COUNCIL MINUTES
AUGUST 3, 1971
INITIATION:
1. Mayor Gilbertson called the regular meeting of the City Council to
order at 7:35 p.m.
2. The invocation was given by the Reverend Charles Clark, Bethlehem
Evangelical Lutheran Church, 5319 N. Halifax Road, Temple City.
3. The Pledge of Allegiance to the Flag was led by Mayor Gilbertson.
4. ROLL CALL:
PRESENT: Councilmen - Briggs, Harker, Tyrell, Gilbertson
ABSENT: Councilman - Merritt
ALSO PRESENT: City Manager Koski, City Attorney Martin,
Recreation Director Kobett, Civil Engineering
Assistant Linares, Planning Technician Burnham
Councilman Tyrell moved to excuse the absence of Councilman Merritt
for cause, seconded by Councilman Briggs and carried.
5 APPROVAL OF MINUTES:
On motion of Councilman Tyrell, seconded by Councilman Harker and
carried, the minutes of regular meeting of July 20, 1971, were
approved as mailed, Councilman Briggs abstaining.
At this point Mayor Gilbertson paid recognition to Temple City Youth
Football, Joseph Candilora, President. A certificate of appreciation
was presented by the Mayor in recognition of the fine contribution
provided to the community by this organization and its many volunteer
assistants. Officers of the organization were introduced.
Mayor Gilbertson paid recognition to the Brighter Side Singers of
Temple City High School, extending the best wishes of the Council
for a most successful concert tour of England during the month of
August (See Matters from City Officials - Resolution No. 71- 1123).
UNFINISHED BUSINESS:
6. ORDINANCE NO. 71 -334: 2nd read. Re. Amendment to Temple City
Municipal Code Re. Outdoor Advertising Structures.
City Manager Koski presented the recommendation from the Planning
Commission following their review of Ordinance No. 71 -334,
which ordinance was substantially different from Planning
Commission Resolution No. 71- 415PC, advising that the Commission
unanimously decided to make no further recommendation with
respect to the ordinance. Councilman Briggs moved to receive
and file the report, seconded by Councilman Harker and carried.
City Attorney Martin presented Ordinance No. 71 -334 entitled AN
ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9202 AND
9273 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO OUTDOOR
ADVERTISING STRUCTURES, for second reading by title only.
Councilman Harker moved to waive further reading, seconded by
Councilman Briggs and carried. Councilman Harker moved to adopt,
seconded by Councilman Briggs. Councilman Tyrell stated that he
still felt these signs should be under a Conditional Use Permit
ordinance, and that the ordinance as presented was far too
liberal, and that all signs should be eliminated as soon as
possible, including those on business buildings which also detracted
from the esthetics.

Councilman Briggs and Harker and Mayor Gilbertson commented to
the effect that the compromise with the outdoor advertising
companies had been practical, particularly in view of legal
recourse which could be taken and which could prove costly; and
that the problem of signs did extend into other areas, however
that this was a first step in improving the overall situation.
The motion to adopt Ordinance No. 71 -334 carried by the
following roll call vote:

7 ORDINANCE NO. 71 -335: 2nd read. Re. Establishment of Zoning
Modification Committee.
City Attorney Martin presented Ordinance No. 71 -335 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW PART IIIA
TO ARTICLE IX OF THE TEMPLE CITY MUNICIPAL CODE ESTABLISHING
A ZONING MODIFICATION COMMITTEE, for second reading. Councilman
Briggs moved to waive further reading and adopt, seconded by
Councilman Harker and carried.
8. STREET IMPROVEMENTS: El Monte Avenue, Live Oak to Lower Azusa
Road (Cash Contract 4767X) - Additional Work.
City Manager Koski advised that pursuant to Council directive,
estimates for sidewalk installation and block wall removal
on east side of El Monte between Grand Avenue and southerly
city limits, now being requested by property owners,had been
obtained, and that estimated total cost was $2,650.75. Further
that two laterals had been inadvertently omitted in the road
improvement plans and were not part of the original contract,
and that estimated cost for performing this necessary sewer
work was $665.
Mrs. Burnhal, 4928 N. El Monte, addressed the Council, advising
that she was not in favor of the improvement because she feared
her shrubs which were an excellent buffer to the busy street
would be destroyed, and that the costs for the project would
also add to her tax burden. She was advised that only the
shrubs which were in the right -of -way would be subject to removal
and that staff would check this matter with her to advise how
her properties would be affected; and that the project was
funded by gas tax monies which had already been accumulated for
that purpose and that there would not be an assessment to her
property.
Charles Fowler, 4902 El Monte Avenue, spoke in behalf of property
owners who favored the inclusion of sidewalks in the project
at this time.
Civil Engineering Assistant Linares reported that 89% of the
property owners had approved the inclusion.
Councilman Harker moved to accept the cost estimates for
additional sidewalk construction and to approve the construction
in connection with the street improvement project on El Monte
Avenue (Cash Contract 4767X), as presented by staff in
memorandum dated July 29, 1971, seconded by Councilman Tyrell
and carried.
Councilman Briggs moved to approve the inclusion of two house
lateral extensions, omitted in the original contract, in the
estimated amount of $655, as outlined in staff memo dated
July 29, 1971, seconded by Councilman Harker and carried.

9. TEMPLE CITY MEDICAL GROUP BUILDING: Re. Vacation of Public
Alley.
City Manager Koski advised that Resolution No. 70 -1063, relating
to vacation of a portion of the alley south of City
Medical Group Building, contained a description of the alley to
be vacated which did not stipulate complete measurements and that
a new description had been prepared for adoption as Resolution No.
70- 1063B. Also, that prior to the resolution becoming effective,
certain conditions dealing with inverse condemnation, plans for
development of the building and undergrounding of utilities, and
a deed for rededication of the alley if vacated portion is no
longer used for parking or landscaping purposes were required,
which were now in order as described in memorandum of July 30,
1971. City Attorney Martin advised that personal guarantee
to ;indemnify the City against claims in inverse :condemnation by

and presented Resolution No. 70 -10638 entitled A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY VACATING THE WESTERLY
190 FEET OF THAT CERTAIN ALLEY LOCATED SOUTHERLY OF LAS TUNAS
DRIVE RUNNING BETWEEN KAUFFMAN AVENUE AND GOLDEN WEST AVENUE IN
SAID CITY, which resolution corrected previous Resolution No.
70 -1063 as it pertained to description of the alley to be vacated.
Councilman Tyrell moved to adopt Resolution No. 70- 1063B,
correcting legal description of Resolution No. 70 -1063; to
accept deed for rededication of alley, pursuant to Item 3,
Section 4 of Resolution No. 70- 1063B; and to accept personal
guarantee in the amount of $10,000, of owners abutting vacated
portion of alley, in satisfaction of Item 1, Section 4 of
Resolution No. 70- 1063B. The motion was seconded by Councilman
Briggs and carried.
NEW BUSINESS:
10. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION -
Meeting of July 21, 1971.
Request by American Field Service for Co- sponsorship of Parks
and Recreation Department's Travel Show Program.
City Manager Koski advised that the Parks and Recreation Commission
recommended co- sponsorship by the American Field Service for
the Parks and Recreation Department's Travel Show Program, wherein
the Department would continue the program as they are presently
doing and that the American Field Service would provide the
leadership at the shows. Also, that while the shows are free
of charge and open to the public, that a donation box is placed
at the door. Co- sponsorship would save the City, approximately
$24 for a season. Following discussion as to legal implications,
it was moved by Councilman Tyrel 1 , seconded by Councilman Briggs
and carried, to deny the request for co- sponsorship of the
Travel Show Program, Councilman Harker abstaining since he was
a member of the American Field Service.
11 RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of July 27, 1971
Mobile Homes and Mobile Home Parks - Assembly Bill No. 2294.
City Manager Koski advised that the Planning Commission recommended
opposition to Assembly Bill No. 2294 which would preempt local
zoning regulations for mobile homes and mobile home parks.
Councilman Tyrell moved to approve, and that a letter be sent to
the Chairman of the Committee concerned, advising of the opposition
of our City, seconded by Councilman Harker and carried.

12. STREET IMPROVEMENTS - Curb, gutter and driveway approaches pursuant
to Chapter 27 of the Streets and Highways Code.
A. SULTANA AVENUE: BETWEEN BROADWAY AND LAS TUNAS DRIVE
B. VAL STREET: FROM GOLDEN WEST TO 390' ± WESTERLY
City Manager Koski advised that petitions for the above improvements
had been circulated by the property owners and signatures represent -
ing more than the minimum 60% requirement had been obtained.
Councilman Tyrell moved to set Public Hearings for Tuesday,
September 7, 1971, at 7:30 p.m., in the Council Chambers of the
City Hall, seconded by Councilman Briggs and carried.
13. ORDINANCE NO. 71 -336: 1st read. Re. Proposed Revision to Civil
Defense Code.
City Manager Koski advised that certain changes in the Civil
Defense Code were necessary to conform with State requirements
and the Federal Civil Defense Act, which were described in memoran-
dum dated July 30, 1971 to the City Council. City Attorney
Martin presented Ordinance No. 71 -336 entitled AN ORDINANCE OF
THE CITY OF TEMPLE CITY REPEALING SECTION 2725 -2.733 OF THE TEMPLE
CITY MUNICIPAL CODE AND ADOPTING NEW SECTIONS 2725-2736 IN 'PLACE
THEREOF, RELATING TO EMERGENCY ORGANIZATION, for first reading
by title only. Councilman Tyrell moved to waive further reading,
seconded by Councilman Briggs and carried.
14. RESOLUTION NO. 71 -1122: WARRANTS & DEMANDS, Demand Nos. 4468
thru 4545, in the amount of $26,884.85.
Councilman Tyrell moved to adopt Resolution No. 71 -1122 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM. OF $26,884.85 DEMAND'NOS.
4468 THRU 4545, seconded by Councilman Briggs and carried.
15. COMMUNICATIONS:
A. City Manager Koski presented a communication from the League
of California Cities re. designating a voting representative
and alternate for League Conference, September 2.6 -29, 1971. .
Councilman Tyrell moved to designate Mayor Gilbertson as
delegate and City Manager Koski as alternate, seconded by
Councilman Harker and carried.
B. City Manager Koski presented a communication from the State
Division of Highways re. public hearings to be held re.
recommendations for changes in the State Highway System for
report to the 1972 Legislature, and advised that a prime
concern would be the deletion of Route 19 (Rosemead Blvd.)
which would place undue burden on the City unless the City
were reimbursed for costs since it is a major street.
Staff was instructed to communicate with the State Division
of Highways, advising that if, at such time as Rosemead
Boulevard would be deleted as a state highway, that necessary
funds should be provided for the continuing maintenance
responsibilities.
C. A communication from the Chamber of Commerce requesting
permission for a sidewalk sale on August 13, 1971, was
received. It was moved by Councilman Briggs, seconded by
Mayor Gilbertson and carried to approve the request as out-
lined in letter dated July 29, 1971 from the Chamber of
Commerce, subject . to the necessary .i nsur.ance.., and provision
that barricades be removed immediately following the event.

D. A communication from the Junior Woman's Club of Temple City
was received, requesting assistance in their fund raising
efforts for wading pool at Live Oak Park, as follows:
(a) to place thermometer type sign at Live Oak Park and
Temple City Park to indicate progress toward the goal
to be reached, and
(b) to be permitted to sell stock (solicit contributions)
for the pool at the City Picnic to be held in September.
Following discussion as to opening up the City Picnic to
groups for fund raising projects, it was moved by` Counci lman
Tyrell to approve the request to place the thermometer type
signs at the parks to indicate progress toward the goal, but
to decline permission to solicit at the City Ricnic. The
motion was seconded by Councilman Briggs and carried.
16. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
A. J. W. Parkhurst, 9651 Olive Street, requested permission to
use the City Hall on one Thursday evening each month for
American Field Service Travel Shows, and to accept donations
from those attending. The request was referred to the City
Manager for a recommendation and report back to Council.
B. Mrs. Rose Stolack, 4904 Kauffman, discussed vibrations she
continues to feel at her home, again asking City assistance.
Staff was instructed to update the file on the matter for
Council review.
C. Complaints were received from two citizens relative to a
house at 6052 Golden West which was being utilized by
teenagers, unsupervised.
D. Matt English, Chamber of Commerce, urged adoption by the
Council of a resolution to commend the Brighter Side
Singers of Temple City High School to take with them on
their tour to England. Councilman Tyrell moved to adopt
Resolution No. 71 -1123 entitled A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF TEMPLE CITY EXTENDING BEST WISHES
TO THE BRIGHTER SIDE SINGERS OF TEMPLE CITY AS THEY EMBARK
ON A CONCERT TOUR OF ENGLAND, seconded by Councilman Briggs
and carried.
17. ADJOURNMENT: On motion of Councilman Tyrell, seconded by
Councilman Briggs, and carried, the meeting adjourned at 9:05p.m.
to a joint meeting with the Planning Commission, following
which adjournment would be to an Adjourned Meeting on Monday,
August 30, 1971, at 7:30 p.m. in the Council Chambers of the
City Hall, omitting the regular meeting of August 17, 1971.
At the joint meeting with the Planning Commission, Eugene
Jacobs, Attorney, discussed the use of a redevelopment agency
for projects in community redevelopment. The joint meeting
was over at 10:30 p.m. at which time the Council adjourned to
Adjourned Meeting of August 30, 191 at 7:30 p.
