AN ORDINANCE AMENDING THE MUNICIPAL CODE OF TIFFIN,
IOWA, SECTION 105.06 OF CHAPTER 105, TO CHANGE THE
DEFINITION OF YARD WASTE AND INCREASE PENALTIES FOR
DUMPING OF NON -YARD WASTE AT CITY BURN SITE.
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to amend Section 105.06
of Chapter 105 of the Municipal Code of Tiffin, Iowa, to change the definition of
yard waste and increase penalties for dumping items other than yard waste at the City
burn site.
Section II. Amendment. Chapter 105 is hereby amended as follows:
CHAPTER 105
SOLID WASTE CONTROL
105.06 SEPARATION OF YARD WASTE REQUIRED. All yard waste shall be
separated by the owner or occupant from all other solid waste accumulated on the
premises and shall be composted or burned on the premises on designated days in the
spring and fall or hauled to the City yard waste burn site. As used in this section,
"yard waste" means grass clippings, leaves, garden residue and branches no larger than
2 inches in diameter. Yard waste does not include tree stumps. In addition to the civil
penalty set out in Chapter 3 of this Code of Ordinances for a violation of this section,
any person who hauls items to the City Yard Waste Burn Site other than what is
defined as "yard waste" in this section shall be liable for the costs of removal and
disposal of said items.
Section III. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
Section IV. Severability Clause. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not
affect the validity of the ordinance as a whole or any section, provision or part thereof
not adjudged invalid or unconstitutional.
Section V. When Effective. This ordinance shall be in effect after its final
passage, approval, and posting as provided by law.
On the 8' day of July 2015, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Upton introduced Ordinance No. 2015-377 and moved that it
be given its first reading. The motion was seconded by Councilperson Havens.
Ayes: Peggy Upton, Jim Bartels, Al Havens, Mike Ryan, Jo Kahler
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2015-377, was read the first
time, discussed, and placed on record.
On the 22nd day of July 2015, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Upton introduced Ordinance No. 2015-377, and moved that it
be given its second reading. The motion was seconded by Councilperson Havens.
Ayes: Kahler, Upton, Bartels, Havens, Ryan
Nayes: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2015-377, was read the
second time and discussed and placed on record.
On the 12th day of August 2015, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Upton introduced Ordinance No. 2015-377, and moved that it
be given its third and last reading. The motion was seconded by Councilperson
Kahler.
Ayes: Havens, Kahler, Upton, Bartels, Ryan
Nayes: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2015-377 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the Council
on the 12th day of August 2015 and approved by the Mayor on the 13th day of
August 2015.

ordinance entitled AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF TIFFIN, IOWA, SECTION 105.06 OF CHAPTER 105, TO CHANGE THE
DEFINITION OF YARD WASTE AND INCREASE PENALTIES FOR
DUMPING OF NON -YARD WASTE AT CITY BURN SITE and known as No.
2015 -377 was duly passed by the Council on the 12' day of August 2015, and signed
by the Mayor on the 13th day of August 2015, and published on the 14th day of
August 2015, by posting copies thereof in three public places within the limits of the
City of Tiffin, Iowa. That I posted copies of Ordinance No. 2015 - 377 in the
following places:
