BETTISON COMMISSIONER EVANS M. CLEMENTS COMMISSIONER Also attending: Attorney, John Randolph, William Gwynn, Manager, Barbara Gwynn Deputy Town Clerk, Consultant, Frank Flannery and Brian Pfeifler. The Meeting was called to order at 9 A.M. by Mayor Koch. Upon motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the Commission approved the Minutes for the Special Commission Meeting December 5, 1980, the regular meeting December 12, 1980 and the Special Commission meeting, December 22, 1980. Upon motion by Commissioner Bettison, seconded by Vice Mayor LaPorte the Com- mission approved the Financial Report for the month of December, 1980. Upon motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the Com- mission approved the Quarterly Report for the period October 1, 1980 to December 31, 1980. In order to reduce the Water Departments loan to Barnett Bank, Commissioner Clements made a motion to approve a $15,000.00 payment, Vice Mayor LaPorte seconded the motion, motion passed. Upon motion by Commissioner Clements, seconded by Vice Mayor LaPorte the Commission approved the 1980 Audit Report as prepared by Dan Ward C.P.A. After a general discussion and noting that the current liability limits had been decreased in some areas due to a recent change in the Town's insurance carrier, Commissioner Clements moved that all policies currently in effect with the Florida Municipal League be increased from $1,000,000 to $2,000,000. Page 2 Attorney John Rsndolph explained that at this time the investigation being made on the two candidates for Police Chief were incomplete and suggested the Commission set a tentative date for another Commission Meeting to hear this report. The Commission set January 14, 1981, 9 A.M. in order to hear this report. Consultant Frank Flannery gave a report of his findings regarding a vicious personal letter writing attack on Lt. David Tinkham. He reported all of the charges made in the letters that had been scotched taped to doors, placed in mail boxes and sent through the mail were completely false and ualicious. Mr. Flannery read a copy of the letter he had written to the Gulf Stream Civic Association which details the scope of this attack, a copy of this letter is included as a part of these Minutes. He noted in closing that action is being taken to find and prosecute the guilty person or persons. Upon a motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the Commission expressed a vote of confidence to Lt. David Tinkham and requested a resolution be drawn up to this effect. Motion passed. A letter from the Town of Ocean Ridge Chief of Police, Lou Spano, was read to the Commission. This letter is a part of the Minutes. The Mayor's Proclamation calling the Town Election to be held on March 10, 1981 was read and is a part of the Minutes. A request from Ocean Ridge asking the Town's support in their fight against Palm Beach County's request to deannex what is known as the inlet property located in their Town. After a general discussion Commissioner Clements moved that a letter be sent to the local delegation stating the Town's support for Ocean Ridge's objections to the deannexation. Commissioner Bettison seconded the motion, motion passed. Mr. Louis Preiditsch explained to the Commission that he would like to obtain permission for an 8' wall to be constructed oo the south and west perimeter of Place Au Soleil sub - division. Mayor Koch stated this would require a variance from the Planning and Zoning Board. After this had been reviewed by the Board, the request would then be brought to the Commission with the Planning Boards recommendations. Meeting adjourned 10:15 A.M. Koch, Jr., Mayor Town of Gulfstream 246 Sea Road Gulfstream, Florida 33444 Dear Mayor Koch: In view of the news articles appearing regarding the operation of your police department, I feel compelled to confirm a conversation regarding the use of our range for firearms qualification of your personnel. I was most irritated at reading a reference to this incident the first time, but when it reappeared in the publication of December 7, 1980, I wanted you to have written confirmation to use as you deem advisable. This is to confirm a conversation of several months previous, the date of which I do not recall, wherein it was requested that your personnel be permitted to use the pistol range at the Department of Public Safety complex in the Town of Ocean Ridge for the pur- pose of qualifying your police officers as there was no record of any firearms qualifications since their having been employed by Gulfstream. Due to your Town's shortage of manpower at the time and my strong feeling that officers should qualify periodically to prove they remain proficient with a weapon thus eliminating any negligence on the part of the Town should there be an incident involving a firearm, it was agreed that officers of the Ocean Ridge Department would respond to emergency calls in Gulfstream if the Gulfstream Officer was qualifying in the range. n�� page 2 December 8, 1980 Mayor Koch While it is true there was no• "routine" patrol during that time, it is not true that Gulf Stream was without police protection. Any emergency would have been answered. I hope this distasteful report, or .rather article, does not change your position on making certain your officers remain qualified to handle a weapon. It is ironic that the Town should be criticized regarding weapon proficiency when the media is constantly expressing concern and even fear in some instances that law enforcement officers are irresponsible and careless in the handling and use of hand guns. Ward l� ?i METHODS OF ACCOUNTING CThe Town's accounting records for General Government operations are maintained on a modified accrual basis with the most important revenues being recorded when earned and expenditures being recorded when incurred. Accounting records for the Water Distribution Fund are maintained on an accrual basis. GENERAL FUND Revenues for General Government functions totaled $309,905 for the fiscal year ended September 30, 1980, an increase of 10.028 over the previous year. Included in this amount is $2,002 which was donated to the Town for carpet for the Town Hall. Actual, collections for General Government exceeded the estimated revenues by $22,050. General property taxes produced 63.07% of General Government revenues compared to 64.16% for the previous year. The investments were for various periods of time, depending on the requirements of Che available cash. The interest earned from these investments amounted to $7,365. The expenditures for the General Fund operations amounted to $290,894 for the fiscal year, an increase of 4.518 over the preceding year. Public Safety, which includes the Police Department and Fire Protection, accounted for 49.30% of the General Fund expenditures as compared to 48.86% for the preceding fiscal year. `- Expenditures for Street and Easements represented 5.94% of the General Fund expendi- tures, an increase of 15.16% over the previous year. Sanitation Department accounted for 19.38% of the expenditures as compared to 19.63% for the prior year. FEDERAL REVENUE SHARING FUND During.the year, the Town received $1,557 from Federal Revenue Sharing. Total expen- ditures,for the year were $3,900, which were spent for Public Safety. At year end, the Town had $550 of appropriated fund balance for approved projects and $1,229 of unappropriated fund balance to be budgeted in subsequent periods. C 0 WATER DISTRIBUTION FUND The Town's Water Distribution Fund continues to show gains in gross revenues. These assets have been recorded on the books at cost or estimated fair market value at date of donation, if donated assets, and bear no relation to the current value of the assets. Depreciation is not recognized in General Government accounting procedures. Regarding recommendations included in the Audit Comments, I have implemented a policy to endorse all checks as they are received and be kept in a 2 hour fire rated four drawer safe - file. Large cash receipts are to be deposited in the bank the same day. Completion of the financial report to be filed with the Department of Banking and Finance will be carefully prepared from the audit report as prepared by the Town's auditors, Dan W. Ward, C.P.A. The Town is in the process of preparing a written plan of organization specifying the division of duties and areas of responsibilities concerned with accounting and administrative controls. The Town will prepare a written manual stating the policies and procedures covering all phases of financial management. Your's truly, William E. Gwynn Town Manager MAYOR'S PROCLAMATION CALLING TOWN ELECTION TO BE HELD ON MARCH 10, 1981 WHEREAS, the Town Charter of the Town of Gulf Stream adopted 3- 11 -80, requires a Town Election to be held on the second Tuesday in March, 1981, which is March 10, 1981. 1. An election is hereby called to be held on Tuesday, March 10, 1981 for the purpose of electing five (5) Town Commissioners who shall hold office for a term of three (3) years beginning on the third Tuesday of said Month of March, 1981. 2. The Election shall be held in the Town Hall of the Town of Gulf Stream, Florida, located at 246 Sea Road in Gulf Stream, and the polling place shall be open between the hours of 7:00 o'clock A.M. and 7:00 o'clock P.M., Eastern Standard Time; 3. Only qualified, registered voters of the Town of Gulf Stream shall be allowed to vote in this election; ( 4. Any person who desires to have his or her name placed upon the official ballot shall file with the Town Clerk, at least 20 days before such election is to be held, a petition signed by at least four (4) qualified electors of the Town of Gulf Stream requesting such person to become a candidate for such office; 5. Tinkham Gulf Stream Police Department Gulf Stream, Florida 33444 Dear Dave: On behalf of the Town Manager and myself I want to thank you for the hard work and the many extra hours you worked during the months we were without a Police Chief and until Police Consultant, Mr. Frank Flannery arrived. The abuse and mental aggravation you endured that was caused by certain members of the Police force was over and above the call DE duty. Residents of the Town of Gulf Stream should be made aware and reassured that they do indeed have honest, dedicated police officers in you and Officer, Charles Bunner who never waivered to do their duty when it would have been easy to walk away. Now that we have a new Chief of Police, and a very fine one in James Greer, I feel confident that with men like you, Gulf Stream will have the best Police Department in the State of Florida. Greer Dear Mr. Randolph: After receiving a copy of Air. Greer's resume of November 24, 1980 on January 9, 1981, we initially checked his credit and determined that apparently there are no credit problems as he has numerous accounts, all in good standing. There is one account at this time which is overdue by thirty days, however, it does not appear to be a problem and, maybe is an oversight and is the only one that there is anything out of the way with. Attempting to obtain a little background information on Air. Greer I have talked with various law enforcement officers and officials as well as officials in the local County govern- ment. Specifically, I have talked with either police — officers or former police officers from the Palm Beach Shores Police Department, Palm Beach Gardens Police Department, the City of West:Palm Beach Police Department, as well as the Palm Beach County Sheriff's Department. Unfortunately, as I have advised you by phone, I am unable to furnish names of these officers who had anything derrogatory at all to say about James Greer, at their request, and had I not given them the guarantee that I would not reveal the name I would not have gotten any information from them. I. Basically, none of the people who I have talked with from all of these departments or the judicial system questions the quality or basic police work of James W. Greer, however, at x I was advised by one supervisof"in the Sheriff's office that a thing in general that occurred was that when other officers would go out and either arrest someone or be talking about a specific subject being a suspect in a felony,that Mr. Greer would always cut in with the fact that he knew all about him and that the particular subject had been a suspect in another crime that he had investigated previously and so-forth. In third hand information from that particular supervisor he advised that fellow workers, at one point, set him up in a situation like that with a dummy suspect that did not exist and, again, Mr. Greer went right along with the fact that he knew all about that suspect and that he had been a suspect in a case that Mr. Greer had investigated. Another former officer of the Sheriff's office advised me of one particular instance that Mr. Greer was involved in, that 'you may recall was the arrest of a couple of prominent jewelers off of Worth Avenue for being alleged fences, which as you know made the headlines in this area. This particular officer "• indicated to me that it was, ..in his opinion, one of the times that Mr. Greer moved too fast in making his decisions and opinions and that it really was not a case because the promin- ent jeweler in Palm Beach had, in that case, paid for that stolen property with a personal check; which is something that a fence would never think of doing. Greer page 2 least two former supervisors from the Palm Beach County Sheriff's office, one who is still with the Sheriff's office and another who has left the Sheriff's office for another position, indicate that Mr. Greer has a tendency to be too opinionated and too vocal in his opinions of other police departments and /or public officials. At least three of the people who I spoke with are of the opinion that Mr. Greer views superiors or high officials in other departments or public officials as sometimes not being totally honest and above board in their various dealings, one supervisor who had formerly been with the Sheriff's office indicated that Mr. Greer was a good police officer and had even been a good supervisor in his capacity with the Sheriff's office, but he would not, however, recommend him for a job as chief of Police because of his past demeanor. Greer's police experience and police work in the capacity that he has served as just a patrolman or deputy sheriff and, again, as a supervisor at the sergeant level, both in uniform as well as in the Detective Bureau has always been good and that he knows his profession. One other thing that I forgot, it paas mentioned to me by one of the former supervisors that at one point Mr. Greer, after making a fairly good felony arrest, had requested a letter of recommendation from that supervisor so that he might be further rewarded with some type of medal I think that they issue at the Sheriff's office and the supervisor refused to do so indicating that that type of thing should be taken care of by the commanfCing officer of a particular division. That particular supervisor is also of the opinion that Mr. Greer may have been responsible for contacting some of the people that have signed these particular letters and solicited those letters. I don't like to send out reports like this withou,t names as I advised you over the telephone, and I really don't like to send out investigations like this, however, as you know we've only had two working days to work on this partic- ular matter and this, at this point, is the best we can do. Messersmith who indicated that he has known James Greer for approximately eight (8) years. You may recall that Mr. Messersmith was formerly with the Sheriff's Office under a previous administration. Mr. Messersmith, again, indicates that James Greer is a capable and knowledgeable police officer land supervisor, as far as he's concerned. Judge Gavin K. Letts was contacted and he indicated that he has known James Greer for five (5) years or more, not only in his capacity as a law enforcement officer but also as a personal friend, as Mr. Greer was a member of Judge Letts' C� John C. Judge Letts indicates that professionally he believes that Mr. Greer is a capable and knowledgeable law enforcement officer and, additionally, he is an upstanding citizen and a good friend.- Thomas Murray, a State Attorney Investigator, indicated that he has known and worked with James Greer for approximately ten (10),years. Mr. Murray, prior to going to the State Attorney's Office, had seventeen (17) years with the Sheriff's Office. Mr. Murray is of the opinion that Mr. Greer is capable and extremely good in the handling of people which, of course, is important in law enforcement since at various times it is necessary to deal with both the lowest form of our society and their manner of living, as well as the higher social strata within our society. We also contacted the current Assistant State Attorney, William \ Bollenger, who indicates that he has known James Greer for. v approximately ten (10) years and thinks of him as an outstand- ing law enforcement officer and very capable in his dealings with all types of people. Mr. Bollenger volunteered to write you a letter on behalf of James Greer, if you desire same. We, additionally, contacted Walter F. Brown, both Jr. and Sr.. Mr. Brown, Jr., had known James Greer for approximately eleven (11)'years and Mr. Brown, Sr., had known him for approximately seven (7) years. They indicate that Mr. Greer is not only a personal friend, in their opinion, but also an outstanding citizen and believe that he does a good job in law enforcement and know, for a fact, that he does a good job in public relation They hunt together with Mr. Greer and they have at times had Mr. Greer make speeches at their Masonic Lodge. Dave Chasteen, a current Deputy Sheriff in Palm Beach County, was contacted and indicated that he has known James Greer ever since he came to work for the Palm Beach County Sheriff's Offic He has, at times, worked directly with him and feels that Mr. Greer is a capable police officer and would make a good Chief of Police in Gulfstream. He, too, indicated that he is aware of several of the applicantswho have been considered for this particular job and, in his opinion, Mr. Greer is far and ahead of all of the others who he has knowledge of. He did indicate that he has heard some information within the Sheriff's Office that Mr. Greer was outspoken in the recent election and did speak up for the current Sheriff's opponent, Mr. Flannery, and there was a possibility that this was the reason for his leav- ing the Sheriff's Office, however, Mr. Chasteen said he did not John C. Randolph, Esq. re: James W. Greer page 3 have personal knowledge that was the case. Fr. Charlie Sullivan, who is the priest for the Palm Beach County Sheriff's Office and attends almost all of their social events, indicated he has known James Greer for many years and from his knowledge within the Department, from various officers, believes him to be a capable and knowledge police officer. James Haggerty, a former member of the Palm Beach County Sheriff's Office who handled the ihternal legal affairs or complaints against the Sheriff's Office in regards to person- nel, etc. and personally did investigations into complaints by citizens, indicated to this writer that he thinks very highly of James Greer and knows him to be a competent and knowledgeable law enforcement officer, as well as a good supervisor. Mr. Haggerty indicated that in the event that a complaint was lodged by a citizen against Mr. Greer, he would do a thorough investigation starting with the very beginning of the complaint, because in his own mind he would be positive that it would be unfounded and would in the end determine that it was unfounded. He went on to indicate that there were other officers within the Palm Beach County Sheriff's Office that he did not have this type of confidence in. This is a 'little hard to explain to someone who has not been involved in law enforcement, however, when a man in law enforcement is out there doing his job and doing it properly it is'almost impossible to do so without, from time to time, getting minor complaints from the disgruntled public. In my personal past experience in law enforcement I've found this to be true. With other officers who do not necessarily go out of their way to do a good job and put their best efforts forth in law enforcement, meaning that they are just sliding by as a job, they do not necessarily get any of these minor complaints. In any event, Mr. Haggerty, who after leaving the Sheriff's Office is currently in business for himself in the West Palm Beach area, indicates that he feels that Mr. Greer would make a good Chief of Police for the City of Gulfstream, and.is a capable supervisor. James S. Street, currently a park naturalist, was contacted and indicated that he has known Mr. Greer for seven to eight (7 to B) years and previously worked with him when Mr. Street was an Animal Regulation officer. He's had an opportunity to work with Mr. Greer on a number of investigations involving cruelty to animals and to his knowledge Mr. Greer is a capable -3- I John C. Randolph, Esq. re: James W. Greer page 4 r and knowledgeable law enforcement officer as well as an outstanding citizen. Additionally, at one time Mr. Greer's wife worked for Mr. Street and he considers both of them fine upstanding citizens of this County. We also contacted Mr. Chuck Lucom, who is currently retired and is Chairman of the Concerned Voters of Washington, D.C. He indicates that he has..known James Greer for several years and has had many conversations with him in reference to Mr. Greer's police work and has read numerous articles in reference to his police work, and believes that Mr. Greer is a capable and outstanding police officer in any type of situ- ation, especially some of the dangerous situations that Mr. Greer has been involved with and has handled very capably. In addition to the aforegoing,there were several people on the furnished list that we were unable to contact. �\ We did contact the State Attorney David Bludworth, as well as Judge Marvin Mounts, and both, apparently because of their Position within the government declined to comment one way or the other. We also chose to check with the neighbors of'Mr. Greer and' determined that he lives in a building that contains seven (7) units. We were not able to contact all of them, although attempts were made at several times. We did contact Allen Kovacs, who lives in unit #1 and he indicates that although he's only lived there approximately six months and known them as neighbors for that period of time,, that they seem to be a very nice, quiet couple. He did indicate that he knows Mr. Greer takes a young man in the building, a fifteen year old boy, fishing quite often; although he wasn't sure which apartment the young man lives in nor his name. We subsequently contacted Karen Wells, who is in unit #2 and has known the Greers for approximately four (4) years. She indicated that at one time while she was away from the apart- ment on vacation or for a weekend that the police were called to her apartment by Mr. Greer because of her daughter and she was, at that time, upset about the fact that he would call the police. however, she indicates that since that time she has determined her daughter was having a pretty wild party and understands that Mr. Greer did the proper thing in noti- fying the police. -4- 4' John C. Greer page 5 She indicates that she knows wife, to he a very nice quiet them, to her knowledge, cause be outstanding citizens. both Mr. Greer, as'well as his couple and that neither of any problems and they seem to E We, additionally, contacted Mr. Paul HUOtai in unit #3 who indicated that he has known Mme, and Mrs. Greer for a number Of years. He finds that they are both very nice people and considerate neighbors. He points out the fact that Mrs. Greer quite often likes to play the piano and if any time she does so and it's quite late that prior to playing the Piano, Mr. Greer checks with him to see if it would be a bother with the piano playing, fie considers both of them to be nice considerate and upstanding citizens in the community. Attempts were additionally made to contact Dottie Darville in unit #9, however, no contact was made on two different occasions. We were under the impression that Mike Jacoby had,/>, been in unit #5, however, since we could not contact him in � person, an attempt was made b moved out. There has been some hint, both gat this t and in the previous two -day investigation, that Mr. Greer time separated from the Sheriff's Office because of Greer was anyone who has lived in Palm Beach County for apnumbersofnd years knows that this is very possible and also knows that the current administration, at whatever time would, o admit to that being thf co1rse, not e case. I hope with the previous and this report we have bebn of some help to you in making a decision in this matter.
