CLEMENTS MAYOR VICE MAYOR COMMISSIONER COMMISSIONER COMMISSIONER Also attending: Attorney, John Randolph, Town Manager, William Gwynn, Deputy Town Clerk, Barbara Gwynn, Police Chief, Robert Holroyd Mr. Brian Pfeifler, Mr. Sampietro and Mr. Thomas Houldsworth. The meeting was called to order at 9 A.M. Commissioner Clements noted a misspelled word on page three paragraph four of the February 8, 1980 Minutes. Correction will be made, Minutes were accepted. It is notedthat Commissioner Hunter arrived at this time, 9:05 A.M. Upon motion by Commissioner Clements, seconded by Vice Mayor LaPorte, the Commission approved the Financial Report for the month of February, 1980. The following Police Report for the month of February, 1980 was submitted to the Commission. Mr. Thomas Houldsworth, Account Executive with Risk Management Services, Inc. gave a short summary of the advantages the Town may derive by inclusion /to the Florida Municipal Liability Self Insurerls Program, he noted that not only could the Town expect a small reduction to the cost of insurance but the possibility of a dividend at the end of the year. After a general discussion the Commission appointed Commissioner Clements to review the insurance program and report at the next meeting. MILEAGE. Upon motion by Vice Mayor LaPorte, seconded by Commissioner Clements the Commission accepted Ordinance 80 -2 on SECOND and FINAL reading. ORDINANCE 80 -2 AN ORDINANCE FOR THE TOWN OF GULF STREAM, FLORIDA, AMENDING ORDINANCE 79 -2 OF THE TOWN AT SECTION 4 OF SAID ORDINANCE REGARDING ANCHORING OR MOORING OF VESSELS BY RESTRICTING THE DOCKING OF BOATS OR VESSELS TO PIERS WHICH ARE ACCESSORY USES TO RESIDENTIAL DWELLING UNITS; BY ADDING A NEW SECTION TO REQUIRE PERMITS FOR THE DOCKING OF BOARS AND VESSELS WITHIN THE TOWN; PROVIDING RESTRICTIONS ON MAINTENANCE ON BOATS AND VESSELS WITHIN THE TOWN; PRO- VIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. Upon motion by Vice Mayor LaPorte seconded by Commissioner Hunter the Commission accepted on FIRST reading Ordinance 80 -3 ORDINANCE 80 -3 AN ORDINANCE FOR THE TOWN OF GULF STREAM, FLORIDA, AMENDING ORDINANCE 71 -5 RELATING TO RESTRICTIONS REGARDING ANIMALS RUNNING AT LARGE. A letter from the South Central Regional Wastewater Treatment and Disposal Board was read to the Commission. After a general discussion the Town Clerk was instructed to write a letter stating the Town's position and the desire to participate subject to future funding when and if it becomes available. Mayor Koch stated the Town Charter was approved by voters in the March 11th, 1980 election. Final count 177 FOR and 30 AGAINST. A discussion followed concerning the desire to have all residents in Gulf Stream vote at the Town Hall, at the present time residents in Place Au Soleil are voting at Atlantic High School. The Town Clerk was instructed to contact Jackie Winchester, Supervisor of Elections to express the Town's desires and report back at the next meeting. Vice Mayor LaPorte reported that landscaping the Gulf Stream Golf Club's water pumps located at the entrance to Place Au Soleil was completed. She also suggested that the curb on the north side of the cement wall be cut making an entrance to the Club's and Mr. Farrar's property and close off the existing opening. The Town Clerk was instructed to follow up on this matter. A letter from Mr. JouJon Rouche was read to the Commission and is a part of the Minutes. Meeting adjourned 9:55 A.M. Thank you for arranging for use of the Town Hall for our Association membership meeting on Tuesday evening, March 25, 1980, at 7 :30 p.m. 2. Please remind the Town Commission that the Association would appreciate hearing from the Gulf Stream Golf Club in regards to the program for improving the view of the pumping stations adjacent to Place Au Soleil. This was to have been completed during the last summer months, but nothing has been done to date. See Mr. Briggs' letter of May 7, 1979, to the Town Council. 3. As you requested we discussed the problem of dumping trash etc. on empty lots during our last officers' meeting - and we'll bring this to the attention of the membership in our coming Newsletter. 4. There has been excessive speeding by motorists on the streets in Place Au Soleil. It would be appreciated if the police would stop and warn motorists, as was reported they do on A.I.A. at the last Commission meeting on February 8th. CARLSON AOMIN15TRATIVE DIRECTOR 734 -2577 OR 272.7063 February 28, 1980 It is necessary to communicate with you at this time on a subject of critical importance to the area served by the South Central Regional Wastewater Treatment and Disposal Board ( SCRWTD). At this time the population projections of the Area Planning Board, confirmed by the estimates of the City Planners in Delray Beach and Boynton Beach, when' added to current sewer plant loads indicate that the current regional facility will experience flows which exceed the design capacity in 1982. We must, therefore, commence action immediately to expand our capacity. Before submitting our request to the pertinent Regulatory Agencies, we would like to inquire as to your intentions. As you know, your area was excluded from consideration in the current 201 Plan by your choice. Should you desire to be considered on the occasion of this increase request, please have your staff provide the following information not later than March 17, 1980: 1. Your current average daily sewerage flow for which the SCRWTD would become responsible; 2. The population projections for your areas through 1990 for the areas the SCRWTD would be asked to accept responsibility; 3. Your staffs estimates of when you desire to begin to be serviced by the SCRWTD. Because of the unanticipated burgeoning growth in our service area we must complete our planning for expansion under extremely tight time con- straints. The current indications are that we will be unable to increase our capacity before reaching our current facility's design limits. There- fore, we must ask for your formal acceptance or rejection of this offer to have the SCRWTD service your citizens in the region not later than March 15, 1980. We regret that this time frame is so short, but we are sure that you will appreciate the urgency of our request. Mayor William F. Koch February 28, 1980 Page Two If you desire your area to be added to the SCRWTD service region, you may expect that we would have the capacity to commence such service in 1985. It is expected that the SCRWTD will, on the basis of this proposed increase, meet all of its needs through 1990. Therefore, a request for inclusion in the region after the above deadline and prior to the next scheduled increase will be considered only if the applicant accepts full responsibility of all costs attendant thereto. In the interest of expediency we have provided copies of this letter directly to your staff and affected regulatory agencies. Your prompt attention to this matter is greatly appreciated. 1 will, of course, hold myself available to meet with you on this subject. Respectfully, I Malcolm T. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, AS FOLLOWS: Section 1. Ordinance 71 -5 of the Town is hereby amended at Section 1 by changing the definition of "at large" to read as follows: "at large" shall mean off the premises of the owner, unless accompanied by an attendant who shall have such dog firmly held by collar and leash or other use of mechanical restraint, which leash is not to exceed eight (8) feet in length. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. In the event any phrase, clause, sentence, paragraph or other section of this Ordinance is declared to be unconstitutional, invalid or unenforceable, such ruling shall not effect any of the remaining phrases, clauses, sentences, paragraphs or sections of said Ordinance. ATTEST: Town of Gulf Stream 246 Sea Road Gulf Stream, Fla. 33444 r uc 1 ORDINANCE NO., 80 -2 AN ORDINANCE FOR THE TOWN OF GULF STREAM, FLORIDA, AMENDING ORDINANCE 79 -2 OF THE TOWN AT SECTION 4 OF SAID ORDINANCE REGARDING ANCHORING OR MOORING OF VESSELS BY RESTRICTING THE DOCKING OF BOATS OR VESSELS TO PIERS WHICH ARE ACCESSORY USES TO RESIDENTIAL DWELLING UNITS; BY ADDING A NEW SECTION TO REQUIRE PERMITS FOR THE DOCKING OF BOATS AND VESSELS WITHIN THE TOWN; PROVIDING RESTRICTIONS ON MAINTENANCE ON BOATS AND VESSELS WITHIN THE TOWN; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF (STREAM, FLORIDA: Section 1. Ordinance 79 -2 of the Town of Gulf Stream, Florida, its hereby amended at Section 4 of said Ordinance, ANCHORING OR MOORING OF VESSELS, (which Section shall be amended to read as follows: "Section 4. ANCHORING OR MOORING OF VESSELS. No boat or vessel shall be moored or anchored within the Tow for a longer period than twenty -four (24) hours in any consecutive thirty -day period. This Section shall not apply to the permanent docking of boats or vessels to piers which are accessory uses to residential dwelling units within the Town if the vessel is owned by the owner of the residential dwelling unit of which the pier is an accessory use or said vessel is owned by a guest of the owner of the residential dwelling unit and accessory dock facility to which the vessel is attached." Section 2. Ordinance 79 -2 of the Town of Gulf Stream, Florida, is hereby amended by including therein the following provision: PERMIT REQUIRED FOR DOCKING OF VESSELS No boat or vessel in excess of eighteen (18) feet shall be locked within the waters in or adjacent to the Town for a period in excess of three (3) days unless the owner or person in control thereof shall first register :he vessel with the Town Manager. No permit shall be issued for the docking of my such vessel if the docking facilities provided therefor are inadequate to rotect the public health, safety and welfare, nor shall any such permit be issued or a period in excess of one (1) year. In no event shall any vessel be docked at ther than a dock accessory to a residence. I 1 Section 3. Ordinance 79 -2 of the Town of Gulf Stream, Florida is hereby amended by including therein the following provision: MAINTENANCE RESTRICTIONS It shall be unlawful for the owner of any boat within the waters of the Town of Gulf Stream, or any person under his supervision and direction to perform any heavy maintenance on said boat within the Town other than the normal day -to -day maintenance required to maintain said vessel and any main- tenance of an emergency nature. Heavy maintenance shall include but not be limitec to overhauling, installing, rebuilding or repairing of engines and other work which may be in the form of reconstruction or building which is considered to be outside the scope of the normal day -to -day maintenance of such a vessel. Section 4. Repeal of conflicting ordinances. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. Severability. In the event any phrase, clause, sentence, paragraph, or other section of this Ordinance is declared to be unconstitutional, invalid or unenforceable, such ruling shall not effect any of the remaining phrases, clauses, sentences, paragraphs, or sections of said Ordinance.
