Present: Absent: Councilmembers Robert Mitchell, Ann Thies, Philip Zietlow and Mayor Acromite. Councilmember Wilfred Scherer Others Present: Public Works Director Jim Dillman, Zoning Administrator Loren Kohnen, Acting Police Chief Michael Rouillard, Clerk -Treasurer Jeff Karlson, City Attorney Ron Batty and City Engineer Glenn Cook. Additions to Agenda 1. Discuss removal of campaign signs from road right-of-ways. 1. APPROVAL OF MINUTES Moved by Mitchell, seconded by Thies, to approve the minutes of the regular meeting of October 6, 1992 as presented. Motion carried unanimously. 2. REQUEST FROM CITIES OF INDEPENDENCE AND GREENFIELD FOR ADDITIONAL SEWER CAPACITY Project Engineer Steve Johnston of Loucks & Associates, representing the Cities of Independence and Greenfield, presented a proposal requesting that the Medina City Council allocate a portion of sewer capacity of the Independence Beach Trunk Sewer to facilitate the discharge of septate from an additional 135 residential units located in the vicinity of Lake Sarah and Lake Independence. Johnston said the request for additional sewer capacity was necessary because of several failing or potentially failing on -site waste disposal systems which jeopardize water quality. Johnston explained the Tri-City Agreement that the Cities of Medina, Independence and Greenfield entered into in 1985 which established parameters by which Independence and Greenfield could construct a septate collection system and discharge septate from up to 154 single family homes into Medina's Independence Trunk Line. The system was initially put into operation on March 12, 1987. Tom Loucks of Loucks & Associates said it was necessary to expand the collection system to serve an additional 135 lots because the initial project did not include several homes with failing systems. 176 Mayor Acromite asked City Engineer Cook if the additional sewage would put Medina at its full sewer capacity. City Engineer Cook affirmed that Medina's Independence Beach sewer system would be at capacity with the addition of 135 connections. Cook noted that an analysis of the sewer system included a projection of 120 future residential homes in the Independence Beach area. Johnston said Independence is looking at lift station upgrades and forcemain replacements at a cost of approximately $195,000. Johnston said a $50,000 gallon holding tank could be added to the City of Independence collection system and pumped during off-peak hours. The City of Medina's lift station in the Independence Beach area will be upgraded from 350 gallons per minute to 500 gallons per minute. Cook estimated that it would cost $57,500 to upgrade the lift station and to reconstruct 350 feet of 8 inch sewer line. The system upgrades would be paid by the Cities of Independence and Greenfield. Loucks said the Metropolitan Council would be amenable to this type of project and that comprehensive plan amendments would begin immediately after approval from the Medina City Council. Moved by Mitchell, seconded by Thies, to support the concept of expanding the wastewater collection system of Independence and Greenfield to preserve water quality and to direct City Engineer Cook and staff to work out the details of the project with Loucks & Associates so that a plan can be formulated which will sustain anticipated future sewer capacity in the Independence Beach area of Medina and recommend back to the Council what action should be taken. Motion carried unanimously. Moved by Mitchell, seconded by Thies to appoint Mayor Acromite and Councilmember Zietlow as an ad hoc Committee to review the details of the sewer expansion project, especially in regard to future sewer capacity needs and costs. Motion carried unanimously. 3. 1993 BUDGET The Council discussed employee salaries and health benefits, the Woodlake Landfill revenue projected for 1993, and the general tax levy. The Council reaffirmed its commitment to keep the city's tax rate at or near its current level of 15.24%. Zoning Administrator Kohnen said the city should receive approximately $150,000 in revenue from the Woodlake Landfill which will close in 1993. The council agreed to budget $75,000 177 for 1993 and set aside any additional revenue from the landfill as a reserve for future budget expenditures. Moved by Acromite, supported by Zietlow, to appoint Councilmember Mitchell and Clerk -Treasurer Karlson to an ad hoc committee to put together a report with each employee's salary and health benefits so the council can establish a percentage increase for each employee. Motion carried unanimously. 4. HAMEL WELL NO. 4 PROJECT City Engineer Cook asked the Council to order plans and specifications for the Hamel Well No. 4 Project. Cook said the well would be constructed in the southwest corner of the old reservoir site along Pinto Drive at an estimated cost of $470,000. Cook said the city should receive favorable bids because of the lack of business in the well -drilling industry. Cook added that the project was planned as a tax increment financing project and would be paid for with TIF funds. Moved by Mitchell, seconded by Acromite, to adopt Resolution No. 92-96, "Resolution Ordering Final Plans and Specifications for Hamel Well No. 4." Ayes: Mitchell, Thies, Zietlow and Mayor Acromite. Nays: None. Resolution No. 92-96 adopted on a 4-aye and 0-nay vote. 5. U.S. WEST PERMIT REQUEST TO INSTALL CABLE The Council reviewed an application for a permit from U.S.West Communication to install buried cable at Medina Road and Capriole Drive. Moved by Mitchell, seconded by Thies, to adopt Resolution No. 92- 97, "Resolution Approving Permit for Cable Installation in City Right of Way." Ayes: Mitchell, Thies, Zietlow and Mayor Acromite. Nays: None. Resolution No. 92-97 adopted on a 4-aye and 0-nay vote. 6. CITY OF MEDINA V. BURDICK Moved by Thies, seconded by Zietlow, to approve a Quick Take Order in the amount of $4,600 as compensation for the taking of easements over Parcels 1 and 18 of the James Burdick property. Motion carried unanimously. 7. CHERRY HILL FARM 4TH ADDITION City Engineer Cook said that the contractor (B & D Underground) for the Cherry Hill 4th Addition Utility and Street Improvement was not being responsive to Bonestroo's request to complete the project. Cook recommended that the City secure an agreement with B & D Underground in which the City would make an arrangement with the subcontractors to complete the work and be paid directly by the City. Cook said another option would be to terminate the contract and hire the subcontractors to complete the work. 178 Moved by Mitchell, seconded by Thies, to secure an agreement with B & D Underground which would enable the City to make direct contact with subcontractors to complete the Cherry Hill Farm 4th Addition Project and make direct payment to the subcontractors; and furthermore, if the contractor does not agree to this, to terminate the contract and hire the subcontractors to complete the work. Motion carried unanimously. 8. CITY HALL WELL REPAIR Moved by Mitchell, seconded by Zietlow, to authorize Public Works Director Dillman to make the necessary arrangements to have the well repaired at City Hall at an estimated cost of $2,000. Motion carried unanimously. 9. AMENDMENT TO ORDINANCE RELATING TO INDIVIDUAL SEWAGE DISPOSAL SYSTEMS City Attorney Batty introduced an ordinance which would require inspections of individual sewage disposal systems every two years instead of every four years. Batty said the new ordinance requirement would meet the requirement of the Minnesota Pollution Control Agency. Zoning Administrator Kohnen said the City would charge $30 for each inspection. Moved by Mitchell, supported by Acromite, to adopt Ordinance No. 272, "An Ordinance Amending Section 720.95 of the Medina Code of Ordinances Relating to Individual Sewage Disposal Systems." Ayes: Mitchell, Thies, and Mayor Acromite. Nays: Zietlow. Ordinance No. 272 adopted on a 3-aye and 1-nay vote. 10. ESTABLISH COUNCIL MEETING DATE Moved by Mitchell, seconded by Thies, to establish the first regular council meeting on Wednesday, November 4, 1992 due to the November 3rd General Election. Motion carried unanimously. 11. APPROVE PAYMENT OF BILLS Moved by Mitchell, supported by Thies, to approve Order -Check Numbers 11251-11295 for $142,478.16 and Payroll Check Numbers 12999-13018 for $14,602.27. Motion carried unanimously. 12. CAMPAIGN SIGNS IN ROAD RIGHT-OF-WAY Mayor Acromite introduced a letter from Robert Franklin requesting the removal of campaign signs from road right-of-ways in Medina. Moved by Mitchell, seconded by Thies to direct staff to notify each local candidate that campaign signs must be removed from road right-of-ways; and furthermore, if any candidate fails to do so, the city shall have the signs removed and hold them until after the election.
