SPECIAL MEETING
I. ROLL CALL
President Mary Davey called the meeting to order at 5:30 p.m.
Members Present: Jed Cyr, Larry Hassett, Nonette Hanko, Deane Little (arrived 6:10

II. CLOSED SESSION
M. Davey stated that the Board would adjourn to Closed Session.
The Board recessed to Closed Session at 5:40 p.m. and the Closed Session commenced at
5:40 p.m. The Board concluded the Closed Session at 7:25 p.m.
REGULAR MEETING
III. M. Davey called the Regular Meeting to order at 7:30 p.m. She announced that the
Board had discussed Agenda Items 1 and 2 in Closed Session, that no reportable actions
had taken place, and that the Board would reconvene in Closed Session following the
regular meeting.

General Counsel called the Board's attention to Supplementary Agenda Item No. 2 and
requested the Board to consider adding this item to tonight's agenda as the need to take
action arose after the agenda was posted.
Motion: K. Nitz moved that the Board adopt the amended agenda. P. Siemens
seconded and the motion passed 7 to 0.
VI. ADOPTION OF CONSENT CALENDAR
N. Hanko announced she would abstain on Revised Claims No. 1357.
Motion: J. Cyr moved that the Board adopt the Consent Calendar. L. Hassett
seconded the motion. The motion passed 6 to 0.
VII. BOARD BUSINESS
A. Agenda Item No. 1 — Award Contract for the El Corte de Madera Creek Open
Space Preserve Watershed Protection Program: Year One Erosion Control
Projects; Authorize the General Manager to Execute a Contract with Peter Davis
Engineering for the Bid Amount of$101 360.00 Plus a Contingency Amount of
up to $13 500 00 for a Total Amount Not to Exceed $114,860.00 to Provide Road
Upgrade and Erosion Control Services at El Corte de Madera Creek Open Space
Preserve—(Report R-04-75).
Matt Freeman presented the report and answered questions from the Board.
Motion: P. Siemens moved that the Board award the contract for the El
Corte de Madera Creek Open Space Preserve Watershed Protection
Program: Year One Erosion Control Projects and authorize the
General Manager to execute the contract with Peter Davis
Engineering for the bid amount of$101,360.00 plus a contingency
amount of up to $13,500.00 for a total amount not to exceed
$114,860. L. Hassett seconded the motion. The motion passed 7 to
0.
B. Supplementary Agenda Item No. 2A — 1. Determine That There is an
Immediate Need to Take Action on this Item and that the Need to Take Action on
this Item Came to the Attention of the Board of Directors after the Posting of the
Agenda for the Board's Regular Meetin of f August 11, 2004—(Report R-04-76).
Motion: N. Hanko moved that the Board consider part 1 of this item.
Discussion: S. Schectman presented the report on the first part of Agenda Item
2 to the Board. There is an immediate need to take action in the
pending Half Moon Bay Coastside Foundation litigation. The
court issued an order on Friday taking under submission the

question as to whether or not there are sufficient protests to
warrant an election on the LAFCo approval of the annexation. At
this time the District does not know the outcome or when the judge
will rule. General counsel recommends that the Board take the
recommended action because the court could rule before the next
Board meeting of August 28, 2004 and the District may have to, as
a legislative body, take this action. l
Vote: The motion passed 7 to 0.
Supplementary Agenda Item No. 213 — 2. Authorize President of the Board of
Directors to Sign on Behalf of the District Written Arguments in Support of the
Coastside Protection Program and to Take Such Other Steps as May Be Necessary
to Comply with Any Potential Order of the Court that LAFCo's July 7, 2004
Approval of the District's Application for Annexation of the San Mateo Coastside
be Placed on the November 2 2004 General Election Ballot for Voter Approval —
(Report R-04-76).
S. Schectman reported that this action is consistent with what the Board approved
on Measure F in 1998. Due to the uncertainty of this matter General Counsel
requested the Board to consider amending this agenda item to authorize the
President of the Board or, in her absence or unavailability, the Vice President of
the Board, to take the listed actions.
Motion: J. Cyr moved that the Board authorize the President of the Board
of Directors, or in her absence, the Vice President, to sign, on
behalf of the District, written arguments in support of the
Coastside Protection Program and to take such other steps as may
be necessary to comply with any potential order of the Court that
LAFCo's July 7, 2004 approval of the District's Application for
Annexation be placed on the November 2, 2004 general election
ballot for voter approval, as amended. N. Hanko seconded the
motion, as amended. The motion passed 7 to 0.
VIII. INFORMATIONAL REPORTS
J. Cyr: Ranger Danielson gave him and a La Honda resident a tour of the Red Barn in La
Honda.
M. Davey: She congratulated the three incumbents who filed their candidacy without
opposition.
D. Little: He discovered that a potential candidate did take out nomination papers with
Santa Clara County but ultimately decided not to file.

K. Nitz: He had a question regarding an FYI item, specifically, C. Roessler's letter to
Elizabeth Lotz of Sonoma State University pertaining to the Sudden Oak Death study.
He wanted to be sure the District would receive a response and what would be the
timeline.
N. Hanko: She has received correspondence from Jim Warren regarding the District's
good neighbor policy.
C. Britton: 1. He mentioned the FYIs contained the request and response to Mr.
McQueen regarding missing signage at Mt. Umunhurn as requested by Director, Siemens.
2. The FYIs also contained the Santa Clara County Parks and Recreation Survey. 3. He
accompanied Lisa Killough for a presentation to a working group in Napa County
attempting to form a new park district. They have no county park department. 4. He
attended a City of Palo Alto meeting that continued the discussion of the regional trail
through Foothills Park. 5. Kent Dedrick passed away July 17th. 6. The dusky-footed
wood rat has stopped a project in Devonshire Canyon in San Carlos. 7. He spoke with
Monterey Peninsula Regional Park District's Manager, Joe Donofrio, regarding the mail
ballot assessment that would raise approximately $1 million per year. They received a
60% "yes" vote. They also discussed co-sponsoring one "not-so-annual" conference in
September 2005. 8. The State Budget was signed and non-enterprise special districts
would suffer a 10% loss of property tax revenue for 2 years. For the District, that equals
out to approximately $4 million. If the District's debt service is exempted, that could
bring it as low as $2.6 million. 9. The FEMA project for Page Mill Road has received
approval to pay the District$33 1,000. 10. Jim Warren has been discussing the idea of an
online discussion group with R. Jurgensen, Public Affairs Manager. This would provide
a venue for staff to talk with residents online. At this time it would be more productive to
have residents direct their questions/input to our staff at infogopenspace.org.
J. Maciel reported that a theft had occurred at the Skyline Field Office. Equipment worth
up to $15,000 was stolen. The San Mateo County Sheriffs Department is investigating
the incident.
IX. ADJOURNMENT
At 8:25 p.m., the meeting was adjourned. The Special Meeting Closed Session was
reconvened at 8:15 p.m. and adjourned at 9:55 p.m., to discuss Agenda Items 3 and 4.

1. Determine that the recommended actions are categorically exempt from the California
Environmental Quality Act(CEQA)as set out in this report.
2. Adopt the attached Resolution authorizing acceptance of the Conservation Easement over the
former Rose-Basich property from POST as an addition to the Coal Creek Open Space Preserve.
DESCRIPTION (see attached map)
The District is being offered a gift of a 5.09-acre Conservation Easement adjacent to Coal Creek Open
Space Preserve. The easement was obtained by Peninsula Open Space Trust(POST)to preserve the
property and to create an open space buffer when the District acquired the lands of Rose(Report R-82-27)
and established Coal Creek Open Space Preserve in 1982. Since that time the easement area has remained
undeveloped open space with only limited human modifications. This easement is important as a buffer
between the open space land and an adjacent, improved parcel for preserving the natural resources within
the easement area, and for protecting the viewshed from adjacent public lands. POST,which acquired the
w easement at the Districts request, is no asking that the District accept the easement and continue
monitoring it as part of its ownership and management of the surrounding Coal Creek Open Space
Preserve.
The property is located on a north-facing slope of the Santa Cruz Mountains within the Skyline Boulevard
Scenic Corridor. The property is directly adjacent to Crazy Pete's Road,which is part of the Valley View
Trail corridor and is one of the primary public access routes to the more remote portions of Coal Creek
Open Space Preserve. The easement area serves as an open-space buffer zone that masks an adjacent
developed residential parcel to the north from Coal Creek Open Space Preserve and the Skyline Boulevard
Scenic Corridor that includes a section of the Bay Area Ridge Trail. The residential parcel is adjacent to
the north boundary of the easement area. The easement area is surrounded on three sides by Coal Creek
Open Space Preserve and is also visible from Russian Ridge Open Space Preserve to the west.
Historically,the property was grazed by cattle and used for harvesting firewood. The property drains
northwesterly to form a tributary to Coal Creek. The easement area originally consisted of a 5.09-acre
parcel. However, following a lot line adjustment,the easement area is now encompassed within a larger
6.29-acre parcel.
The easement area is primarily undisturbed woodland,which provides habitat for a variety of wildlife.
Four distinct plant communities are found in the easement area. Mature coast live oak and canyon live oak
trees dominate the oak woodland area, including several very large,apparently old growth trees. A mixed
evergreen forest of Douglas fir,madrone,tan oak, coast live oak,and California bay is found in the

northwest corner. A row of non-native shore pines grows along the southern side of the easement area,
while small patches of grassland habitat are found in the middle area and in the southeast corner.
There are some improvements on the easement area, including a water pipeline,a power line,a fenced
garden plot, fence lines,and a capped wellhead. A house, a cabin, and a barn are located on the residential
parcel adjacent to the easement area. The parcel with the conservation easement and the adjacent
residential parcel are owned by the same private party. The private party has requested ingress and egress
rights through a portion of Coal Creek Open Space Preserve. This matter is the subject of pending
litigation between that party and the District.
USE AND MANAGEMENT PLAN
Planning Considerations
The property is located within an unincorporated area of San Mateo County and zoned Resource
Management(RM). The parcel, due to the lot line adjustment,could possibly be approved for a legal
separate residential site. The conservation easement prohibits additional structures within the easement
area,but structures could be built within the expansion area of approximately 1.2 acres. The easement also
grants a trail easement anywhere within the easement area to POST and its successor.
Use and Management Recommendations
The conservation easement will be held solely by the District. The District will be responsible for
monitoring and enforcing the conditions of the easement. The conservation easement allows the fee owner
to: 1)take dead or downed trees,2)construct agricultural buildings subject to prior approval, 3)pasture
and graze cattle,4)control predatory and problem animals,and 5)conduct other activities not inconsistent
with the purpose of the conservation easement. The property will be maintained in a natural condition
with no changes in land use, and no additional roads,non-agricultural structures or improvements will be
constructed on the property. POST has prepared an Easement Baseline Documentation Report and a
record of its annual inspections for the District to use when monitoring future activity on the property.
Monitoring: Annual monitoring inspection and report to be performed by the District,probably by District
volunteers trained to do such inspections.
Public Access: Closed to the public at this time.
Dedication: Indicate your intention to withhold dedicating the property-conservation easement as public
open space at this time.
Name: Name the easement as an addition to Coal Creek Open Space Preserve.
CAA COMPLIANCE
Project Description
The project consists of the acquisition of an easement interest in the unincorporated area of San Mateo
County comprising a 5.09-acre area of land,and the concurrent adoption of a Preliminary Use and
Management Plan for the easement. The land will be permanently preserved as open space and maintained
in a natural condition.
CEQA Determination
The District concludes that this project will not have a significant effect on the environment. It is
categorically exempt from the California Environmental Quality Act(CEQA)under Article 19, Section
15317 and 15325 as follows:

Section 15317 exempts the acceptance of easements in order to maintain the open space character of an
area. This acquisition will transfer an easement interest in the property to the District and ensure that the
open space character of the property will be preserved.
Section 15325 exempts transfers of ownership of interests in land in order to preserve existing natural
conditions. This acquisition will transfer an easement interest in the property to the District and ensure that
it will preserve existing natural conditions,including animal habitat.
The actions proposed in the Preliminary Use and Management Plan are also exempt under Article 5,
Section 15061(b)(3),as there is no possibility the actions will have a significant effect on the environment.
TERMS&CONDITIONS
The easement interest is being granted to the District at no cost. The conservation easement will remain on
the property in the event of subsequent property ownership transfer.
PUBLIC NOTIFICATION
Adjacent property owners in the area have been mailed written notices of this proposed acquisition.

There are some improvements on the easement area, including a water pipeline,a power line, a fenced
garden plot, fence lines, and a capped wellhead. A house,a cabin,and a barn are located on the residential
parcel adjacent to the easement area. The parcel with the conservation easement and the adjacent
residential parcel are owned by the same private party. The private party has requested ingress and egress
rights through a portion of Coal Creek Open Space Preserve. This matter is the subject of pending
litigation between that party and the District.
USE AND MANAGEMENT PLAN
Planning Considerations
The property is located within an unincorporated area of San Mateo County and zoned Resource
Management(RM). The parcel,due to the lot line adjustment, could possibly be approved for a legal
separate residential site. The conservation easement prohibits additional structures within the easement
area,but structures could be built within the expansion area of approximately 1.2 acres. The easement also
grants a trail easement anywhere within the easement area to POST and its successor.
Use and Management Recommendations
The conservation easement will be held solely by the District. The District will be responsible for
monitoring and enforcing the conditions of the easement. The conservation easement allows the fee owner
to: 1)take dead or downed trees,2)construct agricultural buildings subject to prior approval, 3)pasture
and graze cattle,4)control predatory and problem animals,and 5)conduct other activities not inconsistent
with the purpose of the conservation easement. The property will be maintained in a natural condition
with no changes in land use, and no additional roads,non-agricultural structures or improvements will be
constructed on the property. POST has prepared an Easement Baseline Documentation Report and a
record of its annual inspections for the District to use when monitoring future activity on the property.
Monitoring: Annual monitoring inspection and report to be performed by the District,probably by District
volunteers trained to do such inspections.
Public Access: Closed to the public at this time.
Dedication: Indicate your intention to withhold dedicating the property as public open space at this time.

area. This acquisition will transfer an easement interest in the property to the District and ensure that the
open space character of the property will be preserved.
Section 15325 exempts transfers of ownership of interests in land in order to preserve existing natural
conditions. This acquisition will transfer an easement interest in the property to the District and ensure that
it will preserve existing natural conditions,including animal habitat.
The actions proposed in the Preliminary Use and Management Plan are also exempt under Article 5,
Section 15061(b)(3),as there is no possibility the actions will have a significant effect on the environment.
TERMS&CONDITIONS
The easement interest is being granted to the District at no cost. The conservation easement will remain on
the property in the event of subsequent property ownership transfer.

GENERAL MANAGER'S RECOMMENDATION
Adopt the attached revised MROSD Parking Violations Penalty Schedule.
DISCUSSION
The fines for District parking violations have remained at$25.00 for many years. The Board
adopted revised District Land Use Regulations (see report 04-80) which included revisions to
Section 801.1 (Parking). As part of the revision process, sub-sections were added regulating
illegal parking in a handicapped-marked space and parking in non-designated areas. Currently
no fine amount is set for either violation.
A review of the District's current Schedule found that the District's fine schedule is lower than
that of surrounding agencies (see Appendix A—attached).
Parking violations continue to be a problem of special concern at Rancho San Antonio Park, and
it is important that the District's fines reflect those of neighboring agencies, and reflect cost of
living increases over the years.
District parking citations are handled as a civil, rather than criminal matter, and so the parking
fine schedule is adopted separately from the bail schedule, which was previously adopted by the
Board for the other Ordinances.

Proposed Amendment to Resolution No. 04-13 Regarding Appointment of an Ombudsperson to Delete
the Provision Requiring District Residency and Approval of the Procedures for Interviews for the
Ombudsperson
GENERAL MANAGER'S RECOMMENDATIONS
1. Amend Resolution No. 04-13 to delete the requirement that the District ombudsperson be a District
resident; and
2. Approve the Procedures for Interviews for the Ombudsperson.
DISCUSSION
On May 26, 2004,the Board adopted Resolution No. 04-13 establishing a plan for appointment of a
citizen ombudsperson in conformity with the San Mateo Local Agency Formation Commission's
Conditions of Approval of the Coastside Protection Program(see Report R-04-57). (This plan was
amended by Board on September 22, 2004 by adoption of Resolution 04-34.) Accordingly the Board has
called a Special Public Meeting for the purpose of initial interviews of the applicants scheduled for
October 20, 2004 beginning at 5:00 p.m. It is recommended that Board approve the attached Procedures
for Interviews for Ombudsperson to be utilized for the first and second rounds of the interview process.
In the District's promotion of the Ombudsperson position, it is stated that residency in the District
boundaries is required. This requirement was not part of LAFCo's conditions, but rather the District's
Resolution. Three of the seven applicants reside outside the District boundaries. In light of the fact that
the District has many people it serves and many people who support the District who reside outside the
District,and in order to enable the Board to interview all applicants, it is recommended to further amend
Resolution No. 04-13 to eliminate the requirement that the Ombudsperson be a constituent of the District.
This recommendation is supported by your Legislative, Finance and Public Affairs Committee. The
following amendment to the resolution is recommended as follows:
Section Two. The Committee's recommendations shall include: a description of the
ombudsperson's role and duties;the desired qualification criteria,

Confirmation of a Special Meeting of the Board of Directors to Further Implement the Processes Set Out in the
District's Resolutions Fulfilling LAFCo's Conditions of Approval of the Annexation of the Coastside Protection
Area
GENERAL MANAGER'S RECOMMENDATION
Confirm a Special Meeting of the Board of Directors for October 26, 2004 beginning at 7:00 p.m, at the Russell
Administration Center in Pescadero for the purposes of receiving additional public input on redistricting.
DISCUSSION
The San Mateo Local Agency Formation Commission (LAFCo)conditionally approved the District's Coastside
Protection Program on April 7, 2004 and subsequently recorded a Certificate of Completion on September 7, 2004.
One of the Conditions of Approval requires that the Board receive public input and reapportion the District wards
to include the Coastside Protection Area within 60 days of the recordation of the Certificate of Completion and
receipt of revised population estimates.
The Board previously confirmed Special Meetings in order to receive public input on ward redistricting alternatives
and approves a redistricting plan within the required timeframe(See Report R-04-91).
• Thursday, October 21, 2004, beginning at 7:00 p.m. at the Days Inn Half Moon Bay(formerly Miramar
Lodge) in Half Moon Bay. The purpose of this meeting is to evaluate and rank ward redistricting
alternatives to include the Coastside Protection Area.
• Thursday,November 4, 2004, beginning at 7:00 p.m. at the MROSD Skyline Field Office.
The purpose of this meeting is to evaluate and rank ward redistricting alternatives to include the Coastside
Protection Area.
• Tuesday,November 9, 2004, beginning at 7:00 p.m. in the Board Room at the District Administrative
Office. The purpose of this meeting is to hold a public hearing for Board approval of a ward redistricting
plan to include the Coastside Protection Area.
In order to provide greater opportunity for public participation in the redistricting process,the following additional
Special Meeting is recommended:
• October 26, 2004, beginning at 7:00 p.m. in Pescadero. The purpose of this meeting is to evaluate and rank

Approval of Salary Adjustment for the Controller and Approval of Controller's Employment Agreement
AD HOC BOARD APPOINTEE EVALUATION COMMITTEE'S RECOMMENDATIONS
1. As a result of the Board's evaluation of the Controller's performance for the Fiscal Year 2003-
2004, the Ad Hoc Board Appointee Evaluation Committee recommends a salary increase of 3
point per annum retroactive to April 1, 2004.
2. Adopt the attached resolution approving the Controller's Employment Agreement to reflect an
adjusted salary of$17,000 per annum.
DISCUSSION
The Board conducted its annual evaluation of the Controller's performance at its August 25, 2004
Special Meeting and was extremely pleased with Mike Foster's performance and service to the District.
The Ad Hoc Board Appointee Evaluation Committee, composed of Directors Cyr, Davey and Siemens,
was instructed to serve as the District's negotiator and was directed by the Board to meet with the
Controller to review his compensation.
The Controller's Employment Agreement calls for an annual performance review and consideration of
any proposals by the Board or the Controller to modify or amend the Agreement. It is also possible for
the Board to award a salary adjustment and grant a meritorious award of up to 5%. However,the
Controller requested that he not be awarded a meritorious increase even though the Board felt he
deserved consideration for the highest award.
The Committee recognized that the original Employment Agreement with the Controller was entered
into on August 23, 1995. The original Agreement is somewhat dated in form, so we have asked General
Counsel to prepare a new Employment Agreement to update and incorporate previous amendments and
modernize the Agreement. The Committee recommends that, based on the Controller's past
performance, the Board approve a salary adjustment for the Controller, increasing his annual salary to
$17,000 (an increase of 3 points) retroactive to April 1, 2004. This salary adjustment takes into
consideration the Controller's past performance and the increase in the cost of living.

WHEREAS, the Agreement provides for an annual review of Controller's performance and an
annual compensation review, which the Board has completed; and
WHEREAS, the Board desires to adjust Controller's annual compensation to include a three point
salary adjustment, increasing his salary to $17,000 per year retroactive to April 1, 2004;
WHEREAS, The Board and the Controller desire to update, modernize and incorporate previous
amendments into the original District Controller Employment Agreement by entering into a new
Employment Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the Midpeninsula
Regional Open Space District does authorize the President of the Board of Directors to execute the
attached District Controller Employment Agreement which incorporates an increase in the Controller's

Authorize an Amendment to the Contract with District Auditor, Macias, Gini & Company, and Authorize
the General Manager to Expend a Total of $28,361 for Auditing Services for Fiscal Year 2003/2004,

GENERAL MANAGER'S RECOMMENDATIONS
1. Authorize an amendment to the contract with District auditor Macias, Gini & Company as set out
in this report;
2. Authorize the General Manager to execute any required amendment and to expend a total of
$28,361 for auditing services for fiscal year 2003/2004, which represents $6,308 over the current
contract amount.
DISCUSSION
In 2002 the District entered into a three-year agreement for auditing services with Macias, Gini&
Company, as the lowest bidder in the Request for Proposal process. The 2003/2004 fiscal year contract
amount for auditing services was quoted as$22,053. Fiscal year 2003/2004 was the first year for the
required implementation of Government Accounting Standards Board(GASB) 34. GASB 34 included
numerous additional requirements, including depreciation schedules for District structures and
improvements, on-site visits, additional interviews,etc. In addition to the added requirements,the
auditors discovered an inconsistency between documents in the District's recent bond refinancing reserve
requirements, which required the auditors to consult with personnel responsible for the District bond
issue. As a result of these two factors, and the fact that District staff could not fully anticipate the
intricacies of the new depreciation schedules,the actual cost of the audit substantially exceeded the
$22,053 quoted.
District staff discussed the overages with Macias, Gini &Company and referred to the contract
requirement that states that any significant additional time necessary would be discussed in advance. The
auditing staff did not fully comply with this portion of contract, giving advance notice only for the bond
refinancing correction discussions. In discussing the total overages with Macias, Gini &Company
management the District staff suggested, upon Board approval,to pay $6,308 of the total overage
amount. This additional amount is not expected to cause an overage in the District's total consulting
services budget. Therefore, no additional budget appropriations will be necessary.

Approval of a Lease Modification/Supplement of Ground Lease for Communications Structures with the
Federal Aviation Administration(FAA), Black Mountain, Rancho San Antonio Open Space Preserve
GENERAL MANAGER'S RECOMMENDATIONS
1. Determine that the recommended actions are categorically exempt from th lifornia Environmental
Quality Act.
2. Adopt the attached Resolution approving the Lease Modification/Supplement of Ground Lease for
Communications Structures with the FAA,Black Mountain,Rancho San Antonio Open Space
Preserve.
DISCUSSION
At your meeting of August 10, 1983,you approved a five-year lease with the Federal Aviation Administration
(FAA)with four five-year options for a communications facility located at Black Mountain, Rancho San
Antonio Open Space Preserve. At your meeting of June 23,2004 you were advised that the District had agreed
to the exercise of the final FAA Option through September 30,2009. In accordance with Section 5563 of the
California Public Resources Code,the District can lease property for a maximum term of 25 years under
certain conditions. A subsequent staff review discovered that in 1993 the District had agreed to a one-year
lease extension. Because of this one-year lease extension in 1993,the current final lease option is for only four
years instead of five(the second and third five-year options were exercised from October 1, 1994 through
September 30, 2004).
Lease Modification/Supplement
Staff has negotiated the terms for the final four years of the lease,ending on September 30,2008. The market
rent over the four-year lease term is a fixed rent of$2,632 per month,which is an increase from the current rent
of$2,015 per month. This rental rate represents a four-year average of market rent for this site factoring in 7%
annual increases. The fixed market rent is preferred by the federal government and is to the District's
advantage as a portion of the later-year increases are received in the earlier years. The calculation of the
proposed rent is as follows:

USE AND MANAGEMENT
On December 8, 1982,the District adopted a communications policy for the existing facilities at Black
Mountain entitled Policies for the Black Mountain Communications Facilities(see Memorandum M-82-119,
November 19, 1982). This policy states that new lease renewals will be considered on a case-by-case basis.
As a continued use of existing communication facilities is what is currently being proposed,the
Communications Site Lease and Agreement is in compliance with the objectives of the above-referenced
communications policy.
CEQA Determination
The project involves the leasing of existing public land and its ongoing maintenance, involving no expansion
of use. It is categorically exempt from CEQA(the California Environmental Quality Act)under Article 19,
Section 15301 as follows:
Section 15301 exempts the operation,repair,maintenance,permitting, leasing, licensing,and minor alteration
of existing public or private structures and facilities involving negligible or no expansion of use beyond that
existing at the time of the lead agency's determination.
Recommendation
Staff supports the Lease Modification/Supplement because the continued use of an existing communications
facility provides increased rental income to the District and conforms to District policy.

THE MIDPENINSULA REGIONAL OPEN SPACE
DISTRICT APPROVING THE COMMUNICATIONS
SITE LEASE MODIIFICATION/SUPPLEMENT WITH
THE FEDERAL AVIATION ADMINISTRATION
(RANCHO SAN ANTONIO OPEN SPACE PRESERVE)
The Board of Directors of the Midpeninsula Regional Open Space District does resolve as
follows:
Section One. The District may, under the provisions of Section 5540 and 5563 of the
Public Resources Code, lease property owned by the District for a period of up to twenty-five
(25)years, and the Board of Directors finds that the premises to be leased for Communication
Facilities remains temporarily unnecessary for park and open space purposes and considers that
amendment of the lease of such premises for Communication Facilities is in the public interest,
on the terms hereinafter set forth.
Section Two. The Board of Directors of the Midpeninsula Regional Open Space District
does hereby approve the Lease Modification/Supplement between the Midpeninsula Regional
Open Space District and the Federal Aviation Administration, a copy of which is attached hereto
and by reference made a part hereof, and does hereby authorize the General Manager to execute
said Lease Modification/Supplement on behalf of the District.
Section Three. The General Manager of the District shall cause to be given appropriate
notice of acceptance to Lessee. The General Manager further is authorized to execute any and all
other documents necessary or appropriate to the closing of the transaction.

Dear Craig:
I want to share with you Save The Bay's full-page advertisement running in the October 8
Mountain View Voice, asking the Navy to fully cleanup Superfund Site 25 in the Moffett Field
wetlands. This ad is part of our campaign to mobilize community pressure on the Navy, which
has been highly effective over the last two years. Our campaign drove the Navy to the
negotiating table with Save The Bay last winter and prompted the Navy to reconsider its 2001
proposal for a partial cleanup. We accomplished this by prompting more than 1000 citizens to
send letters and emails to the Navy demanding a full cleanup, written requests from U.S. Senator
Barbara Boxer and U.S. Representative Anna Eshoo, and a letter from sixteen community
organizations to the Navy.
We are at a critical moment in the campaign. Under tremendous pressure to respond to the
community, the Navy is hosting an informational open house about Site 25 on Thursday, October
14, in Mountain View. We are organizing the community to ask the Navy to fully cleanup its
mess, acutely aware that the Navy is likely to release its revised cleanup proposal in early 2005.
There is much at stake. Moffett Field was once part of a continuous band of pristine tidal
marshes along the South Bay shoreline and a critical part of the Bay's ecology. During the
Navy's occupancy, it turned 260 acres of wetlands that had been diked and separated from the
Bay into a catch basin for stormwater runoff loaded with DDT, PCBs and other dangerous
chemicals. It also disposed of jet fuel and other toxic wastes in a landfill along the shore of the
Bay. With the adjacent salt pond restoration effort commencing, there is an opportunity to
restore this band of wetlands, but this cannot happen if the Navy does not commit and do a full
clean up of all the toxins.
Thank you to Buder Engel and Friends, a top-notch advertising agency that donated its time to
create this insightful ad. We are especially grateful to the hundreds of Save The Bay members
and supporters who have participated in this campaign. I hope you can join us on October 14 to
ask the Navy to protect San Francisco Bay.

I am writing to express my strong support for the Midpeninsula Regional Open Space District's application
for two grants from the Habitat Conservation Fund program to preserve coastal riparian habitat and
endangered andronomous salmonids and trout habitat.
The first $282,500 matching grant in the Riparian Habitat category will use funds to help acquire the 157-
acre Arroyo Leon property,home to fifteen special status species,on the western boundary of the Purisima
Creek Redwoods Open Space Preserve. The property fronts a half-mile segment of the Arroyo Leon,a
perennial stream with a well-developed,dense multi-storied riparian corridor. Red alder,the dorninant
species within the corridor,and other riparian species,grow across the slopes from the property's north
ridge to the streambed on the south side of Arroyo Leon. Wet soils have formed from the abundance of
springs,and the moist conditions are enhanced by the heavy fog drip that occurs nearly year round. The
result is a gradational mix of riparian and mixed evergreen forest on the watershed slopes. An estimated
50%of the property can be considered riparian woodland on the basis of its plants and wet soils.
The second$500,000 matching grant in the Anadromous Salmonids and Trout Habitat category will use
funds to help acquire the 15 1-acre Rapley Ranch property,home to eight special status species, on the
northern boundary of the Russian Ridge Open Space Preserve. A feature of this property is Mindego
Creek,which is important as a spawning and nursery area for the federally threatened steelhead,and is a
potential habitat for the endangered Coho salmon,which historically were present,downstream in San
Gregorio Creek. Recently,a project to restore an area of San Gregorio Creek about one half mile from its
mouth has been started by the San Gregorio Environmental Restoration Center and the San Mateo County
Resource Conservation District. Acquisition of the Rapley Ranch property will protect a key headwater
for San Gregorio Creek, thereby providing an essential link in preserving anadromous salmonid habitat.
These factors make the acquisition and preservation of the Arroyo Leon and Rapley Ranch properties a
high priority for the District,and I urge you to assist in funding these projects,and thereby ensuring these
properties are permanently protected. Together with the adjacent District open space preserves,these
acquisitions enlarge and connect the riparian corridors of the peninsula,as well as enrich the habitats that
are key to protecting steelhead and Coho salmon.

secure funding for two grants that will allow for the purchase and protection of two
distinct properties in San Mateo County.
The first matching grant, for$282,500 is for the 157-acre Arroyo Lean property on the
western edge of the Purisima Creek Redwoods Open Space District. This property is the
home to fifteen special status species, riparian woodland environments and a perennial
stream that serves the riparian corridor.

The second matching grant, for$500,000,is for the 151-acre Rapley Ranch property on
the northern boundary of the Russian Ridge Open Space Preserve. This property is the
home to eight special status species. It is also the source of Mindego Creek, a spawning

interested in preserving these two important properties.

efforts that will result in the extension of San Mateo County's significant open space
areas.

In a year where many camps were still facing declining enrollments, Hidden Villa Summer
Camp continued to be a great success. We served a total of 929 children ages 6 to 18. We are
pleased to have been able to share Hidden Villa's mission of multicultural understanding and
environmental awareness with so many children.
Thanks to the generosity of so many, we were able to award a total of 404 scholarships; 225
scholarships were in the Residential Programs, meaning that 60% of our residential campers
attended with some level of financial assistance. Day Camps awarded a total of 178
scholarships.
Our programs ran exceedingly well last summer — due largely in part to your contributions
that helped us provide a quality educational and recreational experience for our diverse
program participants. We are fortunate to have individuals like you who allow us to continue
building an outstanding program that draws so many committed staff, volunteers, and
program participants to Hidden Villa.
We'd like to especially recognize the efforts and express our gratitude to Ranger Francis
Reneau for her help in educating our 2004 Summer Camp Staff about the Mid Peninsula
Open Space District.

Re: Progress Report—El Corte de Madera Creek Open Space Preserve Watershed
Protection Program
Year one construction activities at the Preserve are nearly complete. The contractor has
finished installing all of the new culverts, and the rock fords are expected to be completed
by the end of this week. Frequently-spaced rolling dips and waterbars have been installed
along sections of the Methuselah, Timberview, Springboard, and Gordon Mill patrol roads.
A few remaining punch list items will be completed over the next two weeks, including
application of baserock to armor the road surface in a few key locations, and installation of
erosion control materials in preparation for the rainy season. Tim Best, the Project
Engineer, and Craig Beckman, Skyline Area Construction and Maintenance Supervisor,
have conducted thorough inspections of the work to date. For the most part, they are
satisfied that the contractor's work meets the project's objectives and will result in a
significant long-term reduction in erosion.
However, due to dry soil conditions and the difficulty of bringing large amounts of water
to the more inaccessible work sites, in some locations the construction activities have
generated more dust and loose soil than was anticipated. To prevent erosion at these
locations and to provide an opportunity for the freshly shaped rolling dips to "settle in",
staff feels that there would be benefit in keeping the roads closed to the public until the
winter rains have soaked in to the soils and further compacted the road surface. These
closures would need to apply to much of the southern half of the Preserve in order to
effectively direct visitor traffic away from all of the construction areas. The northern half
of the Preserve would remain open, providing opportunities for hikers and cyclists to
continue enjoying the Preserve throughout the winter months. The Planning and
Operations Departments will finalize our recommendations for your review this week.
Should you approve these temporary closures, signs would be installed on-site, and
informational materials would be posted on the District's website and sent to project
stakeholders and interested parties.

I am writing to you on behalf of the Midpeninsula Regional Open Space District to express some
concerns about the message of a recent GU advertisement. To give you some background, the
District is an independent, California special district(public agency with an elected Board of
Directors)whose mission is to acquire and preserve a regional greenbelt of open space land in
perpetuity, protect and restore the natural environment, and provide opportunities for
ecologically sensitive public enjoyment and education. Many mountain bicyclists enjoy our
preserves.
Your ad "Ranger dodging. Sweet." (copy enclosed)was probably meant to appeal to the juvenile
in all of us and as such, is harmless,but it has nevertheless left a bitter aftertaste. Here's why:
The attitude you portray to sell your liquid is troubling because it shows a lack of concern for the
environment and a lack of understanding regarding the responsibilities of public land managers.
Racing down hills is, I'm sure, almost as sweet now as it was when we were all teenagers. But
now we've own u and we should know that as a result of the type of behavior that is

encouraged in your ads, our public lands are facing tough problems, including erosion and
sedimentation of streams. Is this really a"Big Deal?" Absolutely. There are streams in the

Re: Boundary Dispute Resolution—El Sereno Open Space Preserve
This memo is to inform you of the successful outcome to a boundary dispute at El Sereno Open Space
Preserve. This outcome was greatly facilitated by Sumudu Welaratna and Matt Sagues of our
Planning Department,and by Kerry Carlson and Frances Reneau of our Operations Department.
District Field staff initially recognized unauthorized use of an area of El Sereno Open Space Preserve
that shares a boundary with a residential parcel adjacent to Highway 17 south of the Cats Restaurant.
The primary question was the exact location of the boundary line,about which even the District's past
property information was unclear. The private-property owner believed the boundary to be uphill of a
Eucalyptus grove, and at a location where dirt roads intersected with an old road used by the District.
The private property owner had cleared brush for fire protection. Planning and Operations staff took
the Trimble GPS unit to the site to map the area of the boundary in question, and then translated that
information onto a professionally prepared set of maps. These maps clearly indicated that the
property owner's activities were well within the Preserve's boundary.
We presented this information and the maps to the private property owner, and explained to him that,
although we felt the information was correct,only an actual survey could precisely define the
boundary location. We further explained that such a survey would be costly to both parties, and
would very likely indicate that the boundary was in the same general area as indicated by the
District's GPS unit. We then suggested that the simplest solution would be for both parties to agree
to respect the boundary location as depicted by the GPS information. The private property owner
approved of this approach,in writing, and agreed to immediately cease his unauthorized use of
District land.
This process has saved the District considerable funds,improved communications and understanding
with an adjacent neighbor,and quickly resolved a boundary dispute.

Dear Ms.Hernandez,
Thank you for providing the Midpeninsula Regional Open Space District(District)an opportunity
to review and comment on the DEIR for the Lenihan Sam Outlet Modifications Project. The
District is a public agency that was formed by voter initiative in 1972 to preserve,protect, and
enhance open space lands in the San Francisco Bay Area. The District owns and manages St.
Joseph's Hill Open Space Preserve, which is located less than one-half mile from the project site
and immediately north of Lexington County Park and east of Los Gatos Creek Trail.
The District is concerned about the potential negative effects that the proposed project may create
recreational opportunities in the area. After reviewing on the natural resources and pp S the DEIR, it
appears that the environmental document does not adequately address a number of important issues
and is missing critical property ownership information. Please accept the following comments
regarding the scope and content of the DEIR:
1. The project description includes plugging the existing outlet pipe with concrete once it
becomes obsolete. Unfortunately,the DEIR does not analyze the physical removal and
disposal of the facility as an alternative to plugging in place. Please explain the feasibility
and environmental concerns associated with the removal of the old outlet pipe.
2. Please add a map showing the trails and public agency ownership and management of lands
located within 1,500 feet of the project site overlaid with the location of the proposed new
facilities.
3. According to the DEIR,at least one parking facility on Alma Bridge Road would be closed
to the public for an extended period of time and used as a temporary staging area. Please
show on a map the location of the parking areas and parking spaces that will be temporarily
inaccessible to the public during construction. Please include the location of other parking
slots and vacant spaces that will be made temporarily available for visitors who wishes to
access nearby trails and open space lands.
4. Please explain the recreational impacts,if any,that may result on other local trails and parks
as visitors seek alternate recreational opportunities to avoid the construction area.
5. The DEIR identifies the need to temporarily reroute trail traffic during construction. Please
show on a map the alignment of the temporary trail reroute and the location of signs,
flagmen,barricades,etc., that will be in place to ensure public safety and compliance.
6. According to the DEIR,monetary costs for the preferred alternative are lower,but the
environmental impacts greater when compared to the option of retrofitting the existing outlet

the retrofitting alternative, such as potential earthquake damage and increased maintenance

term), and the ability to correct the operational problem if it does occur.

Re: Schools participating in the District's Spaces& Species program
In an effort to diversify the circle of schools that participate in the Spaces& Species
program we took the initiative a couple of months ago to increase the number and
geographic location of schools invited to take advantage of the program. In addition,we
adopted a more aggressive approach to informational outreach—with some success.
Since registration began on September 8,2004, we have been able to sign up the Kings
Mountain School and we are in the process of arranging a requested docent-led hike for the
Seacrest School in Half Moon Bay. Pacifica's Oceanview School has expressed an interest
in participating in next spring's Spaces& Species classes. This winter,we will also arrange
visits with coastside schools to further educate them about the program and create a more
personal connection with the District.

At last Monday night's meeting the City Council of Redwood City approved the Proposal and
Plan for the Restoration of Bair Island, part of the Don Edwards National Wildlife Refuge. The
purpose of the Plan is to enhance the restoration plan produced by the United States Fish and
Wildlife Service (FWS). I've enclosed a copy of our Plan for your information.
We're confident that our alternative, complementary Plan offers full protection to Bair
Island's inherent environmental features, while providing enhanced opportunities for low-
intensity public access, education, and understanding of the island's unique qualities. I'm sure
you'll agree that only through such involvement and understanding can the peninsula
commurity gain a flail appreciation of Bair Island's environmental values and the need for long-
term, sensitive stewardship of this unique open space, in the midst of an intense urban setting.
We will be formally presenting our Plan to the FWS at its public hearing on September 22nd
as our official comment on that agency's restoration plan and Environmental Impact Statement
(EIS). The comment period for the FWS plan and EIS ends on October 12, 2004.
Seeing that our restoration proposal is quite consistent with the Midpeninsula Regional
Open Space District's stated mission, Redwood City's Plan would gain a great deal of additional
standing if the District was to add its endorsement, within that comment period. Either
Councilmembers Rosanne Foust or Barbara Pierce, or I will be calling you shortly so we can
discuss how we might best proceed.
In addition to the City's Plan, I have also attached excerpts from our presentation to the City
Council: an outline of the City's goals for Bair Island, a comparison of elements of our Plan with
that of FWS, the City's recommendations, and an encouraging letter from Craig Manson,
Assistant Secretary for Fish, Wildlife, and Parks, in the U.S. Department of the Interior.
