ORDINANCE NO.
AN ORDINANCE OF THE CITY OF IONA, IDAHO;
DECLARING THE CITY CLERK CUSTODIAN FOR
PURPOSES OF THE IDAHO PUBLIC RECORDS ACT;
AMENDING SECTION 1-14-6 OF THE IONA CITY CODE;
AMENDING THE DEFINITION OF CUSTODIAN;
PRESERVING PRIOR ORDINANCE; PROVIDING FOR
METHODOLOGY; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Declaration of Custodian. The City Clerk is hereby designated the
custodian of all records of the City, as required by Idaho Code §§ 74-102(16) and 74-119.
Section 2. Amendment of Section 1-14-6 of the Iona City Code. Section 1-14-
6 of the Iona City Code is amended as follows:
1-14-6: CUSTODIAN DEFINED. For the purpose of this chapter, the term
"custodian" shall mean (A) the Cit Clerk, includin• any and all emplo ees or
representatives of the City Clerk and (B the person having actual physical custody of the
records for which inspection or copying is sought. The custodian shall have custody of,
control of, and/or authorized access to the pertinent records of the City. The custodian
shall also receive all public records requests with any employees or representatives of the
custodian acting as alternate custodians for contingencies.
Section 3. Methodology. Text that is underlined in the preceding sections
means new text added to the former Ordinance or City Code Section, and text that is
stricken through means text that is being deleted from the former Ordinance or Code
Section. Text that is moved from one location in the former Ordinance or Code Section to
another location is similarly shown as underlined text, being stricken through in its prior
position.
Section 4. Severability. The sections and subsections of this Ordinance are
severable. The invalidity of any section or subsection shall not affect the validity of the

Section 5. Effective Date. This Ordinance shall become effective upon its
passage, execution and publication in the manner provided by law.
