CLEMENTS COMMISSIONER Also attending: Attorney John Randolph, Manager William Gwynn, Deputy Town Clerk Barbara Gwynn, Brian F. Pfeifler. The Meeting was called to order by Mayor Koch at 9 A.M. Upon motion by Vice Mayor LaPorte seconded by Commissioner Hunter the Commission approved the minutes of the regular meeting June 8, 1979. Upon motion by Commissioner Clements seconded by Commissioner Bettison the Commission approved the June, 1979 Financial Report. Upon motion by Commissioner Hunter, seconded by Commissioner Bettison the Commission accepted the quarterly report for the period October 1, 1978, thru June 30, 1979. The following summarization of the Police Report for the month of June, 1979, was submitted to the Commission. Mr. Rick Spadone, Engineer with Arthur Strock & Associates, Inc., gave an up to date report on the "Erosion Control Line Program ". He displayed a map depicting the area for restoration from South of the Boynton Inlet to the south end of Briny Breeze, however to receive State approval for this project it was necessary to extend the line to the north end of Delray Beach with a 507 participation of affected beach front owners. He stated that they had 58% approval from Ocean Ridge and Briny Breeze, but with Gulf Stream added they only had 35% approval. Attorney Randolph reported that he had drafted a letter to the Area Planning Boards request for comments concerning the "208 Waste Water Management Program ". MILEAGE DAYS HOURS CALLS WARNINGS Sgt. EMERGENCY ORDINANCE NO. 79 -9 AN EMERGENCY ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, DECLARING THAT ORDINANCE NO. 79 -7 ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, EFFECTIVE JULY 11, 1979, KNOWN AS THE "FAIR SHARE CONTRIBUTION FOR ROAD IMPROVEMENTS ORDINANCE ", SHALL BE OF NO FORCE AND EFFECT WITHIN THE CORPORATE LIMITS OF THE TOWN OF GULF STREAM, FLORIDA; FURTHER DECLARING THAT THE INTENT OF THIS EMEMRGENCY ORDINANCE IS TO CREATE A "CONFLICT" AS THE TERM IS USED IN ARTICLE VIII, SECTION 1 (f) OF THE 1968 FLORIDA CONSTITUTION; FURTHER PROVIDING THAT THIS EMERGENCY ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON FIRST AND FINAL READING. The Commission designated Wednesday September 8th 5 P.M, for the Town's Civil Defense Meeting. A letter from Mr. Hanifin was read to the Commission. He complained of the unsightly overgrown property adjacent to his residence. The Town Club was instructed to look into this matter and take steps to correct it. A copy of this letter is attached as part of the minutes. The Commission was reminded of budget time and should they have items to be considered bring to the attention of the Town Clerk. Z 'OT O O > O M W O M • V] � tl Fa Y ow e u W tl 1.i M 94 3: N N1.7 N N N N N N ID •O %C MM j i� EMERGENCY ORDINANCE NO. 79 -9 AN EMERGENCY ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, DECLARING THAT ORDINANCE NO. 79 -7 ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF PALM BEACH COUNTY, EFFECTIVE JULY 11, 1979 KNOWN AS THE "FAIR SHARE CONTRIBUTION FOR ROAD LMPROVEMENTS ORDINANCE," SHALL BE OF NO FORCE AND EFFECT WITHIN THE CORPORATE LIMITS OF THE TOWN OF GULF STREAM, FLORIDA; FURTHER DECLARING THAT THE INTENT OF THIS EMERGENCY ORDINANCE IS TO CREATE A "CONFLICT" AS THE TERM IS USED IN ARTICLE VIII, SECTION 1(f) OF THE 1968 FLORIDA CONSTITUTION; FURTHER PROVIDING THAT THIS EMERGENCY ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON FIRST AND FINAL READING. BE IT ORDAINED by the Town Council of the Town of Gulf Stream, Florida, as follows: WHEREAS, the Board of County Commissioners of Palm Beach County, Florida, has enacted an Ordinance No. 79 -7, known as the "Fair Share Contribution for Road Improvements Ordinance," effective July 11, 1979, which ordinance will have application within the corporate limits of the Town of Gulf Stream, Florida, unless a conflicting ordinance is adopted by the Town Council of the Town of Gulf Stream pursuant to Article VIII, Section 1(f) of the 1968 Florida Constitution; and WHEREAS, the application of said County ordinance is not deemed by the Town Council to be in the best public interest of citizens and residents of the Town of Gulf Stream because the issuance of building permits by the Town will be conditioned upon payment by the permittee of an undesirable road improvements impact fee in addition to the building permit fee; and WHEREAS, the application of said County ordinance will be of little or no benefit to the Town of Gulf Stream. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF GULF STREAM, that: Section 1. This emergency ordinance is enacted by the Town Council of the Town of Gulf Stream, Florida, pursuant to 9166.041, Florida Statutes, as the same relates to the enactment of emergency ordinances. Section 2. It is the purpose of this emergency ordinance that a "conflict" be established, as the term is used in Article VIII, I' it I� I, Section 1(f) between the provisions of this emergency i ordinance and Ordinance No. 79 -7, known as the "Fair Share li Contribution for Road Improvements Ordinance," enacted by the I! Board of County Commissioners of Palm Beach County, Florida, effective July 11, 1979. It is the intent of the Town Council that no portion of said County Ordinance shall be applicable within the corporate limits of the Town of Gulf Stream, Florida. Section 3. The Town of Gulf Stream shall not collect the road improvements impact fees as described in the aforesaid County Ordinance. Section 4.
