" 05-101 Date of Adoption MARCH 10, 2005 RESOLUTION OF THE BOROUGH OF CARTERET SUPPORTING THE ADOPTION OF S-1990 AND A-2432, AUTHORIZING THE IMPOSITION OF ADDITIONAL FINES FOR OVERCROWDING IN DWELLINGS CONTAINING FOUR OR FEWER UNITS WHEREAS, the Borough of Carteret is one of a number of municipalities that has been struggling to eliminate housing overcrowding; and WHEREAS, overcrowding creates unsafe and unhealthy living conditions, and places a strain on municipal services and schools; WHEREAS, the problem is particularly difficult in smaller dwellings containing four or fewer units that are frequently converted into illegal rooming houses, which are so profitable that any penalties imposed are merely considered a cost of doing business; and WHEREAS, bipartisan legislation, S-1990 and A-Z43Z, now stand at Znd reading in their respective houses and authorize municipalities to adopt, ordinances imposing penalties as high as $10,000 for repeat overcrowding violations which the Mayor and Council believe will help deter such illegal overcrowding; NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Carteret as follows: 1. The Mayor and Council express their support of S-1990 and A-Z43Z, authorizing the imposition of additional fines for overcrowding in dwellings containing four or fewer units; Z. A certified copy of this Resolution shall be forwarded to Acting Governor and Senate President Codey, Senator Anthony Bucca, Senator Nia Gill, Assemblyman Wilfreda Caraballo, Assemblyman Eric Munez, Senator Joseph Vitale, Assemblyman Joseph Vas, Assemblyman John Wisniewski and the New Jersey State League of Municipalities. As you may know, Assemblyman Munoz is the prime sponsor of the Assembly legislation. On March 3,2005, the Senate version was approved by the Senate Community and Urban Affairs Committee with amendments. On November 8, 2004, the Assembly version was approved by the Assembly Housing and Local Government Committee with amendments. Both measures have been referred to their respective houses for consideration by the Senate President and General Assembly Speaker for a vote by the members of the Legislature. We are pleased to inform you that we intend to support this measure should it be posted for a discussion and vote in the Senate and Assembly.
