AN ORDINANCE TO AMEND THE TIFFIN ZONING ORDINANCE TO ADD A
HIGH-DENSITY SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section I. PuMose: The purpose of this ordinance is to add a high density single family
residential zoning district, R -1D, to the Zoning Ordinance of the City of Tiffin.
Section II. Amendment: The heading of Section 3 is replaced with the following:

Section I11. Amendment: Subsection R -1A, R -1B, R -1C of Section 3 of the Tiffin Zoning
Ordinance is replaced with the following:

RESIDENTIAL DISTRICT
LOW -MEDIUM-HIGH DENSITY SINGLE FAMILY
R-1 A, R-113, R-1 C, R-1 D
.01 INTENT and DESCRIPTION OF DISTRICTS
This district intends to establish and preserve quiet single-family, residential neighborhoods free from other uses except those
that are both compatible with and convenient to the residents of the district. The single-family, residential district will be
comprised of larger lots than required within the other residential districts in order to maintain a low population density.
R -1A The R -1A Single -Family Residential District intends to provide and maintain low-density, single-family residential
neighborhoods with a minimum lot size of 18,000 square feet. This district is protected from the encroachment of
incompatible uses. Commercial uses are limited to allowable home occupations.
R-1 B: The R-1 B Single -Family Residential District intends to provide and maintain medium -density, single-family residential
neighborhoods with a minimum lot size of 14,000 square feet. This district is protected from the encroachment of
incompatible uses. Commercial uses are limited to allowable home occupations.
R -IC: The R -1C Single -Family Residential District intends to provide and maintain medium -high-density, single-family
residential neighborhoods with a minimum lot size of 10,000 square feet. This district is protected from the
encroachment of incompatible uses. Commercial uses are limited to allowable home occupations.
R-1 D: The R-1 D Single -Family Residential District intends to provide and maintain high-density, single-family residential
neighborhoods with a minimum lot size of 7,000 square feet. This district is protected from the encroachment of
incompatible uses. Commercial uses are limited to allowable home occupations.

.02 PRINCIPAL USES AND STRUCTURES PERMITTED
A. Dwellings, single-family
B. Churches and temples
C. Public schools, elementary, junior high and high schools
D. Parochial or private schools having no rooms used regularly for housing or
sleeping purposes
E. Public buildings, public and semi-public parks, playgrounds, community centers,
libraries and museums
Day care facilities
R-1 A, R-1 B, R-1 C, R-1 D
.03 ACCESSORY USES AND STRUCTURES PERMITTED
The following uses and structures, accessory to a principal permitted use or a special exception use, are permitted subject to
the provisions of Section 9.05:
1. Private garages, only when an attached garage does not exist.
2. Private swimming pools
3. Private greenhouses not operated for commercial purposes
4. Garden sheds
5. Accessory uses or structures according to the provisions of Section 9.05
6. Temporary uses or structures used in conjunction with construction work; provided however, the buildings comply with the
provisions of Section 9.21.

.04 SPECIAL EXCEPTION USES
The following special exceptions are permitted in the R -1A, R-1 B, aPA R-1 C, and R-1 D Districts, subject to provisions of Section
11.07, which mandates the approval of all special exceptions by the Board of Adjustment.
A. Cemetery or mausoleum
B. Public utilities
C. Swimming pools, golf courses and country clubs, except miniature courses or driving ranges operated for a profit
D. Long-term care facilities

.05 AREA REQUIREMENTS
The minimum lot areas and widths, density, setbacks, and height restrictions, are as prescribed in the following Table R -1A, R -1B
and R-1 C, R-1 D; provided however, the following requirements apply when applicable:
A. Any lot adjacent to U.S. Highway 6, in any way, is required to have a 20 -foot setback in addition to the minimum yard
requirements stated herein, except those properties that are located adjacent to Highway 6 beginning at the east line
of Main Street to a point 233 feet, more or less, west of the intersection with Roberts Ferry Road and Highway Six,
which are required to have a 32 -foot setback, in addition to the minimum yard requirements state herein.
B. Any lot adjacent to a railroad right-of-way, in any way must be required to have a 50 -foot setback in addition to the
minimum yard requirement stated herein.

.06 SIGNS REGULATIONS
Signs are permitted according to the provisions of Section 6.

.07 PARKING AND LOADING REGULATIONS
Parking and loading must be provided according to the provisions of Section 7.

.08 LIGHTING REGULATIONS
Exterior lighting is regulated according to the provisions of Section 8.

.09 LANDSCAPING REGULATIONS
At the time of new construction, all zones require a landscaping plan for review by the Planning and Zoning Commission or the
city designee. The plan must be appropriate to the zone and must be submitted at the time of application for a building permit.
The plan is subject to review and approval of the city.
Applicants in residential zones must provide in their landscaping plans no less than one deciduous tree per building parcel.
The P&Z may also request additional landscaping, such as shrubs and border vegetation if this appears to be beneficial to the
entirety of the building plan.

.10 SPECIAL REGULATIONS:
A. Maximum Occupants
The maximum number of persons who may occupy a dwelling is limited to three persons for each bedroom in the
dwelling. The Titleholder may not allow the number of occupants to exceed this limit.

Section IV. Re ealer. All ordinances or parts of ordinance in conflict with the provisions of
this Ordinance are hereby repealed.
Section V. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance
as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section VI. When Effective. This ordinance shall be in effect after its final passage, approval,
and posting as provided by law.

Councilperson Ryan introduced Ordinance No. 2015-378, and moved that it be given its first
reading. The motion was seconded by Councilperson Kahler
Ayes: Havens, Kahler, Ryan, Upton, Bartels
Nays: NONE
5 members of the Council being present and having voted "Aye", Mayor Steve Berner declared the
motion carried, and Ordinance No. 2015-378 was read the first time, discussed, and placed on
record.
On the 9`h day of September 2015, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2015-378, and moved that it be given its second
reading. The motion was seconded by Councilperson Bartels.
Ayes: Upton, Havens, Ryan, Kahler, Bartels
Nays: none
5 members of the Council being present and having voted "Aye", Mayor Steve Berner declared the
motion carried, and Ordinance No. 2015-378, was read the second time and discussed and placed
on record.
On the 22nd day of September 2015, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2015-378 and moved that it be given its third and
last reading. The motion was seconded by Councilperson Kahler.
Ayes: Bartels, Havens, Kahler, Ryan, Upton
Nays: NONE
5 members of the Council being present and having voted "Aye", Mayor Steve Berner declared the
motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2015-378 be adopted and signified his
approval of same by fixing his signature thereto. Passed by the Council on the 22nd day of
September, 2015 and approved by the Mayor on the 22nd day of September, 2015.
