BETTISON COMMISSIONER ABSENT: EVANS M. CLEMENTS COMMISSIONER Also attending Attorney, John Randolph, Manager, William Gwynn, Deputy Town Clerk, Barbara Gwynn and Police Chief, Robert Holroyd. The Meeting was called to order at 9 A. M. by Mayor Koch. Upon motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the Commission approved the Minutes of the regular meeting May 9, 1980. Upon motion by Commissioner Bettison, seconded by Vice Mayor LaPorte the Commission approved the Financial Report for the month of May 1980. Commissioner Bettison gave the monthly police report paying special attention to the extremely high false alarms answered during the month. After discussing this at great length the Chief of Police was instructed to contact the alarm companies with a "get tough" attitude and stress the fact that they must keep their customers alarms in proper working condition or the Commission will have no other alternative but to pass an ordinance setting a stiff fine for offenders. Attorney Randolph was instructed to have an alarm ordinance prepared for review at the next Commission meeting. The Chief was instructed to note companies as well as residents on all future false alarm reports. The Commission stated their approval to consider for next year's budget the purchase of two shot guns, brackets and locks at a cost of $265.00 each. Commissioner Bettison felt -2- COMMISSION MEETING, June 13, 1980 Cont. this is necessary in light of the recent Miami riots. Chief Holroyd was asked if his men knew how to use these guns? he said "no but they could be trained ". Mayor Koch asked Chief Holroyd if he had received his Florida certification to carry a gun, he said, "no but will attend the next class ". Mayor Koch asked the Chief if he had powers to make arrests and carry a gun, Chief Holroyd answered, to yes, citizen's arrest ". Mayor Koch asked the Chief if he carried a gun since he has been certified? he replied, "yes, according to the Law Inforcement Processing Center he was allowed to carry a gun ". Upon motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the Commission accepted Ordinance 80 -4 on SECOND and FINAL reading. ORDINANCE 80 -4 AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA ESTABLISHING A WATER RATE FOR THE OPERATION OF A WATER DISTRIBUTION SYSTEM FOR THE TOWN. Upon motion by Commissioner Hunter, seconded by Vice Mayor LaPorte the Commission accepted on FIRST reading Ordinance 80 -5. ORDINANCE 80 -5 AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA AMENDING ORDINANCE NO. 76 -1 RELATING TO THE PARKING OF RECREATIONAL VEHICLES AND EQUIPMENT' PROVIDING THAT SUCH RECREATIONAL BOATING AND CAMPING EQUIPMENT SHALL NOT BE PARKED ON VACANT LOTS WITHIN THE TOWN; FUTHER PROVIDING AN EXCEPTION FOR PARKING ON VACANT LOTS WHERE UNITY OF TITLE IS EXECUTED AND RECORDED PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Upon motion by Vice Mayor LaPorte, seconded by Commissioner Bettison, Dr. and Mrs. Scherer were granted a variance to retain the one additional row of cement blocks they had placed on their existing seawall which is in violation of their building permit. Since removal of said blocks would create an even greater eyesore then presently exists, the variance was granted. Upon motion by Vice Mayor LaPorte seconded by Commissioner Hunter the Commission adopted the Employee Personnel Policies Handbook subject to the corrections as noted during the discussion. The Deputy Town Clerk was instructed to reply to the Area Planning Board's memorandum May 15, 1980 to advise them that they are against Federal funding for the PBC Diamond Head Development Corporation Beach project. No action was taken at this time regarding a written request from the Gulf Stream School to install a car sprayer on their property. -3- COMMISSION MEETING. June 13. 1980 Cont. Mr. J. Vincent Sposa, Jr. 11 Hidden Harbour Estates requested a variance concerning a tennis fence. This fence would be 8' high along Mr. Clements property which is approximately 1'1/2" above the existing hedge. The two ends which face the Intracoastal and the street will be 10' high, this fence will be green and eventually be covered with climbing shrubbery. A letter from Mr. Clements stating he has NO OBJECTION to this fence as long as the portion extending above the hedge is green. Upon motion by Vice Mayor LaPorte seconded by Commissioner Bettison approval was granted. Mayor Koch abstained from voting. Mayor Koch noted it is now time for all department heads to review their employees for the next fiscal year's budget. As you have said the most important concern of yours, is the drainage of the tennis court pertaining to your property. The tennis court will be constructed with the pitch or flow going, away from your property. I will take full responsibility in rectifying any drainage problem that may effect your property due to the tennis court. Concerning the tennis fence, as we have discussed, we will have 8' fencing along your property which is appeoximately 1i' above your hedge. BE IT HEREBY ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The schedule of rates and charges be and the same are hereby defined as follows: a) Minimum service charge: The minimum service charge shall be $18.00 per bimonthly billing for 30,000 gallons or less. b) Rate per thousand gallons: The rate of all quantities of water over and above the minimum bimonthly service charge is 60c per each 1000 gallons or fraction thereof. Section 2. All Ordinances and sections thereof in conflict herewith are hereby repealed. Section 3. This Ordinance shall take effect upon passage and approval as provided by law.
