Also attending: Attorney John Randolph, Manager, William Gwynn, Deputy Town
Clerk, Barbara Gwynn, Sgt. Benjamin Burgess, Brian Pfeifler, Mr.
Sampietro, Mr. Dittman, Mr. Barzarte, Mr. Allen, Mr. Eaton.
The Meeting was called to order at 9 A.M. by Mayor Koch.
Upon motion by Vice Mayor LaPorte, seconded by Commissioner Hunter the
Commission approved the Minutes of the regular meeting July 11, 1980.
Upon motion by Commissioner Bettison, seconded by Vice Mayor LaPorte the
Commission approved the Financial Report for July, 1980.
Commencing October 1, 1980 the Town Clerk was instructed to implement quarterly
water billings.
Commissioner Bettison gave the monthly Police Report, he noted an extremely
high number of B 6 E's that have occured in the Town during a short period
of time. Sgt. Burgess was asked if there is a pattern to the B & E's?
He stated that they do not consider the break -ins as professionals and most
items taken are silver, small and easy to carry. Sgt. Burgess was asked
what the police department is doing to stop this rash of B 6 E's, he stated
they are concentrating and physically checking vacant homes and homes with
inadequate or faulty alarm systems. Vice Mayor LaPorte voiced her concern
that even though she has an alarm she did not feel very safe knowing they are
not watching her home. Sgt. Burgess assured her they were watching all homes.
Mayor Koch stated his concern that the men are spending too much time talking to
one another instead of patrolling etc, and wanted that stopped, he also asked
how many tickets had been issued. Sgt. Burgess stated "you haven't wanted
us to make arrests, you wanted warnings issued ". Commissioner Hunter asked if
this is true? Mayor Koch replied "no, no one was told not to make arrests,
however, the Town does not want to be known as a speed trap." Commissioner
Hunter asked Sgt. Burgess if the police department is working according to a
rule not to make arrests?" Sgt. Burgess stated "we're working to concentrate on
the biggest problem, the biggest problem he believes is to keep an eye on the
houses and protect the people ". Commissioner Hunter stated "you don't want to do
that at the exclusion of everything else ". Sgt. Burgess stated "not to the exclusion
but their primary concern, traffic is secondary." Commissioner Hunter stated
"if there is an impression not to make arrests, it should be corrected." Mayor
Koch agreed. Mayor Koch instructed Sgt. Burgess to initiate immediately a
policy that all alarm personel show identification and each officer keep a
log as to the time a key is given out and the time it has been returned. A
general discussion followed. Mayor Koch stated he had instructed Sgt. Burgess

to patrol in an unmarked car and in plain clothes. A suggesion was made that
the Town inform all residents of the problem and should they see anything suspicious
they should contact the police department. Mayor Koch asked Sgt. Burgess if he
had heard from the Chief of Police since he went on vacation, Sgt. Burgess stated
he had not and was instructed by the Chief to call him only in an "extreme emergency"
Mayor Koch stated that there is lack of "direction in the police department and
co- operation among the policemen themselves. Comissioner Bettison stated it is
a very unsatisfactory police report and something must be done, he also stated
that officers should make arrests or at least cite with tickets clearly violable
offenses. Mayor Koch agreed.
The Town Manager presented a proposed tentative millege rate and tentative
budget for the Fiscal Year 10/1/80 - 9/30/81. Manager Gwynn explained the
problem all municipalities are having this year due to the recent legislature
passage of the "Trim" bill, he explained the steps that must be followed
before the budget can be adopted, he al4o stated that the tax assessor is
responsible to send out notices to each property owner as to the date and
time of the 1st public hearing. After a general discussion, Vice Mayor LaPorte
moved that the budget as presented be approved for public hearing, Commissioner
Bettison seconded the motion, motion passed. Upon motion by Commissioner Hunter,
seconded by Commissioner Clements, the Commission approved the new millege
rate of 4.848. Vice Mayor LaPorte moved that September 26, 1980, 5 P.M. be
set for the first public hearing. Commissioner Bettison seconded the motion,
motion passed. In the event there is a conflict in dates September 25th
or 29th has been set as an alternate date. The proposed budget is part of
the minutes.
Upon motion by Commissioner Bettison, seconded by Commissioner Clements, Ordinance
80 -6 was accepted unanimously by the Commission.

AN ORDINANCE OF THE TOWN OF GULF STREAM, FLORIDA, AMENDING
ORDINANCE 72 -4, SECTION 1, TO PROVIDE FOR AN INCREASE IN THE
OCCUPATIONAL LICENSE TAX LEVIED THEREIN BY AMENDING THE FEE
FOR GENERAL CONTRACTORS FROM $75 TO $100 AND ALL OTHER
OCCUPATIONS FROM $30 TO $40; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.

In view of the Town's code restricting fences to a height limit of six feet,
Vice Mayor LaPorte moved that a variance be granted to Mr. John Bordeman and
Mr. James Newman granting them permission to install an 8' wood fence along
the existing cement fence. Commissioner Clements seconded the motion, the
motion passed.

RE: Fence Variance
Dear Mrs. Gwynn,
Per our conversation of 16 July 1980, I am requesting
for Mr. Newman [owner of Lot 161 and myself, owner of
Lot 15, Place au Soleil, a variance for the install-
ation of a fence on our west property line.
There is an existing cement louvered fence that is
deteriorating rapidly. We propose to install a fence
four inches east of the cement one. The new fence
will be wooden and eight [81] high. The primary
reason for the height is to prevent undesirables
from climbing the fence. We do border a business
area along the Federal highway which, too, is growing
and we feel that we need any protection that we can
obtain.
Please advise.
