the General Manager and provide a written summary report for the Board at least quarterly. Determine that the recommended actions are categorically exempt from the California Environmental Quality Act as set out in this report. 2. Adopt the attached Resolution authorizing purchase of the Neville property. 3. Tentatively adopt the Preliminary Use and Management Plan recommendations contained in this Report and naming the property as an addition to the Kennedy-Limekiln Area of Sierra Azul Open Space Preserve. 4. Indicate your intention to dedicate the property as public open space at this time. DESCRIPTION(see attached map) The 24.2-acre Neville property is located southeast of Los Gatos between Lexington Reservoir and Mt. El Sombroso. Situated on steep west-facing slopes above Limekiln Canyon, approximately two miles above Lexington Reservoir,the Priest Rock Trail passes through the property connecting Lexington Reservoir to Mt. El Sombroso,Kennedy Road,and Almaden Quicksilver County Park. The portion of the trail located on the property offers panoramic views of the Lexington Reservoir basin and beyond, including Bear Creek Redwoods,El Sereno, and St. Joseph's Hill Open Space Preserves. Surrounded entirely by Sierra Azul Open Space Preserve,this property represents the last privately owned section of the 11-mile stretch of the dedicated Bay Area Ridge Trail that connects Lexington Reservoir to Almaden Quicksilver County Park. If acquired,the property will not only provide this vitally important final link in the Ridge Trail, but will also protect valuable wildlife habitat,watershed land,and the visual integrity of the Preserve that surrounds it. The rectangular-shaped property is bounded by District property on all four sides and has a diverse landscape, with the upper ridge comprised largely of chaparral and scrub oak while the lower canyons are densely wooded. A narrow spine-like ridge bisects the property in the east-west direction and provides drainage into two separate watersheds. Limekiln Creek enters the property on the north side of the ridge and Soda Springs Canyon Creek forms the southern boundary. The property is accessed by Priest Rock Trail, an un-surfaced road that is the dedicated alignment of the Bay Area Ridge Trail connecting Lexington Reservoir County Park to Mt. El Sombroso and beyond. Hikers,bicyclists, and equestrians have passed through the property for many years, gaining access to adjacent District lands. Generous views of the surrounding area are available along the entire trail. In addition to providing a portion of the regional trail connection between Lexington Reservoir and Almaden Quicksilver County Park,the trail is part of a shorter six-mile loop trail that includes portions of Priest Rock,Kennedy, and Limekiln Trails. jjo Distel Circle 650-691-1200 info@openspace.org BOARD OF DIRECTORS:Pete Siemens,Mary Davey,Jed Cyr, GENERAL MANAGER: Los Altos CA 94022-1404 650-691-0485 fax www.openspace.org Deane Little,Nonette Hanko,Larry Hassett,Kenneth C.Nitz L.Craig Britton R-04-73 Page2 USE AND MANAGEMENT PLAN Plannini;Considerations The property is located within the District boundary in an unincorporated area of Santa Clara County. It is zoned HS (Hillside),requiring one dwelling unit per 160 acres,unless the development is clustered, whereby the allowable density is based on the average steepness of the property. The property has a legal density of one dwelling unit,but has no deeded access rights. The property would be difficult to develop for residential purposes due to the length of the access road,the steep slopes, and the lack of a legal easement. The Santa Clara Countywide Trails Master Plan shows the Bay Area Ridge Trail in the vicinity of the property, located along Priest Rock Trail between Lexington Reservoir County Park and Mt. El Sombroso. The District's Regional Open Space Study shows Priest Rock Trail as a planned section of the Bay Area Ridge Trail. The property was rated in the District's Open Space Master Plan as one that had moderate composite open-space values. Of course the District's Master Plan was prepared some years ago and does not, therefore,reflect that this property is entirely surrounded by District lands,which would elevate its importance to the highest desirable category. It is an important property that will preserve wildlife habitat,provide potential outdoor recreation,and afford a spectacular scenic backdrop for the surrounding Open Space Preserve and Lexington Reservoir County Park. Preliminary Use and Management Plan Recommendations The Preliminary Use And Management Plan will take effect at the close of escrow, and will remain effective until the Plan is amended or a Comprehensive Use and Management Plan is prepared. Any proposed changes to land use would be subject to further environmental review and public input. Public Access: Open for public use. Trail Use Designation: Priest Rock Trail will be designated a multi-use trail and a segment of the Bay Area Ridge Trail. Signs: Signs recognizing the Bay Area Ridge Trail Council and the California Coastal Conservancy,who provided grants for the project,will be placed at appropriate locations near the trailhead and on-site. Patrol: Priest Rock Trail/Road will be used for patrol purposes. Dedication: Indicate your intention to dedicate this land as public open space at this time. Name: Name the property as an addition to the Kennedy Limekiln Area of Sierra Azul Open Space Preserve. Site Safety Inspection: Preliminary inspection is complete and no hazards were found; comprehensive inspection to be complete before the close of escrow. CEQA COMPLIANCE Project Description The project consists of the acquisition of a 24.2-acre parcel of land as an addition to the Kennedy- Limekiln Area of Sierra Azul Open Space Preserve, and the concurrent adoption of a Preliminary Use and Management Plan for the property. Ultimately,the property will be included in a comprehensive Use and Management Plan for the adjacent Open Space Preserve. The land will be permanently preserved as open space and will be maintained in a natural condition. It will be open to the public for low-intensity recreation. R-04-73 Page3 CEQA Determination The District concludes that this project will not have a significant effect on the environment. It is categorically exempt from CEQA(California Environmental Quality Act)under Article 19, Sections 15316, 15317, 15325,and 15061 of the CEQA Guidelines. Section 15316 exempts the acquisition of land in order to create parks if the site is in a natural condition and the management plan proposes to keep the area in a natural condition. The use and management plan specifies the property will be maintained in a natural condition. Section 15317 exempts the acceptance of fee interests in order to maintain the open space character of an area. The District will accept fee interests and will maintain the property as open space. Section 15325 exempts transfers of ownership of interests in land in order to preserve open space. The acquisition will transfer ownership to the District and ensure the property is preserved as open space. This acquisition qualifies under three sections. The actions proposed in the Preliminary Use and Management Plan are also exempt under Section 15061(d)as there is no possibility the actions may have a significant effect on the environment. TERMS AND CONDITIONS The 24.2-acre Neville property is being acquired at a purchase price of$75,000, or approximately$3,100 per acre. This price is considered to be the fair market value of the property based upon an appraisal of the property. This transaction is contingent upon court confirmation of the sale because it is in an estate. The property is being acquired on an"As Is"basis,and staff has conducted due diligence investigations and an inspection of the property and is satisfied that no hazardous conditions exist on the property. This purchase is part of a Bay Area Ridge Trail Council acquisition grant that is being funded through the California Coastal Conservancy. This grant provides for approximately forty-seven percent(47%)of the acquisition funding, or$35,000 as a matching financial contribution. As part of the grant funding agreement,the District is required to dedicate the property for public open space purposes and record a Memorandum of Agreement memorializing the grant agreement with the Bay Area Ridge Trail Council and the Conservancy for the purposes of providing public access,protecting natural resources, and preserving open space. I . . . 1 Miles RESOLUTION NO. 04- RESOLUTION OF THE BOARD OF DIRECTORS OF MIDPENINSULA REGIONAL OPEN SPACE DISTRICT AUTHORIZING ACCEPTANCE OF BID FOR PURCHASE OF REAL PROPERTY AND PURCHASE AGREEMENT, AUTHORIZING GENERAL MANAGER TO EXECUTE ACQUISTION FUNDING AGREEMENT,AUTHORIZING OFFICER TO EXECUTE MEMORANDUM OF AGREEMENT AND THE CERTIFICATE OF ACCEPTANCE OF GRANT TO DISTRICT,AND AUTHORIZING GENERAL MANAGER TO EXECUTE ANY AND ALL OTHER DOCUMENTS NECESSARY OR APPROPRIATE TO CLOSING OF THE TRANSACTION(SIERRA AZUL OPEN SPACE PRESERVE— LANDS OF NEVILLE) The Board of Directors of Midpeninsula Regional Open Space District does resolve as follows: Section One. The Board of Directors of Midpeninsula Regional Open Space District does hereby accept the offer contained in that certain Bid for Purchase of Real Property and Purchase Agreement between the Estate of Marie B.Neville and Midpeninsula Regional Open Space District,a copy of which is attached hereto and by reference made a part hereof,and the President of the Board of Directors or an appropriate officer is authorized to execute the Purchase Agreement on behalf of the District. Section Two. The General Manager and President of the Board of Directors or other appropriate officer are authorized to execute a Certificate of Acceptance on behalf of the District. Section Three. The President of the Board of Directors or other appropriate officer is authorized to execute a Memorandum of Agreement with the Sate of California Coastal Conservancy and the attendant Certificate of Acceptance on behalf of the District. Section Four. The General Manager of the District is authorized to execute the Acquisition Funding Agreement Between The Bay Area Ridge Trail Council and the Midpeninsula Regional Open Space District,a copy of which is attached hereto and by reference made a part hereof,on behalf of the District. Section Five. The General Manager of the District shall cause to be given appropriate notice of acceptance to the seller. The General Manager and General Counsel are further authorized to approve any technical revisions to the attached Purchase Agreement,Acquisition Funding Agreement and other transactional documents which do not involve any material change to any term of the Bid for Purchase of Real Property and Purchase Agreement,the Acquisition Funding Agreement or other transactional documents,which are necessary or appropriate to the closing or implementation of this transaction. Section Six. The General Manager of the District is authorized to expend up to$5,000 to cover the cost of title insurance, escrow fees, and other miscellaneous costs related to this transaction. Section Seven. It is intended,reasonably expected,and hereby authorized that the District's general fund will be reimbursed in the amount of$75,000 from the proceeds of the next long-term District note issue. This Section of this Resolution is adopted by the Board of Directors of Midpeninsula Regional Open Space District solely for purposes of establishing compliance with the requirements of Section 1.103-18 of the Treasury Regulations. The reimbursement of this payment expenditure is R-04-73 Pages consistent with the District's budgetary and financial circumstances. There are no funds or sources of moneys of the District that have been,or are reasonably expected to be,reserved or allocated on a long- term basis,or otherwise set aside to pay the costs of this open space land acquisition project which are to be paid or reimbursed out of proceeds of indebtedness to be issued by the District. The Board of Directors hereby declares the District's official intent to use proceeds of indebtedness to reimburse itself for this open space land acquisition project expenditure. Regional Open Sp,-.-,e R-04-72 MIDPENINSULA REGIONAL OPEN SPACE DISTRICT Meeting 04-16 CELEBRATING 30 YEARS OF OPEN SPACE PRESERVATION July 28, 2004 AGENDA ITEM 3 AGENDA ITEM Authorization to Contract with Balance Hydrologics, Inc Provide In-Stream Sediment Monitoring Services at El Corte de Madera Creek Open Space Prese e GENERAL MANAGER'S RECOMMENDATION Authorize the General Manager to contract with Balance Hydrologics, Inc. in the amount of$56,142.00 plus a contingency of$5,614.00, for a total authorization amount not to exceed$61,756.00. DISCUSSION On January 21, 2004, the Board adopted the Watershed Protection Program for El Corte de Madera Creek Open Space Preserve and directed staff to implement a monitoring program to assess the effectiveness of the implemented erosion control measures(see Report R-04-10). The monitoring project consists of two elements: A) inspection and photo-documentation of the repair work to confirm that erosion repair sites are no longer capable of delivering sediment, and B)a pilot in-stream sediment monitoring program. The in-stream monitoring program has four specific objectives: 1. Measure present levels of bed sedimentation, to establish baseline conditions; 2. Gauge the effectiveness of sediment-reduction measures taken by the District; 3. Assess sediment load from El Corte de Madera Creek, such that its effects within the San Gregorio watershed can be evaluated in a larger watershed and habitat context; and 4. Learn from seasoned sedimentologic professionals how the District can reduce its effects on streambed conditions and credible, site-appropriate methods that District staff can regularly and efficiently use to track the effects of the Watershed Protection Program. Proposals and qualifications were requested from four different consulting firms specializing in hydrology and geomorphology within the Bay Area. Two firms responded with proposals: Balance Hydrologics and Wetlands and Water Resources. The proposal submitted by Balance Hydrologics,was lower in cost and includes a project team of highly qualified professionals and an approach that is best suited to meet the District's monitoring needs. The proposal showed a clear understanding of the District's goals. Implementation of the Watershed Protection Program at El Corte de Madera Creek is estimated to extend over three summers beginning in 2004. Monitoring of bed sedimentation conditions will be conducted by Balance Hydrologics during the summer of 2004 to help assess the effects of upland treatments on the streams. The Watershed Protection Program will be adapted based on the results of the monitoring, as well as observations by District staff of conditions on roads, trails, and slopes. Staff anticipates that monitoring of the in-stream conditions will need to occur for at least one year beyond completion of the Watershed Protection Program and is scheduled to complete implementation by Fall 2007. Monitoring is expected to be conducted through the winter of 2008. Staff estimated$25,000.00 for annual monitoring in the Watershed Protection Program budget. The contract with Balance Hydrologics will cover a period of two years with $33,142.00 allocated for the first year of monitoring and$23,000.00 proposed for FY 05-06. An additional 10% contingency fee is also included for$5,614.00. Reduced construction costs in the first year of the Watershed Protection Program will cover the additional expenditures required for the first year of in-stream monitoring. CEQA COMPLIANCE This project involves in-stream sediment monitoring at El Corte de Madera Creek Open Space Preserve. The work also includes inspection and photo-documentation of trail and road repair work for measurement of sediment levels in El Corte de Madera and Lawrence Creeks. The District concludes that the in-stream sediment monitoring program will not have a significant effect on the environment. It is categorically exempt from the California Environmental Quality Act(CEQA) under Section 15306 of the CEQA Guidelines as follows: Section 15306 exempts basic data collection,research,experimental management, and resource evaluation activities that do not result in major disturbances to an environmental resource. Wickham responded to a report of a vehicle over the side on Hwy 9 at Saratoga Gap . CDF and County Sheriffs were on scene, and determined that the vehicle was associated with a cell phone suicide threat received several weeks earlier. Santa Clara County Sheriff's had conducted an unsuccessful search at that time. Rangers had participated in the search of the Saratoga Gap and Castle Rock area. The vehicle was found and reported by the victim's father. The victim was inside the vehicle. I 6 District rangers were first on scene to a wildland fire on Black Mountain in Monte Bello. They established Incident Command and with the assistance of Palo Alto Rangers and Fire Department, CDF Helicopter 106 and Santa Clara County units, extinguished the fire. Approximately two acres were burned. Azul for a closed area violation. He said his two friends were hiding 7 A man was stopped in Sierra pPg with paint ball guns. The other two men came out and turned over three paint ball guns and other items. These two were issued citations for closed area and warned for weapons. The first man was warned for"closed area," and"weapons prohibited," violations. 12 Rangers responded to a cardio-pulmonary resuscitation(CPR)in progress call on the Black Mountain Trail in Rancho San Antonio. A man hiking with friends had collapsed on the trail. CPR had been in progress for about ''/2 an hour before C. Baressi arrived and took over care. Stanford Life Flight nurses arrived and took over the scene. They pronounced the victim deceased. County Fire, Palo Alto Rangers and American Medical Response ambulance company(AMR)also responded. 13 A minor vehicle accident led to an argument in Rancho County Park. F. Reneau, C. Sparks-Hart and D. Danielson responded, in addition to a sheriff's deputy. The parties finally exchanged information when ordered by the deputy. 19 A man participating in an organized run at Russian Ridge suffered cardiac arrest. CPR was administered by certified run participants. J. Lloyd arrived and assisted with the efforts, with oxygen provided by the event organizer. C. Baressi also assisted. CDF arrived and took over the scene, and pronounced the victim deceased. 19 C. Sparks Hart and F. Reneau contacted two men carrying loaded paint ball guns. They complied with all requests and the weapons were turned over to the Rangers. Both were men were cited for closed area and verbally warned for weapons prohibited. 23 While patrolling Bear Creek Redwoods, K. Carlson observed a vehicle parked adjacent to the preserve. He went on foot around the pond at the old Alma College and observed two men fishing. One had warrants out of San Jose and Los Gatos totaling$12,500. Santa Clara County Sheriff's Department was called. A deputy responded and arrested the man for outstanding warrants. 30 F. Reneau and B. Guzman were in Fremont Older when they heard radio traffic about a bicycle accident in the preserve. A 14 year-old bicyclist was riding with his father and uncle,who estimated their speed at 20 to 25 mph. The boy passed them and lost control of his bicycle. He was semi- conscious and responsive to painful stimuli only. Damage to the helmet indicated the rider probably sustained a head injury. K. Miller escorted County Fire and the AMR medics to the scene,where they followed up with treatment. Stanford Life Flight took the boy to Stanford. A follow up call three days later revealed that the patient was still in a coma as a result of the accident. 30 K. Carlson observed a suspicious burned area of grassland in Sierra Azul. The area was approximately 10 x 20 feet. There was no ignition source and no power lines are nearby. The fire was referred to a CDF fire investigator. June vandalism 2 A combination lock was cut off a gate in Sierra Azul. 4 Three closed area signs in Sierra Azul were discovered missing. 29 Graffiti on the fence near the Red Barn in La Honda Creek was reported. For 35 years the present alignment has served the community well; with the placement of just four culverts, the problem of winter mud could be avoided. 2. The frogs and insects in Sag Pond have co-existed with trail users for these 35 years. (I note that no biologist has actually found a red-legged frog in Sag Pond.) 3. What is the cost benefit both financially and environmentally? Four culverts would be far less expense than cuttinga whole new roads stem Y through this pristine area; chopping up more land which already has adequate trails makes little environmental sense. 4. The existing route already connects to the Sequoia Trail, making a pleasant easy walk for retired residents an p y d requires no new trail connection, which again scars the land. 5. When one walks the Betsy Crowder Trail, and then connects to the Meadow Trail—or visa-versa—the present alignment allows for an easy return to the parking lot on Portola Road, or the parking area on Alpine road. Why take away that nice loop? Included in that plan was the closure and restoration of a segment of lower Spring Ridge Trail. This decision was made after receiving a number of requests from the public and the Town to retain this segment of trail. The Board unanimously directed staff to once again review the trail plan element of the Use and Management Plan Amendment for Wind Hill and to refer p g Y the item back to the Use and Management Committee to consider retaining the lower Spring Ridge Trail as a footpath. As part of this review,the Board further directed staff to consider providing for a separate trail connection between the Betsy Crowder Trail and the Meadow Trail. Lastly,the Board also passed a separate motion to refer the naming of the lower Spring Ridge Trail segment to the District's Legislative,Finance, and Public Affairs Committee with the intention of naming the trail on a historical basis. Since the entire realignment project has been referred back to District staff for a second review, we respectfully request withdrawal of the site development permit(#X9H-517)for the project. We do not anticipate returning to the Town with a revised permit application until after the spring of 2005. The District also requests reimbursement of the remaining permit fee deposit that was provided when the permit application was first submitted to the Town in March of 2004.
