AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING A
SANITARY SEWER WATER EASEMENT IN CHERRY CREEK SECTION 1, AND
RELINQUISHING PORTIONS OF A SANITARY STORM WATER EASEMENT
LOCATED IN CHERRY CREEK SECTION 1.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Council accepts the following prescribed easement for storm
water purposes.
Part of Lot 5 of Cherry Creek Subdivision Section 1, as per plat of record in Plat Book
12, page 497, Cole County Recorder's Office, Cole County, Missouri, more particularly
described as follows:
From the northeast corner of said Lot 5; thence S05046'1 YE, along the easterly
boundary of said Lot 5, 408.52 feet to the northeast corner of Tract 5-63 as shown on
the survey of record in Survey Record Book B, page 253, Cole County Recorder's
Office; thence S83 053'39"W, along the northerly line of said Tract 5-133, 11.65 feet to the
POINT OF BEGINNING for this easement description; thence S83°53'39"W, along the
northerly line of said Tract 5-133, 6.00 feet to a point on the easterly line of a 40 foot wide
sanitary sewer easement as recorded by plat of record in Plat Book 12, page 497;
thence N06°06'21"W, along the easterly line of said 40 foot wide easement, 12.63 feet;
thence N06 039'38"W, along the easterly line of said 40 foot wide easement, 373.61 feet;
thence S68°22'54"E, 6.81 feet; thence S06°39'38"E, 370.41 feet; thence S06°06'21"E,
12.60 feet to the point of beginning for this easement.
Bearing Base: Cherry Creek Subdivision Section 1, as per plat of record in Plat Book 12,
page 497, Cole County Recorder's Office.
Section 2. The Council finds that as a result of Section 1 the following prescribed
easement is surplus property of the City and is no longer needed for any public
purpose:
Part of Lot 5 of Cherry Creek Subdivision Section 1, as per plat of record in Plat Book
12, page 497, Cole County Recorder's Office, Cole County, Missouri, more particularly
described as follows:
From the northeast corner of said Lot 5; thence S05 046'13"E, along the easterly
boundary of said Lot 5, 408.52 feet to the northeast corner of Tract 5-133 as shown on
the survey of record in Survey Record Book B, page 253, Cole County Recorder's
Office; thence S83°53'39"W, along the northerly line of said Tract 5-63, 51.65 feet to the
POINT OF BEGINNING for this easement vacation description; thence S83°53'39"W,
along the northerly line of said Tract 5-B3, 6.00 feet to a point on the westerly line of a
40 foot wide sanitary sewer easement as recorded by plat of record in Plat Book 12,
page 497; thence N06°06'21"W, along the westerly line of said 40 foot wide easement,
12.43 feet; thence N06°39'38"W, along the westerly line of said 40 foot wide easement,
349.51 feet; thence S68°22'54"E, 6.81 feet; thence S06°39'38"E, 346.31 feet; thence
S06°06'21"E, 12.40 feet to the point of beginning for this easement vacation.
Bearing Base: Cherry Creek Subdivision Section 1, as per plat of record in Plat Book 12,
page 497, Cole County Recorder's Office.
Section 3. The easement described in Section 2 is hereby relinquished, and the
City does hereby release and abandon whatever interest previously held in such
easement.
Section 4. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
