TOWN OF HOPKINTON Town Manager’s Office DATE: December 8, 2023 TO: Select Board FROM: Elaine Lazarus, Assistant Town Manager RE:Request to Acquire Town Land - Parcels of Land in the Lake Maspenock Area The Town owns several parcels of land in the Lake Maspenock area, and four individuals inquired over the last several months as to whether certain parcels could be acquired from the Town. Such requests are received from time to time, and the process typically undertaken when a request is received is as follows: 1. Staff determination as to which Board/Committee has jurisdiction of the parcel and whether it is land that can be sold/transferred. For example, if it is designated open space or used by a Town office or activity, it is not available. Most of the land owned by the Town is in these categories. 2. If the land is not encumbered as noted above, staff distributes information about the parcel(s) to town boards/committees and town officials that may have an interest in the land, and seek feedback. 3. Provide that feedback with recommendations to the Select Board for review and a determination as to whether to move the process forward to Town Meeting in order to declare the land available for disposition. In order to gather information as to whether the Town has a potential or planned use or need for each of the properties for which inquiries were received, I distributed a memo to the Conservation Commission, Open Space Preservation Commission (OSPC), Trail Coordination & Management Committee (TCMC), Affordable Housing Trust Fund Board, Planning Board, Parks & Recreation Commission, Director of Public Works, Town Engineer/Facilities Director, Health Director, Fire Chief and Police Chief in August, 2023 asking for feedback each parcel. Below is a compilation of the comments and recommendations received, as well as information on each parcel. Some of the parcels were evaluated previously in the “Town of Hopkinton Small Parcels Analysis & Disposition Plan” study 1998, and I have included information and recommendations from that document as well. Maps showing parcel locations are attached. From Small Parcels Study (Site #19):This lot is also undevelopable by virtue of size and slope.It appears to be used for wood storage by the owner of the house on Hayward Street Lot 34. ●Feedback Received:Maintain ownership of parcels that have drainage swales/infrastructure;maintain ownership of lots that have Lake Maspenock access. Recommendation:Retain ownership. L35 110 0 -0 Knoll Rd. ●Acres:0.28 ●Zoning District:Residence Lake Front ●Assessed Value:$185,000 ●Description:Parcel has about 100 ft.of frontage on Knoll Rd.It was taken for back taxes in 2006.It is not adjacent to other Town owned land. At the Annual Town Meeting in May,2013,Article 63:Voted:that the Town authorize the Board of Selectmen,on behalf of the Town,to sell or otherwise 2 dispose of a parcel of land,consisting of 12,197 square feet of land,located on Knoll Road,shown on the Assessors Map as L35 110 0,as well as all buildings and appurtenances thereon,under such terms as it may determine. The lot was never sold;the potential buyer could not afford the fair market value price. The 2013 vote is still valid,however,the opinions regarding its disposition may have changed since then. ●Feedback Received:None specific to this parcel from Town departments. Recommendation:Consider proceeding with disposition as previously authorized. L35 131 0 -0 Duffield Rd. ●Acres:0.09 ●Zoning District:Residence Lake Front ●Assessed Value:$3,600 ●Description:The parcel fronts on Duffield Rd.,and is adjacent to another small parcel owned by the Town fronting on Beach St.The parcel may have been acquired in 1957. From Small Parcels Study (Site #28):Upland parcel at a very high grade off Duffield Rd. Frontage is unusable for access because of steep slope. ●Feedback Received:None specific to this parcel. Recommendation:Consider disposition of this parcel with an adjacent 0.5 acre parcel landlocked parcel the Town owns behind it,at 0 Beach St.(L35 136 0). L35 173 A -0 Yale Rd. ●Acres:0.51 ●Zoning District:Residence Lake Front ●Assessed Value:$197,900 ●Description:The parcel fronts on Yale Rd.,and is adjacent to other Town parcels.It contains about 100 feet of frontage.The parcel was acquired in 1982. From Small Parcels Study (Site #29):Low lying,undevelopable lots. ●Feedback Received:None specific to this parcel. Recommendation:Retain ownership.Parcel is one of several adjacent parcels owned by the Town which are low-lying and serve an informal stormwater management function and have open space value. L35 189 0 -0 Bowdoin Rd. ●Acres:0.11 ●Zoning District:Residence Lake Front 3 ●Assessed Value:$4,000 ●Description:This narrow parcel is bounded by Bowdoin Rd.(paper street),Yale Rd.,and Old Town Rd.The parcel was acquired in 1978. From Small Parcels Study (Site #38):Landlocked wooded lot only reachable by crossing private property.[Parcel was inaccessible] ●Feedback Received:None specific to this parcel. Recommendation:Retain ownership.Parcel is adjacent to a large parcel of undeveloped land,and therefore has open space value as an extension.Reconsider if adjacent parcel is developed and a road has been constructed to serve the parcel. L35 4 0 -0 Lake Shore Drive ●Acres:0.06 ●Zoning District:Residence Lake Front ●Assessed Value:$16,400 ●Description:The 50 ft.wide lot has homes on either side,and extends from Lake Shore Dr.to Lake Maspenock in the rear. From Small Parcels Study (Site #31):Parcel appears to be used as a drainage easement and runs between existing houses at 42 Lake Shore Drive and 46 Lake Shore Drive.The Town’s ownership stems from unknown circumstances -an undocumented owner and sale date (1900),and a $1.00 conveyance.The parcel contains 2,613 square feet of land. ●Feedback Received:Maintain ownership of parcels that have drainage swales/infrastructure;maintain ownership of lots that have Lake Maspenock access. The Boards of Selectmen from the District‘s participating communities will appoint a Board of Directors pursuant to statute (MGL c.1 15, §11). For the purposes of this agreement, it shall be agreed that the members of the Board of Directors may appoint an alternate each year in the event the Board of Directors member has any extended leave that would render the Board Member unable to participate and potentially cause lack of quorum. The District agrees to appoint a full time Veterans ' Services Director, part-time Veterans' Agent to support the Director’s fulfillment of his duties and to act in his absence, and administrative support staff. Staff will have a presence in each of the communities to ensure a proper level of service to the District's constituents. The District Board of Directors will set the compensation of the above positions, determine the expenses of the department, and said positions and apportion the expenses among the municipalities as determined by the population of each municipality based on the most recent federal census. The member communities will pay the annual assessment as determined by the Board of Directors to the District Treasurer By the 15th of July of each Fiscal Year. These payments will represent compensation for the administrative, administrative, and other costs incurred by the District's Veterans' Services Department. The District Board of Directors will appoint a District Treasurer and District Accountant from the Town that the District Budget is managed from. The District Board of Directors will direct the appointed Director of Veterans' Services to perform the duties of his office in each of the municipalities comprising the District. The duties of the Veterans' Director and staff will be performed principally during regularly scheduled business hours in the designated central office located in Holliston, Massachusetts in a building owned by the Town of Holliston, during set hours in satellite offices in the remaining three participating towns, and by appointment. Hours of operation will be duly posted at each office location. Distribution of benefits payable under Massachusetts General Law chapter 115 to veterans of each community will be paid by the Treasurer of the community in which the veteran resides. The seventy-five percent (75%) reimbursement of veterans’ benefits from the state will be credited to that community which issued such benefits. This Agreement will be subject to renewal on a biennial basis, co-terminus with the approved District term so approved by the Commonwealth of Massachusetts. The member communities may terminate participation by providing sixty (60) days notice to the Board of Directors. Adjustment One proposed the reprogramming of matching funding for MassDOT Community Transit Grants to procure new mobility vans for Cape Ann Transportation Authority, MetroWest Regional Transit Authority, City of Revere, Town of Hull, and Town of Randolph. The TIP is the five-year rolling capital plan for the 97 cities and towns in the Boston Region Metropolitan Planning Organization's planning area. The TIP documents all the transportation projects receiving federal funding in the region over the next five years. This includes projects funded with the specific pot of federal money the MPO has direct discretion over, called Regional Target funds, and projects pursued with federal transportation dollars by the Massachusetts Department of Transportation (or MassDOT), the MBTA, the MetroWest Regional Transit Authority (or MWRTA), and the Cape Ann Transportation Authority (or CATA). What is a TIP amendment? In addition to deciding how Regional Target funds are spent, the MPO board reviews and votes to endorse the full list of projects prioritized by other agencies and any changes made to these projects throughout the life of the TIP. These changes are called amendments and must be released for a 21-day public review period before the MPO can approve them and the funds can be spent. What is a TIP adjustment? Some changes to projects in the TIP are not large enough to qualify for an amendment. These changes are called adjustments, and the MPO can vote to approve them without releasing them for public review.
