The Meeting was called to order by Mayor Rock at 9 A.M.
Upon motion by Vice Mayor LaPorte, seconded by Commissioner Clements the
Minutes of the regular March 9, 1979 meeting were unanimously approved by
the Commission.
Upon motion by Commissioner Clements, seconded by Commissioner Hunter the
Financial Report for the month of March was unanimously accepted by the
Commission.
The following summarization of the Police Report for the month of March, 1979
was submitted to the Commission.

Second and final reading of Ordinance 79 -1 was heard by the Commission. Upon
motion by Vice Mayor LaPorte seconded by Commissioner Bettison Ordinance 79 -1
was adopted by the Commission.
ORDINANCE 79 -1
AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA ADOPTING
BY REFERENCE THE 1979 EDITION OF THE SOUTHERN STANDARD
BUILDING CODE AND THE 1977 REVISION THERETO, AND ALL
AMENDMENTS MADE TO DATE IN THE BUILDING CODES NOW IN
FORCE AND EFFECT IN PALM BEACH COUNTY AS ADOPTED BY
THE BOARD COUNTY COMMISSIONERS OF PALM BEACH COUNTY,
FLORIDA AND THE BUILDING DEPARTMENT OF SAID COUNTY.

On motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the
following resolution was passed by the Commission.
RESOLUTION 79 -2
A RESOLUTION OF THE TOWN OF GULF STREA, FLORIDA
NAMING THE TOWN COMMISSION AS THE LEAD PLANNING
AGENCY FOR THE PURPOSE OF REVIEMING THE TOWN'S
COMPREHENSIVE PLAN, HOLDING PUBLIC HEARINGS IN
REGARD THERETO TO CARRY OUT ALL ACTIVITIES DE-
SIGNATED BY STATE STATUTES OF THE LEAD PLANNING AGENCY.
A preliminary draft of the Town's Comprehensive Plan was reviewed by the
Commission. After a general discussion on motion by Vice Mayor LaPorte
seconded by Commissioner Hunter prelimim ry approval was given this plan.
Commissioner Hunter noted the high insurance rating and requested the Town
Manager to look into the possibility of reducing this.
A letter from the Area Planning Board of Palm Beach County was received, this
letter requested the Town's reply to the 201 sewer project for federal funding
assistance. After a general discussion the Commission instructed the Deputy
Town Clerk to inform the Area Planning Board that due to the fact this project
does not apply to the Town of Gulf Stream they have no favorable comment.
Attorney Randolph was instructed to draw up a letter in answer to the Area
Planning Boards request that the Town reply to the 208 Wastewater Management
Program. Mayor Rock wanted it mentioned in the letter that they feel the
study was useful to some degree however, that cost for this study should be
limited. Attorney Randolph read the two last paragraphs of the model re-
solution sent by the Board, Mayor Koch suggested they be included in the
letter as amended to suit the Commission's feelings.
A variance request was granted to Mr. and Mrs. Van Lennep to place a condencing
unit partially outside the setback line.
On motion by Commissioner Hunter seconded by Commissioner Bettison the
Commission granted approval for demolition of one wood frame building located
on the Gulf Stream School property.
A request from the City of Delray Beach to share cost of a right turn lane
at N. E. 8th Street and ALA was heard by the Commission. This cost to be
shared by the City of Delray Beach, Department of Transportation and Gulf Stream.
Gulf Stream's cost to be $1,000.00. The Commission felt this was quite high
since the responsibility belongs to the Department of Transportation, Mayor
Koch stated he would talk to Delray Beach Manager Eldon Mariott to see if a
reduction to the Town could be granted, in the meantime he asked Mr. F. P.
O'Brien if at the next Bath and Tennis Club's Board of Director's meeting
if he would bring this before the Board to ask their feelings toward con-
tributing the cost to this project since it would greatly enhance the flow
of traffic and solve their traffic problems.
The Town Clerk was instructed to write a letter to the Army Corp of Engineers
for their approval to place uniform waterway regulatory markers and also to
have police power on the intracoastal waterway within the Town limits.

Upon motion by Commissioner Bettison, seconded by Commissioner Clements the
May 11th Meeting is hereby changed to May 10, 1979.
The Commission awarded the bid of $2,587.00 to Bill Overton's Budget Fence
for fencing the Town's wildlife sanctuary. This is being done through the
proceeds of a gift from Mr. Harold F. Johnson for this purpose.
A letter from Mr. Robert A. Dittman of 925 Orchid Lane, Place An Soleil was
read to the Commission, this letter complained in detail of the noise caused
by County Sanitation trucks as early as 3:30 A.M. at tines. The Commission
sympathized with Mr. Dittman and instructed the Town Clerk to take this up
with the contractor.
On motion by Commissioner Hunter, seconded by Commissioner Bettison, the
Commission unanimously approved placing proposed Ordinance 79 -2 on FIRST
READING.

AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, RE-
GULATING THE OPERATION OF BOATS WITHIN THE TOWN; PRO-
HIBITING THE USE OF BOATS WITHIN THE TOWN AS A PLACE
OF RESIDENCE OR FOR SLEEPING OR LIVING PURPOSES; PRO-
VIDING PROVISIONS FOR MOORING OR ANCHORING; PROVIDING
REQUIREMENTS FOR SANITATION.
On motion by Commissioner Bettison, seconded by Vice Mayor LaPorte the
Commission unanimously approved placing proposed Ordinance 79 -3 on FIRST
READING.

AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF
GULF STREAM, FLORIDA, RELATING TO GENERAL AND SPECIAL
ELECTIONS WITHIN THE TOWN; PROVIDING FOR PROCLAMATION
AND NOTICE OF SAID ELECTIONS; PROVIDING FOR A QUALIFYING
FEE; AND INCORPORATING BY REFERENCE STATE LAWS RELATING
TO ELECTIONS.
On motion by Commissioner Hunter, seconded by Vice Mayor LaPorte the Commission
unanimously approved placing proposed Ordinance 79 -4 on FIRST READING.

AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, RE-
PEALING ORDINANCE NO. 120 AND ENACTING A NEW ORDINANCE
RELATING TO SOLICITORS, REQUIRING REGISTRATION; REQUIRING
AND THE ISSUANCE OF A PERMIT; REQUIRING A REGISTRATION FEE;
PROVISIONS FOR REVOCATION; PROHIBITED ACTS; EXCEPTIONS; AND
PROVIDING FOR A PENALTY.
On motion by Commissioner Bettison, seconded by Commissioner Clements, the
Commission unanimously approved placing proposed Ordinance 79 -5 on FIRST
READING.

GULF STREAM POLICE DEPARTMENT REPORT - 1979
The month of March was a very quiet time for the members of
the Gulf Stream Police Department.
There were No Breaking & Entries, No Larcenies or Accidents to
report.
A burglar was arrested by the Ft. Lauderdale Police in March and
it was definitely established that he was responsible for the
theft at the Donnelley residence in February.
The Sheriff has not as yet confirmed if he committed any crimes
in the Gulf Stream & Delray area during the years 1976 & 1977.
The Sheriff's detectives are continuing to question prisoners
in this regard.

ORDINANCE NO. 79 -1-
AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA,
ADOPTING BY REFERENCE THE 1976 EDITION OF THE
SOUTHERN STANDARD BUILDING CODE AND THE 1977
REVISION THERETO, AND ALL AMEND14ENTS MADE TO DATE
IN THE BUILDING CODES NOW IN FORCE AND EFFECT IN
PALM BEACH COUNTY AS ADOPTED BY THE BOARD OF
COUNTY COMMISSIONERS OF PALM BEACH COUNTY, FLORIDA
AND THE BUILDING DEPARTMENT OF SAID COUNTY.
NOW THEREFORE, be it ordained by the Town Commission of
the Town of Gulf Stream, Florida, as follows:
Section 1. The 1976 edition of the Southern Standard
Building Code and the 1977 revision thereto, of which copies have
been and are now filed in the office of the building official of
the Town of Gulf Stream, be and the same are hereby adopted and
incorporated as fully as if set forth at length herein and, from
the date on which this ordinance shall take effect, the provisions
therein shall be controlling in the area of jurisdiction of the
Town of Gulf Stream.
Section 2. The Provisions of all building codes now in
force and effect in Palm Beach County as adopted by the Board of
County Commissioners of Palm Beach County, Florida, are hereby
adopted by reference in the manner and form in which they have been
amended on the effective date of this ordinance, and the provisions
therein shall be controlling in the area of jurisdiction of the
Town of Gulf Stream.
Section 3. Upon copies of future changes by Palm Beach
County in said codes being filed with the Town, such changes shall
be, effective immediately in the Town.
Section 4. The County Building Department shall continue
to perform, on behalf of the Town, inspections to assure compliance
with the above referenced codes in the same manner as previously
set forth in Ordinance No. 70 -2 of the Town of Gulf Stream.

Our objection is most simply stated by example.
On April 11, at 3:30 A.M., the collection truck literally
roared into the subdivision and proceeded down Orchid Lane
in low gear, the driver apparently attempting to make each
brake squealing 100 -150 foot stop in the fastest amount of
time possible; after making the turn at the cul -de -sac he
roared back down Orchid Lane reaching an estimated speed
of at least 35 m.p.h. as he passed our home. My wife and I,
already awakened by the noise, had to rush in our childrens'
bedrooms and try to calm both terrified and crying infants;
it took me approximately 2 hours to get my older daughter
back to sleep after the incident.
While the above problem hasn't been that bad in the
fall and winter when windows may be closed, it is a constantly
occurring one in warmer weather. This problem is not a new one,
I having pointed same out to Chief McQuade in a letter dated
December 21, 1977. Moreover, most of my neighbors have voiced
similar objections and I have been informed that numerous
complaints have been filed with the police.
This problem is a breach of the peace that can not
be allowed to continue. I can not afford to lose 2 hours
of sleep on 2 occasions each week. Moreover, my children
suffer sleep loss which makes them cranky which makes my wife
cranky, all of which makes me cranky. If the town does not advise

me that they will do something, I will do something, which
is only going to prove unnecessarily costly for the Town and
the Contractor, for obvious reasons.
I would suggest you contact the town's contractor, advise
them of the problem and demand that collection be made at a time
after 7:00 or 8:00 a.m. As I have pointed out in the past, the
fact that the Town allows its contractors to work outside the
hours allowed for contractors of Town residents can act to
estop the Town from enforcing its ordinance proscribing contractors
from working beyond the designated hours. In any event the Town's
contract for collection services must be viewed as at least
implicitly requiring the contractor to perform so as not to breach
the public peace; continuing conduct by the Contractor such as
described above, after the Town's formal notice of same and demand
for such conduct to cease, should provide the Town with sufficient
cause to terminate its contract.

I write to ask your permission to
demolish, as authorized by the Trustees of the School,
the northernmore of the two remaining wood frame
buildings on our campus. It is a costly, excess
facility whose few uses can be carried on elsewhere
and by saving insurance, maintenance, air conditioning
and heating, we will effect economy.
We plan to demolish the building no sooner
than the week of June 11, 1979. May we have your
permission?
Later this spring our architects and
D builders will deliver plans for a modest (1,000 sq.ft.)
covered eating area to enhance our campus, construction
to begin in mid -June.
