Barbara Gwynn, Chief, Jim Greer, Police Consultant, Frank Flannery and
Brian Pfeifler.
The Meeting was called to order by Mayor Koch at 9 A.M.
Upon motion by Vice Mayor LaPorte, seconded by Commissioner Bettison the Commission
approved the Minutes of the Regular Meeting January 19, 1981 and Special Commission
meetings January 14th and 22nd 1981.
Upon motion by Vice Mayor LaPorte, seconded by Commissioner Hunter the Commission
approved the Financial Report for the month of January 1981.
Commissioner Bettison moved that the Commission recognize and thank Consultant Frank
Flannery for his fine work in solving the recent police department problems. Commissioner
Hunter seconded the motion, motion passed.
The following is a summarization of the Police Report for the month of January, 1981.

Commissioner Bettison noted that there were no breaking and enterings in January and
that approximately fifteen traffic citations had been issued. He also read a letter
addressed to Lt. David Tinkham and Officer Charles Bunner from the Deputy Town Clerk.
He instructed Chief Greer to place this letter in each officer's file. A copy of
the letter is a part of the minutes.
After a general discussion the Town Clerk was instructed to add a Whereas to Resolution
#81 -1 agreeing with Chief Justice Burgers recent comments concerning the present
criminal justice system. Upon motion by Commissioner Hunter seconded by vice Mayor
Laporte Resolution #81 -1 was approved by the Commission.

At the recommendation of the Planning Board the Commission granted Mr. Louis
Preiditsch, 800 Canary Walk, Place Au Soleil a variance to increase the height
% of his fence to eight feet.

On behalf of the Town Manager and myself I want to thank
you for the hard work and the many extra hours you worked
during the months we were without a Police Chief and until
Police Consultant, Mr. Frank Flannery arrived,
The abuse and mental aggravation you endured that was
caused by certain members of the Police force was over and
above the ca111f duty. Residents of the Town of Gulf Stream
should be made aware and reassured that they do indeed have
honest, dedicated police officers in you and Officer, Charles
Bunner who never waivered to do their duty when it would have
been easy to walk away.
Now that we have a new Chief of Police, and a very fine one
in James Greer, I feel confident that with men like you, Gulf
Stream will have the best Police Department in the State of
Florida.

RESOLUTION NO. 81 -1
A RESOLUTION OF THE TOWN OF GULF STREAM SUPPORTING
THE PALM BEACH COUNTY ASSOCIATION OF CHIEFS OF
POLICE, INC., AND REQUESTING A REVIEW AND REVISION
OF THE FLORIDA JUSTICE SYSTEM.
WHEREAS, the Palm Beach County Association of Chiefs of Police,
Inc., as a result of their unique perspective as it relates to crime in Palm Beach
County, Florida, deemed it necessary to adopt a Resolution recommending changes
in our justice system in order to more effectively combat the increased crime
rate; and
WHEREAS, the Town Commission of the Town of Gulf Stream is in
complete support of the Palm Beach County Association of Chiefs of Police, Inc.,
in its goal to combat the increasing crime rate; and
WHEREAS, as set forth by the Palm Beach County Association of
Chiefs of Police, Inc., in their Resolution, the citizens of the State of Florida no
longer maintain the same respect for the Florida Justice System that they did in the
past and many of the citizens of the State live in fear of being the victims of
crime and
WHEREAS, the Palm Beach County Association of Chiefs of Police, Inc.,
has determined that the criminal element no longer respects or fears the Florida
Justice System and the Florida Justice System has over a period of time been
subject to substantial reformation without due regard being given as to the effect
of those reforms on the increasing crime rate; and
WHEREAS, the law enforcement community has voiced its disagreement
With the philosophical direction the reforms in the Florida Justice System have
taken and by resolution has taken a strong stand on the matter of crime; and

has determined that certain elements of the criminal Justice

by a laxity that encourages the criminal element of believe that crime pays.
WHEREAS, the Town Commission of Gulf Stream agree I with Chief
Justice Warren Burger's comments concerning the present criminal justice system.
NOW, THEREFORE, BE IT RESOLVED that the Town Commission of
Town of Gulf Stream ratifies and adopts the
the recommendations of the Palm Beach County
Association of Chiefs of Police, Inc., which are as follows;

1. That higher bond schedules be developed and uniformly adopted by
all judicial circuits.
2. That more stringent sentences be swiftly meted out, especially
those individuals who have a history of criminal involvement.
3. That sentencing equity be restored to the criminal system
and that most plea bargaining be eliminated.
4. That the responsibility for criminal activity be squarely placed
on the convicted individuals and that they be held responsible for all costs as-
sociated with the crime, including compensation to victims.
5. That funds be provided to build more prisons thereby eliminating
the revolving door policy which presently exists.
6- That the following measures be taken regarding the increasing
involvement of juvenile offenders in serious crimes:
a. The first offender be considered a higher priority
for rehabilatative counseling.
b. The repeat offenders be held more accountable for
their criminal acts.
c. That Health and Rehabilitated Services be held
accountable for the ever increasing recidivism
rate of juvenile criminals.
